MINUTES ORANrR COUrT`_['Y BOARD OF COR'~]"!ISSTONERS AU~US'_?' 29, 1977 The Orange County Board of Commissioners met jointly with the nranae County Planning Boars? on Monday, P.ugust 29, 1977, at 7:3~ p.rm., for a quarterly public hearing. 'T'he meeting was held in the Superior Courtroom of the Courthouse in Hillsborough. Commissioners present were Norman Tlalker, Jan Pinney and Donald.T7illhoit. Commissioners absent were Richard T+lhitted and rTOrman ~ustaveson. Flapping Board members present were Chairman nr. Robert Bonar, members' Pat Crawford, Col. T^lillvam Breeze, Paul dates, Andrew Dobelstein, .Tean Anderson, Hazel Lunsford, John Scarlett, Ast Cleary, and Lindsay Ffland. Staff personnel present were S. ?'~?. Mattis, County *4anager, Irvin Dobson, Planning Director, Eddie Kirk, from the Planning Department and P.rratha Johnson, Clerk to the Board. Jeffrey Gledhill, County Attorney was also present. In the absence of Chairman Richard Plhitted, Commissioner TTorman T^lalker called the meeting to order. Mr. T^lalker turner? the meeting over to Chairman Bonar, who presided. Dr. Bonar states? that the person making the rezoning request would be heard from first and then persons wishing to speak in favor of the proposal would. be Given an opportunity to speak. Anyone opposing the rezoning re- truest would be heart? from next. The person making the rec?uest would. be given a final opportunity to speak and to answer any questions raised.. ]Te stated that no decisions would be made tonia_ht. The requests will be con- sidered by the Planning Board at their next regular meeting and the Board will make a recommendation to the County Commissioners, who will make the final decision. Dr. Bonar referred to Item 1 on the agenda: Raymond T.+lilliams - Rezoning request to general Commercial from Residential. This one acre lot is located at Blackwood Station on N. C. 86. Mr. T4i11iams stated that he wanted to operate a body shop on the one acre tract of land at Blackwood Station. xe had purchasecT the land with the understanding that the land would he used for future commercial pur- poses. He stated that he had applied for rezoning one Year ago, and at that time, the Planning Board had unanimously approved the request, however, the County Commissioners did not approve the rezoning request. The one acre lot is adjoined by a 22 acre parcel of commercially zoned land, a Bar-B-c?ue business, a grocery store, mobile home parks anc~ across the road is located a graveyard. The Planning Staff presented maps of the area under discussion. TTr. Kirk stated that those businesses which are allowed in.a general commercial zoned area should be that which provides for general business uses adjacent to main highways, such as outdoor storage, commercial uses, outdoor food services establishments, automobile service stations, anr? repair Garages, laundries, and other customary commercial uses. Dr. Bonar asked if anyone would like to speak in favor of the rezoning request of Mr. i^Iilliams, No one came forth. Dr. Bonar asked if anyone would like to speak in opposition to the request. No one came forth. l+x'. Kix'k read the minutes of the Planning Board dated September 34, 1976, which stated the original request of T^s. T7i11iams was unanimously approved. by the Planning Board. The October 4, 1977 County Commissioners' minutes were reviewed. The minutes stated that the rezoning request was denied because it is not con- sistent with the Orange County Zoning Plan. s° t~ v:.~ The T4ay 2, 1977 County Commissioners' minutes were reviewed. ^'his was a meeting at which the Board of Commissioners reconsidered the rezoning request of Mr. [gilliams. At that time, :T".r. [+lilliams was advised by the Board to resubmit his request again after one year through the normal procedures. P4r. [9illhoit pointed out that complaints were heard at the first public hearing from residents of the mobile home par]c rectardzng paint fumes which came from the garage. Mr. Ffland asked if in the Land [Jse Plan, adoptes~ b_y the Gounty Com- missioners, was not the Blackwood Station area envisioned as a service community? The Planning Director stated the Planning Department did draw up a proposed Land Use Plan, but this was a plan drawn up fox stud.v. - P'[r. Ffland pointed put that the plan was part of the Land [Ise Plan adopted by the County Commissioners relative to the proposed 2-40".Highway opposition. Dr. Sonar. asked if anyone else would like to speak for or against the rezoning rec[uest of P'!r. [~illiams. Alo one came forth. The second item on the agenda was a request o.f Thomas ?:'. dates to rezone to.c;eneral Industrial from Residential. This consists of a 1.6 acre tract that is located inside of a 6.9 acre tract of f_ Lawrence Road. Mr Kirk presented a map of the Lawrence Road area to the two Boards. Irvin Dobson stated that a general industrial zone could. entail such uses as individual mok~ile homes on individual lots, general whole- sate and retail sales, mobile home sales, automobile service stations, offices, industrial research facilities, assemblincr, fabricating, dis- tribution anc? storage, as well as salvacring anti storage of_ used auto- mobile parts, scrap metal and other used material with storage and operar tion entirely within a building or enclosed by a wall of solid material a~ least eight feet high. Dr. Bonar pointed out that once a parcel of land is rezones? to a particular category, and if the land is sold at some future date, the uses A1r. Mr. fates stated that he made and installed, septic tanks for a living and the purpose of the rezoning request is to locate his business on this own land. He stated that he would be willing to make a statement for the benefit of neighbors that this will be the only use for which the laps? will be used. Mr. fates stated that the proposed shoe will be approximate- ly 300 feet from the road and will have a buffer of trees surrounding it. r[r. rates is presently renting a shop which is located about one cruarter of a mile away from the area reouested to be rezoned. Dr. Bonar stated that it had been pointed out to Mx. l;ates that the 50 foot right of way is not sufficient, and that P+x. (sates hoc? stated that this is because he has no intention of developing the hack portion of the land. Chairman Bonar asked if there were those present who wished to sneak in favor of the rezoning request. Nv one came ~Eorth, The Chairman asked if there were those present who wisher? to speak in opposition to the recruest. - Mrs. Merritt, a neighbor of P?r. states, stated that the driveway which -M.r: rates is proposing to use would be about 30 feet from her house and the proposed business will be about 200 feet from her douse. She states? that the noise from the machinery and the dust from the road traffic would be a bother to her and should be taken into consic?eration, She added that she had lived in the neighborhoor since 1951, r. ~ ~, n ei ~ .,, Elizabeth Rogers, another neighbor_.taho has lived in the neic~hborhooc~ for 10 years spoke against the rezoning request. She stated that she brought the land. in Eno ?'ownship because it was zoned. She ad.det~ that she horsed the land woulc? remain a suite, residential district. A.1so, noises from the present location, which is located cliacronally across 26 acres of woodland, could be heard at her home. T?rs. Eva T^larren spoke against the rezoning rec?uest. T?rs. 7"Territt's mother spoke against the rezoning request and stated. that her daughter had a lung problem whiih woulc? be irritated by c~.ust which would be generated. Mr. gates stated that he would be willing to work with those in the neighborhood to handle the noise and the c?ust Arohlems. Mrs. Johnson, a resident of the Lawrence Road area, stated that she felt it was not right to .put a business on this land where peoT7le have lived for years. , Chairman Bonar turned the meeting over to Commissioner tialker. Mr. P?alker declared that the public hearing was concluded. He stated that Chairman T~'hittec~ had requested that the !3oarc~ c~iseuss a date rmutually agreed. upon by both ?3oards _to conc?uct a public hearing in the Southern part of the County to discuss the Extraterritorial jurisdic- tion request of the Town of Chanel Hill. Tuesday, October 4, 1977, was scheftulecl as the public hearin« to hear the extraterritorial jurisdiction request of Chapel ?ill. The County Attorney was requester? to inform the Planning Staff_ of the Dersons required to be notified of the public hearing. The meeting was then ad.journec?. Richard. R.
