MINUTES
ORANGE COUNTY BOARD OF COMMISSrONERS
Tuesday, June 15, 1976
The Orange County Board of Commissioners met in regular session
on Tuesday, June 15, 1976, at 7:30 p.m. in the Commissioners' Roam
of the Courthouse in Hillsborough.
Members present were Chairman Flora Garrett, Commissioners,
Norman Gustaveson, Jan~Pinney, Norman Walker and Richard Whitted.
Members absent were none.
Others present were S. M. Gattis, County Administrator; Neal
Evans, Finance Directox, Jeffrey Gledhill, County Attorney; and
Betty June Hayes, Clerk to the Board.
William Laws, Tax Supervisor, presented to the Board a Land
Use Evaluation and stated that this evaluation was adopted in 1974,
however, last year new legislation was passed which stated that every
County must adopt a new set of values for land use for appraisal
at its use value rather than its market value. He stated that the
evaluation was based on the number of bushels producted on different
types of soil in Orange County and that compared with the previous
year's evaluation, the new standards in Orange County were still within
the correct range.
Discussion ensued concerning advertising the evaluation as required
by law.
Upon motion of Commissioner Walker, seconded by Commissioner
Gustaveson, it was moved and adopted that the Land Use Evaluation
be approved and the Tax Supervisor was authorized to publish the
Land Use Evaluation in the newspaper.

Chairman Garrett referred to Ttem I on the Agenda: Persons
not on the Agenda having business to transact should make their
presence known at this time.
No one came forth.
Item 22: Approval of Minutes - This item was deferred until
later in the meeting.
The Chairman referred to Item TI2: Appointments:
A. One member pf the Orange County Board of Commissioners should
be named as a member of the Board of Directors of the Triangle Committee
an Criminal Justice.
Mrs. Garrett informed the Boat~d that as of January 1, 1976,
the Commission on Criminal Justice was reorganized by merging with
the Triangel J Council of Governments, and as a result of the merger,
the bylaws of the Triangle Commission on Criminal Justice required
modification.
Upon motion of Commissioner Gustaveson, seconded by Commissioner
1~hitted, it was moved and adopted that Jan Pinney be nominated as the
Orange County Elected Official to the Board of Directors of the
Triangel Committee on Criminal Justice.
B. Jane Monree has resigned from Orange County's Commission
on the Status of Women. Chairman Garrett will nominate a replacement
on the committee.

Chairman Garrett stated that she would like to defer this
appointment until the first Tuedsay's Meeting (July 6, 1976) in
July.
The Chairman referred to Item 2V: Resolution authorizing
Orange County's Sediment Control Officer to administer the Orange
County Sediment Control Ordinance within the corporate limits of
the Town of Chapel Hill.

Upon motion of Commissioner Gustaveson, seconded by Com-
missioner Pinney, it was moved and unanimously adopted to approve
the resolution authorizing Orange Ca~nty's Sediment Control Officer
to administer the Sedimenti Control Ordinance within the corporate
limits of the Town of Chapel Hill.
The Chairman referred to Item V: Preliminary Resolution
to establish a Paving Assessment Program for State Roads #1711,
1$31, 1$32 and 1833. Geoffery Gledhill will present and review
this resolution.
Mr. Gledhill reviewed for the Board and residents of the
stated roads the General Statutes procedures of special assessment
for the paving of roads. He pointed out that all property owners
must be assessed, however, they may pay the amount in full within
thirty days at no interest charge. He stated that someone must be
directed to prepare an assessment roll prior to the public hearing.
Discussion essued regarding 'the amount per linear foot
of road frontage required to be paid by the property owners. The
Board requested that particular number of dollars per linear foot
be omitted from the document.
Dicussion ensued and Mr. Gledhill continued to review with
the Hoard the technical aspects of the document.
Mr. Gene Conti, a resident of the area, stated that he was
the one of the larger land owners and it would be easier to be
assessed over a ten year period rather than a five year period, and
that it would be a hardship for him to be required to repay his
assessment within five years.
Commissioner Gustaveson stated that this would be a resol-
ving fund set up by the Coun~y and that five years would keep the
monies flowing rather than over a ten year period.
Mr. Gledhill stated that this legal opinion was that the
same pay back period should be used for each property owner in
each project undertaken.
Mr. Conti inquired if it would be possible to change the
pay back period from five years to ten years at some later date.
Mr. Gledhill stated that legally this could be changes.
Commissioner Garrett stated that she and other property
owners understood Mr. Conti's situation and that there might be
some arrangemnets that could be made with the other property
owners.
Upon motion of Commissioner Gustaveson, seconded by Com-
missioner Walker, it was moved and unanimously adopted~to approve
the Preliminary Assessment Resolution for the Financing by Orange
County of the. Local Share of the cost of Paviny North Carolina State
Roads Numbers 1711, l$3l, 1832, and 1833 located in Eno Township,
Orange, County, North Carolina, as amedded by Mr. Gledhill.

July 6, 1976, at 10:00 a.m. was scheduled for the public
hearing on the matter.
Commissioner Garrett referred to Item VI: The Finance
Director will present amendments to the current County Budget.

Neal Evans, Finance Director, filed with the Board 1975-1976
Proposed Budget Ordinance Amendments.

Upon motion of Commissioner Pinney, seconded by Commissioner
Whitted, it was moved and unanimously adopted to approve the Budget
Ordinance Amendments as presented by the Finance Director.
Chairman Garrett referred to Item VI: The Board of Commissioners
will discuss possible positions it might take concerning the new pro-
posals of the North Carolina Department of Transportation to locate
U. S. Highway I-40 in Orange County.
Chairman Garrett reminded the Board of two Public Hearings
which were coming up. 1) On June 23, 1976, a Public Hearing regarding
Primary Highway ImprovQment Plans which included all primary roads
such as Highway #86 and 54. 2) On June 29, 1976, there is a Public
Hearing concerning the Environmental Impact Statement of various routes
of I-40. On June 22, 1976, from 11:00 a.m. until 9:00 p.m., there will
be a representative from the Highway Department at the Municipal
Building in Chapel Hill to discuss informally the proposed I-40.
Mrs. Garrett stated .that the Triangle J Council of Governments will
review the proposed project and would like a consensus statement from
the local governments as well as the County concerning I-40. She
stated that the last official action of this Board was that the Com-
missioners did not approve of any of the alternatives
Chairman Garrett read a letter from B. B. Olive regarding I-40
and the Orange County Land Classification System.
Discussion ensued. Commissioner Gustaveson suggested that the
Board meet with private and governmental groups to plan a joint
strategy for the Public Hearing. He stated that any of the alternatives
in Orange County would be disasterous and that it is important to do
all that we can to delay or even stop I-40. He spoke of the amount
of land that would be used for the Highway and the cost factor involved.
Chairman Garrett stated that the I-40 was being built for the
purpose of intrastate traffic.
Commissioner Whitted stated that there were a number of ways of
moving local traffic without building intrastate Highway. He stated
that the problem was Interstate traffic on T_-85 and even after the
building of any of these alternates,fhere would still be much traffic
on I-85.
Commissioner Gustaveson urged the Board to call a meeting to
mobilize governmental groups and private groups.
The Board agreed to call a meeting for Friday, June 18, 1976 at
the K & W Cafeteria in Chapel Hill at 11;30 a.m. to discuss joint
strategy for the Public Hearing on June 29.
Chairman Garrett referred to rtem II - Approval of Minutes.
Upon motion of Commissioner Pinney, seconded by Commissioner
Whitted, the Minutes of the June 3, 1976 meeting were approved.
Upon motian of Commissioner Pinney, seconded by Commissioner
Whitted, it was moved and adopted that the minutes of the June 10,
1975 meeting be approved.
Chairman Garrett referred to Item VIIT - Further discussion
of proposed County Budget for the coming Fiscal Year.
The Board began discussion of the Budget at the point where
they had ceased at the previous mee 'ng of June 10, 1976.

WHEREAS the Board of County Commissioners of Orange
County has elected to finance the local share of the cost of
paYring North Carolina State Roads n 1711, 1831, 1832, and 1833,
loca•tcd in Eno Township, Orange County, as permitted by North
Carolina General Statute § 153A-185(4) and as provided iol' i.rr -

1. Orange County shall undertake the financing of

2. The basis far assessment for the loaal share of
the cost of this project shall be linear--faot-street--fxontage.
3. Orange County will assess the total local share
according to the basis set out in number (2) above.
