BACKGROUND: General Statute 105-282.1(a)(5) Action of Governing Body -Pleasant Green United Methodist Church filed an application for property tax exemption on parcel number 5.23..6 in November 1998. The United Church of Chapel Hill filed two applications for property tax exemption on parcels 7.24..19A and 7.24..19E on July 6, 1998. Where N. C. General Statutes states that applications for exemption must be filed during the normal listing period, which is during the month of January, G.S. 105-282.1(a)(5) does allow some discretion. Upon a showing of good cause by the applicant for failure to make a timely application, an application for exemption or exclusion filed after the close of the listing period may be approved by the Department of Revenue, the board of equalization and review, the board of county commissioners, or the governing body of a municipality, as appropriate. An untimely application for exemption or exclusion approved under this subdivision applies only to property taxes levied by the county or municipality in the calendar year in which the untimely application is filed. RECOMMENDATION: The Administration recommends that all three (3) applications for 1998 exemption be approved. NORTH CAROLINA ORANGE COUNTY EXEMPT STATUS RESOLUTION Whereas, North Cazolina General Statutes 105-282-1 empowers the Boazd of County Commissioners to approve applications for exemption after the close of the listing period, and Whereas, the County Commissioners have determined that the applicants could have been approved for 1998 had applications been timely. NOW, THEREFORE, IT IS RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ORANGE COUNTY THAT the properties applying for exemption for 1998 aze so approved as exempt. We were granted a zoning special-use permit by the Chapel Hill Town Aldermen for our site plans this past autumn, and site preparations were begun. Our building permit will be issued and our building construction activity initiated shortly. The property that the church owns actually includes two parcels: ^ The first parcel is on the west side of Airport Road (7.24.. 19A, 9880-21-0778, Tract 756847). Because this property is part of ow church property, we are requesting exempt status under General Statute 105-278.3 which allows exemption for "real and personal properly used for religious purposes." We failed to file the appropriate application during the month of January because we were unaware of our responsibility to do so. My understanding is that applications for exempt status that were not filed during the normal listing period may be submitted for consideration by the Board of County Commissioners in accordance with General Statute 105-282.1(a)(5). This letter constitutes our request for the enclosed application to be submitted under the guidelines of these required statutes. Thank you for your assistance.
