ORANGE COUNTY BOARD OF COMMISSIONERS
AND
ORANGE COUNTY PLANNING BOARD
REGULAR QUARTERLY PUBLIC HEARING
DECEMBER 11 1990
The Orange County Board of Commissioners met in Joint Session
with the Orange County Planning Board for the regular Quarterly
Public Hearing on December 11, 1990 at 7:30 p.m. in the Superior
Courtroom, new County Courthouse, Hillsborough, N.C.
COUNTY COMMISSIONERS PRESENT: Chairman Moses Carey, Jr. , and
Commissioners Stephen Halkiotis, Verla Insko, Alice Gordon, and Don
Willhoit.
PLANNING BOARD MEMBERS PRESENT: Chair Betty Eidenier and members
Pegge J. Abrams, Chris Best, William J. Waddell, Jr. , Michael
Lewis, Clinton Burklin, Jean Hamilton, Virginia Boland, and Carol
Cantrell.
PLANNING BOARD MEMBERS ABSENT: Barry Jacobs, Dan Eddleman, and
Larry Reid.
COUNTY ATTORNEY PRESENT: Geoff Gledhill
STAFF PRESENT: County Manager John M. Link, Jr. , Clerk to the
Board Beverly Blythe, Planning Director Marvin Collins, and
Planners Emily Cameron (Crudup) , Eddie Kirk, Don Powell and Mary
Scearbo.
NOTE: All documents referenced in these minutes are in the
permanent agenda file in the Clerk's office.
A. OPENING REMARKS:
Chairman Carey made introductory remarks and announced that
Item 2 (a) Weston Place Planned Development had been withdrawn from
the agenda.
C. PUBLIC HEARING ITEMS
1. Assignment of House and Building Numbers
a. Rural Route 6 - Hillsborough
This presentation was made by Marvin Collins. In
summary this item was presented to consider a proposed change from
existing rural box numbers to a system of permanently assigned
house numbers. Route 6, Hillsborough, encompasses an area from
South Churton Street southwest along Orange Grove Road to Davis
Road, including New Grady Brown School Road, Crossroads Church
Cemetery Road, Shamrock Road, and the western half of Ode Turner
Road; then northward along Dimmocks Mill Road to Ben Johnston Road,

including Moorefields Road and Rex Drive; then north on West Hill
Avenue from Ben Johnston Road to US 70 West, including Eno Street,
Latimer Street, King Charles Road, and Kind Edward Road, and that
portion of US 70 West from Lloyd Dairy Road to NC 86 North; then
along Frank Perry Road to Coleman Loop Road, including Daye,
Dalton, Hill Torain, Lawndale, Harper, Locust, and Tuliptree Roads.
b. Rural Route 1 - Efland
This presentation was made by Marvin Collins. In
summary this item was presented to consider a proposed change from
existing rural box numbers to a system of permanently assigned
house numbers. Route 1, Efland, includes that area beginning at
US 70, then southwest along Mt. Willing Road to Buckhorn, including
Forrest Avenue, Gym Road, Center Street, Southern Drive, Watson
Road, Gaines Chapel Road, and a portion of West Ten Road, Bushy
Cook Road, Chestnut Ridge Road, Camp Chestnut Road, and the western
third of Borland Road; then south from Buckhorn on Buckhorn Road
down to and including Bradshaw Quarry Road from Orange Grove Road
to Applemill Road and a portion of Teer Road; then extending north
from US 70 along Brookhollow Road to Efland-Cedar Grove Road, up
to and including a portion of Halls MillRoad, Bane Road, the
Eastern end of East Lebanon Church Road, and Blacksmith Road.
Including also are US 70, West from Lloyd Dairy Road to Fuller
Road, and including Tinnin Road and School House Road.
c. Rural Route 2 - Efland
This presentation was made by Marvin Collins. In
summary this item was presented to consider a proposed change from
existing rural box numbers to a system of permanently assigned
house numbers. Route 2, Efland, includes an area beginning at US
70, then extending north along Efland-Cedar Grove Road to and
including Governor Scott Road; and then northwest from Efland-
Cedar Grove Road along Harmony Church Road to Lynch Store Road,
including Shanklin Dead End, and a portion of Poteat Road and
Charlie' s Dead End; then all of High Rock Road extending from US
70 northwest to the Alamance county line, including Ira Road.
THERE WERE NO QUESTIONS OR COMMENTS FROM THE BOARD OF COMMISSIONERS
OR THE PLANNING BOARD.
THE PUBLIC HEARING WAS OPEN FOR CITIZEN COMMENT
Roger Eibest indicated that he lives in the Rural Route 1 area
on Juniper Road. He indicated that the road is scheduled to be
renamed Andy Smith Road. He requested that the name not be
changed.
Bill McFerrin also indicated that he would like for Juniper
Road to maintain its original name.
It was the consensus of the Board of Commissioners that Don
Powell research the reason behind this proposed name change. If

possible this road will remain Juniper Road.
THE PUBLIC HEARING WAS CLOSED
A motion was made by Commissioner Halkiotis, seconded by
Commissioner Insko, to approve the proposed house and building
numbers, followed by notification of the Hillsborough Postmaster,
the Efland Postmaster and the N.C. Department of Transportation,
as required by G.S. 153A-240.
VOTE: UNANIMOUS
2. Zoning Atlas Amendments
a. PD-4-90 - Weston Place Planned Development
This item was deleted.
3. Zoning Ordinance Text Amendments
These presentations were made by Mary Scearbo for items
(a) , (b) and (c) and by Eddie Kirk for items (d) , (e) , and (f) .
a. Article 2 .4 .2.1 (e) Development Advisory Committee
This item was presented to amend ARTICLE 2 .4 .2. 1 (e)
DEVELOPMENT ADVISORY COMMITTEE by eliminating the role of the
Committee in advising the Zoning Officer about the issuance of Stop
Work Orders.
THERE WERE NO QUESTIONS OR COMMENTS FROM THE BOARD OF
COMMISSIONERS, THE PLANNING BOARD OR CITIZENS
A motion was made by Commissioner Gordon, seconded by
Commissioner Halkiotis, to refer this matter to the Planning Board
for recommendation to be returned to the Board of Commissioners no
sooner than February 4 , 1990.
VOTE: UNANIMOUS
Items 2 (b) & (c) were heard together.
b. Article 4.2.27 Protected Watershed (PW-II)
This item was presented to amend ARTICLE 4 .2 . 27
PROTECTED WATERSHED-II (PW-II) DISTRICT by clarifying that the PW-
II zoning district overlay will be applied in the zoned portions
of the county designated as Water Supply Watershed in the Land Use
Element of the Comprehensive Plan.
c. Article 4.2.28 Water Critical Area (WQCA)
This item was presented to amend ARTICLE 4 . 2 .28
WATER QUALITY CRITICAL AREA (WQCA) DISTRICT by clarifying that the
WQCA zoning district overlay will be applied in the zoned portions
of the county designated as Water Quality Critical Area in the
Land Use Element of the Comprehensive Plan.

A motion was made by Commissioner Insko, seconded by
Commissioner Halkiotis, to refer these matters to the Planning
Board for recommendation to be returned to the Board of
Commissioners no sooner than February 4 , 1990.
VOTE: UNANIMOUS
Items 3 (d) , (e) & (f) were presented together.
d. Article 4.3 Permitted Uses (Camp/Retreat Centers)
This item was presented to amend ARTICLE 4 . 3
PERMITTED USE TABLE by adding "Camp/Retreat Centers" as a use
permitted in the Rural Buffer (RB) , Agricultural-Residential (AR) ,
and Rural Residential (R-1) zoning districts following the approval
and issuance of a Class B Special Use Permit.
e. Article 8.8 Special Uses (Camp/Retreat Centers)
This item was presented to amend ARTICLE 8.8
regulations governing individual special uses by adding a new
Article 8 .8 . 5 Camp/Retreat Center which sets forth specific site
plan and development standards applicable to camp/retreat centers.
f. Article 22 Definitions (Camp/Retreat Centers)
This item was presented to amend ARTICLE 22
DEFINITIONS by adding the definitions of "camp" and "retreat
center" .
THERE WERE NO QUESTIONS OR COMMENTS FROM THE BOARD OF
COMMISSIONERS, THE PLANNING BOARD OR CITIZENS.
A motion was made by Commissioner Halkiotis, seconded by
Commissioner Insko, to refer these matters to the Planning Board
for recommendation to be returned to the Board of Commissioners no
sooner than February 4 , 1990.
VOTE: UNANIMOUS
4. Subdivision Regulations Text Amendments
a. Section III-D-2-e Application Requirements
This presentation was made by Mary Scearbo. This item
was presented to amend SECTION III-D-2-e APPLICATION REQUIREMENTS
by adding another factor which the Board of Commissioners may
consider in determining whether or not to approve an amended
phasing plan for a subdivision. The new provision would allow
approval of an amended phasing plan if the time available to
install improvements (roads, etc. ) was not extended.
THERE WERE NO COMMENTS OR QUESTIONS FROM THE BOARD OF
COMMISSIONERS, THE PLANNING BOARD OR CITIZENS.
Commissioner Gordon asked if the Four Birch Subdivision would
have been approved with this proposed amendment. Scearbo indicated

that this amendment would have made a stronger case for them,
however, they did not have a very strong case for approval.
A motion was made by Commissioner Halkiotis, seconded by
Commissioner Insko, to refer this matter to the Planning Board for
a recommendation to be returned to the Board of Commissioners no
sooner than February 4 , 1990.

5. Flood Damage Prevention Ordinance Text Amendments
a. Article 2 Definitions
b. Article 4.5 Manufactured Homes
These presentations were made by Eddie Kirk. This
item was presented to amend ARTICLE 2-DEFINITIONS and ARTICLE J4 . 5-
MANUFACTURED HOMES to conform with changes to the floodplain
management regulations administered by the Federal Emergency
Management Agency (FEMA) . The proposed amendments include new
definitions, clarifications to existing definitions, and new
requirements concerning manufactured homes. In designated
floodplains, replacement manufactured homes in existing
manufactured home parks will have to be elevated to the base flood
elevation or 36 inches above grade on reinforced piers.

COMMISSIONERS, THE PLANNING BOARD OR CITIZENS.
A motion was made by Commissioner Gordon, seconded by
Commissioner Willhoit, to refer this matter to the Planning Board
for a recommendation to be returned to the Board of Commissioners
no sooner than February 4, 1990.
VOTE: UNANIMOUS
D. ADJOURNMENT
With no further business for consideration by the Board,
Chairman Moses Carey, Jr. adjourned the meeting. The next meeting
will be held on Tuesday December 18, 1990 at 7 : 30 p.m. in the
Courtroom of the Old Post Office in Chapel Hill, North Carolina.
