HomeMy WebLinkAboutOrdinance Animal Control Amendment (Civil Penalty and Fee Increases) 12-03-2007-6a .AMENDMENTS TO THE ORANGE COUNTY ANIMAL CONTROL ORDINANCE (Only those sections or subsections amended are set out below) BE IT ORDAINED BY THE BOARD OF COMIVIISSIONERS OF ORANGE COUNTY, NORTH CAROLINA, hereby amends the Ordinance To Provide For Animal Control Protection In Orange County, North Carolina by adding (indicated by underlined language) and deleting (indicated by stricken through language) as follows: Section V -Licenses, Permits, Registrations, and Fees Required By This Ordinance. D. In order to defray the costs of administering and enforcing ordinances adopted under this Section V and in order to account for the additional costs of locating responding to and caring for unvaccinated and unlicensed animals found within the County additional fees shall be assessed as follows if the Owner or Keeper of an animal fails to pay the following: fees within the time specified in the ordinance: Failure to Vaccinate for Rabies (Section XVI) $200.00 Failure to Wear Rabies Tag~Section XVII) $50.00 Failure to License (Section V~ $200.00 Section X~ -Kennel Standards. 5 A. Standards for Class II Kennels. All Commercial kennels shall, in addition to the other requirements of this ordinance, comply with the minimum standards of this subsection. Owners or operators of Class II kennels must apply to the .Animal Control Director, pay any designated fee, and receive a permit to own or operate a Class II commercial kennel in Orange County. Facilities shall be subject to inspection during reasonable hours by an Animal Control Officer upon his or her request. A fee in the amount of $25 00 shall be assessed against the Owners or Operators of a facility for failing to permit an inspection pursuant to this subsection in order to defrav the costs of reheat travel to the facility_Failure to meet the standards set out herein shall be grounds for the issuance of a citation subjecting the owner to the penalties described herein, and/or the issuance of an abatement order to comply with the provisions of this ordinance. The premises of commercial kennels shall meet the following standards: Section XX -Permits and Standards for Animal Collection. A. ... 1. ... a. ... b. Au investigation may then be conducted by the Animal Control Director which may include inspection of the premises where the animals are to be kept and any vehicles in which animals are to be transported. A fee in the amount of $25.00 shall be assessed against an applicant or permit holder for failing to permit an inspection pursuant to this subsection in order to defrav the costs of repeat travel. Section Xx[ Penalties. The following penalties shall pertain. to violations of this ordinance. A. ... B.... C.... 1. The Animal Control Director may issue to the known owner or keeper of any animal, or to any other violator of the provisions of this ordinance, a ticket or citation giving notice of the alleged violation(s) and of the civil penalty imposed. Tickets or citations so issued maybe delivered in person or mailed by first class mail to the person charged if that person cannot readily be found. This civil penalty is in addition to any other fees, or costs or fines imposed that are authorized by this ordinance. AMENDMENTS TO T'I~ ORANGE COUNTY ANIlVIAL CONTROL POLICY FOR TIC COLLECTION OF UNPAID CIVIL PENALTIES (Only those sections or subsections amended are set out below) BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF ORANGE COUNTY, NORTH CAROLINA, hereby amends the Animal Control Policy For The Collection of Unpaid Civil Penalties by adding (indicated by underlined language) and deleting (indicated by stricken through language) as follows: ANIMAL CONTROL POLICY FOR THE COLLECTION OF UNPAID CIVIL PENALTIES AND FEES Pursuant to Sections X~, V, XIX and XX of the Orange County .Animal Control Ordinance, civil actions maybe commenced in the name of Orange County by the Animal Control Director for the collection of unpaid penalties and fees. ' Violators who have not paid the penalty or fee will be informed that payment is due and that further legal actions may be taken. Requests for payment over a period of time will be taken into consideration by the Animal Control Director if it can be shown that the person issued the penalty or fee has taken measures to comply to the Animal Control Ordinance. In. no event shall the payment extended over a period greater than two 2) months.
