MINUTES
ORANGE COUNTY BOARD OF COMMISSIONERS
Monday, June 21, 1976
The Orange County Board of Commissioners met in special session
on Monday, June 21, 1976 , at 7 : 30 p.m. , in the Superior Courtroom of
the Courthouse in Hillsborough. The purpose of the meeting was two
schedulekPublic Hearings.
Members of the Board present were Vice-Chairman Richard Wh.itted,
Commissioners Norman Gustaveson, Jan Pinney and Norman Walker. Chair-
man Garrett joined the meeting later.
Others present were S. M. Gattis , County Administrator; Neal
Evans, Finance Director; A. B. Coleman, Jr. , County Attorney; and
Betty June Hayes, Clerk to the Board.
Vice-Chairman Whitted opened the meeting by announcing that the
first item of business would be the Public Hearing for the Orange Water-
Sewer Utility. He then proceeded to turn the meeting over to the
County Attorney. Mr. Coleman announced that the purpose of this
Public Hearing was to tell the public that the Orange Water-Sewer
is a reorganized utility, wherein, the Town of Chapel Hill has five
members, the Town of Carrboro has two members , and the County of
Orange has two members. He stated with respect to the properties'
to be owned by the Orange Water-Sewer, will remain the same, with
the University of North Carolina, the Town of Chapel Hill and Carr
boro conveying to the Oranqe Water-Sewer Authority all their interest
to the Water-Sewer Utility.
Mr. Coleman asked if there were any questions concerning the
reorganization of the Water-Sewer Authority.
Commissioner Walker stated that the people from the northern
Orange County area were unaware of this particular hearing in as
much as the only advertisements of the matter appeared in the
Chapel Hill newspaper, a paper that does not circulate in northern
Orange County to any significant degree. This lack of actual notice
to thepublic he felt constituted improper advertising of the issue
even though the legal requirements of advertisement might have been
fulfilled by publication in the Chapel Hill newspaper.
Mr. Coleman replied to Commissioner Walker ' s comments that
the Town of Carrboro did not select their members to the Water-Sewer
Authority until Tuesday night and that did not give enough lead time
to publish in the Orange County Paper.
Mr. Coleman stated that the Resolution read as follows :

of the Board of Commissioners of Orange County to Reorga-
nize the Orange Water and Sewer Authority Organized Under

under Section 162A-3. 1 of the North Carolina Water and Sewer
Authorities Act (Article 1 of Chapter 162A of the General
Statues of North Carolina, as amended. See Minute Docket
Book Nine, Page ) .
The Board of Commissioners decided to not vote on the Resolution
until the Chairman had arrived.
Vice-Chairman Whitted stated that the next Public Hearing was with
regard to the 1976-1977 County Budget.
He asked if there were those present who wished to speak concerning
the proposed budget.
Mary Scroggs of the Chapel Hill-Carrboro School Board asked to
speak. She stated that the items requested by the Chapel Hill-Carrboro
School Board in their Budget were necessary to carry on an adequate
program. She spoke of the increases in salary requested in the budget,
the increase in teaching positions , as well as additional teachers for
the Learning Disability Program, improvement in the Health Program,
improvement in the maintenance and facility service. She urged the
Board to approve these requests and include the supplement for adult
bus monitors and paid bus drivers , and the current capital outlay needs
for repairs to the busses and equipment.
Other citizens from the Chapel Hill-Carrboro area spoke in favor
of the Chapel Hill-Carrboro School Budget and amendments as presented
and urged the Board to approve the school budget.
The Chairman of the Orange County Day Care Coalition asked to
speak concerning the Day Care Program supported by Title XX monies.
She spoke of the need for continuation of the Day Care Program and
requested consumers of the Day Care Program to so speak.
Mr. Robert Strayhorn, of the Orange County Recreation Advisory
Council spoke in regard to the Orange County Recreation Budget. He
requested that the Commissioners increase the Recreation personnel.
Members of the Recreation Advisory Council spoke of the many hours
of work performed by the Recreation Department and requested an in-
crease in personnel.
Commissioner Gustaveson questioned certain items within the
Recreation Department ' s budget.
Mr. Weston, Orange County Recreation Director stated that a
travel allowance of $. 16 had been requested because before the
travel has been paid by his staff, and he did not feel that this could
continue.
George Spransy of Dogwood Acres stated that he was present to
speak of "Refuse and Recreation" He stated that he felt his area
of the County had been neglected in recent years. He requested that
a Green Box be placed in the Dogwood Acres area.
Chairman Garrett assumed the chair at this time.
Chairman Garrett asked if there were others present who wished to
speak concerning the 1976-1977 Budget.
Alice Myers spoke in behalf of the total Mental Health Program and
the Council on Aging. She requested the Board to be sure that the older
adults receive their fair share of the services and money.
Discussion on the 1976-1977 Budget ended at this time.
Commissioner Gustaveson moved that the previously read Resolution
Signifying the Determination of the Board of Commissioners of Orange
County to Reorganize the Orange Water and Sewer Authority Org-anized
Under Section 162A-3. 1 of the North Carolina Water and Sewer Authorities
Act (Article 1 of Chapter 162A of the General Statues of North Carolina
as amended) . The motion was seconded by Commissioner Whitted.
Discussion ensued. Commissioner Walker stated that he could not
in good conscious vote for this motion in that he felt it was not
properly advertised.

The Chairman called for the vote.
Voting aye were Commissioners Garrett, Gustaveson, and Whitted.
Voting nay were Commissioners Walker and Pinney.
The Chairman declared the motion passed.
Commissioner Gustaveson read the following resolution con-
cerning a Section Eight Rent Supplement Program in Orange County.
(For Copy of Resolution, See Minute Docket Book Nine, Page 629 )
Commissioner Gustaveson moved for the adoption of the Reso-
lution. The motion was seconded by Commissioner Whitted.
All members of the Board voted aye and the motion was declared
passed.
The Clerk was requested to prepare a certified letter designa-
ting Commissioner Norman Walker as the voting delegate to the NACO
Convention in Salt Lake City, Utah.
The Commissioners resumed their business in the Commissioner 's
Room of the Courthouse. (There is no tape for this portion of the
meeting. )

Marvin Silver, a member of the Chapel Hill Board of Alderman
spoke of the County Support for the Municipal Recreation Progam.
Commissioner Gustaveson requested the Board to add $18,000
to the Recreation Program to develop the formula as set out by the
Joint Intergovernmental Task Force. The formula allocates 70% to
Chapel Hill and 30% to Carrboro.
Commissioner Whitted discussed with the Board the Planning
Personnel request for an additional Planner, which is set ou in
the Eno River Proposal.
Commissioner Walker stated that he felt the present Planning
Staff is sufficient to handle this project and suggested that the
Board talk with Irvin Dobson before hiring a full time Planner.
Commissioner Gustaveson stated that the Board of Commissioners
have given their word as stated in the Eno River Proposal.
Further discussion ensued concerning priorities contained on
the "wish list".
Upon motion of Commissioner Walker, seconded by Commissioner
Whitted, it was moved and adopted that the Board go into Executive
Session to discuss positions and salaries.

EXECUTIVE SESSION
The Board reconvened from Executive Session and the Chairman
explained to the press and public the action that was taken in
Executive Session.
The Board had agreed that the Pay Grade of 50 should be the
lowest of which any employee should start.
To be included within the "wish list" were the recommendations

Personnel - Re-Classifieds 19736
Personnel - Step Adjustments 11589
Upon motion of Commissioner Walker, seconded by Commissioner
Pinney, it was moved and adopted that the meeting be adjourned.

MINUTES
ORANGE COUNTY BOARD OF COMMISSIONERS
June 24, 1976
The Orange County Board of Commissioners met on Thursday, June
24, 1976, at 7 : 30 in the Commissioners Room of the Courthouse in
Hillsborough.
Members present were Chairman Flora Garrett, Commissioners
Norman Gustaveson, Jan Pinney, Norman Walker and Richard Whitted.
Members absent were none.
Others present were S. M. Gattis, County Administrator; Neal
Evans, Fiscal Officer, Jeff Gledhill, County Attorney, was, present
for part of the meeting; and Agatha Johnson, Acting Clerk.
The Chairman informed the people present that on Monday, June 28,
1976 , at 1 :00 p.m. there would be a meeting to discuss Title XX.
Ricky Poole, Administrative Assistant with the Department
of Social Services stated that his Department needed either new con-
tracts signed by all persons involved in the different programs , or a
letter of intent to continue the programs at the existing level of
service. These contracts must be submitted to Raleigh by June 29, 1976.
The Chairman stated that the Board had agreed to extend the con-
tracts and would decide what contracts to extend on Monday.
Mrs. Garrett recognized Chris Edwards of the County Planning
Department who presented to the Board three plats for their approval.
1. Plat of James Ray. Mr. Edwards stated that this land was
located on Highway #70 near the golf course. There is a house and
garage on the lot which has road frontage and set back lines. '
Upon motion of Commissioner Whitted, seconded by Commissioner
Pinney, it was moved and unanimously adopted to approve the plat of
James Ray.
2. Robert Davis - Mr. Edwards explained that Mr. Davis was
cutting a 1.35 acre tract off of a larger tract. This is located in
Chapel Hill Township and has road frontage on SR #1130. A Health
Permit has been issued.
Upon motion of Commissioner Pinney, seconded by Commissioner
Whitted, it was moved and unanimously adopted to approve the plat of
Robert Davis.

fallcwing rate of taxes on each ($100) assessed valuation of taxable
property as listed as of January 1, 1976 for the purpose of raising the
revenues from current year's property tax County vride and ~vithin the
special districts as set forth in the foregoing estimates of revenues,
and in order to finance foregoing appropriations:

shall be required. On all other dogs a license costing $1.00 shall be re-
quired.
Section VI: In accordance with Section B of the Revenue Act (Article 2, Chapter 5, of
the General Statutes) and any other sections of the General Statutes so
permitting, there are hereby levied privilege license taxes in the maximum
amount permitted on all businesses, trades, occupations,or professions
which the County is entitled to tax.
