It will be accessed from the south side of Ode Turner Road (SR 1130) via Sparrow Hawk Crest Road, a Class B private road.' All four lots will be served by Wood Thrush Lane (Class B) which extends from Sparrow Hawk Crest Road. One lot (1A) is also accessed by an extension (Class C) of Sparrow Hawk Crest Road. Ode Turner Road intersects 5,700 feet to the north with Orange Grove Road and 2,250 feet to the south with Davis Road. The proposed subdivision includes 20.04 acres. Four lots are proposed to be created from two existing 10 -acre parcels of record. One 10.01 a parcel (Tax Map No. 7.1..21) will be divided into a 7.01a lot and a 3a lot, and the other 10.03a parcel (Tax Map No. 7.1..21G) will be divided into a 7.01 a lot and a 3.02a lot. ' Note that Sparrow Hawk Crest Road is designated as Class A on the Preliminary Plat but is now eligible to be listed as a Class B Road because it serves no more than nine lots. Originally the road would have accessed more than 10 lots as proposed in Concept Plan requiring a Class A designation. Subsequently, the applicants have pared down the subdivision to four lots in the Preliminary Plan thus lowering the number of lots which would be served by Sparrow Hawk Crest. The name of the extension will be Sparrow Hawk Crest rather than Red Tail Hawk Lane. v 2 The southern two- thirds of the subdivision is located in the U- ENO -PW (Upper Eno Protected Watershed). The upper one -third is undesignated. Impervious surface limitations in the U- ENO -PW are 12 percent for existing and new lots outside Transition Areas as designated in the Land Use Element of the Comprehensive Plan. BMP's (Best Management Practices) cannot be used here to satisfy watershed requirements. A 150' Duke Power transmission easement crosses the extreme northerly end of Lot 3. A Type D 50' land use buffer runs along the southern edge of the power easement. Except for the power easement, the entire tract is wooded with mature hardwoods and locally common understory species. The Division of Environmental Health and the soils survey show that the soils are suitable to support septic systems. The subject property ranges in height from 700' to 780' above MSL sloping to the southwest and north and typically running in the Th to 15 percent slope range. Lots will be served by individual wells and septic systems. Private roads are justified because the proposal maintains rural character by providing larger lots and building setbacks than required in the R -1 zoning district, by prohibiting further subdivision, by limiting tree removal, and by minimizing disturbance and grading. The area is designated as Rural Residential in the adopted Land Use Element of the Comprehensive Plan. This property and surrounding parcels are zoned R -1 Rural Residential. Land uses are single - family residential. The Orange County Fire Marshal and EMS indicate that the subdivision can be served adequately by their respective agencies. � The final plat of the `first phase' of High Point Woods was approved as a minor subdivision by Planning Staff on November 26, 1996. The next activity required major subdivision approval by the Planning Board and County Commissioners because it was submitted prior to the expiration of two years after the approval of the minor subdivision of the property. Titled LQJ 4A High Point Woods Subdivision, this `second phase' consisted of the subdivision of Lot 4A into two lots fronting on the south side of Davis Road. Final plat approval-by the Board of County Commissioners was on August 4, 1997. -'r The Planning Board unanimously approved a major subdivision Concept Plan on August 5, 1998, and a Preliminary Plan on January 6, 1999, for High Point Woods, Phase III. 3 Planning Board Recommendation The Planning Board unanimously recommends adoption of the Preliminary Plan for High Point Woods Subdivision, Phase III, to the Board of County Commissioners with the conditions listed in the proposed in the attached Resolution of the Orange County Board of Commissioners. Also please see attached Planning Board minutes for January 6, 1999. Sparrow Hawk Crest Road, its south extension, and its east extension (Wood Thrush Lane) shall be maintained by the owner /applicant (Monarch Consulting Trust) and homeowners of High Point Woods, Phase III, until such time as they are accepted for maintenance by NCDOT or some other governmental body. Before the Final Plat of High Point Woods, Phase III, can be recorded: A. Sewage Disposal 1. All lots shall contain adequate septic disposal and repair areas, approved by the Orange County Division of Environmental Health. 2. Disclosure that the septic system location may restrict the size and location of improvements shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document disclosing that information on the tentative location of septic systems is available from the Division of Environmental Health. B. Roads and Access 1. Sparrow Hawk Crest shall be constructed to Class B private road standards within a 50 -foot right -of -way. Wood Thrush Lane shall be constructed to Class B private road standards within a 50 -foot right -of -way, and Wood Thrush Crest Extension shall be constructed to Class C private road standards within a 50 -foot right -of- way. Construction shall be inspected and approved by the Orange County Erosion Control Division. •O A letter of credit or escrow agreement or other security shall be submitted to secure construction of Sparrow Hawk Crest Road and its east and south extensions to Orange County standards. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Orange County Planning Department. The financial guarantee must reflect 110 percent of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by Orange County. 2. An erosion control plan for construction of Sparrow Hawk Crest Road and its two road extensions shall be submitted by the applicant to the Erosion Control Division for review and approval. 3. An approved street name sign shall be erected at the intersection of Sparrow Hawk Crest Road and Ode Turner Road (SR 113 0) and at the intersection of Sparrow Hawk Crest Road with Wood Thrush Lane, as required in Section IV- 13- 3-c -12 Street Name Sins of the Orange County Subdivision Regulations. The applicant shall submit either evidence that the signs are in place or a receipt for purchase of the signs. 4. Access to all four lots shall be from Wood Thrush Lane and Sparrow Hawk Crest Road. C. Land Use Buffers and Landscaping 1. Landscaping shall be installed or preserved as indicated on the approved landscape plan for the subdivision and must be inspected and approved by the Planning Department. 2. Provisions for protection of existing trees as shown on the approved landscape. plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D. Drainage 1. Impervious surface data for all four lots, pursuant to Article 6.23 Extra Reuirements for Watershed Protection Overlay Districts of the Zoning Ordinance, shall be included in the development restrictions and requirements document to be prepared by Planning Staff and recorded concurrently with the Final Plat. Minimum building setbacks shall be stated on the plat and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. G. Certifications 1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be notarized on the face of the Final Plat. 2. A Dedication and Maintenance Certificate, as provided in Section V -D -6 -b Certificates of Dedication and Maintenance of the Subdivision Regulations, signed by the landowner and developer, shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. Concept Plans W* (1) High Point Woods, Phase 3 (8 Lots - Chapel Hill Township) Presentation by Emily Cameron. The property is located in the northwest corner of Chapel Hill Township on the south side of Ode Turner Road (SR 1130) north of Davis Road (SR 1129) on a private road called Sparrow Hawk Crest. The total acreage to be subdivided is 50.08 acres, which is currently in five (5) lots that are slightly over ten (10) acres each created in December 1996. The current zoning is Rural Residential (R-1) with approximately one -third of the acreage in the Upper Eno Protected Watershed. Adjacent land uses are residential, a power transmission line, and towers for Duke Power and AT&T. The entire tract is wooded (except for the power line right -of -way and existing gravel road) with predominantly mature hardwoods and typical understory species. A 50 -foot Type D Land Use Buffer is required adjacent to the power transmission line located on the northern boundary of the subdivision. Most of the slopes are in the 71/2 to 15 percent range. Slopes over 15 percent (secondary conservation area) and over 25 percent (primary conservation area) are likely to remain undisturbed because the proposed lot sizes are larger and the steeper slopes occur near drainage ways and lot boundaries. The applicant has submitted a report from a soil scientist which evaluates the suitability of the soil to support on -site subsurface sewage disposal. Most of the soils are provisionally suitable, with the exception of the drainage area shown on the site analysis. The Orange County Health Department is currently reviewing the proposed lots for septic system suitability. Two Concept Plans have been submitted by Monarch Consulting Trust for review. One Concept Plan is a conventional design featuring four 7 -acre lots, four 3 -acre lots, and a 10 -acre recombination. The existing right -of- 12 way for Wood Thrush Lane is proposed to be extended north to serve four (4) lots. The alternative Concept Plan follows the conservation option for fleadble development and includes the same number and a similar arrangement of lots using the existing private easements for access and featuring 23.37 acres (46°x6) open space permanently protected with deed restrictions. The open space protects mature woodland on moderate to steep slopes, drainage ways, and additional buffer next to the power line right -of -way. In both Concept Plans, the lots will have individual wells and septic systems. The applicant's private road justification and the Staffs evaluation of the private road request are attachments to these minutes on pages / lo- 2 The private roads are justified because the proposal maintains rural character by proposing larger lot sizes and building setbacks, prohibiting further subdivision, limiting tree removal, and minimizing disturbance and grading- The Planning Staff recommends approval of the Concept Plans for High Point Woods, Phase III, with private roads and conditions as follows: Conventional Plan 1. Sparrow Hawk Crest shall meet Class A private road standards from the entrance to the intersection of Wood Thrush Lane. The portion of Sparrow Hawk Crest south of Wood Thrush Lane shall meet Class C standards; 2. Wood Thrush Lane shall meet Class B standards, including minimum centerline curve radius; and 3. On the Preliminary Plan, indicate the watershed boundary based on the location of the ridgeline as determined on site. Conservation Option 1. Sparrow Hawk Crest shall meet Class A private road standards from the subdivision entrance to the intersection of Wood Thrush Lane. The portion of Sparrow Hawk Crest south of Wood Thrush Lane shall meet Class C standards; 2. Wood Thrush Lane shall meet Class B standards; 3. On the Preliminary Plan, indicate the watershed boundary based on the location of the ridgeline as determined on site; and 4. With the Preliminary Plan, submit draft forms of the homeowners association documents, road maintenance agreements, and restrictive covenants and/or a conservation easement which contain use and maintenance provisions for the open space. The restrictive covenants or the conservation easement shall designate a third party as an alternate grantee, in the event the homeowners association is eliminated. Cameron noted that letters were sent out regarding the Neighborhood Information Meeting. The developers and staff were the only ones present. Brooks asked for clarification of the boundaries on the two plans. Cameron responded indicating boundaries on the two plans. She continued that the main difference between the two plans is that they are adding a private road on 13 the conventional plan. They realized that a more efficient plan would be to put. in a cul-de -sac and have all of the lots come off of it Cameron indicated she felt it was a more efficient use of the lots creating unified access and not having four driveways coming off of Wood Thrush Lane. It may minimize disturbance allow for shorter driveways. Barrows asked about the difference in acreage. The conservation plan indicates 50.8 acres and the conventional plan indicates 401 acres. Cameron responded that the difference is the recombined ten -acre lot M. The Preliminary plan will probably indicate the 40.8 acre plan. She continued that the applicant had contacted her and stated he probably would not be interested in constructing a Class A road. He stated he would most likely leave out two of the lots. Brooks asked about the current covenants. Cameron noted that Woodthrush Lane is existing and running east -west. Under that scenario, lots 2 and 3 will remain 10 -acre lots. She continued that the existing covenants require 100. foot setbacks from road rights -of -way so there is currently open space protection through the existing covenants which would remain in place. Selkirk asked if the current covenants arise from Phase I and IL Cameron responded that there was one division on the south side of Davis Road last year that split three acres into 2 lots. There is some remaining acreage that is not proposed to be divided Selkirk continued asking if phase III is in keeping with Phases I and 11. Cameron responded the density is changing slightly from 10- acre lots to 7 and 3 -acre lots. With the 100 -foot setbacks and tree protection, it would be difficult to determine that there were some smaller lots. Barrows asked for clarification of item #2 on the application which indicates no natural area and habitats. Cameron responded that this refers specifically to those designated in the inventory provided by the Triangle Land Conservancy. She continued that, in this case, it is all wooded Searles asked if the Planning Board would review the Concept Plan again if the change indicated by the developer to Cameron on the phone today was made. Cameron responded that the change, if made, would be a reduction by two lots. It would go to the Preliminary Plan stage without being reviewed by the Planning Board again. She continued that Staff would alter their recommendations about the class of private roads to address the reduction in the number of lots. Selkirk indicated he felt either plan was a good one, but, asked if it is known which plan the developer prefers. Cameron responded that, since there are restrictions already in place to protect some of the open space, she felt they would choose the conventional option. MOTION: Brooks moved approval with the conditions as recommended by the Planning Staff for both the conventional and conservation plan. Seconded by Strayhorn. VOTE: Unanimous. 14 Barrows suggested that the Planning Board come to a decision and have the applicants work with the Planning Staff to accomplish the suggestion made by Woods. Preliminary Plans (1) High Point Woods Phase III Presentation by Jim Hinkley. The current Phase III Preliminary Plan presented herein is a modification of the Concept Plan approved by the Planning Board on August 5, 1998. The developer has opted to remove from the Phase III plat the 10 -acre lot lying immediately to the west of proposed lot 3 and not to create three lots from the two existing lots along the southeastern side of Sparrow Hawk Crest. The proposed four -lot High Point Woods, Phase III major subdivision is located in the northwest comer of Chapel Hill Township. It will be accessed from the south side of Ode Turner Road (SR 1130) via Sparrow Hawk Crest Road, a Class A private road. All four lots will be served by Wood Thrush Lane (Class B) which extends from Sparrow Hawk Crest Road. One lot (IA) is also accessed by Red Tail Hawk Road (Class C) which also extends from Sparrow Hawk Crest Road. Ode Turner Road intersects 5,700 feet to the north with Orange Grove Road and 2, 250 feet to the south with Davis Road. The proposed subdivision includes 20.04 acres. Four lots are proposed to be created from two existing 10 -acre parcels of record. One 10.01 acre parcel (Tax Map No. 7.1..21) will be divided into a 7.01 acre and a 3 acre lot, and the other 10.03 acre parcel (Tax Map No. 7.1..21G) will be divided into a 7.01 acre lot and a 3.02 acre lot. The southern two- thirds of the subdivision is located in the U- ENO-PW Upper Eno Protected Watershed. The upper one -third is undesignated. Impervious surface limitations in the U- ENO -PW are 12 percent for existing and new lots outside Transition Areas as designated in the Land Use Element of the Comprehensive Plan. BMP's (Best Management Practices) cannot be used to satisfy watershed requirements. A 150' Duke Power transmission line easement crosses the extreme northerly end of Lot 3. A type D 50' land use buffer runs along the southern edge of the power easement. A Type D Buffer is composed of 50- 75% evergreen vegetation distributed so as to create a semi - opaque screen to a height of at least 30'. (Section 12.6.1 Standards for Required Buffers, Orange County Zoning Ordinance. 15 Except for the power easement, the entire tract is wooded with mature hardwoods and locally common understory species. The Division of Environmental Health and the soils survey show that the soils are suitable to support septic systems. The subject property ranges in height from 700' to 780' above MSL sloping to the southwest and north and typically runs in the 71/2 to 15 percent slope range. Lots will be served by individual wells and septic systems. Private roads are justified because the proposal maintains rural character by providing larger lots and building setbacks than required in the R -1 zoning district, prohibiting further subdivision, limiting tree removal and mmunizing disturbance and grading. The area is designated as Rural Residential in the adopted Land Use Element of the Comprehensive Plan. This property and surrounding parcels are zoned R -1 Rural Residential. Land uses are single- family residential. The Orange County Fire Marshal and EMS indicate that the subdivision can be served adequately by their respective agencies. The final plat of the `fast phase' of High Point Woods was approved as a minor subdivision by Planning Staff on November 26, 1996. The next activity required major subdivision approval because it was submitted prior to the expiration of two years after the approval of the original minor subdivision of the property. Titled Lot 4A High Point Woods Subdivision, this `second phase' consisted of the subdivision of Lot 4A into 2 lots fronting on the south side of Davis Road. Final plat approval by the Board of County Commissioners was on August 4, 1997. The Concept Plan for High Point Woods, Phase III was approved unanimously by the Planning Board on August 5, 1998 per the Resolution of Approval (copy an attachment to these minutes on pages ). Planning Staff recommends approval of the a Preliminary Plan for High Point Woods, Phase III, with conditions listed in the Resolution of approval.
