PURPOSE: Consideration of the Preliminary Plan for Section Five of Village of the Oaks Major
Subdivision
BACKGROUND: The applicant proposes arsine-lot major subdivision in the northwest quadrant of the
intersection of Mebane Oaks Drive (SR 1007) and Thom Road (SR 2145)Bradshaw
Quarry Road (SR 1100).
The proposed subdivision encompasses a total of 19.43 acres in Bingham Township (Tax
Map No. 6.16..13A). The Preliminary Plan shows the proposed subdivision as straddling
the Orange/Alamance County Line. The applicant`s surveyor shows Lots 1-5 on the west
side of Acorn Knoll Drive as being split by the County Line. The Orange County Land
Records Office shows all of the proposed Subdivision as being in Orange County.
The plan consists of nine 1.3-acre lots and "Tract A," a 0.67±-acre parcel and "Tract B,"
a 5.89±-acre pazcel. A and B are conservation tracts reserved as common areas.
The location of the proposed subdivision is designated asAgricultural-Residential in the
adopted Land Use Element of the Comprehensive Plan. Accordingly, it is zoned
ARCANE-PW}-Agricultural-Residential (Cane Creek Protected Watershed). The
maximum permitted impervious surface (ISR) is six percent.

Surrounding lands aze in pasture and single-family residential use. Adjoining pazcels are
zoned AR Agricultural-Residential.
Entrance to the proposed subdivision is shown as being on the north side of Thom Road
(SR 2145)Bradshaw Quarry Road (SR 1100) via Acorn Knoll Drive-a 900'f cul-de-sac
with a proposed 50' public right-of--way and an 18' public travelway. The Acorn Knoll
Drive entrance is 350' west of Mebane Oaks Road. All nine lots shall be accessed from
Acorn Knoll Drive. No stub-out is recommended for the proposed subdivision. Lands to
the north aze proposed to be reserved permanently as a common conservation azea.
The Concept Plan was offered by Planning Staff for consideration to the Planning Boazd
on May 7, 1998. A quorum was not present. (See attached 5-7-98 Planning Boazd
Minutes). Section III-D-2-c Plannine Boazd Review and Approval Procedures states:
The Planning Board shall take action within forty-five (4S)
days of the meeting at which the Planning Department's report
is submitted to it or within such further time consented to in
writing by the applicant. If the Planning Board fails to take
action within the specified time period, or extension thereof,
the Planning Board shall be deemed to recommend approval of
the Concept Plan without conditions.
Following the flexible development option as presented in Section IV-B-10 of the
Subdivision Regulations, 6.56a or 40% of the subdivision is proposed as openspace
which will be reserved in the form of conservation easements or restrictive covenants.
These tracts will be owned by the Homeowners Association. The purpose is to establish
and preserve visual vegetative buffers, in addition to those buffers (30') required along
Mebane Oaks and Bradshaw Quarry Roads as designated collectors in the Transportation
Element of the Comprehensive Plan. To the immediate north of Lots 5 & 6, a 5.89a
conservation azea is reserved as common space. This azea would be available for
recreational use by residents.
Planning Board Recommendation
The Planning Board unanimously recommends adoption of the Preliminary Plan for
Village of the Oaks, Section Five, to the Boazd of County Commissioners with the
conditions listed in the proposed attached Resolution of the Orange County Board of
Commissioners. Please see attached Planning Boazd minutes for February 3, 1999.
RECONIlVIENDATION:
The Administration recommends approval of the Preliminary Plan for Village of the
Oaks, Section Five, with the conditions listed in the Resolution of Approval.

THE ORANGE COUNTY BOARD OF CONIlVIISSIONERS

The Board of County Commissioners hereby approves the Preliminary Plan of Section Five of Village of
the Oaks, Section, dated August 4, 1998, and subject to fulfillment of requirements specified herein.
Acorn Knoll Road shall be public and built to NCDOT standards and shall be maintained by the
owner/applicant (Rachel T. Best) and future homeowners of the subdivision, until such time as it is
accepted for maintenance by NCDOT or some other governmental body.
Before the Final Plat can be recorded:
A. Sewage Disposal
1. All lots shall contain adequate septic disposal and repair areas, approved by the Orange
County Division of Environmental Health.
2. Disclosure that the septic system location may restrict the size and location of
improvements shall be included in a document describing development restrictions to be
recorded concurrently with the Final Plat. The document disclosing that information on
the tentative location of septic systems is available from the Division of Environmental
Health.
B. Roads and Access
1. Acorn Knoll Drive shall be constructed to NCDOT public road standards within a 50-
foot right-of--way. Construction shall be inspected and approved by the Orange County
Erosion Control Division.
OR
A letter of credit or escrow agreement or other security shall be submitted to secure
construction of Acorn Knoll Drive to NCDOT standazds. An estimate of the
construction cost must be prepazed by a certified/licensed engineer or grading contractor
and submitted to the Orange County Planning Department. The fmancial guazantee must
reflect 110 percent of that estimate and be issued by an accredited fmancial institution
licensed to do business in North Cazolina.
The document describing development restrictions to be recorded with the Final Plat
shall state that the financial guarantee will not be released until the road construction has
been inspected and approved by Orange County.
2. An erosion control plan for construction of Acorn Knoll Drive shall be submitted by the
applicant to the Erosion Control Division for review and approval.

3. An approved street name sign shall be erected at the intersection of Acorn Knoll Drive
and-Thom Road (SR 2145), as required in Section IV-B-3-c-12 Street Name Si,~s of the
Orange County Subdivision Regulations. The applicant shall submit either evidence that
the signs are in place or a receipt for purchase of the signs.
4. Access to all nine lots shall be from Acorn Knoll Drive.
C. Land Use Buffers and Landscaping
1. Landscaping shall be installed or preserved as indicated on the approved landscape plan
for the subdivision and must be inspected and approved by the Planning Department.
2. Provisions for protection of existing trees as shown on the approved landscape. plan
shall be included in a document describing development restrictions and requirements to
be prepared by Planning Staff and recorded concurrently with the Final Piat.
D. Drainage
Impervious surface data for all nine lots, pursuant to Article 6.23 tra Re uirements for
Watershed Protection Overlay Districts of the Zoning Ordinance, shall be included in the
development restrictions and requirements document to be prepared by Planning Staff
and recorded concurrently with the Final Plat. All nine lots are located in the CANE-PW
Cane Creek Protected Watershed where impervious surface limitations are six percent.
BMP's (Best Management Practices) cannot be used to satisfy watershed requirements
in this subdivision.
2. Drainage easements, as required, shall be located following review and approval of the
Erosion Control Plan.
3. Drainage culverts shall be sized and located as required by the Erosion Control Officer.
E. Parkland
1. Nine lots are to be created in the proposed subdivision. As per the decision of the
Department of Recreation and Parks, cash in the amount of $4,095$455 per lot shall be
paid to Orange County as payment-in-lieu of parkland dedication.
F. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance with Section
V-D-2 Title Block and V-D-3 Vicinjly Man of the Subdivision Regulations.
2. Minimum building setbacks, common areas, and conservation areas and easements shall
be stated on the plat and in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with the Final
Plat.
G. Certifications
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be
notarized on the face of the Final Plat.

2. A Dedication and Maintenance Certificate, as provided in Section V-D-6-b Certificates
of Dedication a_nd Maintenance of the Subdivision Regulations, signed by the landowner
and developer, shall be on the face of the plat and included in a document describing
development restrictions to be recorded concurrently with the Final Plat.
3. A Certificate of Approval shall be signed by the Planning Department.

The azea is designated as Agricultural Residential in the adopted Land Use
Element of the Comprehensive Plan, and accordingly is zoned AR(U-ENO-
PW}-Agricultural Residential (Upper Eno Protected Watershed). An
exception to this zoning is found in the southernmost 2.5 acres of Lot 1 on
the south side of the proposed subdivision where the designation is AR(U-
ENO-CA) Agricultural Residential (Upper Eno Critical Area). Surrounding
land uses aze wooded and single family residential. Adjoining pazcels are
zoned AR
The proposed subdivision encompasses 19 acres. It consists of seven two-
acre lots and afive-acre lot located partially in the Upper Eno Critical Area.
Lot sizes average 2.37a.
The subdivision would be accessed from the north side of Carr Store Road
via existing Pore Road (private}-a Class A cul de sac to be constructed as
an extension of an existing access easement which the developers propose
to change the name from Pore Road to Chambers Court. The Class A
designation is justified because there aze lazge lots and wider setbacks, and
the proposed development is located in a protected watershed. Moreover,
covenants will protect permanent open space and prohibit further
subdivision. No stubout is recommended for the proposed subdivision
because lands to the north are reserved permanently for flood.control
purposes, and lands to the west lie within the 100-yeaz floodplain along the
East Fork Eno River.
Following the flexible development option as offered in Section IV-B-10 of
the Subdivision Regulations, the Concept Plan was approved by the
Planning Boazd on December 3, 1997. The proposal includes 9.35 acres or
49% open space which will be privately owned and reserved in the form of
conservation easements surrounding identified building azeas. The purpose
of the easements is to protect woodlands on gentle slopes, streams, and
adjacent stream buffers. In addition to these natural buffers along each lot
line, easements follow the subdivision boundaries.
Planning Staff recommends approval of the Preliminary Plan for the Carl
and Teresa Chambers Major Subdivision, with conditions listed in the
Resolution of Approval (copy an attachment on pages )and the
recommendation that conservation easements not be included in the 50'
front setbacks designated for the development. This suggestion would
remove 1.6a of open space making the tota17.75a or 41%.
MOTION: Selkirk moved approval as recommended by the Planning Staffwith the
conditions listed in the Resolution of Approval and the recommendation
regazding conservation easements. Seconded by Andrews.
VOTE: Unanimous.

The applicant proposes anine-lot major subdivision which is shown as
straddling the Orange-Alamance County Line in the northwest quadrant of

the intersection of Mebane Oaks Road (SR 1007) and Thom Road (SR
2145)Bradshaw Quarry Road (SR 1115).
The Preliminary Plan is shown as being partially situated in Alamance
County. The applicant's surveyor shows Lots 1-5 on the west side of Acorn
Knoll Drive as being split by the county line. This is based on the claim
that the line is that shown on the USGS 7.5 minute Saxapahaw Quadrangle.
The Plan shows the location of the County line to be some 1,500' to the east
of that shown on Orange County Tax Maps and verified by the Land
Records Office. The Orange County Board of Commissioners stands by
that claim.
The proposed subdivision is a total of 19.43 acres of which 14.81 a is
claimed to be in Bingham Township of Orange County (Tax Map No.
6.16..13A) and 3.19a is in Thompson Township of Alamance County (Tax
Parcel No. 9-35-9). Orange County Land Records show all of the proposed
subdivision as being in Orange County.
The plan consists of nine 1.3-acre lots and "Tract A," a 0.67+-acre parcel
and "Tract B," a 5.89+-acre pazcel. A and B aze conservation tracts

Planning Staff recommends approval of the Preliminary Plan for Section
Five of Village of the Oaks Major Subdivision, with conditions listed in the
Resolution of Approval (copy of the Resolution an attachment to these
minutes on pages ).
Rachel Best, developer, noted that the question of disputed location of the
County line between Orange and Alamance, is.an ongoing question.
However, from previous approvals, Ms. Best was proceeding assuming all
of this portion is in Orange County.
Allison asked if this plan must be submitted to Alamance County for
approval. Hinkley responded that the developer has developed the tract
according to Orange County regulations which aze considerably more
stringent than those of Alamance County. Ms. Best responded that the
project was approved in Alamance County as well.
In regard to a question from Selkirk regarding the tax bill for Lot #5, Ms.
Best responded that it has been agreed that this section is Orange County.
She also noted that she owns an additional 90 acres in Alamance County
adjacent to this tract.
Ms. Best noted that this had been her family's farm and she is very
particular about the way the project is developed.
Lincoln pointed out that in cases such as this, the plats aze recorded in both
counties.
MOTION: Strayhorn moved approval as recommended by the Planning Staff.
Seconded by Katz.
VOTE: Unanimous.
(3) Creekwood
(64 Lots -Chapel Hill Township)
Presentation by Eddie Kirk.
The property is located in the Rural Buffer portion of Chapel Hill Township
on the north side of Whitfield Road (SR 1730/1731) and on the south side
of Mt. Sinai Road (SR 1718). The total acreage of the tract is
approximately 462. It is bounded on the west by the H.J. Oosting Natural
Area owned by Duke University and on the east by Turkey Farm Road (SR
1730) and Stoneridge subdivision lots and recreation area. New Hope
Creek crosses the property at the northeast corner. Other surrounding land
uses are residential. A 136-foot tower transmission line right-of--way
crosses the northern portion of the property aligned northeast to southwest.
The tract is characterized by rolling topography that surrounds and drains
toward several stream valleys. The Johnston Branch flows out of a pond on
the south side of Whitfield Road under the road and north along the western
boundary of the subdivision until it joins Old Field Creek as it emerges
from the Oosting Natural Area near the central portion of the site. Old

The Board of County Commissioners hereby approves the Preliminary Plan of Section Five of Village of
the Oaks, Section, dated August 4, 1998, and subject to fulfillment of requirements specified herein.
Acorn Knoll Road shall be public and built to NCDOT standards and shall be maintained by the
owner/applicant (Rachel T. Best) and future homeowners of the subdivision, until such time as it is
accepted for maintenance by NCDOT or some other governmental body.
Before the Final Plat can be recorded:
A. Sewage Disposal
1. All lots shall contain adequate septic disposal and repair areas, approved by the Orange
County Division of Environmental Health.
2. Disclosure that the septic system location may restrict the size and location of
improvements shall be included in a document describing development restrictions to be
recorded concurrently with the Final Plat. The document disclosing that information on
the tentative location of septic systems is available from the Division of Environmental
Health.
B. Roads and Access
1. Acorn Knoll Drive shall be constructed to NCDOT public road standards within a 50-
foot right-of--way. Construction shall be inspected and approved by the Orange County
Erosion Control Division.
OR
A letter of credit or escrow agreement or other security shall be submitted to secure
construction of Acorn Knoll Drive to NCDOT standards. An estimate of the
construction cost must be prepared by a certified/licensed engineer or grading contractor
and submitted to the Orange County Planning Department. The financial guarantee must
reflect 110 percent of that estimate and be issued by an accredited financial institution
licensed to do business in North Carolina.
The document describing development restrictions to be recorded with the Final Plat
• shall state that the financial guarantee will not be released until the road construction has
been inspected and approved by Orange County.
2. An erosion control plan for construction of Acorn Knoll Drive shall be submitted by the
applicant to the Erosion Control Division for review and approval.

• 3. An approved street name sign shall be erected at the intersection of Acorn Krioll Drive
and Thom Road (SR 2145), as required in Section IV-B-3-c-12 Street Name Sig~c of the
Orange County Subdivision Regulations. The applicant shall submit either evidence that
the signs are in place or a receipt for purchase of the signs.
4. Access to all nine lots shall be from Acorn Knoll Drive.
C. Land Use Buffers and Landscaping
1. Landscaping shall be installed or preserved as indicated on the approved landscape plan
for the subdivision and must be inspected and approved by the Planning Department.
2. Provisions for protection of existing trees as shown on the approved landscape. plan
shall be included in a document describing development restrictions and requirements to
be prepared by Planning Staff and recorded concurrently with the Final Plat.
D. Drainage
1. Impervious surface data for all nine lots, pursuant to Article 6.23 Extra Requirements for
Watershed Protect~~n (~vPrla istrictc of the Zoning Ordinance, shall be included in the
development restrictions and~requirements document to be prepared by Planning Staff
and recorded concurrently with the Final Plat. All nine lots are located in the CANE-PW
• Cane Creek Protected Watershed where impervious surface limitations are six percent.
BMP's (Best Management Practices) cannot be used to satisfy watershed requirements
in this subdivision.
2. Drainage easements, as required, shall be located following review and approval of the
Erosion Control Plan.
3. Drainage culverts shall be sized and located as required by the Erosion Control Officer.
E. Parkland
1. Nine lots are to be created in the proposed subdivision. As per the decision of the
Depaztment of Recreation and Pazks, cash in the amount of $4,095@$455 per lot shall be
paid to Orange County as payment-in-lieu of parkland dedication.
F. Miscellaneous
1, The Final Plat shall contain a title block and vicinity map in accordance with Section
V-D-2 Title Block and V-D-3 Vicini Man of the Subdivision Regulations.`
2. Minimum building setbacks, common areas, and conservation areas and easements shall
be stated on the plat and in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with the Final
Plat.

G. Certif cations
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be
notarized on the face of the Final Plat.
2. A Dedication and Maintenance Certificate, as provided in Section V-D-6-b certificates
of Dedication and Maintenance of the Subdivision Regulations, signed liy the landowner
and developer, shall be on the face of the plat and included in a document describing
development restrictions to be recorded concurrently with the Final Plat. ~
3. A Certificate of Approval shall be signed by the Planning Department.
