Petition for Road Addition INFORMATION CONTACT: Karen Lincoln, 245-2594 Karen Markovics, 245-2583 Craig Benedict, 245-2592 PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT) concerning a petition to add Northridge Lane to the State Maintained Secondary Road System. BACKGROUND: Northridge Estates, originally known as "Sunrise Springs", was approved by the Board of County Commissioners on March 21, 2001 through the major subdivision process. Northridge Lane was platted and approved as a public road. The plat designates Northridge Lane as a "Public Right of Way". The NCDOT District Engineer at that time signed a certificate on the plat stating that the road meets NCDOT construction standards. Property owners within the subdivision (9 homes) have petitioned the NCDOT to accept maintenance responsibilities for Northridge Lane. Northridge Lane is approximately .15 miles in length and is located north of I-40 on the west side of Sunrise Road, Chapel Hill Township, and is within the Rural Buffer. This application meets the criteria endorsed by the Board of County Commissioners for recommending acceptance of a public road into the State Maintained System for roads approved through the governing jurisdiction's major subdivision process. NCDOT has investigated this request (please refer to attached Secondary Road Addition Report) and has submitted the petition to the Board of Commissioners for its review and recommendation. In accordance with North Carolina General Statute §136-62', the Board is required to make a recommendation regarding the petitions to the North Carolina Board of Transpartation (NCBOT) before the NCBOT can consider the petitions. North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads. The board of county commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their recommendations." 2 FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. The right-of-way will extend the entire length of the road that is requested to be added to the state maintained system and will nc{ude the necessary areas outside of the right-or-way for cut and fill slopes and drainage. Also, we agree fo dedicate additional right-of-way at intersections for sight distance and design :purposes and execute said right-of-way agreerr-ent forms that wil! be submitted to us by representatives of the NCDOT. The right-of-way shall be cleared at no expense to the i~tCDOT, which includes the removal of utilities, fences, other obstructions, etc. General Statute 136-102.6 (see page 29 for Statute} states that any subdivision recorded on or after October 1, 1975, must be built in accordance with NCDOT standards in order #o be eligible for addition to the State Road System.
