ORANGE COUNTY BOARD OF COMMISSIONERS
AUGUST 28, 1978
The Board of Commissioners of Orange County met in joint session
with the Orange County planning Board at 7:30 p.m. in the auditorium of
the Cultural Arts Building at the Chapel Hill High School. A11 members
were present.
This meeting was convened as the quarterly public hearing the
Orange County Commissioners and the Orange County Planning Board jointl•
hold to xeceive petitions for rezoning and to hear other matters of
public concern regarding land use planning issues.
Three petitions for rezoning were received:
1. Clarence Gates, to rezone 3.2 acres near Lawrence Raad and
shown on Erio Township Tax Map 20, as part of Lot 16, from
Residential to General Industrial.
2. Cedar Rills Subdivision to rezone 4.39 acres in Chapel Hill
Township shown on Map 25 B, Block A, Lot 1;. Block B, Lot 1-6
and Block C, Lot 1 from Residential to General Commercial.
3. Timberlyne Subdivision to rezone 92.9 acres shown on
Chapel Bill Township, Tax May 24, Lot 28 from Residential
to General Commercial.
A fourth item of consideration, extra territorial zoning jurisdiction.

The Orange County Board of Commissioners met in joint session with
the Orange County Planning Board at 7:30 p.m. in the auditorium of the
Cultural Arts Building at the Chapel Hill High School on August 28, 1978.
Commissioners present: Commissioner Richard Whitted, Chairman, and
Commissioners Jan Pinney, Don Willhoit, Norman Walker and Norman Gustaveson.
Chairman Whitted called the meeting to order and then turned the
meeting aver to pr. Boner, Chairman of the Orange County Planning Board,
to conduct a public hearing.to receive petitions for rezoning and to
s hear other matters regarding land use planning issues.
Agenda Item 1: Clarence Gates Petition to Rezone
The Planning Director explained Mr. Gates has requested to rezone 3.2
acres near Lawrence Road, Eno Township, Tax Map 20, part of lot 16, from
residential to general industrial.
Mr. Clarence Gates spoke on his behalf and a Mr. Clark stated he had
no objection to Mr. Gates' proposal.
Mr. Gordon Warren spoke in opposition to spot zoning and expressed
his concern that rezoning this 3.2 acres to general industrial would have
a negative impact on his property values. Ms. Elizabeth Rogers and Mr. Glenn
Bunting also spoke in opposition to Mr. Gates' request.
Agenda Item 2: Cedar Hills Subdivision Petition to Rezone
The Planning uirector explained this request was to rezone approximately
x.39 acres along State Road 1733 (Weaver Dairy Road) in Chapel Hill Township,
Tax Map 25B, Block A, Lot 1, Block B, Lot 1 & 6 and Block C, Lot 1 from
residential to general commercial.
A representative of O'Brien/Atkins Associates and a representative of
Cedar Hills Developers spoke on behalf of this request.
A gentleman spoke on behalf of residents of this area in apposition to
the petition to rezone. A representative of Country Side Subdivision spoke
in apposition to the petition to rezone. A Ms. Linda Chris spoke in
i opposition to the petition to rezone.
Ms. Peg Parker, Chairperson, Chapel Hill Planning Board, said the
Planning Board recommended denial of this rezoning request because
this rezoning would not conform to Chapel Hill's land use plan.

Mr, Bill O'Brien spoke to why the request for rezoning had been
changed from multi-family to general commercial.
A resident of Cedar Hills and a Mr. Charles Pullen spoke in opposition
to this request to rezone.
Agenda Item 3: Timberlyne Subdivision Petition, to Rezone
The planning Director explained this request was to rezone 92.9 acres
in Chapel Hill Township along State Road 1733 (Weaver Dairy Road), Tax Map 24,
Lot 28, from residential to general commercial.
Mr. Robert Page spoke on behalf of Timberlyne Associates,
Mr. Jim Heavner, an associate of Village Company, spoke on behalf of
Timberlyne's request. Mr. Bill O'Brien pointed out 6 acres north of
Weaver-Dairy Road for a proposed office park far WCHL. Mr. Will Mann,
a co-owner of a nearby mobile home park, said he was not opposed to this
rezoning request.
The Chairperson of the Chapel Hill Planning Board said the Chapel
Hill Planning Board recommended delaying action on this request until
a decision had been made on the planning area.
Mr. Kenneth Cheek, Jr., Mr. Charles Johnston and Mr. Allen Smith
all spoke in opposition to the petition to rezone.
Agenda Item 4: Extension of Planning Area of Chapel Hill
The 'Chapel Hill Planning pirector presented geographic aspects of y
extension. The Chapel Hill Planning Board's Chairperson gave Chapel Hiii's
planning objectives and policy.
Ms. Jerry Soldi, New Hope Improvement Association, requested the
Board refuse Chapel Hi 11 's request to extend the planning area.
Mrs. Josephine Barbour, Mr. Will Manrr, Mr. John f. Parks, Mr, Charles
Johnston, Mr. Stanley Bennett, Mr. Graham Moody, and three unidentified
individuals spoke against extension of the planning area.
Mr. Randall Waugh requested the Board table Chape] Hill's request
until the Chapel Hill zoning ordinance was amended and all public hearings
completed.
