Frank Newton, Inc. for the development of a Consolidated Housing Plan for Orange County and authorize the Chair to sign the associated contact document contingent upon final review and approval of the County Attorney. BACKGROUND: A Consolidated Plan for Housing and Community Development Programs in Orange County is a five-year document required by the U.S. Department of Housing and Urban Development (HUD) for all communities receiving HOME funds and Community Development Block Grant (CDBG) entitlement funds (Chapel Hill). The Plan details housing needs of very low income, low income and moderate-income families and special population groups in addition to outlining the strategies and plans for addressing those needs. The last Plan was completed in May 2005 for the years 2005 ~ 2009, thus a new plan is needed for the coming five-year period (2010 - 2014). The 2005-2009 Consolidated Plan was also completed by a consultant -Training and Development Associates, Incorporated. In November 2009, a Request for Proposals (RFP) was issued soliciting proposals from qualified housing consultants. A total of four (4) proposals were received on December 31, 2009. The respondents were: 1. Bay Area Economics 2. Clarion Associates 3. Ken Weeden and Associates 4. W. Frank Newton, Inc. Upon receipt of proposals, members of the HOME Program Council reviewed the proposals based on the following evaluation criteria: • Demonstrated prior experience authoring Consolidated Plans, particularly multi- jurisdiction consortium plans. • Strong background in current conditions data analysis. • Experience with Housing Market Studies. • Experience meeting with and working with a variety of constituencies, agencies, non- profits, and governmental bodies. • Thorough understanding of procedures as outlined in this request for proposals. • Reasonableness of projected expenses and allocated time. • Financial capability to carry out the work program. Based on this evaluation criterion, the HOME Program Council recommends contracting with W. Frank Newton, Inc. at a cost not to exceed $35,000. The consultant agrees fo complete the Consolidated Plan process by the HUD deadline of May 14, 2010. The scope of work is more fully described in the attached proposal summary. FINANCIAL IMPACT: The total cost for this contact, $35,000, will be funded through existing HOME Program administrative funds and does. not decrease the amount of HOME funds available for direct housing development/services. RECOMMENDATION(S): The Manager recommends that the Board award a contract for consulting services to W. Frank Newton, Inc. for the development of a Consolidated Housing Plan for Orange County and authorize the Chair to sign the associated contact document contingent upon final review and approval of the County Attorney. This planning process provides the County with an opportunity to integrate its economic, physical, environmental, community, and human development components into a comprehensive and coordinated effort in order to facilitate the communications among families and community agencies so that they can work together and thrive. WFN, Inc. will develop a strategic Comprehensive Plan that will establish program goals, specific objectives, annual goals, and benchmarks for measuring progress. Z. Specific Consolidated Plan Experience Since 1982, WFN, Inc. has completed all planning and management activities for the CDBG Programs in Clayton, Cobb and Gwinnett Counties and has completed 14 Consolidated Plans. In 2009, WFN, Inc. was awarded the contract to manage the City of Dalton, Georgia's CDBG Program, as well as complete the Housing Needs Assessment for Cumberland County and the City of Fayetteville, North Carolina and the Analysis of Impediments to Fair Housing Choice for Wake County, North Carolina. Scope of Services [Methodology] WFN, Inc. has established operational controls for the planning and preparation of the Five-Year Consolidated Plan, to include a 1St-Year Action Plan and Analysis of Impediments to Fair Housing Choice, and will utilize this approach for the Orange County HOME Consortium and Chapel Hill. As such, WFN, Inc. relies upon experienced and well-trained personnel. Operating controls are established by WFN, Inc., in accordance with the various legislation, regulations, guidance, RESPONSE TO 2010-2015 CONSOLIDATED PLAN -DECEMBER 2009 directives, and policy memoranda published by HUD. This ensures that the Consolidated Plan will be prepared in a quality manner, following all operational policies for the CDBG, HOME, ESG, HOPWA, NSP, HPRP and CDBG-R Programs, as well as the Orange County HOME Consortium's operational controls and policies. All grant activities, including the Consolidated Plan process, budgets, and amendments aze subject to public review and comment through public hearings conducted by WFN, Inc. staff. It is the practice of WFN, Inc. to encourage public participation and to solicit the involvement of the various Departments, residents and non-profit Agencies that provide facilities and deliver services to the residents of the Orange County HOME Consortium. I. Preparation of the Consolidated 5-Year Plan with I S` Year Action Plan WFN, Inc. has established a proprietary Performance Measurement System, which it uses in managing its CDBG Programs. The following summarizes the Consolidated Plan Preparation process that will be implemented to ensure WFN, Inc.'s maximum efficiency and effectiveness in our performance. WFN. Inc.'s Consolidated Plan Activities - Preparation of the Consolidated Plan every five years, including the Strategic Plan [needs, goals objectives, strategies, outcomes], and activities which address high priority needs, in accordance with HUD statutory and regulatory requirements. - Conduct Public Hearings as outlined in the Orange County HOME Consortium's Citizen Participation Plan. - Maintenance of the Citizen Participation Plan consistent with the statutory and regulatory requirements required by HUD and the Orange County HOME Consortium. - Submission of the Consolidated Plan to the U.S. Department of Housing and Urban Development within the time limits established by HUD for approval. WFN, Inc. has provided a detailed flowchart outlining the Consolidation Plan preparation process in Exhibit 1. Scope of Services As adopted by the Orange County Board of Commissioners and approved by HUD, WFN, Inc. will ensure the Five-Yeaz Consolidated Plan [ConPlan] and ls` Year Action Plan will set forth the Consortium's existing policies, programs and measurable objectives for expenditure of various federal grants to include the CDBG, HOME as well as incorporate a Comprehensive Housing Affordability Strategy [CHAS] for the HOME Program. WFN, Inc. will research, plan and prepare a Consolidated Plan that will provide a comprehensive strategy that addresses the Orange County HOME Consortium's housing and community development needs. WFN, Inc. will consider all funding sources available. WFN, Inc. will follow regulations set forth by Title 24 CFR Part 91 et seq., and in accordance with instructions prescribed by HUD, including tables and narratives. WFN, Inc. will comply with the Orange County HOME Consortium's recommended four-step process to prepare an analysis and report in accordance with the following regulations: 1. Subpart C: Local Governments; Contents of Consolidated Pian - § 91.200 RESPONSE TO 2010-2015 CONSOLIDATED PLAN -DECEMBER 2009 I) Subpart A: General Program Overview and Definitions - ~ 9l I Over the past 38 years, WFN, Inc. has worked with federal, state and local government grant programs in Metro-Atlanta, in particulaz, Cobb County, Georgia [since 1982], Gwinnett County, Georgia [since 1986] and Clayton County, Georgia [since 1998]. The overazching focus of the fum has been to ensure that services are provided to the taxpayers in the most efficient and cost effective manner. As stewazds of the public trust, WFN, Inc. strives to maintain a balanced and fair approach in all of its grant management activities. We aze dedicated to program integration and simplification resulting in a streamlined approach to program administration with acost-conscious management process. WFN, Inc. believes that it is not necessary to create additional functional entities each time a new federal and state grant program is introduced. By combining resources to address similar needs, eliminating duplication of personnel and equipment and developing relevant processes, we aze able to reduce administrative costs. This approach allows more grant dollars to fund the actual facilities and services, thus serving more citizens. This approach has served our clients well. WFN, Inc. provides expert advice and up-to-date information to its clients to ensure that programs are effectively implemented in a timely manner. The complexities of various grant programs require multiple reporting formats to provide status reports and grant activities at many levels. WFN, inc. provides up-to-date information on all on-going projects to clients in a monthly management report along with monthly meetings to discuss program progress with the appropriate County-liaison staff. WFN, Inc. has provided all aspects of program planning, design, implementation, and administration services for HUD-funded grant programs. This includes the preparation of each jurisdiction's Consolidated Plan and Annual Action Plan prepazation and submission to HUD. 2) Subpart B: Citizen Participation and Consultation - $ 91.100 WFN, Inc. will collaborate with the agencies that provide: housing and social services; fair housing services; homeless services; health services; chronically homeless services; Lead-based Paint services, as well as collaborate with adjacent State [non-housing], County, metropolitan planning agencies and the local public housing authority. WFN, Inc. will also collaborate with neighborhood- serving organizations located with the Orange County HOME Consortium. In addition to services required as Program Management Consultants for Clayton, Cobb, Gwinnett and Henry Counties and the City of Dalton, WFN, Inc. has also performed the following tasks: 1. Creation of the Cobb Collaborative [A group of over 40 non-profits and public service agencies that works with community organizations to facilitate the sharing of ideas, expertise and resources to meet the needs and resolve issues to assist all individuals, families and communities in Cobb County]; 2. Interaction with the Clayton Collaborative and Gwinnett County Human Services Coalition; 3. And, meets regularly with Chairmen, County and City Managers and liaison personnel with grantee agencies. In order to maximize citizen participation, WFN, Inc. will conduct Public Hearings, a Fair Housing Survey and a Needs Assessment Survey for residents, non-profits, and community advocates. WFN, Inc. will interview local non-profit housing and non-housing agencies serving the Orange County HOME Consortium. 4 RESPONSE TO 2010-2015 CONSOLIDATED PLAN -DECEMBER 2009 J Subpart C: Local Governments • Contents of Consolidated Plan - ~ 9I 200 WFN, Inc. will prepare a Consolidated Plan which provides a concise summary of the Orange County HOME Consortium's estimated housing needs projected for the ensuing five-yeaz period. Housing data included in this portion of the plan shall be based on U.S. Census data, as updated by any properly conducted local study, or any other reliable sources that the jurisdiction clearly identifies, and should reflect the consultation with social service agencies and other entities conducted in accordance with §91.100 and the citizen participation process conducted in accordance with §91.105. A. § 91.205: Housing, Homeless. and Non-Homeless Needs (Including HOPWAI Task 1: Housing Needs WFN, Inc. will review the Orange County HOME Consortium's 2005-2010 Consolidated Plan and Fair Housing-related documentation, Continuum of Care and past homeless studies prior to engaging in further housing needs research [if available]. This information will provide a background analysis for the Orange County HOME Consortium. WFN, Inc. will address specific housing needs in the form of a "housing market analysis" to establish priorities, goals and measurable outcomes based upon the needs derived from the analysis of the information collected. This analysis will address specific housing issues to include an "affordability snapshot" which will address the cost burdens associated with rental prices and the affordability of homeownership within the Orange County HOME Consortium. The "affordability snapshot" will provide "Cost of Living" scenarios that will detail the average monthly costs for Orange County HOME Consortium families [one and four-person households] at four distinct income levels; varying from the "high" income bracket [120% of the area median income] down to the "very low/low" income brackets [30% and below, 31%-50% and 51% - 80% of the area median income]. The purpose of these scenarios is to detail "affordable" cost of living snapshots for families at different income levels in the Orange County HOME Consortium. We will also provide an aggregate listing of rental housing [at various income levels] to depict surplus and/or deficiencies that exist at various income levels for residents of the Orange County HOME Consortium. The income levels will be addresses in the categories of very low income [30% and below AMI], low income households [31-50% AMI], moderate income [51-80% AMI] and "middle income j81 - 120% AMI]. This analysis will also encompass a review of substandard living conditions, as well as overcrowding. The models WFN, Inc. will provide will result in an affordabilitylavailability format. WFN, Inc. will use housing-based census records to include current data sources, documents and field surveys to estimate current and projected housing needs for the next five yeazs. If requested, WFN, Inc. will also include a "barriers analysis" which will provide a discussion regarding any racial or ethnic group that have a disproportionately greater need in a specific income category compared to the overall needs of that particular income category. Task 2: Homeless Needs WFN, Inc. will review the Orange County HOME Consortium's most recent sheltered and unsheltered surveys, and point-in-time homeless survey prepared by the local Continuum of Care [if available]. This information will provide a background analysis for the Orange County HOME Consortium's homeless needs. WFN, Inc. will survey local non-profits specializing in emergency, transitional, and permanent housing and shelter programs in order to identify and describe the need for facilities and services for the homeless population. This survey will include needs assessments for sub-categories of the RESPONSE TO 2010-2015 CONSOLIDATED PLAN -DECEMBER 2009 homeless population to include persons living with AIDS, families with children, the disabled, victims of domestic violence and the mentally ill. This process may also involve coordination with local non-profit organizations, in order to receive a "point-in-time" homeless count. By combining resources and fostering a collaborative effort with local non-profits, WFN, Inc. will describe and define the linkages between the availability of homelessness assistance and other private resources with the numbers of persons actually served. This will also implement a narrative description of the nature and extent of homeless by raciaUethnic group. WFN, Inc. will use census and other data to produce maps that will depict the following demographics: - Overcrowded owner-households - Low & moderate income azeas - Overcrowded renter-households - Services & facilities by type - Caucasian population - Schools and pazks - Hispanic population - Persons in poverty - Black population - Unemployed persons - Asian population Task 3. Non-Homeless Special Needs WFN, Inc. will identify the size and characteristics of the Orange County HOME Consortium's non- homeless special needs population. By combining resources and fostering a collaborative effort with local non-profits, WFN, Inc. will estimate [to the extent practicable] the number of persons in various subpopulations that aze not homeless but may require housing or supportive services, including the elderly, frail elderly, persons with disabilities [mental, physical, developmental, persons with HIV/AIDS and their families], persons with alcohol or other drug addiction, victims of domestic violence, public housing residents, and any other categories the jurisdiction may specify and describe their supportive housing needs. B. ~ 91.210: Housing Market Analysis WFN, Inc. will review the Orange County HOME Consortium's most recent County-wide housing conditions survey and available market studies and feasibility report provided by the Orange County HOME Consortium [if available]. This information will provide a background analysis for the Orange County HOME Consortium's housing market. WFN, Inc. will complete a housing market analysis to focus specifically on two major issues: affordability and availability. This will require atwo-step process to first define what is affordable [at various income levels and various household sizes] via an "affordability snapshot", and secondly, to find available rental and homeowner units based on the "affordability" findings. This "affordable/available" inventory listing will also be "broken" down into sub-segments of the Orange County HOME Consortium's "special needs" population to also detail accessibility. The following list will be provided: 1. WFN, Inc. will describe the significant chazacteristics of the housing mazket in terms of supply, demand, condition, the cost of housing, and the housing stock available to serve persons with disabilities. 2. WFN, Inc. will provide an estimate, to the extent information is available, of the number of vacant or abandoned buildings and whether units in these buildings are suitable for rehabilitation. 3. WFN, Inc. will coordinate with local Housing Authority and/or Community Housing Development Organization [CHDO] to discuss topics pertaining to Public and Assisted Housing. WFN, Inc. will reseazch and determine the needs of public housing, to include: RESPONSE TO 2010-2015 CONSOLIDATED PLAN -DECEMBER 2009 - The number of public housing units in the jurisdiction; - The physical condition of such units; - The restoration and revitalization needs of public housing projects within the jurisdiction; - The number of families on public housing and tenant-based Section 8 waiting lists; and - Results from the Section 504 needs assessment of public housing projects located within its boundaries [i.e. assessment of needs of tenants and applicants on waiting list for accessible units as required by 24 CFR 8.25]. 4. WFN, Inc. will provide anavailable/affordable inventory listing to describe the number and targeting [income level and type of household served] of units currently assisted by local, state, or federally funded programs, and an assessment of whether any such units aze expected to be lost from the assisted housing inventory for any reason, [i.e. expiration of Section 8 contracts]. 5. WFN, Inc.'s inventory listing [and narrative description] will include a summary of the existing facilities and services that assist homeless persons and families with children and subpopulations to include outreach and assessment services, emergency shelters and services, transitional housing, permanent supportive housing, access to permanent housing, and activities to prevent low-income individuals and families with children [especially extremely low-income] from becoming homeless. This inventory of facilities should include [to the extent it is available to the Orange County HOME Consortium] an estimate of the percentage or number of beds and supportive services programs that are serving people that are chronically homeless. 6. WFN, Inc. will describe the supply versus demand of housing in the Orange County HOME Consortium, as well as general mazket conditions and housing trends with an emphasis on the changes in: - Socioeconomic, employment, population, and income characteristics; - Housing land use trends and general absorption analysis [for rent and for sale]; - Impediments /opportunities created by the market conditions for: o Promoting new home ownership o Producing rental housing o Alleviating overcrowding o Meeting the needs of underserved populations 7. WFN, Inc. will also provide a description of overall demand for housing to include: - Identification and description of the demand needs for home ownership by first-time homebuyer [describe constraints and trends]. - An aggregate analysis [the new demands for additional units by type/tenure of units] - And, to the degree practical, identification of any potential need for additional units by income category and type of family [elderly, lazge family, small family, and single persons]. 8. WFN, Inc. will identify and describe the concentration of low-income azeas, as well as concentrations of minorities within the Orange County HOME Consortium. WFN, Inc. will provide maps to depict this information, as well as a narrative summary. 9. WFN, Inc. will identify and describe the government assisted affordable housing multifamily complexes [non Public Housing Authority [PHA]] within the County to include: - the name of project; - address; - number of units; - average rent structures; - nature of assisted financing; and, - nature of supportive services. RESPONSE TO 2010-2015 CONSOLIDATED PLAN -DECEMBER 2009 10. Finally, WFN, Inc. will deterraine if any government-assisted housing is at-risk of going free market or being lost from the inventory. This determination will include the name of each housing development, the type of complex, and the number of units, applicable assisted program, address, and potential conversion date. C. § 91.215: Strategic Plan Task 4: Strategic Plan to include 1st Year Action Plan WFN, Inc. will review [with the Orange County HOME Consortium] the completed Housing Market Analysis and work with the County to develop a strategy for providing services to the "tazget group[s]" in a collaborative effort to assist in creating the Orange County HOME Consortium's Strategic Plan. WFN, Inc. will prepare a Strategic Plan, to include a 1 S` Yeaz Annual Action Plan, that will detail how the Orange County HOME Consortium intends to provide new or improved availability, affordability, and sustainability of decent housing, suitable living environment, and economic opportunities, principally for extremely-low, low and moderate income residents with the use of federal funds for Fiscal Years 2010-2014. WFN, Inc. will publish Public Notices, and host Public Hearings in order to meet the Orange County HOME Consortium's Citizen Participation Process in preparing and submitting the Strategic Plan and 1S` Year Action Plan. WFN, Inc. staff members are trained on the use of the Consolidated Plan Management Process [CPMP] Tool, and have completed Annual Action Plans, CAPERS and Consolidated Plans for our four client-jurisdictions utilizing this tool since 2004. Task 5: Other Requirements After preparing the draft Consolidated Plan, WFN, Inc. will address all comments and/or recommendations by County staff, Consortium members, County Commissioners, the public or other stakeholders. WFN, Inc. will prepare and track all revisions made to the draft[s] as requested by County personnel. WFN, Inc. will provide the County with five sets of the draft [and final] Consolidated 5-Year Plan and Analysis of Impediments to Fair Housing Choice accompanied by an electronic compact disc [CD], completed in Microsoft Office Word [2003] format. WFN, Inc. will include both a bibliography, and a resource binder to include all data sources, copies of data collected, and any other records or. supporting documentation used in the compilation and . development of the Consolidated 5-year Plan and Analysis of Impediments to Fair Housing Choice. WFN, Inc. will assist Orange County HOME Consortium personnel in preparing all Public Notices, Memorandums, Advertisements, and announcements/updates for inclusion on the County's website in English, Spanish, and any other appropriate languages 5. Project Timeline WFN, Inc. will complete a draft version of the Orange County HOME Consortium's Consolidated Five-Year Plan, to include an Analysis of Impediments to Fair Housing Choice, by March 26, 2010.
