PURPOSE: To authorize the Interim Manager to sign the Letter of Agreement with artist Cindy
Newport for the Temporary Installations Made for the Elements (T.I.M.E.) Public Art Project at
Cedar Grove Park.
BACKGROUND: During the summer/fall 2009, the Orange County Arts Commission is co-
sponsoring a "Temporary Installations Made for the Elements (T.I.M.E.)" Public Art Project with
the Orange County Parks and Recreation Department. This project is modeled after a program
by New Mexico Arts.
This project will help to "grow" public artists in Orange County. The Arts Commission planned to
initially commission two temporary outdoor, visually engaging artworks to be exhibited in two
Orange County parks. The artworks would relate to a specific park and theme developed by the
artist selection committee. These small-budget temporary installations give local artists the
opportunity to "get their feet wet" in the public art arena. The T.I.M.E. project committee met
during the spring/summer of 2009. The list of committee members and the Call to Artists are
both attached.
Because the Arts Commission was notified of a decrease in the amount of FY 2008-09 state
Grassroots money available, the T.I.M.E. committee decided to fund only one temporary public
art project and selected Cedar Grove Park as the site. The deadline to apply for the Call to
Artists was May 7, 2009. Only Orange County residents were eligible to apply.
Cedar Grove artist Cindy Newport was selected for the T.I.M.E. project at Cedar Grove Park.
Ms. Newport will design and coordinate the painting of a working fuel tank located at the
entrance to this park on Hwy. 86 North in northern Orange County. This location at Cedar Grove

Park was selected by the T.I.M.E. committee upon recommendation by Orange County Parks &
Recreation Department. Community volunteers may assist Ms. Newport with the painting and
will be required to sign a "hold harmless clause". Ms. Newport's artwork will relate to the theme
of recreation and baseball athletics chosen by the T.I.M.E. committee and Ms. Newport wil!
coordinate with appropriate County staff regarding the installation. It is anticipated that this
temporary public artwork will not be replaced after it fades away. (NOTE: Commissioners have
been informed about the progress of this project by the Arts Commission via two Managers
Memos dated January 9, 2009 and June 16, 2009.)
FINANCIAL IMPACT: $807 from the Arts Commission's FY 2008-09 state Grassroots Arts
Program allocation from the NC Arts Council will be used for this project. In addition, up to
$2,000 in County money (from the FY 2009-10 local arts grant money) will be used for this
project.
RECOMMENDATION(S): The Interim Manager recommends the Board authorize the Interim
Manager to sign the Letter of Agreement with artist Cindy Newport contingent upon final review
by staff and the County Attorney.

The Orange County Arts Commission and the Orange County Parks and Recreation Department seek to
commission one temporary environmentally based public artwork to be installed at Cedar Grove Park in Cedar
Grove, NC.
Project Intent
The T.I.M.E. project seeks to commission one temporary, visually engaging and conceptually rich environmental
artwork to be installed at Cedar Grove Park in Cedar Grove, NC. The proposed artwork should relate to the
theme of recreation and baseball athletics.

1. recreation: refreshment of one's mind or body after work through an amusing or stimulating activity
2. athletics: the principles or system of athletic exercises and training. It is anticipated that this park will be
the leading park for baseball and softball in northern Orange County.
Orange County Arts Commission challenges artists to create artwork that will inspire, engage, question, puzzle,
amuse and otherwise influence the citizens of and visitors to Cedar Grove. Orange County Arts Commission is
particularly interested in interactive art. Interactive work promotes actions and it transforms participants into active
contributors to the creative process. Please visit these websites for examples of temporary artworks:

agreed upon time of removal, the artist will return the installation site to its original condition, subject to the site's

Media must be low maintenance, safe for both children and adults, ADA compliant, and not leave a
permanent mark on the environment when removed.
Site Information
Artwork will be located in Cedar Grove Park (5800 Highway 86) in Cedar Grove, seven miles north of Hillsborough,
NC. Specific sites for the artwork will be determined by the requirements of the selected artwork in conjunction with
the T.I.M.E. Project Selection Committee. The outdoor site chosen is a working fuel tank surrounded by a
cinder block wall, located at the entrance to the new Cedar Grove Park on Hwy. 86 N., in rural Orange
County. (Please see attached photos.)
Access to electricity will be available for installation only at this site.
To prevent irreparable environmental damage, no large holes may be dug or foreign organic materials released into
the environment.
Artwork must also be sufficiently secured against high winds and intense weather conditions.
The artist understands that their artwork may be subject to damage, vandalism or theft at anytime. Neither
Orange County Arts Commission, Orange County Parks and Recreation Department, nor the site will be
responsible for such occurrences.
Project Amount
$800 (subject to change). This amount includes all applicable expenses that the artist may incur creating the artwork, such
as materials, labor, insurance, taxes, installation, and retrieval of the artwork.
Artists will be paid in 1 payment. Because of the terms of the state grant supporting this project, the payment of
$800 (subject to change) will be made after the commission is awarded. The artwork must be removed (if applicable) at the
end of the project.
There is no medical or workers' compensation insurance provided by either the State of North Carolina, Orange
County or the sites. Artists will be responsibly for providing coverage.
The selected artists will be required to enter into a professional services contract with Orange County. For a sample

This project is open to Orange County, NC residents only. Artists in all stages of their careers are encouraged
to apply.

A one-page resume listing relevant experience, including temporary environmental art installations if applicable.
Up to two-paces of sketches, diagrams or computer renderings of your proposed artwork, including scale, media
and the approximate lifespan of the artwork.
A detailed description, including dimensions, materials, installation, lifespan, interactivity, content and physical
impact. Be sure to include what your proposed artwork means to you and what you're trying to communicate.
A well thought out clean-up plan. YOU MAY NOT LEAVE ANYTHING BEHIND.
Slides or CD containing up to ten images of recent works.
A one-page annotated image list, listing the title, media, dimensions, and year of completion. Your name should
appear at the top of the image list. Images maybe submitted either digitally on a CD or with 35 mm slides.
All printed materials must be in black ink on white 8 ~/z" x 11"paper.
Do not staple pages or submit them in a binder or in plastic sheets.
Size: Not to be more than 1920 pixels in either height or width.
File format: baseline jpg
Compression: files should not be larger than 1.2 MB
File Names: each jpg must be titled with the artist's name and number that
corresponds to the annotated image list. For example - johndoe0l.jpg,
johndoe02.jpg.
If you are using a mac, please note that computers sometime have
trouble identifying images that are burnt to a CD using iphoto.
