Secondary Roads Investigation Reports PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT) concerning a petition to add subdivision roads in Tuscany Ridge Subdivision to the State Maintained Secondary Road System. BACKGROUND: The Board of County Commissioners (BOCC) approved Tuscany Ridge Subdivision on June 27, 2002 through the major subdivision process with Tuscany Drive and Front Street as public roads. (Front Street was later renamed Craftsman Street on the Final Plat.) The developer of Tuscany Ridge Subdivision has petitioned the North Carolina Department of Transportation to accept maintenance responsibilities for Tuscany Drive (8 homes) and Craftsman Street (8 homes). Tuscany Ridge is located off the north side of Arthur Minnis Road in Chapel Hill and Bingham Townships. This application meets the criteria endorsed by the BOCC for recommending acceptance of a public road into the State Maintained System for roads approved through the governing jurisdiction's major subdivision process. NCDOT has investigated this request (please refer to Attachment 4) and has submitted the petition to the BOCC for its review and recommendation. In accordance with North Carolina General Statute §136-62', the Board is required to make a recommendation regarding the petitions to the North Carolina Board of Transportation (NCBOT) before the NCBOT can consider the petitions. FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. " North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations." 2 RECOMMENDATION(S): The Manager recommends the Board: 1. Forward the Petition for Addition to the State Maintained System for subdivision roads in Tuscany Ridge Subdivision to the North Carolina Department of Transportation; and 2. Recommend the Board of .Transportation accept those roads for maintenance as State secondary roads. The right-of-way will extend the entire length of the road that is requested to be added to the state maintained system and will include the necessary areas outside of the right-or-way far cut and fill slopes and drainage. Also, we agree to dedicate additional right-of-way at intersections for sight distance and design purposes and execute said right-of-way agreement forms that will be submitted to us by represen#atives of the NCDOT. The right-of way shall be cleared at no expense to the NCDOT, which includes the removal of utilities, fences, other obstructions, etc. General Statue 136-102.6 (see page 29 for Statute) states that any subdivisian recorded on or after October 1, 1875, must be built in. accordance with NCDOT standards in order to be eligible for addition to the State Road System.
