PURPOSE: To:
• Consider a bid award to McQueen Construction of Bahama, NC in the
amount of $498,992.40 for the construction of the Twin Creeks (Moniese
Nomp) Park, Phase I;
• Approve and authorize the Chair to sign the resolution required by the North
Carolina Department of Transportation (NCDOT);
• Authorize the Manager to sign the construction contract on behalf of the
BOCC; and
• Authorize the Manager to sign necessary change orders to the extent of the
project budget.
BACKGROUND: On April 7, 2009 the Board approved a 0.62-mile greenway from the Morris
Grove Elementary School through the Twin Creeks Park site as the new Phase I of Twin Creeks
Park. At that time, the Board also approved amending the existing engineering consultant
contract to authorize the preparation of construction documents for Phase I.
The project consists of a 10-ft. wide concrete multi-use trail following the existing sewer
easement through the park site, and a 111.5' steel truss bridge crossing Jones Creek. The trail
will end at the southern boundary of the County property and will be marked with signage.
Currently the Town of Carrboro is pursuing an access easement with MI Homes (the adjacent
landowner to the south between Twin Creeks and Lake Hogan Farms) to allow connection to
the residential neighborhoods to the south.

On June 16, 2009 the Board endorsed a resolution as part of a project agreement with NCDOT
to provide transportation stimulus funds for the project. The project is eligible for
reimbursement up to $429,457 in American Recovery and Reinvestment Act program funds, on
condition that the County meets all federal deadlines and reporting requirements.
On September 29, 2009, NCDOT and the County received construction authorization from the
Federal Highway Administration for the Twin Creeks Greenway Project (U-4726 GA). The
project was advertised per NCDOT requirements and bids were received on November 19tH
In order to qualify for this stimulus fund reimbursement of up to $429,457, this bid award and
construction contract must be approved before December 31, 2009. In compliance with federal
requirements, construction contracts must be awarded to the lowest responsible, responsive
bidder after advertisement and solicitation of competitive bids.
FINANCIAL IMPACT: The bid award is well within the overall project budget excluding the
stimulus reimbursement. The project budget also includes approximately $200,000 in
contingency funds that will remain in the Twin Creeks project account if not applied to
unforeseen site conditions once construction begins. A summary of the Phase I budget is
attached.
RECOMMENDATION(S): The Manager recommends the Board:
• Award the bid to McQueen Construction in the amount of $498,992.40 for the
construction of the Twin Creeks (Moniese Nomp) Park, Phase I; and
• Approve the resolution as requested by NCDOT; and
• Authorize the Chair to sign the resolution; and
• Authorize the County Manager to execute the contract subject to County Attorney review
on behalf of the Board, and to sign necessary change orders to the extent of the project
budget.

Please fnd enclosed a Certified Bid Tabulation for the Twin Creeks Greenway project. Bids
were opened and read publicly on Thursday, November 19, 2009, at 3:00 p.m. at the Orange
County's Purchasing offices at ] 29 East King Street in Hillsborough.
The following revisions and corrections have been made on the Bid Tabulation:
1. In the Eastern Services bid, there was a math error in [he extension of Item 48. The item
was incorrectly shown as $1,500.00; and should have been $375.00. Correction of this
error did not change the total unaunt bid. Correction of this error does not change the
order of bids.
2. In the White Oak Construction hid, there was a math error in the extension of I[em 29.
The item was incorrectly shown as $113,500.00, and should have been $113,560.00.
Correction of this error did not change the total amount bid. Correction of this error does
not change the order of bids.
3. In the North State Environmental bid, there was a math error in the extension of Item 22.
The item was incorrectly shown as $17,250.00, and should have been $17,205.00.
Correction of this error did not change the total amount bid. Correction of this error does
not change the order of bids.
We would also like to note that the DBE subcontractor listed in the bid by Hy-Tech Construction
does not appear to be listed on NCDOT's list of pre-qualified subcontractors. This may would
prove problematic for the DBE goal if Hy-Tech Construction were the low responsive,
responsible bidder.
The lowest bid received was submitted by McQueen Construction, Inc. at $498.492.40. The
second lowest bid received was submitted by Eastern Services LLC (dba Raleigh Paving) at

$517,137.00. The third lowest bid received was submitted by Narron Contracting, Inc. at
$575,937.00
The Certified Bid Tabulation is furnished to the County to assist in its review of the submitted
bids for the purpose of awarding a contract to the lowest responsive, responsible bidder.

RESOLUTION
AUTHORIZE THE COUNTY MANAGER TO EXECUTE ON BEHALF OF ORANGE
COUNTY A CONTRACT AND ANY CHANGE ORDERS WITHIN THE BUDGETED
AMOUNT WITH MCQUEEN CONSTRUCTION FOR THE PROJECT KNOWN AS THE
TWIN CREEKS GREENWAY PROJECT U-4726 GA
WHEREAS, Orange County solicited formal bids on the County website, the North
Carolina Department of Transportation (NCDOT) website and in the Durham Herald
Sun Newspaper on October 25, 2009; and
WHEREAS, eight bids were received and opened on November 19, 2009; and
WHEREAS, the low bid was confirmed as satisfactory to meeting Orange County
qualifications;
NOW, THEREFORE, BE IT RESOLVED by the Orange County Board of County
Commissioners that the County Manager is hereby authorized to execute on behalf of
Orange County a contract with McQueen Construction in the amount of $498,992.40
and any change orders within the budgeted amount for the Twin Creeks Greenway
project, pending concurrence with award by the North Carolina Department of
Transportation.
BE IT FURTHER RESOLVED by the Orange County Board of County Commissioners
that the Manager is authorized to work with NCDOT and/or the Federal Highway
Administration to approve change orders in a method consistent with NCDOT and/or the
Federal Highway Administration policy and procedures, but not to exceed the approved
project budget without additional Board action.
