BACKGROUND: Orange County proposes an amendment to the Joint Planning Agreement to authorize Transition Area Advisory Committees. The composition, duties and responsibilities of such committees will be specified in the Carrboro Land Use Ordinance. This amendment will implement a recommendation contained in the Facilitated Small Area Plan for Carrboro's Northern Study Area (see the attached Resolution "B" adopted by the Board of County Commissioners on February 2, 1999). FINANCIAL IlVIPACT: There will be no direct fmancial impact from the consideration of this amendment; however, with the creation of a Transition Area Advisory Committee there may be additional staff resources required of Carrboro (and possibly Orange County) to assist the committee with its work. RECOMMENDATION: The Orange County, Chapel Hill, and Carrboro Planning staffs recommend approval of the proposed amendment to the Joint Planning Agreement. Following conclusion of the public hearing, the matter should be referred to the towns of .Chapel Hill and Carrboro for decision and then to the Orange County Planning Board fora recommendation to the Orange County Commissioners. The attached a-mail from Ed Kerwin, Executive Director of the Orange Water and Sewer Authority (OWASA), serves as notice concerning the intentions of OWASA and the other applicants related to the plan amendment requests identified as JPA-1- 99 and CP-2-99. A letter from American Stone making this request is on the way. A follow-up letter will also be sent by our Chairman, Dan VanderMeer. As we discussed, the decision to request the delay was made last Thursday night. at a work session of the OWASA $oard of Directors. The OWASA Board of Directors remains strong in its belief that using the stone quarry is a very desirable water storage and supply option. The request for delay is based on OWASA's desire to have the most up-to-date information possible regarding future population and water demand projections for our service area and to more accurately forecast - "how the expanded stone quarry reservoir fits into OWASA's long-range water supply plan?" As you know, our Comprehensive Master Plan project is well underway and we are currently reviewing and evaluating the necessary information which will allow us to thoroughly answer this fundamental question. This work should be done well before the next-joint public hearing this fall. Craig, thanks again for touring the quarry operation and addressing our Board last Thursday - it was very helpful. MAKING RECOMMENDATIONS CONCERNING THE NORTHERN TRANSITION AREA ADVISORY COMMITTEE AND AGREEING TO CONSIDER FURTHER AMENDMENTS TO THE JOINT PLANNING'AREA LAND USE PLAN AND JOINT PLANNING AGREEMENT CONCERNING THE. IMPLEMENTATION OF THE FACILITATED SMALL AREA PLAN FOR CARRBORO'S NORTHERN STUDY AREA WHEREAS, the Board of County Commissioners has approved amendments to the Joint Planning Area Land Use Plan and the Joint Planning Agreement to implement. recommendations contained in the Facilitated Small Area Plan for Carrboro's Northern Study Area; and WHEREAS, the Board of Commissioners would like to implement certain Orange County Planning Board recommendations; and WHEREAS, the Board of Commissioners is willing to consider, at an appropriate time in the future, authorizing Carrboro to approve Village-Mixed Use and Office/Assembly conditional use "floating" zone districts. NOW THEREFORE, THE BOARD OF COUNTY CObIl~tISSIONERS OF ORANGE COUNTY HEREBY RESOLVES AS FOLLOWS: To pursue amendments to the Joint Planning Area Land Use Plan or the. Advisory committees, such as the Northern Transition Area Advisory Committee recommended in the Facilitated Small Area Plan for Carrboro's Northern Study Area, may be established in the Carrboro Joint Planning Transition Areas. Box 8181 Hillsborough, NC 27278 Dear Dr. Gordon: 1 y77 APA 1 4 1~'.'9 I am writing to clarify the request from the American Stone Company and OWASA to postpone the public hearing on amendments to the Joint Planning Agreement, Joint Planning Area Land Use Plan and Map, and the Land Use Element and Map of Orange County's Comprehensive Plan. These amendments were proposed to allow American Stone to extend its quarrying activities onto OWASA property near the intersection of Highway 54 and Bethel-Hickory Grove Church Road west of Carrboro. Under an agreement with American Stone, OWASA would obtain the resulting quarry pit for additional raw water storage. This long-standing plan has been a part of OWASA's strategy to satisfy our obligation to meet the long-term water requirements in our service area. Please be assured that the request to postpone the hearing until the fall of 1999 does not signify any retreat by the OWASA Board of Directors from our conviction that additional quarry reservoir capacity is an essential component of a long-term strategy to meet the future water needs of the citizens of southern Orange County. When we asked that this topic be scheduled for the April 14, 1999 hearing, we had anticipated that the OWASA Water and Sewer Master Plan project would provide additional data needed to be more precise in planning and financing the OWASA infrastructure in the coming decades. With respect to the plans for acquiring expanded quarry storage, we have been developing estimated rates of growth and associated water demand for the next 50 years; how expansion of a quarry reservoir would affect our need for water from Jordan Lake; and how much more water would be provided by additional quarry capacity.. In addition to making a persuasive case based on technical, financial, and demand estimates, we also want to be responsive to legitimate questions regarding the impact of water conservation measures OWASA might employ on future demand estimates and to any potential adverse environmental impacts from extending quarry operations onto OWASA property. We will address each of these matters when we testify in the fall. In the interim, we will keep you and the Orange- County Planning staff informed of our progress and hope to continue to rely on you for information, advice, and guidance on this vital effort.
