BACKGROUND: At its April 24, 2007 meeting, the BOCC created the Historic Roger's Road Community Enhancement Plan Development and Monitoring Task Force. The purpose of this Task Force is to develop and recommend a plan to the BOCC for the enhancement of the living environment in the historic Rogers Road Community and to monitor the implementation of the plan. The BOCC has requested a recommended enhancement plan be submitted by September 1, 2007. The Task Force met on June 6 and June 11 at the Faith Tabernacle Oasis of Love Church. Issues discussed to date are the Task Force Charge, review of various materials, Task Force process and timeline, desired outcomes, delineation of the specific Historic Rogers Road Community boundaries, and options for obtaining maximum community input into the process. The community conducted a public forum without the participation of County staff and elected officials on June 19 to talk among themselves on community priorities and desired Task Force process outcomes. The Task Force is scheduled to conduct a community information gathering meeting on June 25 at the Homestead Community Center. A written interim report will be provided at the June 26 BOCC meeting. FINANCIAL IMPACT: There are currently no expenditures anticipated related to the meeting of the Task Force. RECOMMENDATION(S): The Manager recommends that the Board receive the interim report and provide additional instructions to staff as necessary. Memorandum To: Laura Blackmon, County Manager From: Gayle Wilson, Solid Waste Director Subject: Historic Roger's Road Community Enhancement Plan Task Force. — Interim Report Date: June 26, 2006 —Revised September 7, 2007 At its April 24, 2007 meeting, the BOCC created and approved the Historic Roger's Road Community Enhancement Plan Development and Monitoring Task Force. The purpose of the Task Force is to meet with residents of the Historic Rogers Road Community as needed to determine issues they deem important for improving the quality of life in their community in order to address the concerns related to the long term presence of the solid waste facilities located in their community. The Task Force membership includes 1 Chapel Hill Resident, 2 County Commissioners, 1 Carrboro Resident, 3 Rogers Road Residents, and one Carrboro alternate. The Solid Waste Management Department is providing primary staff assistance to the Task Force. The Task Force has met on June 6, June 11 and June 25. These first two meetings were held at the Faith Tabernacle Oasis of Love International Church at 5:30. A separate Rogers Road Community residents only (no county staff or BOCC's welcome) meeting was held on June 19 to speak neighbor to neighbor about their vision of the community. The most recent meeting was held on June 25 at the Homestead Community Center. June 6, 2007 Meeting The June 6 meeting included 13 total participants and was presided over by Commissioner Carey, who will chair all of the Task Force meetings. This first meeting provided an overview of the Task Force purpose, charge, process, timeline and recapped some of the history of community interaction with the local governments regarding the landfill, other current and past neighborhood public input opportunities, etc. Participants were invited to ask questions or provide any opening comments. Considerable time was spent discussing what the actual formal boundaries of a "Historic Rogers Road Community" might include. Preliminary discussions of potential desirable outcomes of the Task Force resulted in mention of- Issue of trust • Revisiting public water & sewer issue and how to minimize costs to the community; that the government should pay all costs and give some thought to minimizing property tax increases • Chapel Hill development ordinances being too restrictive; difficulty in developing their own land; must have public water and sewer • Traffic May-13. 2009 3:44PM ORANGE COUNTY SOLID WASTE No. 2247 - P. 3 • New developments in the area; should pay their own way for sewer for example • Concern that development will push out folks from the historic area and also lower income, folks • Consider pro's and con's of all recommendations • Quality of life needs to recognize issue of fairness; fairness has costs • Septic tanks have disturbed by nearby construction and development June 11.2007 Meeting The June .11 meeting was attended by a total of 12 participants. Staff had previously met with two Rogers Road neighbors who developed a draft "Historic Rogers Road Community" boundary recommendation for the Task Force to consider. Staff answered questions regarding the proposed Transfer Station and the issue of relocating the Solid Waste Convenience Center to adjacent to the existing Hazardous Household Waste facility on the south side of Eubanks Road. Further discussion were held regarding defining the final boundaries of the historic area, perhaps including Billabong Lane, Ms. Nunn, Mr. and Ms. Street, etc. Commissioner Carey indicated an interest in obtaining a broader.input'through a public forum. Another'participant suggested that the community needed to meet among themselves first to discuss the interests and concerns of a smaller group. It was decided that this neighbor to neighbor smaller group meeting should take place on. June 19 and that county staff would provide support including maps, preparation of meeting notices, etc. as requested. The larger group public forum was scheduled for June 25. The issue arose of how to pay for whatever improvements result from the Task Force recommendations. Commissioner Carey suggested the importance of educating the public about the need to determine how any improvements will be paid for by the community at large, which has benefited from the present landfill and future transfer station being in this community. It is likely that the financing of these improvements will include a strategy that broadly spreads the burden of financing. June 19, 2007 Neighbor to Neighbor Meeting (community initiated and conducted) The Rogers Road area community held a neighbor to neighbor meeting on June 19 so that area residents could discuss among themselves and organize their input to the Task Force using broad neighborhood input and advice. The attached list of enhancements resulted fiom this meeting and was distributed at the June 25, 2007 Task Force Meeting. June 25, 2007 Meeting The Task Force sponsored a community meeting attended by about 30 Rogers Road area residents. Notices were delivered advertising this public forum by mail, email, and neighborhood handouts. The meeting was held at the Homestead Community Center. The primary objectives of this meeting were to obtain further input regarding desired 2 community quality of life outcomes and the definition of "Historic Rogers Road Community" Three breakout sessions were held so that discussion of interests and concerns could more easily take place. Each of the three breakout groups listed their top neighborhood enhancement priorities and commented on the preferred boundaries of the designated historic area. All of the breakout group's comments /requests are found on the attached enhancement list, with the following exceptions: Suggestion that property behind Park & Ride Lot could be purchased and Chapel Hill Public Works access road be built to exit at the Park & Ride Lot, not Millhouse Road. St. Paul Church purchased a 20 -acre property that holds 3 -story house and neighboring cemetery filled with history of local families. Community would like to see efforts that that section of the property be protected from demolition and preserved as a registered Historic Site. Eubanks Road needs to be widened and turn lanes installed at Landfill facilities. It is already bearing too much and is extremely unsafe and congested in the mornings especially. Street lights Pay impact stipend to property owners whose land boarders the landfill. Some comment was made regarding revisiting the transfer station siting decision. They were informed that the Task Force charge and purpose did not include reconsideration of that decision and that the Boards decision should be considered final. Summary The Task Force is making good progress in identifying and clarifying neighborhood enhancement issues. However, it is becoming clear that the Task Force's work will not be completed by September 1, 2007. We believe additional time will be required to insure that the community has time to fully discuss and understand the implications and consequences for the community as a whole, and each resident individually, of the specific outcomes they may request of the County and Towns which intended to improve the quality of life of the community. This additional time may also be necessary to develop a realistic and sound plan for financing the final list of actions /improvements /requests. The Task Force will evaluate its remaining work at an upcoming meeting and possibly suggest to the Board of Commissioners an amended timeline for completion of its work. Additionally, it was acknowledged that to substantively address many of the enhancement requests considerable consultation and cooperation between Chapel Hill, Carrboro and Orange County must take place. The Task Force will attempt to meet once during July. A primary goal of this meeting will be to finalize a recommendation for the formal designation of the Historic Rogers Road Community area. Historic Rogers Road Community Enhancement Plan Meeting June 25, 2007 7:00 PM Homestead Community Center 600 Homestead Road, Chanel Hill You are invited to a meeting at the Homestead Community Center to discuss issues local residents deem important for improving the quality of life in your Rogers Road community and to address the concerns related to the long term presence of the solid waste facilities located in the community. The meeting is sponsored by the Historic Rogers Road Task Force which was appointed by the Board of County Commissioners. The meeting will include small group discussions to encourage full participation. Orange County's Board of Commissioners (BOCC) have established a Historic Rogers Road Task Force consisting of elected officials and Rogers Road area neighbors to develop and recommend a plan, including financing options, for the enhancement of the living environment in the historic Rogers Road Community and to monitor the implementation of whatever plan is ultimately adopted by the BOCC. The discussions and recommendations made at the community meeting on June 25 will be used by the Task Force in developing its recommendations. If you are interested in or concerned about the future of your neighborhood please attend the meeting and express you opinions. The BOCC is also interested in your opinions regarding exactly what specific area should be officially considered the "Historic Rogers Road Community ". Review of Final Task Force's Historic Rogers Road Area Delineation Map for Recommendation to the Board of County Commissioners Moses Carey Expressed concern over the small number of members present at the meeting. Reviewed materials handed out for the meeting: Color coded Map of the Historic Rogers Road Planning Area, minutes of the July 17 community meeting, an agenda for the current meeting and a Revised interim Report with revisions recommended at the last meeting and the list of the combined recommended enhancements from the Community Meeting of June 17, 2007, the Neighborhood Working Group of 1997 and the Breakout Session of June 2007. Referring to the agenda noted that the first item is the Review of Final Task Force's Historic Rogers Road Area Delineation Map for Recommendation to the Board of County Commissioners. He asked for any comments about the map as it would be forwarded to the County Commissioners immediately. He pointed out that the map showed the heritage area as well as the enhancements area and the OWASA water lines. The BOCC had requested the Task Force make comments about the map and this is the first time possible to record them. Neloa Jones sought clarification concerning the location of the Green Tract on the map and asked why it was included in the map. Moses Carey said that the Green Tract was part of the original map of the area and the Chapel Hill Town Council was using the same map for its planning efforts. He expressed the importance of the area to the community. He asked if there was a consensus of the group that the map be forwarded to the Board of County Commissioners as the focus of this study area. Neloa Jones said she was confused about why the Green Tract was included in the study area because no one lived in that area. Moses Carey stated that all areas that weren't lived on could not be excluded from the Task Force's Study. He reminded the group that they were to make recommendations concerning what they wanted to be done in the community and the Green Tract may be part of those recommendations. Valerie Foushee informed the group that 18 acres of that property was delineated by the Chapel Hill planners as affordable housing. Moses Carey stated that if there were no objections to this map going to the BOCC as the focus point of the Task Force, then he would proceed accordingly. There were no objections from the group. 2) Discussion of Combined Enhancement List Items Moses Carey asked staff to explain how the list was created and what the codes mean: Gayle Wilson responded with the list of enhancement items came from the community meeting of June 17, the original list generated in Sept 1997 and some additional items raised at the June 25, 2007 Rogers Road Enhancement Plan Development and Monitoring Task Force meeting break out sessions. The codes assigned reflect the origin of the enhancement. The lists were all combined and grouped by topic. The immediate objective of the Task Force is to compile the list into a single set of recommendations without duplication and remove completed ones or items no longer relevant. Origin Key: CM — Community Meeting of June 2007 NWG — Landfill Neighborhood Working Group of 1997 BS — Breakout Session of June 2007 Each item is identified with the governmental entity with responsibility to implement /authorize. Moses Carey expressed the need to have this meeting again when more of the Task Force is present so that more input will be expressed in the recommendations of the Task Force. He asked if there were any questions about the list or comments? Audience Do we need to focus on items where Orange County is responsible for the implementation? Moses Carey said that the taskforce will look at all the items, combining when possible and eliminating when appropriate. All items will be discussed, trying to get a clear collective understanding of the items. A final list will be developed that we want to recommend to the commissioners as the list of enhancements that we want to achieve to improve the quality of life. Where would you like to start? Neola Jones said let's start with number one. Find another site for the Transfer station. 2 Moses Carey stated finding a site for the transfer station is not a charge for this committee. If you want that to stay on the list, we can, but that is not the intent of this task force. This group needs to make recommendations to improve the quality of life. Neloa Jones We could put it in bold face. The odor at OWASA has improved at the Waste Treatment plant. Does anyone know anything about why it changed? Moses Carey That is #3 on the agenda. Let's go there now and discuss it now since the question has come up. Then we will come back to the list. Gayle Wilson Paul Spire has done some research for that question. 3) Response to Question Concerning Odor/Lime Applications Paul Spire There are specific reasons for odors in or around the landfill. C &D -there is a possibility of some specific odors caused by certain products put in the C &D landfill if they are mixed with water. MSW- garbage is placed on the south side of the landfill that comes in every day and begins to decompose. Convenience Centers have boxes that are open to the air and contain decaying MSW garbage brought in by citizens. Mulch smells as it decays. When the mulch is turned, the odors go into the air. The leachate pond is another source of odor caused by moisture that seeps through the decaying material and out of the landfill into the leachate pond. Strategies to minimize odors at Orange County Landfill: Garbage that comes in each day is put in cells and packed down to minimize the odor. Mulch causes odor as it decays and the odor is spread when the mulch is turned. Mulch is turned more quickly so that the odors can be contained. Ninety eight percent of the gases that are produced as material decays are carbon dioxide and methane, which do not smell. The other 2% are the smells at the landfill. Torches have been installed at the landfill to burn off the gas so the odors are not as strong. . Other possibilities include using the gas to heat buildings in the future. The leachate pond will be channeled directly into the sewer so that the leachate will not come in direct contact with the air and lessen the odor. 3 The Solid Waste Act of 1976 required that decomposing garbage be covered to improve the environment. Now posi -shell is used which contains lime and is a hard stucco type material, both of which control odors. Certain masking agents exist to cover the smell of decaying garbage, but when it is very windy, they do not work. Others are considered an undesirable alternative. Hydrated lime is not considered an option for odor control. The lime dust is very light and small, so it blows in the wind and can be very carcinogenic to people with certain health problems. Staff consulted with DENR, who recommended against using hydrated lime in this manner. Moses Carey inquired if there were any further questions about this report. Neloa Jones requested that the taskforce discuss the odor issue for the purpose of making recommendations. Moses Carey suggested that the taskforce go back to the list of recommendations so that the recommendations can be discussed. Return to Combined Enhancements List Gayle Wilson had previously suggested to Paul Spire that a demonstration for the masking odors be set up at the landfill. The citizens around the landfill can judge the results of the demonstration. Neloa Jones For item number CM 3. Getting rid of the leachate pond should be done more quickly. She expressed the opinion that lime should be excluded but to include the masking odor that is the most effective. She also added that she thought the compactors should be used at the new convenience centers. (item #CM 20) Moses Carey Put revise next to CM 20. Are there any questions about item CM16? He went on to say that that enhancement was already being worked on. He didn't know how much success we would have, but it was being worked on. Neloa Jones For number 17, are we talking about increasing the tipping fees? Greensboro increased tipping fees to raise money for their transfer station. She said that we should find other ways to raise revenue. Jeanie Stroud thought that the citizens should not be responsible for raising revenue for the transfer station. She recommended that item CM 17 be taken off the list. CM 20 is about moving the convenience center. She wants to leave the convenience center there because she doesn't want the transfer station there. 4 Gayle Wilson There is no scenario with the transfer station that will allow the convenience center to remain where it is. Moses Carey CM 20 has already been discussed and it will be revised to include the masking odors. Neloa Jones Please leave the convenience centers on the north side and upgrade them to compactors. Once they do and have to buy a tarp, then they do not drive to the landfill without a tarp any more. Moses Carey Then NWG 29 is fully implemented. At some point we will take it off the list when we have more people here to see what we have done. Gayle Wilson NWG 30 is fully implemented and very strict. He explained the procedures that happen at the scalehouse to find out if there is a tarp and if not, one is sold to the driver. He is also instructed that he must put the tarp on the truck before he goes out on the road. Gayle Wilson NWG 31 is essentially implemented. He said that the number of pickups for the area west of the landfill is the same as for east of the landfill and not 8 times annually as in the item. He asked if the number of pickups need to be increased. Reverend Campbell expressed his frustration about how trash occurs frequently along the road. He wishes for the pickup of trash to occur more frequently, especially along Rogers Road. 5 Paul Spire indicates they will increase the number of times they pick up trash along Rogers Road. Moses Cary stated that there has already been a committee for the purpose of identifying historic sites, and there had been a report already generated. E Moses Carey indicated that we could check the previous report to see if that house and cemetery have already been identified as a historic site in Orange County. Moses Carey asked Gayle to look at Chapel Hill to see if there was a reference to this site as a historic site. We will do this research and report at our next meeting. BACKGROUND: At the May 3, 2007 BOCC meeting the BOCC created the Historic Rogers Road Community Enhancement Plan Development and Monitoring Task Force. The purpose of the Task Force was to develop and forward to the Orange County Board of Commissioners a proposed plan, including financing options, for enhancements in the historic Rogers Road Community. The Task Force was also charged with recommending the geographical size /parameters of the . Historic Rogers Road community, for which the recommended enhancements would be provided The Task Force has met seven times, with the first meeting held on June 6 and the most recent meeting on November 12. A June 26, 2007 interim report was provided. At the September 12 Task Force meeting the attached map was adopted by consensus and is being recommended to the BOCC for consideration. At the November 12 meeting the Task Force adopted a final list of community enhancement recommendations. FINANCIAL IMPACT: There will be a substantial financial impact related to implementation of many of the Task Force's. community enhancement recommendations. RECOMMENDATION(S): The Manager recommends that the Board receive the Historic Rogers Road Task Force's Recommended Historic Rogers Road Enhancements and Area Map. The list is presented below: la. Do not use Eubanks Road as a site for the transfer station. Leave the Solid Waste Convenience Center at its current location on the north side of Eubanks Road. Upgrade the convenience center waste containers to enclosed waste containers as soon as possible.. This will ' help reduce odor and the number of rodents escaping into the Rogers and Eubanks Roads communities. Orange County lb. Extend water and sewer mains be extended to provide public service to the recently endorsed Rogers Road Community Enhancement Area, (which is the landfill impacted area), including Ms. Nunn's property, at no cost to any of the residents. The Task Force further recommends that water and sewer connections and OWASA impact fees for these connections be provided to the Rogers Road Community Enhancement area at no cost to any of the residents. Orange County, Chapel Hill, and Carrboro should utilize Community Development Block Grants, other grants, or local funds where allowed by state law to pay for adding water and/or sewer mains, house connections, and OWASA impact fees. Chapel Hill, Carrboro, Orange County and OWASA 2. Reduce the odor from the landfill and convenience center now!! Pursue a masking agent atomization for landfill working face. Complete landfill leachate sewer project to eliminate leachate storage basin as soon as possible. Confer with OWASA and utilize best management practices for the landfill industry to control odor and vermin., For finance: lease the landfill areas to a private company that can harvest the methane gas for profit and to help in odor reduction. Orange County and Chapel Hill 3. Build a barrier wall (beginning with below the surface of the ground) to impede stop rodents and other animals from leaving or entering the landfill and to decrease noise, improve air quality. Plant more trees and other vegetation to obscure the view of the landfill mount. Orange County and Chapel Hill 3 4. The Task Force recommends that water and sewer mains be extended to provide public service . to all of the Task Force recommended Community Enhancement Area (map attached), including Ms. Nunn's property. The Task for also recommends that Orange County, Chapel Hill, and Carrboro provide public water and sewer in the Community Enhancement Area where water and sewer service are to be extended in paying the costs of connecting to water and sewer. This assistance can take the form of Community Development Block Grants, other grants, or local funds where allowed by state law. Costs for all residents should be eliminated or minimized to the extent possible. Chapel Hill, Orange County, Carrboro, and OWASA 5 Institute a moratorium on property taxes. Pay for /subsidize future taxes for the residents in the community enhancement area for as long as any solid waste facilities remain in their community. Pay impact stipend to property owners whose land is adjacent to the landfills. Be vigilant about not allowing residents to lose their homes and/or property because of their inability to pay taxes; advocate for residents who become at risk of losing their homes and/or land due to inability to pay property taxes. Return property taxes paid from the time of the opening of the landfills. (This would include Millhouse Road residents.) Orange County 6. Build park and other recreation facilities within the Rogers Road Community Enhancement Area such as basketball and park type equipment: jungle gym, swings, picnic tables, benches. The Parks and Recreation Department should maintain these facilities. Children within the Enhancement Area should be provided summer youth employment opportunities. Chapel Hill, Carrboro and Orange County 7. Add NCDOT traffic calming bumps on Rogers Road and decrease speed limit to 25 mph. The Task Force recommends that Orange County erect "Children Playing" and "School Bus Stop signs on Rogers Road. Residents of the Community Enhancement Area will identify appropriate locations for these signs. Chapel Hill, Orange County, Carrboro, and DOT 8. Add sidewalks to both sides Rogers Road from Homestead Road to Eubanks Road. Chapel Hill and Carrboro 9. Widen Eubanks Road and add shoulders and turn lanes at landfill facilities. These areas are extremely unsafe and congested — especially in the mornings. Given the garbage and UPS trucks and city buses, Eubanks Road is too narrow to be safe. Chapel Hill, Orange County, Carrboro and DOT 10. Bring the bus service down Rogers Road at least three times (morning, noon and evening). The Task Force also recommends that Chapel Hill Transit re -route the North -South connector bus 2 4 line to serve Rogers Road on either its northbound or southbound trip, beginning as soon as possible. For the duration of the 2007/2008 service year, the Community Enhancement Area should be designated as a Shared Ride Feeder Zone. Build an enclosed and lighted waiting area at the bus stops. Chapel Hill and Carrboro . 11. Add publicly financed street lights for public roads and streets. Chapel Hill and Carrboro 12. Add fire hydrant north of Edgar Street, between the properties of Tim and Edward Peppers and Nola Mae West. This hydrant will service properties that presently are more than 400 feet and as far as 1500 feet from a fire hydrant. Chapel Hill 13. Modify building, zoning, and other ordinances that make it difficult/impossible for landowners in the Community Enhancement Area to develop their property. Chapel Hill, Carrboro and Orange County 14. Do not allow industrial zoning. Do not allow any zoning that makes this community vulnerable to big developers. Chapel Hill, Carrboro and Orange County 15. Do not allow any large development (including affordable house) on Purefoy Drive that has no other means of egress into the Purefoy, Sandberg, and Edgar Road area other than Purefoy Road. Chapel Hill 16. Ensure adequate representation of this community in local government'decisions that affect this community, including land use ordinances. Orange County, Chapel Hill, and Carrboro 17. Re -unify this community by de- annexing the west side of this community from Carrboro. Carrboro Do not divide this community between different jurisdictions. Do not annex this community Carrboro and Chanel Hill 18. Document in writing all meetings concerning this neighborhood and have these documents officially recorded and filed. Orange County, Chapel Hill, Carrboro 19. The Task Force recommends that residents living near the Orange Regional Landfill take initiative in identifying perpetrators of illegal dumping near the landfill to assist in successful prosecutions. Identification of vehicles, license tags, drivers, and/or types of articles discarded should be made when possible. The BOCC should coordinate with the Orange County Attorney to pass legislation, which provides for civil penalties for illegal dumping to make it easier to penalize people who litter or dump. In addition, the BOCC will publicize the names of those convicted of illegal dumping. The BOCC should increase enforcement of anti- dumping laws in the Community Enhancement Area. 3 5 The Task Force recommends that additional No Littering" signs be erected in the neighborhoods near the landfill. Orange County 20. Allow power to be turned on in power outages in a different order so we are not next to last every time. Duke Power 21. Pay more attention to our roads during ice and snow events. Chapel Hill, Carrboro, and DOT 22. Expand fire, EMS, and sheriff services as soon as possible. Chapel Hill, Orange County Carrboro 23. St. Paul Church purchased a 20 -acre property that holds 3 -story house and neighboring cemetery filled with history of local families. Community would like to see efforts that that section of the property be protected from demolition and preserved as a Historic Site. The house was recorded as part ofa countywide survey for historic properties or historic architectural resources in the early 1990's These countywide surveys were conducted throughout the state in conjunction with the North Carolina State Historic Preservation Office. This particular house was first recorded in 1992 and re- surveyed during 2006 update.
