HomeMy WebLinkAboutMinutes - 19760818The Chairman referred to Item XIII on the Agenda: The Planning Director will present proposed amendments to the Orange County Planning Ordinance. The Planning Director, Ervin Dobson, presented to the Board the proposed amendments as well as alternate proposals. He stated that he was attempting to draft the most recent suggestions which were made during the work sessions. He directed the Board's attention to page 3, Section 1.1 which had been rewritten for clarification; and on Pages 6 and 7, Section 1.2.2 and 1.2.3 which deals with an impact statement and the hand out pages which contain some general changes. Mr. Dobson stated that the Planning Board did not meet far their last regular meeting because of a lack of quorum and the Planning Board had not seen the proposed changes. - Hal Minis of the Planning Staff reviewed the proposed changes with the Board. Following discussion, the Board agreed that the public hearing scheduled for August 9, 1976, should be postponed and that another work session between the Planning Board and Staff and the Com- missioners should be held before the public hearing. Upon motion of Commissioner Gustaveson, seconded by Commissioner Whitted, it was moved and adopted to postpone the August 9, 1976, Public Hearing to the regular quarterly public hearing scheduled for August 31, 1976. The County Attorney encouraged the Board to make decisions regarding the proposed Ordinance with standards in mind. The last order of business for the County Commissioners was to designate a voting delegate to the North Carolina Association of County ¢ommzssioners Convention on August 19, 1976. Garrett, Chairman Betty June Hayes, Clerk ORANGE COUNTY BOARD OF COMMISSIONERS August 18, 1976 The Orange County Board of Commissioners met in regular session on Wednesday, August 18, 1976, at 7:30 p.m., in the Superior Courtroom of the Courthouse in Hillsborough. Members of the Board present were Chairman Flora Garrett, Commis- sioners Norman Gustaveson, Jan Pinney and Richard Whitted. Member absent was Commissioner Norman Walker. Others present were S. M. Gattis, County Administrator; Neal Evans, Finance Director, Jeffrey Gledhill, County Attorney; and Betty June Hayes, Clerk. The Chairman of the Board called the meeting to order and announced that there were two Public Hearings on the Agenda and then inquired if there were person; present, who were not listed on the Agenda, and having business to transact with the Board of Commissioners. The County Administrator, Mr. Gattis, stated that he had one items that should be added to the Agenda which concerned assurances for the Section Eight Housing Program. Chairman Garrett stated that this was the time and place for the 7 - .. scheduled Public Hearing .relative to the $6,D00,000. School Band Issue. The Chairman asked if there were those persons present who wished to be heard an the question of the validity of the "Order Authorizing $6,000,000 School Bonds." No one came forth, either in person or by attorney, to be heard an the question of the validity of said order or the advisability of issuing bonds and the Clerk to the Board of Commissioners and Register of Deeds announced that no written statement relating to said questions had been received. Commissian'er Whitted read the Order Authorizing $5,000,000. School _. Bond. (For copy of Order, see next page) Upson motion of Commissioner Whined, seconded by Commissioner Gustaveson, it was moved and adopted that the Order Authorizing $6,000,000. School Bond be approved. The Chairman announced that the Order Authorizing $6,000,000 has been adopted. Commissioner Pinney introduced a resolution which was read. (for copy of Resolution, see next page). Commissioner Pinney moved that the Resolution Calling a Special Bond Referendum be adapted. This motion was seconded by Commissioner Gustaveson. The Chairman called for a vote on the motion and all members. of the Board voted aye. The motion was declared passed. The Chairman stated that this concluded the proceedings of the School Bond Public Hearing relative to the $6,000,000 School Bond Issue. Chairman Garrett stated that the next item on the Agenda was a duly called Public Hearing on the Assessment Ro11 for the Paving of State Roads 1711, 1831, 1832, and 1833. The Chairman stated that for the record she would like to inform those present of letters which had been received relative to the paving of the above referred to roads. The Chairman read letters from Sarah R. Feathers, Lena F. Brady, and Thelma M. Wynn. The Chairman then asked if there were those present who would like to speak concerning the Assessment Roll. Various members of the audience spoke in favor of the proceedings for the paving of the roads in the Colonial Hills area. Other members of the audience inquired about the tax map reference (lot number) and the Sudivision lot number. The Chairman stated that the tax map reference and the subdivision lot numbers were not one in the same. That in preparing the Assessment Roll, the County had used the tax map reference. Mr. Eugene Conti questioned the footage on :his property located on State Road 1711 and the footage was changed on the Assessment Roll to 282 feet instead of 330 feet which would make the amount tv be assessed from Mr. Conti $611.94. Bobby Tarlton inquired about what portion of the road he was paying for. Discussion ensued about how the assessment could be paid. The Chairman informed the audience that from the day of publica- tian of the Assessment 13011, owners had 30 days in which to pay their assessment in full without being charged interest. Chairman Garrett called for a motion to adapt the Assessment Roll as adjusted for the Conti property Upon motion of Commissioner Whitted, seconded by Commissioner Gustaveson, it was moved and adopted that the Assessment Roll for the paving of State Roads 1711, 1831, 1832, 1833 be adopted with the Conti property assessment amended on the Assessment Roll to 282 feat instead of 330 feet at a cost of $611.94. The Chairman then directed the Clerk to the Board to enter into the minutes the date, hour, and minutes of confirmation of the Assess- ment Roll. The County Attorney stated that the purpose for this action was that as of August 18, 1976, at 8:34 p.m., this assessment became a lien on the property of the participating owners. The Clerk was instructed to deliver a copy of the Assessment Ro11 as amended to the Tax Collector. Chairman Garrett instructed the Tax Collector to publish a notice once no earlier than 20 days from the day of confirmation. That the roll has been confirmed as adjusted and that assessment can be paid without interest at any time before the expiration of 30 days from the date that the notice is published, and if not paid within this time, all installments thereof, shall bear interest as determined by the Board of Commissioners. (For copy of Assessment Roll see Page of this book). The Chairman asked if there were any other questions or discussions regarding the Assessment Roll. Chairman Garrett recognized Bill McDowell, a Orange County resident, who desired to speak on the proposed legislation to reduce litter, solid waste and the consumption of energy and natural resources by promoting refillable or recyclable containers. Mr. McDowell stated that he represented the "Citizens for Return- able Beverage Containers." He stated that beer and soft drink containers made up about 40 percent of all litter, and that the cost for picking up this litter throughout North Carolina last year cost about one million dollars. Containers that are designed to be thrown away after a single use will continue indefinitely. He spoke of the sufficient saving in energy and resource that could be realized from the increased use of refillable bottles. Mr. McDowell urged the :Board to adopt the proposed Resolution concerning Beverage Container Deposit. Commissioner Gustaveson moved that the Resolution concerning Bever- age Containers be adopted and to be passed on to the N. C. Association of County Commissioners on August 19th. The motion was seconded by Commis- sioner Whitted. The Chairman called for the vote and all members of the Board voted aye. (For copy of Resolution see page of this book). The Chairman referred to Item V: Durham-Orange Manpower Consortium discussion regarding plans for the next year. She stated that the Board should have received a summary o£;the plans and the ways in which the money for the coming year would be spent, as. well as the Contract as amended by the City Council Committee with imput from Orange County. Mrs. Garrett recognized Mr. L. G. Holloman, Director of the Durham-Orange Manpower Employment and Training. She stated that one of the goals for the coming year was to have an Advisory Committee that is an active planning body. She recommended reviewing the members to the Advisory Board to see if any changes should be made. Mr. Holloman reviewed with the Board the outstanding changes made in the Manpower Contract: 1. Each unit of government, Durham City, Durham County and Orange County will name eight person to the Advisory Council. 2. The-Chairman of each governmental unit will be a member of the Council. 3. The Council will elect a Chairman. 4. Representatives to the Council must represent six different economy areas. 5. Each unit of government shall select two areas of the economy it desires to appoint to the Council. Chairman Garrett informed the Board of a follow-up study which would be conducted by the Manpower Development Corporation to determine what impact the Manpower Programs have made on the Community. Mr. Holloman discussed with the Board the Out of School Programs through the Manpower Consortium. He stated that these programs were inherited from Operation Breakthrough and were proven to be both ineffective and expensive. The Staff feels emphasis in this area should be reduced, and that people should attempt to be reached through Human Resource Development Courses offered by Durham Technical Institute, and then follow this with 13 weeks of work experience. The Board requested the County Attorney to review the Manpower Consortium Contracts for the 1976-1977 year before being approved. The next item an 'the Agend a was Title XX. The State has advised the Orange County Department of Social Services that Orange County's Title XX allocation for the current fiscal year is $677,657. Plans to expend these funds should be developed as soon as practical. The Chairman referred to the Recommended Title XX Expenditures for 197fi-1977, prepared by the Social Services Department and stated that since the previously submitted budget of Social Services requested $1,097,027 in Federal Title XX Funds, it is now necessary to request that the recommended Title XX Expenditures be made. The County Administrator stated that the County did not know whether there would be any additional reallocation of funds or not and if there is, how much it would be. He stated that the Social Services Director, the Finance Director, as well as himself, felt it not wise to take the calculated risk that is entailed in assuming there is going to be additional reallocation. He stated that realistic, there is a chance for additional allocation, however, at this point, it is diffi- cult to assume that there will be additional monies. The source for reallocation of monies would probably come from the State, not from the different counties' unused portion. Tam Ward, Social Service Director, reviewed with the Board the recommended Title XX Expenditures for 1976-1977. Commissioner Gustaveson stated that he would like to know what impact the cuts would have and the effect on the contracts. Discussion ensued concerning the Frank Porter Graham cutback, and other areas of the recommended expenditures. The Board agreed that a letter should ba sent to contract providers notifiying them of the intent not to renew contracts. Commissioner Pinney moved that a letter be sent to Life Enrichment, Legal Aid, Chore Service, Frank Porter Graham (Children Disabilities) and Triangle J Housing Development stating that within thirty days (September 20, 1976) Title XX funds wculd be cutoff and that the letter should also state that a meeting to discuss these cutoffs would be conducted sometime, the first of September. Commissioner Whitted seconded the motion and all members of the Board voted aye. The Chairman declared the motion passed. The last item on the Agenda was a Contract for Section Eight Housing. Mrs. Garrett explained to the Board that this Contract tried to answer HUD's questions concerning the additional 150 housing allocations which were requested to be located in the town of Chapel Hill and the County has requested this allocation be in Orange County putting the houses where the need exist. The County Manager stated that what he had for the Board's approval tonight was the assurances that the matter of the Contract would be taken care of later. The County Manager stated that the Federal people had concurred in all aspects of the Section Eight Housing project except the Contract between Orange County and the Chapel H211 Housing Authority. He stated that the question of the duration of the Contract had been questioned. The Contract between HUD and Orange County i.s a Contract for five years, while the agreement between Orange County and Chapel Hill is for one year. HUD would like to know what plans we have far administration of the project for the remaining four years. He explained that there were several alternatives, however, he and Mr. Gledhill had worked out some assurances for FiUD in the event the Contract with Chapel Hill was not renewed, just what the County would do. Upon motion of Commissioner 'Gustaveson,_seconded by Commissioner Whined, it was moved and adopted that the Assurances be approved as presented by the County Manager. Garrett, presi.di.ng, and Commissioners Richard Whi.tted, Jan Martin Pinney, and Norman Gu.staveson Absent: Norman 'Walker ~ ~ * a~ a~ f The Chairman announced that this was the hour and day fixed.by the Board of Commissioners for the public hearing upan the order entitled: "ORAER AUTHORIZING ~6,000,ODO SCHDOL BONDS" and that the Hoard of Commissioners would immediately hear anyone who might wish to be heard on the question of the validity of said order or the advisability of issuing said bonds. No one appeared, either in person or by attorney, to be heard on the question of the validity of said-order or the. advisability of issuing bands and the Clerk of the Board of Commissioners and Register of Deeds announced that no vrritten statement relating to said questions had been rece5.ved. Thereupon, upon motion of Commissioner Whitted , seconded by Commissioner Gustaveson and carried, the order introduced and passed on first reading on August 2, 1876 entitled: "ORDER AUTHORIZING $6,000,000 SCHOOL BONDS" was read a second time and placed upon its final passage. The vote upon the final passage of said order was: Ayes: Commissioners Richard Whitted Jan Ma and Norman Gustaveson and Chairman Flora Garrett Noes: None __ The Chairman then announced that the order entitled: "ORDER AUTHORIZING $6,000,000 SCHOOL BONDSR had been adopted, The Clerk of the Board of Commissioners and Register of Deeds was thereupon directed to publish said order, together with the appended statement as required by The Local Govern- ment Bond Act, as amended, once in The News of Oran a County and. once in The Chapel Hill Newspaper. Thereupon Commissioner Pinne introduced the following resolution which was read: RESOLUTION CALLING A SPECIAL BOND REFERENDUM BE IT RESOLVED by the Board of Commissioners for the County of Orange: Section 1. •A special bond referendum is hereby called to be held between 6:30 A.M. and 7:30 P.M., on Tuesday, November 2, 1976, at which there shall be submitted to the qualified voters of Orange County the question stated in the. Notice of Special Bond Referendum set forth in Section 3 of this resolution. Section 2. For said referendum, ,(i) the regular registration books for elections in Orange County shall be used and the registration books, proc~ss or records shall be open. for the registration of qualified persons and for public inspectic.,- -~- r-, in the manner, under the 'conditions and at the times and places as provided 3.n said notice set forth in Section 3 of this resolution, (ii) the registrars, judges and other officers of elections appointed by the County Board of " Elections of Orange County for the several precincts and voting places in said County shall be the election officers for such precincts and voting places, and (iii) the precincts and voting places shall be those fixed by said County Board of Elections as provided in said notice set forth in Section 3 of this resolution, subject to change as provided by law. The County Board of Elections of Orange County is hereby requested to conduct said referendum and to take a1.1 necessary steps to that end in accordance with the provisions of this section. Section 3.
