Tuesday, March 18, 1975
The Board of County Commissioners of Orange County met in regular session on Tuesday,
March 18, 1975 in the Commissioners Room of the Courthouse in Hillsborough, N. G., at
8:00 p.m.
All members were present.
Chairman Garrett called the meeting to order and stated the first item of business
would be the hearing of an appeal of the University of North Carolina (The State of North
Carolina) to the decision of the Orange County Tax Supervisor to assess certain properties
of the University of North Carolina for ad valorem tax purposes.
Chairman Garrett called upon the Tax Supervisor to read the list of properties he is
requesting the Board of Commissioners to assess.
The Tax Supervisor presented the following lists of properties to be assessed, their
proposed assessment, and the years for which each should be taxed.
"This is to notify-that pursuant to North Carolina General Statutes 105-278.1,
105-312 and other applicable law the property described in the attached exhibits
held for the use and benefit of the University of North Carolina at Chapel Hill,
has been listed for the years indicated in the name of the State of North
Carolina tentatively appraised at the indicated valuations by the Tax Supervisor
of Orange County for ad valorem taxation.
The listing of this property and its tentative appraisal will be presented to
the Board of County Commissioners for review and approval at 8:00 p.m. on
Tuesday, February 18th, 1975 in the Commissioners Room of the County Courthouse
in Hillsborough, N. C.
The State of North Carolina has a right to be present at this meeting, to be
heard, and to present any objections it may have to the listing or appraisal
of this property.
This is the 30th day of December, 1974."

At conclusion of the reading of this list, Chairman Garrett recognized representatives
of the University: Dr. Clayborn Jones, Vice Chancellor for Business and Finance, Honorable
Myron Banks from the staff of the Attorney General representing the University and the
State, and Mrs. Grace Wagner, Property Officer of the University.
Mr. Banks assumed the floor and asked the Tax Supervisor if this were all the propertie:
the County had under consideration for assessment. The Tax Supervisor replied there was
one other parcel to be added to this list, a nine (9) acre tract known as the Carmichael
Property.
Mr. Banks then objected to the listing and appraisal of these properties and gave
notice to the Board of Commissioners that he intends to appeal any decision adverse to the
University to the gate Property Tax Commission.
Mr. Banks also requested the Board of Commissioners file copies of their decision with
himself, Dr. Jones, and Mr. Bruce Lentz, Director of the State Department of Administration
as soon as possible.
Mr. Banks stated the County has no authority to assess property owned by the State
and University. Since 1789 the General Assembly has decreed that property of the State
and University is exempt. At present Chapter 116.ffi a classification Statute classifies and
exempts property of the University from ad valorem taxation. Mr. Banks also filed with the
Board a copy of the opinion by the Attorney General dated January 16, 1975 concerning the
ad valorem tax status of property held by the University of North Carolina.
At the conclusion of Mr. Bank's presententation, Commissioner Pinney moved that the
assessments previously read by the Tax Supervisor be confirmed.

Commissioner Gustaveson offered a second to Co_missioner Pi.nney's vote.
Chairman Garrett called for a vgte and all members voted aye. The motion was passed.
Chairman Garrett stated the Board had several appointments to make:
A. One vacancy exists on the Emergency Medical Service Council
Commissioner Jan Pinney moved Mr. Si11 heriford be named to replace Mr. Carl
Smith Smith who has resigned. Commissioner Richard Whetted offered a second.
Vote: Ayes 5 Noes 0
B. One vacancy exists on the County Council on Aging.
Commissioner Riehazd Whetted suggested that consideration of this appointment
be deferred until the meeting pn April 7.
The members agreed to commissioner whitted's request.
C. One vacancy exists on the Carrboro Soard of Adjustments.
Commissioner Jan Pinney moved that Mr. Essel Womble be appointed to the Carrboro
Board of Adjustments.
Commissioner Richard Whetted offered a second.
Vote: Ayes 5 Noes 0
D. One vacancy exists on the County Soard of Adjustments as an alternate member.
• Chairman Garrett moved Mr. Gregg Garneau be named to this position.
Commissioner Pinney offered a second.
Vote Ayes 5 Noes 0
E. One vacancy exists on the County Soard of Adjustments. Dr. S. Logan Irvin's
term has expired.
Commissioner Norman Walker moved Mrs. Christine Lockhazt be named to replace
Dr. Irving. There was no second to Mr. Walker's motion.
Commissioner Pinney moved that consideration of this appointment be deferred
until the meeting of April 7th.
Commissioner Gustaveson seconded this motion.
Vote: Ayes 5 Noes 0
Chairman Garrett stated that the Board would now consider the RSVP matter.
Commissioner Norman Walker requested that Social Services Director Tom Ward
be allowed to speak concerning the new Title 20 Programs being implemented by
the Department of Health, Education, and welfare, as they are quite possibly related
to the RSVP Matter.
Mr. Ward stated a new title to the Federal Social Security Act had been
implemented covering a wide range of social programs that would be administered by
agencies other than the Social Services Department. Application far grant funds
under this title must be approved by the local Social Services Department.
He felt that there was a distinct possibility thSt the RSVP Program might
qualify for a 75% - 25~ grant under this title.
The Human Services Department Director from Chapel Hill stated that presently
the RSVP Agency was funded under Title 8 of the E.ocial Security Act and that their
application for the fiscal year 1975-1976 must be submitted before March 31, 1975.
The Tow±l Administrator of Chapel Hill was requesting that the County shaze.l/3 of
t'^e local portion of this budget or $4,193.00.
Commissioner Whetted moved the County issue a letter of commitment to the
Human Services Department of the Town of Chapel Hill stating that the County
would assume 1/3 of tre local cost of tis program up to $2,193,000.
Commissie:er Gustaveson offered a second.
Vote Ayes 5 Noes O. The motion was declared passed.
In a non agenda item the Board heard Mrs. Katherine Wright representing the
owner of a tract of property recently acquired from UNC by her client. The County's
action in assessing this property of UNC placed a lien on the land that her client
has acquired.
The chairman requested that Co•.inty Attorney review this matter with Mrs. Wright
and attempt to make some resolution of the situation.
Mr. C. D. Jones delivered to the Soard of Commissioners copies of a brochure

developed by the Orange County Medical Foundation concerning the proposed Medical
Office proposed to be built in Hillsborough.
