No ATTACHMENT(S): Area Map INFORMATION CONTACT: Pam Jones, ext. 2650 Telephone Number: Hillsborough 732 -8181 Chapel Hill 967 -9251 Mebane 227 -2031 Durham 688 -7331 PURPOSE: To consider declaring as surplus one lot in Clark Hills Subdivision and authorizing the County Manager or his designee to enter into negotiations with the prospective buyers. BACKGROUND: In February 1985, the County acquired a lot in Clark Hills Subdivision in the Town of Chapel Hill, in conjunction with a tax forfeiture. The property is comprised of about 1.15 acres on the north side of Markham Drive. The lot contains a utility easement and resource conservation district (RCD) restrictions. There would be significant site development costs if someone wished to construct a building on this site because of the aforementioned constraints. A citizen has approached staff requesting that the County entertain an offer for the property. The potential buyer has been made aware of the site limitations and has continued to express serious interest in acquiring the property. County Engineer Paul Thames and Housing and Community Development Director Tara Fikes have visited the site and view it as impractical for affordable housing purposes because of the significant site development expenses that would be involved. The County has no identified present or future need for the property. Staff therefore recommends that the property be declared surplus and the disposal process begun. Under North Carolina law, the County may dispose of surplus property in several ways. One of the appropriate disposal methods for real estate is negotiated offer /advertisement/upset bids. Steps would be as follows: ➢ The Board declares the subject property as surplus. ➢ The Board authorizes a County official to negotiate with the prospective buyers. A 2 ➢ A negotiated offer is established between the County and the prospective buyers and presented to the Board of Commissioners for acceptance. ➢ If the Board proposes to accept the offer, it shall require the prospective buyer to deposit with the County a bid bond equal to five percent (5 %) of the offered /negotiated price. ➢ The offer is published in a "newspaper of general circulation" and upset bids are invited. ➢ If an upset bid is submitted within 10 days and exceeds the original negotiated price by at least 10% then the advertisement process begins again until the upset bid solicitation ceases to draw upset bids. ➢ The Board would be advised of the accepted terms and conditions of sale, the Board would approve the sale and closing documents would be drawn up to reflect the sale. The County would be divested of the property.
