STATE OF NORTH CAROLINA AGREEMENT FOR CONSTRUCTION
THE COUNTY OF ORANGE SERVICES
This Agreement made and entered into by and between the County of Orange, on behalf of its
Solid Waste Department, herein referred to as "County" and Jerry W. McCullock, 1415
McCullock Loop Rd., Hurdle Mills, NC., 27541, herein referred to as "Contractor".
WHEREAS, the County wishes to contract with the Contractor for the construction of the
expansion of the Solid Waste Collection Center at 3605 Walnut Grove Church Road,
Hillsborough, NC, and
WHEREAS, the Contractor wishes to provide these services.
NOW THEREFORE, it is mutually agreed as follows:
1. TERM: This Agreement, unless amended as provided herein, shall be in effect from
the date of the execution of this agreement, until May 4, 2007. The work shall be
_ .....substantially completed on or before A_ pri124, 200.7 and_ completed and ready for final
payment on or before May 4, 2007.
2. DUTIES OF CONTRACTOR: The Contractor shall construct the Solid Waste
Collection Center in accordance with the attached Plans and Specifications contained
• in ORANGE COUNTY BID NO. 1449.
3. DUTIES OF COUNTY: The County shall pay the Contractor for completion of the
Work a total amount not to exceed a lump sum payment of $197,387.05 for the
services as set forth in the attached plans and specifications.
4. BILLING AND PAYMENT: The Contractor shall submit an Application for Payment
on a monthly basis. The Contractor shall submit a Certificate of Final Payment.
5. CHANGES IN THE WORK: Agreement may be amended only in writing by mutual
agreement by the County and the Contractor.
6. INSURANCE PROVISIONS: The Contractor shall have the following insurance
coverage:
• Worker's Compensation -Coverage to apply for all employees for statutory
limits in compliance with the applicable state and federal laws. The policy
must include employer's liability with a limit of $100,000 for each accident,
$100,000 bodily injury by disease each employee and $500,000 bodily injury
by disease policy limit.
• Comprehensive General Liability -Shall have minimum limits of $1,000,000
per occurrence combined single limit for bodily injury liability and property
damage liability. This shall include premises and/or operations, independent
• contractors, products and/or underground damage coverage, sudden and
accidental pollution losses, and a contractual liability endorsement.
• Business Auto Policy -Shall have minimum limits of $1,000,000 per
• occurrence combined single limit for bodily injury liability and property
damage liability. This shall include: owned vehicles, hired and non-owned
vehicles and employee non-ownership.
• Special Requirements -The County of Orange is to be named as an additional
insured on the Comprehensive General Liability Policy.
• Current, valid insurance policies meeting. the above requirements shall be
maintained for the duration of the project. A certificate of insurance shall be
submitted to County as beginning of construction. Renewal certificates shall be
sent to the County of Orange thirty (30) days prior to any expiration date.
There shall also be a 30-day notification to the Cowity in the event of
cancellation or modification of any stipulated insurance coverage. Certificates
of insurance on an Accord 25 (8/84) or similar form meeting the required
insurance provisions shall be forwarded to the County of Orange. Wording on
the Certificate of Insurance, which states that no liability -shall be imposed
upon the company for failure to.provide such notice is not acceptable. _ Original
policies or certified copies of policies may be required by the County at any
time.
~ Subcontractors - It shall be the responsibility of the Contractor to insure that
all subcontractors comply with the same insurance requirements of the
Contractor.
7. The Contractor hereby agrees that each clause of this Agreement has been read and
fully understands the meaning of the same and will comply with al.l terms.
