The amount of the application is $181,941.00. BACKGROUND: Since FY 1995-96, Orange County has received grant funds from the NC Depaztment of Correction to operate CJPP programs for both. Orange and Chatham Counties. These programs include: (a) a pre-trial release program for the jails; and (b) a sanctions center to enhance the offenders' success with probation. Both programs aze tazgeted for individuals sentenced to intermediate sanctions and designed to reduce recidivism. FINANCIAL IMPACT: The programs operate solely on state funds and are administered through contractual arrangements. Without this funding from the state, the programs will have to be discontinued unless replacement dollazs can be secured. Grant acceptance will require an appropriate budget amendment. The Coordinator's duties consist of assessing individuals to determine the appropriate counseling, classes, therapies, and treatment and to provide case management and supervision for Intermediate /Active Structured Sentencing Offenders to assist Adult Probation and Pazole Services with these high need offenders. The primary purpose is to offer a comprehensive approach to the rehabilitation of repeat offenders at locations convenient to probation services in the 15-B District to enhance the services of Adult Probation. The offenders will participate in counseling, therapy, and treatment that will be geared to success with the special conditions of Probation. For substance abusers the time at the FSSC will train them to overcome their drug dependent life styles and /or learn skills to remain in the community as a productive citizen. The Coordinator/Clinician's responsibilities also include supervision of all interns assisting the center in developing and sustaining. the new program. The Coordinator's main objectives aze to: work closely with Adult Probation Services personnel; outline program guidelines and procedures; provide clinical treatment; therapy resources; setup referral protocol; develop a monitoring and tracking system; prepaze brochures and other written materials to assist in the day-to-day operation of the program; maintain communication with the Probation Officers, Criminal Justice Partnership Program for regular program updates and reports; establish successful and unsuccessful termination criteria and outline guidelines for re-entry into the program; provide guidance and support for the treatment team in evaluating clients progress and needs; and to work closely with other community agencies (OPC Mental Health, Vocational Rehabilitation, Literacy Program, Employment Security Commission, Consumer Credit Counseling, and related clinicians) to provide the necessary caze for our clients. The Coordinator/Clinician will lead groups in CognitivaBehavioral Restructuring and substance abuse treatment. Re-evaluation of these program guidelines and procedures aze performed quarterly. The Coordinator/Clinician is supervised by the Director of Orange and Chatham Alternative Sentencing, Inc. (See more details under proportional breakdown of this job.) 15 Attachaent III=B FIRST STEP SANCTIONS CENTER '-6 SUBSTANCE ABUSE COUNSELOR I Position Authorized Criminal Justice Partnership Program Nature of Work An employee in this position would develop and implement a new system to intensely monitor court ordered intermediate sanction offenders with the goal of reducing recividism and probation revocations through emphasis on substance abuse treatment and education. An employee in this position must have the ability to work effectively with offenders, probation officers, courts and mental health substance abuse treatment programs. An employee in this position must have previous experience in substance abuse treatment, community-based punishment programs, law enforcement and/or corrections. Ezamples of Work Develop reporting, tracking, monitoring and other data gathering system. Arrange referral and follow-up guidelines within the criminal justice system. Maintain a resource list of treatment facilities and other human service resources. Ability to document case notes in a thorough and timely manner. Develop and foster working relationships with criminal justice system (probation and courts) and treatment programs. Screen eligible candidates, conduct initial intake and orientation and coordinate with the Program Coordinator recommended treatment goals. Ability to renegotiate alternative plan for effective outcome for those clients that are not progressing with their treatment goals. Conduct urine drug screens. Provide intensive supervision of daily activities of participants, maintain records on all participants and compile reports required by the Department of Corrections and the Criminal Justice Partnership Program. 17 Working Relationship Regular contact with offenders (families, significant others), Probation Officers, Defense Attorney, Judges, Treatment Alternative to Street Crimes (TASC), Orange- Person-Chatham Mental Health Clinic, Employment Security Commission, Vocational Rehabilitation Services, Literacy and General Equivalency Diploma Programs and other private and public agencies. Attachment IV-A 18 MEMORANDUM OF AGREEMENT BETWEEN ORANGE-CHATHAM TREATMENT ALTERNATIVES TO STREET CRIME AND FIRST STEP SANCTIONS CENTER The .purpose of this memorandum of agreement is to outline the flow of referrals and reporting procedures between the First Step Sanctions Center and the TASC Program. A. First Step Sanctions Center agrees: 1. To provide both positive and negative results of all urinalysis done on TASC clients. 2. To inform the TASC case manager(TCM) as soon as possible of any missed appointments, pending violations, arrests, and upcoming court appearances. 3. To agree to discuss with the TCM, if a client begins to fail in the program, to discuss disposition and possible increase in sanctions. 4. To have the TASC referred client sign a release of information form to share information with the TASC Program. 5. To provide reports to TASC of clients' progress in treatment. 6. Upon successful completion of the client in the First Step Sanction Center Program, First Step will notify the TCM in writing within five(5) working days. 7. To confer with TASC to develop protocols, policies and procedures for the TASC Program, and to meet to discuss any needed changes in the TASC Program on an as needed basis. B. Orange-Chatham Treatment Alternatives to Street Crime(TASC) agrees: 1. The TCM will be available to District and Superior Court in order to receive potential TASC~referrals or to serve as a consultant for sentencing. 2. TASC will provide an eligibility criteria assessment for the defendant convicted to Intermediate Sanctions. TASC will provide a diagnostic screening to eligible defendants and will forward the recommendations, court judgement and other appropriate court documentation to First Step Sanctions Center. 19 3. TASC will attend staffings and conferences with First Step Sanctions Center staff as scheduled. 4. The TCM will consult with First Step Sanctions Center staff if client begins to fail the program, to discuss disposition and possible increase in sanctions. 5. The TCM will refer ull eligible i~.termediate sanctioned defendants to the First Step Sanctions Center, and will monitor their compliance and progress. 6. The TASC Program will confer with First Step Sanctions Center to develop protocols, policies and procedures involving the First Step Sanctions Center, and to meet to discuss any needed changes on an as needed basis. AND ORANGE CHATHAM COUNTY PROBATION AND PAROLE SERVICES This memorandum of agreement is between First Step Sanctions Center (FSSC) of Orange-Chatham Alternative Sentencing, Inc.'s and Orange-Chatham County Probation and Parole Services.. This agreement is effective from July 1, 1998 through June 30, 1999. The purpose of this memorandum is to outline the procedure used for interfacing services for the clients attending the First Step Sanctions Center. These clients are case managed by the FSSC Coordinator/Clinician and/or Case Manager. Probation/Parole agrees: 1. Notify FSSC within 24 hours of new cases as soon as adjudicated. 2. Provide a copy of the judgment within 72 hours of sentencing, whenever possible and any other pertinent documentation necessary to facilitate delivery of services. 3. Advise FSSC of any violations of probation/parole, including revocation orders, additional sanctions and scheduled court dates. 4. Provide FSSC with any positive urinalysis results taken by Probation/Parole Officers prior to and during the offenders' participation in the program. 5. Participate in staffing and conferences at FSSC to discuss offenders' treatment plan and/or further sanctions as scheduled. FSSC Staff agrees: 1. To obtain all required release of information forms needed to facilitate the exchange of information between agencies. 2. To provide access to monitoring logs kept by FSSC staff. 3. To make available to Probation the results of drug tests that FSSC performs on clients by phone and/or in writing on the bi-monthly progress reports. 4. To notify Probation, in a timely manner, if a client fails to comply and/or participate in the FSSC program. 5. To be available to the court to discuss potential clients' appropriateness for FSSC services. Both parties undertake to institute appropriate procedures for safeguarding such information with particular reference to client identifying information and to resist, in judicial proceedings, any efforts to obtain access to information pertaining to FSSC clients otherwise than as expressly provided for in the Federal regulations. Releases will be signed by the FSSC client to allow an exchange of information between FSSC and relevant agencies. Information to be exchanged will concern legal issues and cooperation and compliance with the FSSC program or service provider treatment plan and will not include personal nor psychological information revealed in treatment sessions. Attachment VI 23 Taxpayer ID# 58-2063924 STATE OF NORTH CAROLINA COUNTY OF ORANGE COUNTY OF CHATHAM AGREEMENT THIS AGREEMENT is hereby made between First Step Sanctions Center a program of Orange and Chatham Alternative Sentencing, Inc., hereinafter known as the "Agency" and William Autry, hereinafter known as the "Contractor". WITNESSETH That WHEREAS, the AGENCY desires to engage the CONTRACTOR to perform the professional services hereinafter described; 1. Contractual status. The AGENCY and CONTRACTOR agree that the CONTRACTOR shall perform the services-required of the CONTRACTOR herein set forth, provided, that the CONTRACTOR is not and will not by virtue of this contract acquire the status of an employee of the AGENCY. 2. Time of Performance. The effective date of this Agreement is July 1, 1998 and the termination date is December 31, 1998. 3. Compensation. The AGENCY agrees that it will pay the CONTRACTOR $40 (forty dollars) an hour for services pursuant to Paragraph 5 of this agreement. Payment will be made pursuant to the receipt and approval by the AGENCY of the CONTRACTOR'S completed and signed requests for reimbursement utilizing such forms as the AGENCY may prescribe. 4. Invoice. Payment under this Agreement will be made upon receipt of an original invoice from the CONTRACTOR setting forth the amount due and payable pursuant to Paragraph 3 of this Agreement. All services must be performed to the satisfaction of the AGENCY prior to any payment being made. S. Scope of Services to be Rendered. The CONTRACTOR hereby agrees to perform in a manner satisfactory to the AGENCY the following services: a. Group therapy session(s) (Up to 2 evenings/week for 2 hours per evening). b. Document individual case notes on each client. c. Communicate possible treatment plan updates to FSSC Coordinator. 24 6. Contract Administrator. Patricia Jones is designated as the contract administrator for this Agreement. The contract administrator is responsible for monitoring the CONTRACTOR'S performance, approving payment to the CONTRACTOR and - for providing evaluation of the CONTRACTOR 7. Funding. All terms and conditions of this Agreement are dependent upon and subject to the allocation of funds for the purpose set forth and the Agreement shall automatically terminate if funds cease to be available. 8. Taxes. The CONTRACTOR shall be considered to be an independent contractor and as such shall be responsible for all taxes. The CONTRACTOR agrees to provide the AGENCY with the CONTRACTOR'S correct taxpayer identification number upon the execution of this Agreement. The CONTRACTOR agrees that fafiure to provide the AGENCY with a correct taxpayer identification number authorizes the AGENCY to withhold 15% of any amount due and payable under this Agreement pursuant to the provisions of the Internal Revenue Code, Title 26, United States Code. 9. Warren As an independent contractor, the CONTRACTOR will hold the AGENCY harmless for any liability and personal injury that may occur from or in connection with the performance of the Agreement. 10. Termination of Agreement: a. State Property. The CONTRACTOR shall be responsible for the custody and care of any property fiunished for use in connection with the performance of this Agreement and shall reimburse the AGENCY for any loss or damage to said property. The CONTRACTOR fiuther agrees not to release any information concerning the AGENCY or its operation provided to him without the express written approval of the AGENCY, that all such information shall remain confidential, and all reports and other documents prepared pursuant to this Agreement shall become the property ofthe AGENCY and not released by the CONTRACTOR without the written approval of the AGENCY. 25 12. Situs. This Agreement shall be governed by the laws of North Carolina and any claim for breach or enforcement of the Agreement shall be filed in State Court in Orange County, North Carolina. 13. Antitrust Laws. This Agreement is entered into in compliance with all State and Federal antitrust laws. 14. Compliance with Law. The CONTRACTOR shall remain an independent contractor and as such shall be wholly responsible for the work to be performed under this Agreement and for the supervision of his employees. The CONTRACTOR shall be responsible for compliance with all laws, ordmances, codes, rules, regulations, licensing requirements and other regulatory matters that aze applicable to the conduct of his business and work performance under this Agreement, including those of federal, state and local agencies having appropriate jurisdiction. 15. This Agreement or any interest therein shall not be assigned or transferred by the CONTRACTOR The CONTRACTOR shall not subcontract any work to be performed pursuant to this Agreement without the written approval of the AGENCY. 16. Advertisemeat. This Agreement shall not be used for any advertising by the CONTRACTOR without prior written approval of the Contract Administrator. 17. Personal Services. This Agreement is a contract for personal services and is not for consultant services. If it is found to be a consultant contract, then it shall not be deemed executed until approved in writing by the Contract Administrator. 18. Entire Agreement. This Agreement and any exhibits and amendments annexed hereto and any documents incorporated specifically by reference represent the entire agreement between the parties and supersede all prior oral and written statements or agreements. WiTNESSETH That WI~REAS, the AGENCY desires to engage the CONTRACTOR to perform the professional services hereinafter described; 1. ' Contractual status. The AGENCY and CONTRACTOR agree that the CONTRACTOR shall perform the services required of the CONTRACTOR herein set forth, provided, that the CONTRACTOR is not and wdl not by virtue of this contract acquire the status of an employee of the AGENCY. 2. Time of Performance. The effective date of this Agreement is July 1, 1998 and the termination date is December 31, 1998. 3. C m~ensation. The AGENCY agrees that it vviIl pay the CONTRACTOR $40 (forty dollars) an hour for services pursuant to Pazagraph 5 of this agreement. Payment v~n71 be made pursuant to the receipt and approval by the AGENCY of the CONTRACTOR'S completed and signed requests for reimbursement utilizing such norms as the AGENCY may prescribe. 4. Invoice.- Payment under this Agreement will be made upon receipt of an original invoice from the CONTRACTOR setting forth the amount due and payable pursuant to Paragraph 3 of this Agreement. All services must be performed to the satisfaction of the AGENCY prior to any payment being made. 5. Scope of Services to be Rendered. The CONTRACTOR hereby agrees to perform in a manner satisfactory to the AGENCY the following services: a. Group therapy session(s) (Up to 2 evenings/week for 2 hours per evening). b. Document individual case notes on each client. c. Communicate possible treatment plan updates to FSSC Coordinator. 27 6. Contract Administrator. Patricia Jones is designated as the contract administrator for this Agreement. The contract administrator is responsible for monitoring the CONTRACTOR'S performance, approving payment to the CONTRACTOR and for providing evaluation of the CONTRACTOR 7. Fem. All terms and conditions of this Agreement are dependent upon and subject to the allocation of funds for the purpose set forth and the Agreement shall automatically terminate if funds cease to be available. 8. Taxes. The CONTRACTOR shall be considered to be an independent contractor and as such shall be responsible for all taxes. The CONTRACTOR agrees to provide the AGENCY with the CONTRACTOR'S correct taxpayer identification number upon the execution of this Agreement. The CONTRACTOR agrees that failure to provide the AGENCY with a correct taxpayer identification number authorizes the AGENCY to withhold 15% of any amount due and payable under this Agreement pursuant to the provisions of the Internal Revenue Code, Title 26, United States Code. 9. Warran As an independent contractor, the CONTRACTOR wiIl hold the AGENCY harmless for any liabi7lt' y and personal injury that may occur from or is connection with the performance of the Agreement. 10.
