The Board of County Commissioners met in regular session an Tuesday,
January 2, 1979, at 10:00 a.m., in the Commissioners' Room of the Courthouse, in
Hillsborough, North Carolina.
Members present: Commissioners Richard 4lhitted, Norman Gustaveson,
Donald Willhoit, Anne Barnes and Norman Walker.

Commissioner 1•lhitted opened the meeting by asking if any Board member or
person in the audience wished to add additional items to the ailenda. The following
items were added to the agenda: - -

Agenda Item 3: Petition Re uestin hlaminn of County P,oads
"•1r. John Kennedy submitted a petition requesting the Commissioners authorize
the Planning Department study and implement a road naming and posting procedure.
h1r. Kennedy said Alamance County had implemented the program one year at a time
by fire districts and had costs figures available. He said suoalies were purchased
from the prison enterprises.
Deputy Sheriff David Hughes said the naming and posting of ali streets would
certainly cut response times of fire, rescue and law enforcement agencies.
The Planning Director said one-half of the A1amance County project
was X45,000, but he did not have a projected cost estimate for implementing this
program in Orange County.
Commissioner l~lillhoit moved, seconded by Commissioner Barnes, to appoint a
task force composed of individuals from the El15 Council, Sheriff's Department,
Fire Departments, Planning Department and P1anager's Staff and concerned citizens
tc~ achieve the following goals: 1) Develop a list of locally accepted names;
2) Develop a list of priorities in terms of major road; 3) Look at subdivision
ordinance to review how far out subdividers are required to name subdivisions.

Subdividers should install signs an all subdivision roads consistent with county
standards. Subdividers should also identify subdivisions an secondary roads in
addition to subdivision roads. Commissioner Willhoit said the primary duty of the
task force would be to present the Board with a report of these goals and their
recommendations so the Board could decide how to proceed with this project.
Gorr~issianer Walker wanted the task force to have clear directions so the road
naming process could be expedited. He asked whether the county had a listinn of
road names.
The Planning Director said the Highway Department has a printed list of road
numbers and corresponding names-but-it..was.not:-a comolete.list for.al].~oads_in the ...--.

Commissioner Gustaveson pointed out that a lot of work has been done on this -
project already and the next step would involve a lot of planning staff time. .He
requested discussion of this item later in the meeting when nrioriti.es would be
discussed.
Co~r~nissioner Whitted said this project could not be implemented in one year
and a task force could coordinate where the greatest needs are, determine in what
sequence to proceed and decide what the road names should be. He said it is not
feasible to assign these tasks to the Planning Department at this time. He felt
a coordinating body was needed.
Commissioner Walker said he is in favor of the road naming project and he
does not evant to see the project delayed by a task force. He suggested assiclninn
the project to the Planning Board and Advisory Councils.
Commissioner Willhoit withdrew his motion. Commissioner Whitted said this
item will be considered at the afternoon work priar•ity session.
Agenda Item 4: Traffic Control Problems
Dr. Robert Hanes, Superintendent of Chapel Hill-Carrboro schools, and Pir. Bob
Munson, Principal of Chapel Hill Senior High School, reported to the Board a traffic
problem that has occurred on the road that runs i~ front of SeawellElementary an
which connects Homestead Road with Estes Drive Extension ,(Seawell Rd.). Dr. Hanes
said the road is heavily traveled by school buses, parents of students and f
high school students with their own cars. He explained to the Board several problem_ ~I
connected with the road: 1) The road was re-surfaced in late summer and there has
been some difficulty in stabilizing the shoulders. He .said he had contacted
the District Engineer from the Department of Transportation and had been promised
DOT would continue to look at the shoulders. 2) Dr. Hanes said he had contacted
Mr. Watkins, Division Highway Engineer in Greensboro,requesting he review speed
limit markings and see what is necessary to establish a school zone marking in front

of 5eawe1l Elementary School. 3) Dr. Hanes requested briefer patrols and greater
surveillance by the Highway Patrol and Sheriff's Department. 4) Dr. Hanes said
he would apprise students and their parents of the dangers of the road, the posted
speed limit and the need for safe driving.
Deputy Sheriff Hughes said there are a lot of accidents on the road. He said
the upper part of~Homestead Road and the railroad tracks are two problem locations.
that should be patrolled by two cars when the greatest problems occur. He said
the area is not patrolled regularly at this time. He said manpower is a problem
for .the Sheriff.'_s Department and the_ Highway .Patrol. _____.__ ....
Dr. Hanes said problem-times are one hour in the: morning before school opens,
two hours at lunch and one hour after school.
Deputy Hughes said the Sheriff's Department does not have radar equipment
and that the Highway Patrol controls road traffic. He said the Sheriff's Department
usually does not handle traffic matters but handles civil work and answers calls.
Commissioner Whitted said involving the Sheriff in traffic monitoring will
be changing the scope of what the Sheriff is currently doing.
Mr. Munson said the road is currently zoned 55 miles per hour. There is a
caution sign in front o'; 5eawe1lElementary that indicates a 25 mile per IYOUr zone
but the Highway Patrol cannot ticket anyone unless they are driving`-in excess of
55 miles per hour. He said there is a need to rezone and lower the 55~miles per
hour zone.

Commissioner Barnes, seconded by Commissioner Gustaveson, moved the Board
send letters to: 1) Mr..Watkins, Division Highway Engineer, encouraging him to
expedite his review'of SeawellRaad for extension of the school zone in the appropriate
place and review of the speed zone for the entire road; and, Z) Mr. Sizemore, of the
High-aay Patrol, expressing Board concern that the road be patrolled regularly
one hour prior to schools opening in the morning, two hours during the lunch break
and one hour after school in the afternoon. Vote: ayes, 5; noes, 0.
Commissioner Walker wanted to include Orange High School in the motion.
Commissioner Gustaveson said Orange High School administration should make a
formal request for the Board to take a Course of action.
Agenda Item 5: Northside School Property
The County Attorney said the Northside property was surveyed by the Housing
Authority and their attorney has sent us a deed which needs to be modified to
include the tract conditions from the School Board to the county. The Board
needs to request written notice, executed by the chairman and attested by the
secretary of Chapel Hill-Carrboro School Board, stating the School Board does

not desire to have the property. The Board also needs to authorize the Chairman

~' to execute the deed to the Housing Authority under the conditions the Board wishes
to impose. Today, the Board should resolve whether to convey the property and
authorize the Chairman to execute the deed. The conditions set forth 6v the
€ School Board are as follows: 1) The tract be put to public use that receives fin-.-.--
ancial support from Orange County. '.
The County Manager said the Housing Authority does receive indirect financial
support from Orange County at this time under the contract with Section 8.

financial support to the Chapel Hill Housing Authority. - - •
The County Attorney said, if the county transfers the property and gives the
Chapel Hill Housing Authority a deed, the county will be relieved of the legal
requirement to provide financial support. Once the county receives permission from
the Chapel Hill-Carrbaro School Board to convey the property, then the only legal
requirement would be the to see that the property remains used for public purpose.
There should be a provision in the deed that the land would revert back to the
county if it were used for other than public purpose.
Condition No. 2 from the School Board is, if the•land is not 'developed for --~
public use in three years, it will revert to grantor. Condition Pto. 3 is the tract
shall not be used for private development. Condition tlo. 4 states, in case
Orange County should choose to divest itself of the tract within 50 .nears from
the date of the deed, Orange County shall, without charge, convey the property to
the Chapel Hill-Carrboro.Board of Education unless the Board of Education gives
written notice to Orange County that it does pat desire to have the property.
Dr. Hanes said the intent of the Board of Education was to see the property
be available for county-wide use so that it would not revert to Chapel Hill City
use. The Board of Education felt the Ghanel Hi11~Housing Authority an appropriate
use.
• Commissioner Gustaveson said he would like to have more specific wording
in•the county's deed to the Chapel Hill Housing P.uthority than "public purpose"
to assure county use rather than municipal use.
Commissioner Walker said, some provision should assure the property vrould
revert back to.the county if there were no longer a Housing Autfority or a
Section 8.
The County Manager said, if the Authority ceases to use the property
for other than public offices - the purpose for which the property was convened -

the property should revert back to the county. He said HUD gave the Housing

ra Authority a grant for $15D,000 to build a building, but there was no provision
- ~ ~ in the grant to purchase land.
r The County Attorney asked whether the deed should be restricted to Housinn

Commissioner Whitted said the conveyance should be restricted to oaerati•nn

HUD guidelines. He said the deed should also include restrictions by which the

Gommissioner Whitted said the•i;oard of education should be advised we have
~ conducted public hearings, received no adverse sentiment from the public,
and request permission to convey the property. Commissioner Whitted
requested to see the restrictions on the deed before the County Attorney
met with the Chapel Hill-Carrboro Board of Education.
Agenda Item 6: Additions to State Highway System
Gommissioner Gustaveson moved, seconded by Commissioner l~Jalker, to acknowledge
receipt of information from Division of Highways on Roberts Road and Beasley Road
' - and to concur with approval to add Ingram Road to the State Flighway System.

Commissioner Willhoit said he would like the tax receipt to contain
the same information that is shown on the tax bil>zs. Mr. Laws said
the receipts would be undergoing changes this year.and could be altered to
show the requested information.
Agenda Item 8A: Health and Medical Care Advisory Council ,• -
Commissioner Willhoit said he would like to delay action on this item and
seek additional resumes. The Clerk is to publicize the purpose of the Council
and request additional resumes.
Agenda Item 88: Library Board
Commissioner Whitted requested Carrboro be advised of the vacancy on the
county library board and requested this item be placed back on the agenda.

Commissioner Whitted announced the Ghapel Hi 11-Carrboro Schaal Board would
hold a dinner meeting with the Legislative Delegates on Thursday evening and

they have requested one Board member attend. Commissioner Whitted said he would
attend and report back to the Commissioners.

€ Commissioner Barnes announced the Council on Aging will hold two public•

hearings in January regarding the South Orange Senior Citizens Center. One is

Commissioner Whitted called the meeting to order after the lunch break.
~ Agenda Item 9: Potential Industry in,_Orange County
Commissioner Whitted said Orange County has been requested to install a
pump station and line for a new industry considering locating in Orange County.
Oranae County has been asked to provide materials and the Town of Tii11sborouc~h
has been asked to install the line. The. building site is located close to
- the Hillsborough Waste Water Treatment•5tation. The Tine wi11.serve two sites -
one for this industry and one for another potential industry. The industry has
requested the Commissioners give some indication of their willingness to provide
the pump station and line. The name of the industry is not public by their request.
The building to be constructed would be approximately 75,000 square feet and
the industry would employ approximately 125 individuals. Commissioner l+Ihitted
said the Mayor of Hillsborough would accept negotiations an constructing a line
pending action of the Board of Commissioners.
The County Manager said the industry is a manufacturer of metalic labels
such as those on appliances or motor parts-so-there will be no industrial bv-
product or waste product: The company's fiscal year-begins September 1st
~ and they want to have the plant in operation by the first day of their fiscal
vear. The tom?any proposes to invest about $2 million, employ approximately
125 skilled or semi-skillei individuals at local wage rate or better. They
plan to train su?ervisory personnel here. !~lith a 52 million investment, the
industry would bring $12,OOa to $1,000 county tax•base its first taxable
year.

Commissioner Barnes expressed concern that the Board had not developed
a "sewer line policy" to provide guidelines for making these kinds of decisions.
She also expressed concern that the county should have a way to "recoup" monies
expended for these type investments.
Commissioner t"lillhoit felt the Town of Hillsborough should not charge
a differential since the Town would not be advancing extra Honey to provide
services. -.

Commissioner !Talker said Orange County is in competition with
~ neighboring counties for industry. He felt money spent to encourage the
industry's settling here would be well spent because it would .provide .jobs
~ for Orange County residents and would increase the tax base. He said he
would rather make, decisions about industry on an individual basis rather than
a broad policy basis.'
~j CorrRnissioner OustaVeson moved, seconded by Com^~issioner Walker, to
authorize the County Manager and the Chairman to negotiate with the Totivn of
Hillsborough and the industry about settling in Orange Gounty. The Board
of Commissioners will assist in.nroviding sewer lines for the plant within
an estimated outside limit of $12,00 to $15,000. This gives the County
Manager and Chairman authority to move with the endorsement of the Board to
indicate to the industry that Orange County wants the industry to settle here.

Commissioner ~rVhitted said reviewing industry on an individual basis
rather than a broad policy basis allows the Board to be more selective. He
suggested contacting a State agency to find out S~vhat neighboring counties
are doing to attract industry.
Agenda Item 10: Bid Results for Remodeling Crady Brown

The County Manager said the windows were bid $67,400 with only one
bidder.

Agenda Item 11: Architect's Review of Bid Opening for
Remodeling Grady Brown

Commissioner !•Jhitted said there is $1,915,000 in the building fund to
renovate 9rady Brown and remodel and make additions to the .jail. Renovating
f Grady Brown would consume all available funds.

The Board would manage construction. with th.e general contractor.at a savings
of approximately 15 percent. Once the Baard selects a general contractor, it
-vould probably take three to four weeks to seek subcontractor's bids.
The Finance Director said available net debt reduction bonds.wi1l total
$Z15,OO0 on July 1, 1979 and, if we do not exercise the first option, will total
$3'5,000 on July 1, 1980. He suggested the Board allow far other commitments,
such as schools, which would come up during the year.
The County Manager said there was a possibility of renovating the
attics of the Social Services 3uilding (approximately 7,700 square feet) and
the Health Buildin3 (approximately 2,007 square feet) or makinn additions to
either buildin7. He said the Council on Aging can get a•grant ofi $57,00`) if
the Board decides to renovate rrady Brown.
Commissioner !Jhitted asked Brady Brown Renovation be placed on the agenda
for the third Tuesday meeting.
Agenda Item 13: Refuse Collection S stem
The County Manager said, with the landfill closed over the Christmas
holidays, the green box system was over taxed. He said a dinosaur system
would use larger containers owned by the county and would be located at the Chapel Hili
landfill and other sites developed or landscaped for that purpose. He said
the green box system was not designed to tarry surburban areas like Hillsborough
or Carrboro. He. .said the dinosaur program has worked well in Wilson County.
He said dinosaur boxes contain 1400 yards, while green boxes contain 3 to 4
yards. Contractors charge $25 per load at the landfill and $45 per load to
collect at other sites. To empty boxes once a day would cost approximately
$15,000 per .year.

Commissioner Gustaveson said the Director of Public yforks should report
the department's needs and problems and submit a list of options to the County
Manager from which the Board could make some decisions.
Mrs. Josephine Barbour suggested fining people for littering around green
boxes when they are filled. She said volunteers nicked uu trash on 5unda.vs
at one time.
Mrs. rillian, from Mebane, said the green boxes she used were removed
but the property owner, Mr. McBane, had agreed to allow the county to put

sites for the green boxes and report recommendations for immediate and long-
term solutions to the garbage problems.
h1rs. Mary Cary suggested setting up a citizens community watch .to check
the green box sites and see what the problems are and when they occur. She
said garbage collectors .empty their trucks into the green boxes rather than
drive to the landfill,.

Agenda Item`17: Preliminary Plat-Lockridge Community, Section
Mr. Ken ldilliamson, a representative of Lockridge Gommunity, told the -
Board the development planned eleven lots on a 41 acre tract. He said the
subdivision previously received preliminary approval on April 4, 1977 but this
approval had since expired.
Commissioner tdillhoit moved, seconded by Commissioner !Jhitted, to adopt
the Planning 4oard's'recommendation to approve the preliminary plat of Lockridge
Community, Section B. Vote: ayes, 5; noes, ~.
Commissioner !Talker left the meeting at this time.
Agenda Item 18: Report_on Erosion Control Measures at
Stagecoach Run 5u division ~'

The Erosion Control Officer reported the owner had satisfactorily -
completed all necessary work to bring this site into compliance with the ordinanr.
He. said since Mr. Davis has. cooperated and there has been little damage to
other properties, he recommended rescinding the demand for civil penalties.
Commissioner ~ustaveson moved, seconded by Commissioner Barnes, to
adopt the Erosion Control Officer's recommendation to rescind the civil penalty
of $1O a day for 55 days for noncompliance with the Erosion Control Ordinance.

Title II money will allow funding For the 33 slots previously approved by
the Commissioners under Title VI. He .said there will be money available Far
additional slots. The hiring freeze has been lifted for January, February
~ and Plarch for positions that had a positive termination. This means, before

we can hire someone far a particular slot, we have to help the former
employee find another job or take them over ourselves.

additions. Commissioner Gustaveson said Chapel Hill, Hillshorough and
Carrboro's requests should also be considered.
j Mr. Bradshaw said the new regulations encourage Tess governmental

said every person in CETA P5E program will be terminated October 1 - that is
18 months of service. A slot can remain but not the person. Approvals for
supplements must go through the state and the wage level will be about $7,ZOD.
He said that in the future, Title II will be a direct allocation relatinn to
income and employment and Title VI will be a fluctuating sum based on levels
of unemployment.
