HomeMy WebLinkAboutMinutes - 19930405 e APPROVED SIV 93 MINUTES ORANGE COUNTY BOARD OF COMMISSIONERS REGULAR MEETING APRIL 5, 1993 The Orange County Board of Commissioners met in regular session on April 5, 1993 at 5:30 p.m. at the Pleasant Green Community Center, Eno Township, Durham, North Carolina. COUNTY COMMISSIONERS PRESENT: Chair Moses Carey, Jr. , and Commissioners Stephen Halkiotis, Alice M. Gordon, Verla C. Insko and Don Willhoit. COUNTY ATTORNEY PRESENT: Geoffrey Gledhill COUNTY STAFF PRESENT: County Manager John M. Link, Jr. , Assistant County Manager Rod Visser, Deputy Clerk to the Board Kathy Baker, Clerk to the Board Beverly A. I. ADDITIONS OR CHANGES TO THE AGENDA Two names were added to appointments for consideration. Margaret Brown has indicated an interest to serve on the Planning Board and Tom Mason has indicated an interest to be appointed to the South Orange Fire District. II. AUDIENCE COMMENTS A. MATTERS ON THE PRINTED AGENDA Chair Carey announced that he would recognize at the appropriate time those citizens who have indicated a desire to speak. B. MATTERS NOT ON THE PRINTED AGENDA Several citizens expressed their concern about a proposed landfill site in Eno Township. Linda 011is stated her opposition to continue the landfill search and her support to implement a strict waste management plan. Walt Swainey spoke about morality and cost of the proposed landfill. Dr. Ruth Zweidinger spoke about a recent supreme court decision and questioned if Orange County could prevent other jurisdictions from using the landfill. Dorothy Dailey questioned the process of the Landfill Site Search Committee and her desire to send the garbage outside of the County. Caroline Long submitted a letter from the Eno River Association and asked what is being done to stop dumping by out-of-county residents. Paul Jones feels that recycling is the best alternative to a landfill. Willie Glover asked why the County is considering such large sites and Commissioner Willhoit responded to his concerns. Lori Ventura expressed concern about a small creek that runs into the Eno. Mark Schultz feels the County should spend more money on waste reduction. PUBLIC CHARGE Chair Carey dispensed with the reading of the Charge. III. ITEMS FOR DECISION - CONSENT AGENDA Motion was made by Commissioner Halkiotis, seconded by Commissioner Insko to approve those items as listed below: A. ESTABLISH PUBLIC HEARING DATE FOR COMMISSIONERS' 1993-94 GOALS The Board set May 18, 1993 at 7:30 p.m. at the OWASA Community Room in Carrboro for a public hearing on the Commissioners' 1993-94 goals. B. BUDGET ORDINANCE AMENDMENT #9 The Board approved the following budget ordinance amendments and authorized 1. 0 full-time equivalent positions for the Carolina ACCESS program in the Department of Social Services: GENERAL FUND Source - Charges for Services $ 10, 000 Appropriation - Tax and Records 10,000 (To budget for additional Register of Deeds revenues) Source - Intergovernmental $ 185,784 Appropriation - Human Services 185,784 (To budget for additional day care funds for DSS) Source - Intergovernmental $ 5,987 Appropriation - Miscellaneous 5,987 (To budget for receipt of Emergency Food and Shelter funds) Source - Intergovernmental $ 5, 015 Appropriation - Human Services 5, 015 (To budget for receipt of additional Food and Lodging funds) Source - Intergovernmental $ 3, 000 Appropriation - Human Services 3, 000 (To budget for 3 months of the Carolina Access program for Social Services) C. CLASSIFICATION PLAN AMENDMENT The Board approved an amendment to the Orange County Classification and Pay Plan by adding the class of Public Health Educator/Kellogg Project Director at Salary Grade 68. D. CONTRACTS BETWEEN THE ORANGE COUNTY HEALTH DEPARTMENT AND THE UNC- CH SCHOOL OF MEDICINE. DEPARTMENTS OF FAMILY MEDICINE AND PEDIATRICS The Board approved and authorized the Chair to sign the renewal of Professional Services Contracts between the Orange County Health Department and the UNC-CH School of Medicine, Departments of Family Medicine and Pediatrics. Fes. HISTORIC INVENTORY GRANT PHASE III The Board approved and authorized the County Manager to sign a $15,000 Survey and Planning Grant from the State Historic Preservation Office and to certify matching funds of $15,000 cash and $5,200 in-kind contribution. This grant will be used to conduct an inventory of archaeological sites in the unincorporated portions of Orange County and prepare the manuscript for the countywide inventory. F. CHANGE IN MEETING SCHEDULE The Board approved changing the June 3 budget public hearing to June 2, 1993 at 7:30 in Superior Courtroom, Hillsborough, North Carolina. G. RATIFICATION OF CHANGE TO JPA PUBLIC HEARING NOTICE The Board approved adding a second rezoning to the agenda for April 15. This request involves the Pollitzer property, consisting of two tracts totalling sixteen acres, located on the south side of Homestead Road. H. ESTABLISHMENT OF PUBLIC HEARING DATE - REFINANCING OF 1988 BONDS The Board approved scheduling a public hearing on the refinancing of the 1988 bonds for Monday, May 3, 1993 at 7: 30 p.m. at the Cedar Grove Ruritan Building in Cedar Grove, North Carolina. VOTE ON THE CONSENT AGENDA: UNANIMOUS IV. RESOLUTIONS/PROCLAMATIONS A. PROCLAMATION FOR FAIR HOUSING MONTH Motion was made by Commissioner Gordon, seconded by Commissioner Halkiotis to proclaim the month of April, 1993 as Fair Housing Month as stated below: PROCLAMATION FAIR HOUSING MONTH WHEREAS, April, 1993 marks the twenty-fifth anniversary of Title VIII of the Civil Rights Act of 1968, the Federal Fair Housing Act, which provided for equal opportunity for all Americans in the sale, rental and financing of housing and prohibited housing discrimination on the basis of race, color, religion, sex, age or national origin; and WHEREAS, the Fair Housing Amendments Act of 1988 added familial status and handicap to those classes protected by Title VIII and added strong new rights, remedies, monetary penalties and judicial and administrative enforcement procedures; and WHEREAS, numerous studies have shown that housing discrimination is as pervasive, if not more so, than in 1968, and far more insidious than ever before; and WHEREAS, illegal barriers to equal opportunity in housing that diminish the rights of some of our citizens diminish the rights of all; NOW, THEREFORE, be it resolved that the Orange County Board of Commissioners proclaim the month of April, 1993 as FAIR HOUSING MONTH and commend this observance and related activities to all Orange County citizens. VOTE: UNANIMOUS B. PROCLAMATION FOR PIIBLIC HEALTH WEEK Motion was made by Commissioner Gordon, seconded by Commissioner Halkiotis to proclaim the week of April 18 through April 24, 1993 as Public Health Week as stated below: PIIBLIC HEALTH WEEK PROCLAMATION FROM THE COUNTY COMMISSIONERS WHEREAS, The State of North Carolina has adopted the week of April 18 through April 24, 1993, as Public Health Week in North Carolina; and WHEREAS, The public health facilities in Orange County serve thousands of our citizens each year; and WHEREAS, Public health assures a cleaner, safer, more wholesome environment in which to live; and WHEREAS, Healthful living is the major prevention of the financial burdens of disease and chronic illness; and WHEREAS, Concerned, informed and active citizens will ensure a healthy future for Orange County; THEREFORE, We, the Orange County Board of Commissioners hereby proclaim April 18 through April 24, 1993 as PUBLIC HEALTH WEEK in Orange County, with the theme "Healthy Living. " VOTE: UNANIMOUS C. PROCLAMATION OF COUNTY GOVERNMENT WEEK Motion was made by Commissioner Gordon, seconded by Commissioner Willhoit to proclaim the week of April 17 through April 24, 1993 as Orange County Government Week as stated below. PROCLAMATION COUNTY GOVERNMENT WEEK WHEREAS, The North Carolina Association of County Commissioners and the National Association of County Commissioners have encouraged citizens across the state and the nation to learn more about county government's role in our lives; and WHEREAS, Orange County government has served the citizens of the County since 1752 and places its emphasis on addressing citizens concerns and needs; and WHEREAS, The elected and appointed officials of Orange County take pride in serving the citizens in the County; and WHEREAS, Orange County is on the forefront of many issues critical to both our state and nation, including health care, child and elder care, environmental protection, social services, job training, emergency management services, drug and alcohol abuse treatment, law enforcement, water and sewer services, and library services; and WHEREAS, Citizens may develop an increased awareness about county services and resources through outreach efforts provided by County officials. NOW THEREFORE, We, the Orange County Board of Commissioners hereby proclaim the week of April 17 - 24, 1993 as ORANGE COUNTY GOVERNMENT WEER, and further encourage all citizens to become familiar with the services provided by Orange County government. VOTE: UNANIMOUS D. TELECOMMUNICATOR WEER PROCLAMATION Motion was made by Commissioner Gordon, seconded by Commissioner Halkiotis to proclaim the week of April 11 through April 17 as National Public Safety Telecommunicators Week as stated below: TELECOMMUNICATORS WEEK PROCLAMATION WHEREAS, Thousands of dedicated Telecommunicators daily serve the citizens of the United States and Canada by answering their telephone calls for police, fire and emergency medical services by dispatching the appropriate assistance as quickly as possible; and WHEREAS, The critical functions performed by professional Telecommuni- cators also include those related to forestry and conservation operations, highway safety and maintenance activities, and many other operations performed by federal, state and local government agencies; and WHEREAS, Professional Telecommunicators work to improve the emergency response capabilities of these communication systems through their leadership and participation in training programs and other activities provided by the Associated Public-Safety Communications Officers, Inc. ; and WHEREAS, The Associated Public-Safety Communications Officers, Inc. , an organization of nearly 10, 000 people engaged in the design, installation and operation of emergency response communications, has set aside the week beginning April 11, 1993 to recognize Telecommunicators and their crucial role in the protection of life and property; and WHEREAS, The telecommunicators of Orange County answer over 450,000 phone calls and initiate over 85,000 responses for Orange County citizens in their time of need; NOW, THEREFORE, We, The Orange County Board of Commissioners, hereby proclaim the week of April 11 - 17, 1993 as "National Public Safety Telecommunicators Week" in Orange County, North Carolina in honor and recognition of our County's Telecommunicators and the vital contributions they make to the safety and well-being of our citizens. VOTE: UNANIMOUS V. SPECIAL PRESENTATIONS - NONE VI. PUBLIC HEARINGS - NONE VII. REPORTS A. REPORTS TO THE COMMUNITY Planning Director Marvin Collins gave specific information on the Comprehensive Plan Element for Eno Township. He noted that Eno had a growth rate of 7% between 1970 and 1980 and a growth rate of 2% between 1980 and 1990. He also gave information on the proposed economic development district for Eno Township. He noted that the watershed classification will result in very little change in their development standards. Budget Director Sally Kost gave a brief overview of the County's revenues and expenditures and shared some of the challenges for the future. Assistant County Manager Rod Visser made brief comments about the landfill site search and the County's Solid Waste Committee. Solid Waste Coordinator Beth Wickham presented information on staffing at green box sites and other solid waste issues. Archie Daniel of the Sheriff's Department presented information about public safety and other crime statistics. B. COMMUNITY CONCERNS Barbara Robertson asked about the status of University Station. She voiced a concern about the traffic on Old NC10 and asked for an update on the extension of water and sewer into the more urban areas. She feels that water and sewer extensions from Durham and Hillsborough will present all kinds of problems. Chair Carey indicated that University Station is being developed within the guidelines already approved and that no amendment was made for this development. Her traffic concerns on Old NC10 will be referred to NCDOT. C. IMPLEMENTATION OF MOTOR VEHICLE TAXATION CHANGES John Link reported that as of January 1, 1993, the process for listing, billing, and collection of property taxes on registered motor vehicles is tied to registration with the North Carolina Department of Motor Vehicles. Vehicle owners will receive a bill for property taxes approximately three months after their registration expires for each vehicle, instead of being billed in July for taxes on vehicles as well as real property. This report was received for information only. D. SOLID WASTE ORDINANCE This will be placed on the next agenda for further discussion. E. FISCAL IMPACT ANALYSES FOR RESIDENTIAL DEVELOPMENT - POSTPONED F. REPORT ON UTILITY SERVICE AREA BOUNDARIES - POSTPONED VIII. ITEMS FOR DECISION - REGULAR AGENDA A. 1993-98 CAPITAL IMPROVEMENTS PLAN Motion was made by Commissioner Willhoit, seconded by Commissioner Insko to tentatively approve the CIP reserving funds for the swimming pool project and setting aside the additional money generated from sales tax in a reserved account for possible use for an elementary school. VOTE: AYES, 4; NOES, 1 (Commissioner Gordon) B. MONITORING AND MAINTENANCE ASSURANCE PROGRAM - POSTPONED IX. BOARD COMMENTS - NONE X. COUNTY MANAGER'S REPORT - NONE XI. APPOINTMENTS Motion was made by Commissioner Halkiotis, seconded by Chair Carey to appoint alternate John Forrest as a regular member of the Hillsborough Board of Adjustment as a County representative. VOTE: UNANIMOUS Motion was made by Commissioner Gordon, seconded by Commissioner Halkiotis to appoint Stella Maunsell to the Multi-Jurisdictional New Hope Advisory group as the County's representative. VOTE: UNANIMOUS NOTE: All other appointments were postponed. XII. MINUTES - POSTPONED III. EXECUTIVE SESSION - NONE XIV. ADJOURNMENT With no other business to consider, Chair Carey adjourned the meeting.
