PURPOSE: To provide a utility concept plan report and design proposal in the Buckhorn-
Mebane Economic Development District (EDD) Corridor.
BACKGROUND: There are multiple projects in this Efland-Buckhorn-Mebane corridor (see
Attachment 1). Some of the projects are underway (i.e. State/EPA grant and construction
review) such as the Environmental Protection Agency Special Appropriations (EPA SPAP) grant

for Central Efland and North Buckhorn sewer improvements. At the BOCC meeting on October
19, 2009, the County Manager's Office and Planning provided an overview of utility planning in
the area. Many of these various projects are inter-related so a complete summary list is
included as Attachment 3. However, the focus of this agenda item and discussion will be linked
to the Buckhorn EDD Phase 2 noted in Attachment 2.
Buckhorn EDD -Mebane Coordination
This information relates to the continued utility planning with the City of Mebane consistent with
the March 1, 2004 Orange County/City of Mebane Utility Service Area Agreement. Specifically,
the agreement includes the City of Mebane's agreement for utility extension by private/public
entities into an approximate 1,000-acre EDD area. However, there were not specific allocations
reserved for that area that would help Orange County obtain certified business site status. by the
State. Therein, staff proposes to work with the City of Mebane to augment the agreement.
Utility design planning has been completed to illustrate how an orderly and multi-phase plan of
development could occur and how an anchor development such as Buckhorn Village could
complement the utility master plan for the larger Buckhorn EDD and Office, Commercial/Light
Industrial Nodes.
To this end, Orange County, City of Mebane, Buckhorn Road Associates and its engineering
consultants (Summit Engineers) embarked on a conceptual investigation to find out:
a. what needs to be done,
b. in what sequence
c. for what design costs, and
d. eventual construction cost.
See Attachments 2, 3, 4, and 5 which show these preliminary designs.
The above information has been refined, and therefore this topic has come back to the BOCC
for discussion. Tonight's item will explain aspects a - d, but is focused on contracting for utility
engineering design for Phase 2 only. Staff is suggesting that Orange County expend monies to
complete the design work. The engineering design work will be in accordance with City of
Mebane utility standards and approved by the city. Although this item does not include funding
for construction, when construction of these pre-approved designs are complete (pursuant to a
later BOCC decision), the City of Mebane would take ownership and maintenance of these
facilities.
Later Interlocal Agreement
At a later date, an agreement for construction is suggested that would be apublic-private sector
agreement between City of Mebane, Orange County and Buckhorn Road Associates (Buckhorn
Village PUD applicant). The purpose of the agreement would be to fund future engineering
design and construction costs for water and sewer `backbone' infrastructure in the Buckhorn-
Mebane EDD. `Backbone' systems refer to the major offsite pipe trunk lines that generally
extend sewer system collection points or loop a water system back to the utility plant or other
high capacity public infrastructure service point. These types of agreements would analyze and
set forth the prorated share contributions. Specific onsite site plan infrastructure would still
need to be installed concurrent with individual development proposals by the developer.
The Buckhorn EDD Phase 2 (southeast quadrant of Buckhorn Road and I-85/40) includes over
400 acres of primarily undeveloped lands. Orange County has made an investment of over $2
million dollars already in the area to serve Gravelly Hill Middle School and the Eurosport Soccer

Complex by providing the first phase of water and sewer infrastructure as noted on the last
page of Attachment 1 d.
Although this is valuable, necessary and supportive infrastructure for the area, fire suppression
and trunk gravity sanitary sewer lines are limited with the existing system.
Opportunities
After the design is completed for Buckhorn EDD Phase 2, State permitting can be pursued, so a
future construction project will be primed for funding. Orange County has been discussing
funding for construction options with the City of Mebane since these utilities will be built to their
standards, and, after completion, will be maintained by them as part of their overall utility
system. These areas are also likely to be annexed by the City of Mebane wherein other
services will be municipally provided. Mebane would benefit from the looped water system
since it travels through its extra-territorial jurisdiction (ETJ) and city limits in places along
Washington Street.
In any event, these areas have been intended by economic development land use and
favorable tax base and they will remain in Orange County whether annexed by City of Mebane
or not.
Orange County has investigated American Recovery and Reinvestment Act (ARRA) grants for
this type of project. As the BOCC is familiar, stimulus monies are primarily used for
construction ready projects where design and permitting is complete. The federal government
acknowledges that a significant amount of time can be spent on this preliminary work and their
interest was to have more responsive job creation from construction.
Authorizing the design work at this time will create funding opportunities in the near future
and/or be able to be bid for construction in a period when costs are more favorable and prepare
a 400-acre economic development area for eventual certification as a state commerce site.
FINANCIAL IMPACT: The estimated costs of the engineering design work is approximately
$200,000. Funds will come from a combination of general fund and capital project funds. The
Financial Services Department will bring back a revised capital project ordinance at a future
meeting.
RECOMMENDATION(S): The Manager recommends the Board:
1. Approve the master infrastructure utility concept plan for the Buckhorn Mebane Area.
2. Authorize staff to revisit the existing utility service agreement adopted in 2004 with City of
Mebane and Attorney's Office and bring back for BOCC review.
3. Authorize up to a $200,000 budget ordinance amendment to fund engineering design
activity for this project.
4. Authorize staff to seek proposals for water and sewer utility civil engineering design work
for this project.
5. Direct staff to bring back recommendations for final approval by the Board of
Commissioners.
