BACKGROUND: At the February 11, 1999 meeting of the Landfill Owners' Group, the LOG received an oral petition from the Eno River Association that landfill fees be waived for cleanup activities that the Association will engage in between mid-February and July, 1999. The cleanup will take place on a recently acquired tract of land that is to become part of the Eno River Park. The LOG approved the request at the February 11 meeting. The interlocal agreement between the County and the Towns of Chapel Hill and Carrboro specifies that all three governing boards must agree to any changes in the landfill fee schedule. Therefore, all three owners must approve this waiver request before it can be put into effect. FISCAL IMPACT: The exact cost of this action cannot be determined at this time, because the amount of material collected through cleanup of this tract of land is unknown. The current tipping fee is $38 per ton. If the fees are waived, the cost of disposal would be absorbed in the Landfill enterprise fund administered by the Town of Chapel Hill. RECOMMENDATION(S): The Manager recommends that the Board confirm the action of the LOG and approve the requested waiver of landfill tipping fees. 2 MEMORANDUM T0: Landfill Owners Group FROM: W. Calvin Horton, Chapel Hill Town Manager SUBJECT: Setting Fees for the Orange Regional Landfill DATE: February 22, 1999 6C~MC~ FEB 2 6 1999 D I understand that the Landfill Owners Group received an oral petition at its February 11 meeting from the Eno River Association. The Association requested that the tipping fees be waived for the solid waste that it would deliver to the landfill during its volunteer clean-up of a tract recently acquired to become part of the Eno River Park. The Association intended for the clean-up to begin on February 15. The Landfill Owners Group acted favorably on the petition that same evening. I can understand that the timing of this request put pressure on the Landfill Owners Group for an immediate decision. However, it is my duty to remind you that the 1972 Agreement among the Town of Chapel Hill, the Town of Carrboro and Orange County states that "A fee schedule approved by all the Parties shall be adopted." The annual review of tipping fees normally includes the recommendations of the Landfill Owners Group and the subsequent action of each of the governing bodies. Changes aze made to the current tipping fee schedule only upon the approval of all three of the owners. Previous requests for fee waivers have been dealt with in the same way Thank you for your consideration of this procedural issue.
