PURPOSE: To hold a required public hearing and approve submitting an application for
American Recovery and Reinvestment Act (ARRA) funds for rural transit projects.
BACKGROUND: On February 17, 2009 President Barack Obama signed into law the American
Recovery and Reinvestment Act of 2009. These funds are only eligible for capital projects and
are intended to preserve and create jobs, provide investments needed to increase economic
efficiencies, invest in transportation infrastructure, and stabilize state/local government budgets.
The Federal Transit Administration has awarded North Carolina non-urbanized areas $33.05
million to stimulate the economy. The North Carolina Department of Transportation, Public
Transportation Division requires a public hearing to ensure the residents of Orange County are
aware of the request for ARRA funds before submission. The application is due to NCDOT no
later than May 18, 2009 for review/acceptance by the North Carolina Board of Transportation.
All awarded funds will be presented to Orange County Finance/Budget offices as
reimbursement and must be spent no later than June 30, 2011. The following requests would
assist Orange County in achieving the above mentioned intentions:
A. Rolling Stock: Replace eight (8) vehicles in the transit fleet that are no longer in service
or require high maintenance costs. Two of the vehicles were approved in the FY
2009/2010 CTP grant application. All Vehicles will offer additional seating and will be
diesel. Requested amount: $1,517,600
B. Associated Capital: Purchase shop equipment and spare vehicle parts to provide
safe/faster maintenance of vehicles. Purchase four(4) bike racks for public transit
vehicles. Promote alternative transportation by providing bike riders a safe storage on
public transit vehicles. Requested amount: $69,890
C. Facility Improvement: Install steps and hand rails at the Transportation vehicle parking
lot. Allow safe access for all employees to the vehicles.. Requested amount: $8,500

D. Facility Construction: Purchase a bus stop shelter to be located in the Hillsborough
downtown area. This provides a comfortable stop and should encourage additional
public riders. Requested amount: $6,750
E. Advanced Technology: Purchase transportation scheduling software that will interface
with Chapel Hill Transit software system. Future coordination between E Z Rider and
Orange Bus will be possible with this application. Requested amount: $65,000
F. Preventative Maintenance: Request funds to assist with the maintenance of the transit
fleet. These funds would reduce the amount of funding Orange County needs to ensure
a safe and reliable transit fleet. Requested amount: $98,522
G. Mobility Management: Hire atime-limited (22 months) staff person to enhance and
market public transit in Orange County. This position would coordinate transportation
services with Human Service organizations, operate. transportation brokerages to
coordinate service providers, support local and state partnerships, provide travel/trip
training, and short term management for implementing coordinated services. Requested
amount: $94,400
FINANCIAL IMPACT: Total amount requested is $1,860,662. There is no local match required
and the funds will be dispensed for 22 months only.
RECOMMENDATION(S): The Manager recommends the Board hold the required public
hearing on the ARRA transit application and authorize the Chair to sign the resolution to submit
the application and to accept the funds if approved.

WHEREAS, the "American Recovery and Reinvestment Act, 2009" (Pub. L. 111-5; °ARRA"), signed into law by President
Barack Obama on February 17, 2009, includes 58.4 billion for transit capital Improvements, for which the intent of the
legislation is to: a) preserve and create jobs and promote economic recovery; b) assist those affected negatively by the
recession; c) provide investments needed to increase economic efficiency by spurring technological advances: d) invest in.
transportation infrastructure that will provide long-term economic benefits; and e) stabilize State and local government
budgets, in order to minimize reductions in essential services and counterproductive State and local tax increases; and
WHEREAS, the ARRA provides $680 million of the 56.9 billion available under the Transit Capital Assistance Program, to
nonurbanized areas based on 49 U_S.C. section 5311; and
WHEREAS, the nonurbanized area funds are apportioned based upon the nonurbanized population of each state relative
to the national urbanized area and land area in nonurbanized areas, of which the Stat® of North Carolina has been
apportioned $33 million, and, after required set-asides for intercity projects and state administration costs, North Carolina
has announced the availability of approximately $24.7 million to fund eligible transit capital projects, as defined in
49 U.S_C. 5302(a)(1), in nonurbanized areas; and
WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes and the Governor of North Carolina have
designated the North Carolina Department of Transportation t;NCDOT) as the agency responsible for administering
federa( and state public transportation funds; and
WHEREAS, the purpose of these ARRA transportation funds is to provide grant monies to local agencies for rural public
transportation capital improvement proj®cts consistent with the intent of the legislation and to support efforts to stimulate
the economy; and

Statutes, regulations, executive orders. Section 5333 (b) Warranty, and all special Federal and State r®porting

PUBLIC HEARING NOTICE
This is to inform the public that a public hearing will be held on the proposed American
Recovery and Reinvestment Act of 2009 Application to be submitted to the North Carolina
Department of Transportation no later than Mav 18, 2009. The public hearing will be held on
Mav 5, 2009, 7:00 p.m. at the Central Orange Senior Center, 103 Meadowland Dr,
Hillsborough, N.C before the (governing board) Orange County Board of Commissioners.
Those interested in attending the public hearing and needing either auxiliary aids and services
under the American with Disabilities Act (ADA) or a language translator should contact AI
Terry, Transit Manager, 919-245-2008 on or before Mav 4, 2009.

The Community Transportation Program provides assistance to coordinate existing
transportation programs operating in Orange County as well as provides transportation options
and services for the communities within this service area. These services are currently provided
using Fixed routes, subscription routes, demand response routes, and deviated fixed
routes. Services are rendered by Orange Public Transportation (Orange Bus).
