EXECUTIVE SUMMARY Orange County is working with retired colonel William Breeze Sr. to complete the protection of his historic 295 -acre family farm in rural Orange County. ADFP funds are requested to complete Phase II of a planned two- phased project. Phase I was completed in April 2008 when the County purchased a conservation easement on 141 acres with matching funds from the USDA Farm and Ranch Land Protection Program (FRPP) with 18% of the easement value donated the landowner. In this Phase II of the project Orange County will purchase a perpetual conservation easement on the 153 -acre eastern half of the farm. The County requests $290,000 in ADFP funds, which will be matched by $189,000 in County funds and a landowner donation of 20% of the easement value ($118,000). This ADFP project would contribute to a larger public - private collaboration involving the Breeze family, NC State University, Orange County and US Department of Agriculture. The result will be 564 contiguous acres of protected prime farmland in an area with good access to markets and with opportunities to further agricultural research and education. XI. PROPERTY BACKGROUND AND HISTORY A. Please describe operations ownership and history of agricultural operations. Colonel William Breeze and his late wife Elizabeth purchased "Blue Bonnet Farm" in 1947. From 1947- 1970 they raised tobacco and row crops. From 1970 -1998 he raised Charolais beef cattle (125 -130 head), along with corn, soybeans and small grain. Since 1998 he has leased the land to two area farmers who raise cattle (40 head), hay, corn, and small grain (wheat). Colonel Breeze retired from farming in 1998, and now lives off -site in nearby Durham. He is sole owner of the farm and continues to make all the decisions regarding its future. Colonel Breeze recently updated his Conservation Plan with the Orange Soil & Water Conservation District. For the past 20 years he has managed the woodlands with a forest management plan and guidance from Bernard & Dryman, Consulting Forestry Inc. The farm is enrolled in the NC Forest Stewardship Program (since 1994). B. What values does this easement hold? The conservation easement will protect highly productive agricultural land, which features prime or statewide important soils (Georgeville B /C), productive timberland, forested stream corridors (Little River public water supply watershed), and scenic views along Schley Road (SR 1548). The farm also has historic /cultural values associated with the early settlement of Orange County, including a late 18th century home site and mid -19th century log cabin. The farmstead is also on the National Register Study List. Finally, this proposed ADFP project is part of a larger public - private collaboration in farmland conservation involving the Breeze family, NC State University, Orange County and US Department of Agriculture. A conservation easement on half of the farm was completed in April 2008 with funding assistance from the USDA Farm and Ranch Land Protection Program. C. How will it benefit the landowners to place their property in an easement? Colonel Breeze was born on the adjacent farm (1918), which he donated to NC State University for agricultural research and development. He purchased the subject property in 1947, and perserving the entire farm complex (560 acres) will help to further the his family's agricultural legacy. The "bargain sale" of the conservation easement will help to compensate him for this permanent commitment. Colonel Breeze hopes to take advantage of new federal and state tax benefits available for partial donations of farmland conservation easements. Colonel Breeze's daughter (Ann Breeze Sebesan) lives across the road from the easement property, and upon her father's death she will own the farm and remain proud of her parents' role in preserving agriculture as a way of life in Orange County. What, if any, projected changes will the operators establish in the future? (Examples include future products, livestock operation, shifts in markets, new tree plantings, etc.) Colonel Breeze has no immediate plans to change the current operations. He continues to lease the property to two area farmers (Bill Latta and Darnell Hester) who operate the farm in accordance with a recently updated SWCD Conservation Plan. Mr. Hester, however, is 70 years old and is transitioning away from active farming. He currently raises beef cattle (40 head) on the property. So Mr. Latta may assume a larger role or Colonel Breeze might lease to another farmer. [Mr. Latta and his brother operate the nearby Latta Dairy, which is also protected by a conservation easement held by Orange County.] B. Has a formal notarized estate plan been done for this property? (Please describe the measures taken to ensure the successful transition of the property to the next generation of producers.) Colonel Breeze has an formal, notarized estate plan prepared by attorney Doug Hargraves of Hillsborough. Upon his death Colonel Breeze will bequeath the 295 -acre farm to his two adult children. The western half will be deeded to his son Bill Breeze Jr. (Tract 1 in Figure 3) and the other eastern half to his daughter Ann Breeze Sebesan (Tract 2). Mrs. Sebesan and her husband reside on land that they own directly across Schley Road from the easement property. Both children are both supportive of protecting the farm with a conservation easement, and both have been active participants in drafting the terms of the easement agreements. The conservation easement on Tract 1 (141 acres) was completed in April 2008 (Phase 1). If ADFT grant funds are awarded the easement on the eastern 153 acres should close in Fall 2009. When the farm is divided and conveyed to the children, both Mr. Breeze Jr. and Mrs. Sebesan will continue leasing the farm to area farmers. If they decide to sell the farmland (encumbered by the easement) it would likely be to farmers interested in continuing agricultural activities. The proximity to the NC State agricultural research facility makes it a highly attractive and sought -after location. Moreover, the farm is located in an agricultural community with good access to farm markets. C. Has a written business plan been developed? XIII.THREAT OF CONVERSION A. Is there a threat of conversion? 11 • ■ B. If YES, please describe the conditions that threaten project. Is the property subject to potential forced sale or estate settlement sale? Is the property actively marketed for voluntary sale? (Please include neighboring tracts, road frontage, development pressure, sewer, and zoning issues etc.) Colonel Breeze wants to protect the farm he has owned since 1947so there is no immediate threat of conversion. But at age 90, he is no longer farming the property himself; it is leased to two area farmers. Neither Colonel Breeze's son nor daughter are farmers, however both are committed to conserving the farm. But if the land is not protected by a conservation easement, it is highly likely that future owners would divide the farm into smaller parcels and convert portions to non - agricultural uses. Many factors contribute to that threat of conversion. Breeze farm has 4,800 feet of frontage along highly scenic Schley Road. [Tract 2 has 1,500 feet of road frontage.] The farm is situated between NC 86 and NC 57— Page 9 of 17 Easement Application principal north -south road corridors leading to Hillsborough. The farm is just 5 miles from historic Hillsborough (county seat), and Chapel Hill, Durham, and RTP are also in commuting distance. The property was appraised in 2004 and updated in 2007. In those 3 years, the market value increased from $3,500 /acre to $6,000 /acre. The easement value increased from $1,564 /acre to $3,993 /acre. Breeze farm is 2.5 miles west of Pleasant Green Farm subdivision on Schley Road. The first two 10 -acre lots sold for $370,000 (a record price for 10 -acre lots in Orange County). C. CONSERVATION AND ENVIRONMENTAL CONCERNS A. Please describe any conservation and environmental practices and assistance programs currently associated with the project. Col. Breeze has long been a true steward of the land. He has installed many conservation practices over the yearswith assistance and guidance from the Orange NRCS /Soil and Water Conservation District. including Grassed Waterways, Field Borders, Conservation Tillage, Conservation Crop Rotations, and Upland Wildlife Habitat (See the enclosed SWCD Conservation Plan). The Breeze farm is enrolled in the NC Forest Stewardship Program (since 1994), and in 2008 was recognized by the NC Division of Forest Resources for the outstanding management of his forst land. There is also a forest management plan for the farm, administered by Bernard & Dryman, Consulting Forestry, Inc. In 2008 the NC Forest Service presented Colonel Breeze with a certificate recognizing a NC Champion Big Tree located in front of the farmhouse (American Holly - 61 feet tall, 91" dbh). Colonel Breeze has graciously allowed agencies such as the USDA Natural Resources Conservation Service to use his farm for numerous training sessions where new conservationists learned to design and install conservation practices. SCOPE OF WORK Applicant Name: orange Count Applicant Tax Identification Number: 56- 6000327 Project Title: Breeze Farm Conservation Easement Phase II A. What is the purpose of the project? Orange County is working with retired colonel William Breeze Sr. to protect his historic farm (295 acres) with perpetual conservation easements in two phases. Phase I was completed in April 2008 when the County acquired an easement on 141 acres with matching funds from the USDA Farm and Ranch Land Protection Program (FRPP) and a partial easement donation by the landowner. Phase II of the project would be a perpetual conservation easement on the 153 -acre eastern half of the farm (Figure 5). Orange County requests $290,000 from the ADFP Trust Fund to purchase the easement. The County would provide $189,000 in matching funds and Colonel Breeze intends to donate 20 percent of the easement value ($118,000) as determined by a certified appraisal. The deed of conservation easement for Phase II would have similar terms as the Phase I easement agreement (subject to ADFP Trust Fund approval). It would allow one future residence and new farm structures located in a designated "farmstead envelope." Forest management would also be allowed to help derive future income for the property. B. What community need(s) will the project serve? The conservation easement would help guarantee that this prime farmland will remain available for agricultural use in the future, which is especially important in the Triangle Region where farmland is being converted to other uses, yet there is an ever growing demand for local food products. Protected farmland provides the community with more certainty, which stimulates investment in local farm infrastructure. This project would contribute to larger public - private partnership resulting in 564 contiguous acres of protected prime farmland in an area with good access to markets and with opportunities to further agricultural research and education. The planned 153 -acre easement is adjacent to 141 acres of the Breeze farm that was protected with an Orange County conservation easement in April 2008. The project is also 0.6 miles from the State -owned W.C. Breeze Family Farm Agricultural Extension & Research Facility -- a 269 -acre farm managed by NC State University (Figure 2). Colonel Breeze and his late wife Elizabeth donated the majority of that property to the University in 2003. The NC State facility includes a "new farm enterprise incubator" managed by NC Cooperative Extension. The conservation easement will also help to protect an historic farmstead complex located on the Breeze Farm. The farm is recognized by the NC Department of Cultural Resources as the proposed Ray - Kenion National Historic District (National Historic Register Study List). Finally, the protection of this farmland will contribute to the rural character along this highly scenic section of Schley Road in northern Orange County (Little River Township). C. Are other organizations, programs, projects, etc. serving this community need or these community needs? If yes, how is this project different/why is this project necessary? Orange County intends to acquire the conservation easement through its Lands Legacy program. Since Lands Legacy was established in 2000 the County has acquired 13 agricultural conservation easements that protect 1,277 acres of farmland. In all cases matching funds were contributed by outside sources, including the NC Farmland Preservation Trust Fund (2001). The completion of this project is particularly important because of the high regard that Orange County citizens have for Colonel William Breeze. His land conservation and stewardship efforts have been recognized widely in the agricultural community, and his placing a conservation easement on this farm will certainly influence others in the community to consider doing the same thing. Page 12 of 17 Easement Application D. Are there sustainability plans for the project? If yes, please describe. If not, please explain why. When the larger farm passes to Colonel Breeze's children (Wm Breeze Jr. and Ann Breeze Sebesan) both are expected to continue leasing the farm to area farmers. if they decide to sell the farmland (encumbered by the easement) it would likely be to a farmer interested in continuing agricultural activities. The proximity to the adjacent NC State agricultural research facility makes it an attractive location. Moreover, the farm is located in an agricultural community with good access to farm markets. It is five miles from downtown Hillsborough (county seat), which has two farmers markets and Weaver Street Market featuring locally -grown food. Orange County is working to establish regional Shared Use Food Processing Center (awarded an ADFP Trust Fund grant in 2008), which would be a tremendous asset to area farmers.
