Whereas both the Department and the School mutually agree that the purpose of providing school health nursing services is to promote the optimal health and well-being of all students in the Chapel Hill Carrboro City Schools, and Whereas both the Department and the School mutually agree that the long-term purpose of these funds is to provide full-time nursing services to each school in the system; and Whereas both the Department and the School mutually-agree to continue providing school nursing services as specified in the annually developed "M~morandum of Agreement between Orange County Health Department and Chapel Hill Carrboro City Schools;" NOW, THEREFORE, in consideration of the premises and the following mutual covenants and conditions and any sums to be paid, the Department and the School agree as follows: The Department agrees: 1. To provide funds not to exceed $382,925 to the School for the purpose of supporting six 10-month ' registered nurses to provide school nursing services for the 2007-2008 school year. 2. That the funds will be paid quarterly upon submission of an invoice that specifies personnel costs and that the Department shall pay the School within thirty (30) days of receipt of the School's invoice. Any adjustments to the invoice shall be taken into account in the next succeeding invoice or as soon thereafter as reasonably practicable. 3. That the funds may be used in their entirety for school nurse personnel costs including associated benefits and the local supplement. 4. To assign a nursing supervisor to coordinate the implementation of this contract and to initiate the annual development of the Memorandum of Agreement that specifies operating procedures. 5. To arrange for and provide at least three continuing education offerings for all nurses in the School during the school year at a mutually agreed upon time, whenever possible arranging for the sessions so as to minimize time away from the individual school assignments. The School agrees: 1. To utilize funds not to exceed $382,925 for the purpose of supporting six 10-month registered nurses to provide school nursing services for 2007-2008 school year. The nurses will provide direct nursing services to students within individual schools. The School agrees that the funds will not be utilized to support a nurse with a supervisory role. 2. To submit an invoice to the Department quarterly that specifies personnel costs for the period. 3. To provide adequate space, computer equipment and supplies for the designated positions through other funds at a level comparable to the support provided to all school nurses supported by the School. 4. To inform the Department of the employment of the nurses, and in the event of termination, whether voluntary or involuntary, of the date of termination. 5. To provide nursing supervision within the School consistent with the annual Memorandum of .Agreement. 7. To release all school nurses to attend at least three continuing education events during the school year at mutually agreed upon times. 8. To assume the full responsibility for negligence of its employees that provide nursing services under the terms of this contract for the contract positions and for all nurses employed directly by the School but functioning under the direction of the annual Memorandum of Agreement. 9. School shall provide, or cause to be provided, insurance covering professional liability of nursing personnel of at least $1 million. Proof of insurance shall be submitted to the Department annually. This contract shall be in effect for the period July 1, 2007 through June 30, 2008 and is renewable annually thereafter. Either party may terminate this contract with or without cause upon 90 days written notice. Pat ams, Orange County chools Finance Officer Date: ~ ~ ~ FOR AND ON BEHALF OF THE COUNTY OF ORANGE Moses Carey, Jr., Chair Orange County Commissioner y~ Date: d/ S:\DOHADMIN\CONTRACTS\SCHOOL CONTRACTS\2007-2008 Contract OCS Nursing Services.doc ~'-~ r~~ April 9, 2007 Addendum A to Agreement between UNC and OCHD For Medical Director Services Whereas, the Chapel HilUCarrboro City Schools (CHCCS) employs one (1) School Nurse who is a licensed and qualified Nurse Practitioner (Head Start Program), ana; Whereas, the Chapel HilUCarrboro City Schools (CHCCS) seeks to have the School Nurse provide limited nurse practitioner services to students at her site, and; Whereas, the School Nurse Practitioner requires medical supervision, and; Whereas, the Orange County Health Department (OCHD) maintains a Memorandum of Agreement with the Chapel HilUCarrboro City Schools to provide medical direction to school nurses by the OCHD Medical Director, and; Whereas, -The University of North Carolina at Chapel Hill (`The University') through its Department of Family Medicine of the UNC School of Medicine (Department) provides medical supervision to OCHD Nurse Practitioners through its Medical Director contract and is agreeable to expanding the contract to provide medical supervision to the CHCCS School Nurse Practitioner. Therefore, the above parties agree to the following: ~~r~ 1. OCHD Medical Director (or other mutually agreed upon UNC Family Practice physician) will provide medical supervision to the CHCCS School Nurse Practitioner from August 15, 2007 to June 15, 2008 (10 months) in accordance with the term of the Agreement between The University and OCHD. 2. CHCCS will maintain medical malpractice insurance equal to or exceeding a $1 million per incident and a $3 million upper limit coverage for its School Nurse Practitioner and will furnish proof of insurance to the OCHD and the Department. 3. CHCCS will submit all nurse practitioner protocols to OCHD for review by the Medical Director or designee prior to implementation of the protocols. 4. CHCCS will assure the School Nurse Practitioner has an approved Board of Pharmacy registration and Registration and Approval to Practice by the NC Boazd of Nursing and the NC Medical Board. CHCCS will provide OCHD with a copy of the Nurse Practitioner's current license. 5. CHCCS will assure the School Nurse Practitioner has a Collaborative Practice Agreement completed with the University's assigned OCHD Supervising • Physician. Apri19, 2007 • 7. OCHD will amend its agreement with CHCCS to include the medical supervision of its School Nurse Practitioner by the University's assigned OCHD Medical Director or designee with its corresponding period of coverage and costs. 8. CHCCS will pay OCHD for medical supervision of its School Nurse Practitioner the amount of $1000/year (1 hour/month @$97/hour) in one lump payment by September 30, 2007. 6. CHCCS will assure that the School Nurse Practitioner abides by all laws and regulations governing the confidentiality of patient information, including HIPAA privacy rules. 9. OCHD will pay The University for the above services in one lump payment of $1000 by December 30, 2007. 10.
