ORANGE COUNTY BOARD OF COMMI55IDNERS
JANUARY 9,, 1979
The Board of County Commissioners met in special session on Tuesday,
January 9, 1979, at 7:30 p.m., in the Commissioners' Room of the Courthouse,
in Hillsborough ,. North Garolina to complete the January 2, 1979 agenda. '
Members Present: Commissioners Richard Whitted, Norman Walker,
Norman Gustaveson, Donald Willhoit and Anne Barnes.

Agenda Item 12: - Su ested Rules of Procedure for:...
the Board of Count Commissioners -
Commissioner Barnes suggested, on a trial basis, setting aside a time w -
during each meeting,to hear items of public concern. Commissioner !dillhoit
said he thought this policy might expedite getting through the agenda.
Commissioner Gustaveson said he wanted the Board to continue an easy access
policy but would be willing to try setting aside 15 minutes at the beginning of
each Board mee~ing to hear items of public roncern on a trial basis.
Commissioner Walker requested some flexibility in the policy since some
members of the public would not always be able to appear during the first
15 minutes. He said he was not in favor of excluding the public,•even on an
experimental basis:
Commissioner ~dhitted said, on an experimental basis, the Board will try
hearing items of public concerns as the first item on the agenda. The public
can address the Board on items on the printed agenda or an.y other items of public
concern. After hearing items of public concern, the rest of the meeting would
allow Board discussion.
Commissioner Barnes offered to draft a document setting forth accepted
rules and procedures for Board consideration.
Agenda Item 16: Clean Water Bond Funds
Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to authorize
the County Manager to file an application for approximately $15D,ODD of Clean
Water Bond Funds to supplement Community Development Grant Funds in the
Northern Fairview area. Vote: ayes, 5; noes, D. See pane 069 of this book..
Agenda Item 19: Tentative Work Program for Planning

The Planning Director submitted an outline of three alternative -
work programs for the Planning Department. For a conv of this outline, see
page 043 of this book.

Commissioner ldillhoit said some items are county-wide in nature, while others
are specific to townships and could be handled by township advisory councils.
He said goals which are county wide, such as agriculture, `
could be given in the form of a charge to a task force. He said a technical
advisory committee could be reconstituted to deal with the zoning ordinance.
He suggested a committee could draft a watershed protection plan far University ':
Lake that could be used i:n other watershed areas as model.

adopt a work plan to accomplish objectives during a specific time period.
Commissioner Gustaveson submitted a draft outline of. priorities to be
accomplished January, 1979 through December, 1980. Fora copy of this document,
as amended, see page. 049 of this book.
The Planning pirector said the priorities set forth in this outline could be
accomplished under the ;Planning Department's proposed Alternatives II and III,
- ...-
wh.ich would include a county-wide land use plan for Orange County.
Commissioner Gustaveson said he would like to see zoning accomplished in
stages - first in gingham, then in Hillsborough, then in Cheeks.
Commissioner Willhoit expressed his concern about the high priority of
watershed orotection and strip development along Highway 54. He felt zoning
along Highway 54 should.be accomplished by an extension of the present ordinance,
before amendment. .He felt. watersheds should be zoned under a protective reservoir
zone and he suggested 5 acre minimum lot Sizes until a more extensive zoning
ordinance is completed.
The Planning Director said it might be easier and less time consuming to
approach zoning county wide - issue by issue, phafing in rural residential zoning
and watershed protection - rather than zoning township by township.
Commissioner Whitted said the Board has discussed a more pressing need for
zoning in Bingham, Hillsborough and Cheeks townships. --
The Planning Director said zoning issues such as watershed protection, small
lot zoning for low-income housing and commercial zoning would apply to and could
be implemented in all townships, county wide, rather than in phases.
The County Manager said these issues could be handled under too. 3, Revision of
Zoning Ordinance. Commissioner Gustaveson suggested the existing ordinance might
be adequate to include Bingham township.

Commissioner Willhoit said watershed protection and strip zoning along
Highway 54 and certain residential areas. can be accomplished by an extension of the
present zoning ordinance.
Commissioner Whitted said, when land use plans are being developed in
phases, and you discover that the existing zoning ordinance is adequate to
handle Bingham's plan, you then would be in a position to extend the present
ordinance. If the zoning ordinance is not adequate to handle the plan as the
advisory councils would like, then the ordinance would have to be revised.

The Planning Director said the Planning Department will prepare a work -
program based on the six objectives outlined in Commissioner Gustaveson's draft
outline. He said the present zoning ordinance will not serve the purpose of
watershed protection, so a watershed protection task force will be needed.
Commissioner Gustaveson moved, seconded by Commissioner !Jil1hoit, the
Board formally adopt the following six (6) specific planning objectives fvr
January, 1979, through December, 1980, as clarified and amended.
1. Complete land use plans for Bingham, Hillsborough and Cheeks townships
including subzoning for watersheds, strip commercial and certainre~°fdentiai areas.
2. Extend Zoning Ordinance to Bingham, Hillsborough and Cheeks townships,
in phases, in priority order, including subzoning for watersheds, strip commercial
and certain residential areas.
3. Revise existing Zoning Ordinance and Chapel Hill and Eno zoning Maps
as necessary.
4. Develop intergovernmental long-range planning council.
5. .Complete a county-wide land use plan.
fi. Formulate water resource development policy, plan and protection

Commissioner ldhitted suggested this Board communicate to all departments
and agencies which it funds they should compile their base budget requests
this year with no more than a 7% ceiling over. last year's appropriation in
keeping with President Carter's request. Items that are essential but not
priorities included in the "A" budget (7% ceiling) may be requested in a "B"
budget.

Commissioner Gustaveson moved, seconded by Commissioner Barnes, to
authorize the Chairman of the Board of Commissioners to write a letter to all
agencies and departments indicating the Board's desire all budgets be prepared
with no more than a 7% increase over last year's budget in compliance with
President Carter's request for voluntary inflation control. Vote: ayes, 5; _
noes, 0.

Commissioner Whitted said. the Board could make a decision on whether to
install street signs after reviewing the feasibility study. At that time it
can also decide how much to appropriate toward the cost of the project.
Commissioner Willhoit said the Executive Committee for the Council on '
Status of Women would like to have a work session with this Board before
the budget sessions and have suggested a luncheon and work session on Tuesday or
Wednesday, January 23 br 24 to discuss the director's position, classification and -
role. The Clerk is to make reservations for 12:30, Tuesday, January 23rd at
the Colonial Inn.
Commissioner ldhitted said consideration of Gradv Brawn decision and
subdivision ordinance amendments would be set far the January 16th meeting.
Commissioner Barnes said the Council on Aging scheduled an additional public
hearing on the proposed Senior.Citizens Center for January 31st from 7:30 to 9:30.
She said they have tentatively set the hearing at the Guy B. Phillips School.
~ Commissioner Barnes requested Orange County, Chapel Hill and Carrboro
Recreation Directors and Recreation Advisory Commission chairpersons be notified`
of the meeting on January 22nd concerning recommendations of the Recreation
Advisory Council. '
Mrs. Josephine Barbour, Mr. Ben Lloyd and Mr. !9au~h all spoke out against
the Board's proposed policy of allowing public input during only the first
designated portion of the Commissioners' meetings.
Commissioner Barnes moved, seconded by Commissioner Gustaveson, to adjourn.

BE IT RE50LVED: '
That the Board of County Commissioners for Orange County, PJorth
Carolina hereby authorizes the submission of an application for a State
Grant under the Clean Water Bond Act of 1971 as amended for a waste water
Collection system and water supply system; and,
That the Board of County Commissioners for Orange County, North
Carolina has substantially complied or will substantial 1y comply with all.
Federal, State and local laws, rules, regulations or ordinances applicable
to the proposed project; and,
That the Board of County Commissioners for Orange County, North Carolina
~ _ will arrange financing far its share of costs of the project if approved for
a grant award; and,
That the Board of County Commissioners for Orange County, North Carolina
will designate S. M. Gattis, County Manager, as its authorized representative
empowered to certify or execute such assurances or other documents as may be
