BACKGROUND: The next regular quarterly public hearing is scheduled for February 22, 1999. A summary of each item proposed for public hearing is provided below. The proposed legal advertisement and background information on the public hearing items are attached. The advertisement is scheduled for consideration by the Board of Commisssioners on February 2,1999. ORANGE COUNTY ZONING ATLAS AMENDMENTS 1. PD -3 -98 Lawrence Park Planned Development This hearing is being resumed from the November 23, 1998, public hearing. At that public hearing, the Board voted to keep the public hearing open in order for the applicant to submit more information on storm water management and information about other similar development that the company has built in other areas in North Carolina. The Board also directed staff to obtain more information from Emergency Management Services, Recreation and Parks, and the Board of Education with respect to the impact of the proposed development on those services. 2 The property is located in Eno Township on the east side of Lawrence (SR 1709) approximately 400 feet south of US Highway 70A and 200 feet north of Interstate -85. Lannie Drive (SR 1831) intersects Lawrence Road just south of the property. The applicant is requesting a change in zoning from Rural Residential (R -1) to Planned Development Housing (PD- H -R -3) for an 83.32 -acre parcel. Adjacent land uses are single - family residential zoned R -1, R -2, and R-4, and a church. The property is located in the Twenty -Year Transition Area. The applicant requests a Class A Special Use Permit to allow development of the subject property for 237 single - family residential units at a density of 2.8 units per acre. The parcel is referenced as part of lot 17 on Tax Map 4, Eno Township. Proposed lot sizes will average 7725 square feet with an average house size of 1550 square feet. The site plan includes 26.37 acres (31.6 %) open space featuring 7.17 acres of improved recreation area. The proposed lots will be served by new public roads and water and sewer from the Town of Hillsborough. Access to the site will be from Lawrence Road, US 70A, and Lori Drive. 2. Z -01 -99 Armin Lieth The applicant is requesting to rezone approximately 4.0 acres of an 11.5 acre lot identified by PIN 9749 -50 -8084 (tax map reference 6.30B..10) from R1, Rural Residential, to NC -2, Neighborhood Commercial ll; to rezone approximately 2.5 acres of the same lot to LC -1, Local Commercial I; and, to rezone approximately 1.5 acres of an 11.5 acre lot identified by PIN 9748 -59 -4995 (tax map reference 6.308..9) from R1, Rural Residential to LC -1, Local Commercial I. The property is located on the South side of N.C. Hwy. 54, between Butler Road (SR 1951) and White Cross Road (SR 1952), Bingham Township. The Land Use Element, Orange County Comprehensive Plan designates the area within a one -half mile radius surrounding the intersection of N.C. 54 and White Cross Road as a Rural Community Activity Node. The Plan identifies the LCA Local Commercial and NC -2 Neighborhood Commercial Zoning Districts as appropriate for a Rural Community Activity Node. The Orange County Zoning Ordinance limits the maximum amount of land zoned LCA and the maximum amount of land zoned NC -2 at any node not to exceed nine (9) acres; a maximum of five (5) acres shall apply where population density is lower and distributed more widely than in the Transition areas. Currently, approximately five (5) acres of land within the White Cross Rural Community Node is zoned LCA and approximately five (5) acres of land is zoned NC -2; remaining land is zoned R -1, Rural Residential, or AR, Agricultural Residential. 3 ORANGE COUNTY COMPREHENSIVE PLAN AMENDMENTS 1. CP -1 -99 Apex Northwest Partnership Apex Northwest Partnership requests an amendment to the Land Use Element of the Orange County Comprehensive Plan to expand the Ten - Year Transition plan category to land currently designated Agricultural Residential. The property in question is north of the Town of Hillsborough and lies between NC 86 and NC 57 and north of Rocky Lane (SR 1622). It lies west and north of Mars Hill Baptist Church which is approximately 1.25 miles north of the intersection of NC 86 and NC 57. The property is undeveloped, contains 312.96 acres, and is further referenced as parcel 14, tax map 3, Hillsborough Township. The southern portion of the property is proposed for dedication as a school site. A smaller tract containing 78.11 acres referenced as parcel 1A, tax map 5, block B, Hillsborough Township, and owned by Eva P. Brown et al and Lanie B. Powell is adjacent to the Apex Northwest Partnership tract on the south and is also included in the request. 2. Bicycle Transportation Plan Component Amend SECTION 2.6 OTHER SIGNIFICANT TRANSPORTATION ELEMENTS to include the ORANGE COUNTY BICYCLE TRANSPORTATION PLAN. An amendment to include a Bicycle Transportation Plan Component is necessary because the Durham - Chapel Hill - Carrboro Metropolitan Planning Organization is currently updating the 1993 DCHC Regional Bicycle Plan and will have to include consideration of locally adopted Bicycle Plans in the update; Bicycle Commuting is being advocated by environmental groups and the NC Department of Environment and Natural Resources, Division of Air Quality; the proposed Bicycle Transportation Plan was developed by Orange County Bicyclists; and the BOCC has directed it through their adopted Goals and Objectives. RECOMMENDATION: The Administration recommends approval of the attached advertisement for theFebruary 22,1999, quarterly public hearing. 4 NOTICE OF PUBLIC HEARING ORANGE COUNTY BOARD OF COMMISSIONERS A public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on Monday, February 22, 1999, at 7:30 p.m. for the purpose of giving all interested citizens an opportunity to speak for or against the following items: ORANGE COUNTY ZONING ATLAS AMENDMENTS 1. PD -3 -98 Lawrence Park Planned Development East -West Partners requests a change in zoning from Rural Residential (R -1) to Planned Development Housing (PD- H -R -3) for an 83.32 -acre parcel referenced as part of lot 17 on Tax Map 4, Eno Township. Bicycle Transportation Plan Component The proposal is to amend SECTION 2.6 OTHER SIGNIFICANT TRANSPORTATION ELEMENTS of the Land Use Element, Orange County Comprehensive Plan to include the ORANGE COUNTY BICYCLE TRANSPORTATION PLAN. If adopted, the Bicycle Plan will be included in the Durham - Chapel Hill - Carrboro Metropolitan Planning Organization's update of the DCHC Regional Bicycle Plan. In order to be eligible for Federal transportation funds, bicycle projects must be included in the MPO Regional Plan. Changes may be made in the advertised proposals which reflect debate, objections and discussion at the hearing.
