HomeMy WebLinkAboutMinutes - 19741015 The Register of Deeds presented the following request: This is to certify that on September 16, 1974, the law firm of Harriss & Ruis did present tv the Prange County Register of Deeds office fdr recording a deed dated September 16, 1974, from Willia-n R. Winders, Trustee for Larry 0. Marlin, bankrupt, to A. E. Morgan and wife, Phyllis H. Morgan. The Register of Deeds office did collect from the firm of Harriss and Ruis the sum of seventy nine ($79.00) dollars for documentary stamps. It has since been learned that the documentary stamp law did not apply to this purchase. Said law did not apply for the following reasons: Quote taken from a letter dated September 17, 1974, from William R. winders, Attorney, to the law firm of Harriss &.Ruis. "the 1974 Bankruptcy Guide, page 30: 'Tn the sale of real estate, the Trustee does NOT pay for documentary stamps, since they are considered to be a state tax;...'.' The request for reimbursement of seventy nine ($79.Op) dollars is authorized under G. S. 105-405.1. Upon motion of Commissioner Henry S. Walker, seconded by Commissioner Flora Garrett, it was moved and adopted that the County Accountant be authorized to refund $79.00 to William R. Winders, Attorney at Law of Durham, N. C. The County Administrator presented a letter from the Orange County Emergency Medical Council. Said letter requested the Board to make two recommendations to the Emergency Medical Council. Upon motion of Commissioner Richard E. Whitted, seconded by Commissioner Melvin Whitfield, it was moved and adopted that Fred Parker and Dr. Thomas Griggs be recommended to the Region J Emergency Medical Services Council. There being no further business to come before the Board the Meeting was adjourned. ~~ ~ C. Approved: MINUTES DF THE ORANGE COUNTY BOARp OF COPIPII5SIONERS October 15, 1974 The Board of County Commissioners of Orange County met in regular session on Tuesday, October 15, 1974, at S o'clock p.m. in the Commissioners Room at the Courthouse in Hillsborough, N. C. Members Present: Chairman Norman Walker, and Commissioners Flora Garrett, ! Richard E. Whitted and Melvin Whitfield. I, Members Absent: Commissioner Henry S. Walker The minutes of the September meetings were reviewed and Commissioner Melvin Whitfield stated that there was one correction that needed to be made in the minutes ~ of September 3rd meeting. The correction being the request of Mr. Dobson to require a lot size of 40,OOD square feet prior to the issuance of a building permit or mobile home Installation. The Clerk was instructed to correct the minutes of September 3, 1974. ~i% 418 Upon motion of Commissioner Richard E. Whitted, seconded by Commissioner Melvin Whitfield, it was moved and adapted, that the September minutes be approved. Chairman Walker refereed to Item I on the Agenda: (Pearson Stewart and Mark surnhams A. Discussion of the Community Improvements Act. B. Response to the Farmers Home Administration Inquiry. "Is the proposed Hillsborough sewer plant consistent with County Water and Sewer plans:") ~ A. Pearson Stewart of the Triangle J Council of Governments filed, With the Board, a copy of a report entitled "Community_Deyelopment Title I of Housino and Communit Develo ment Act of 1974." He then proceeded to review the~~requirements for making application under "Community development Title I of Housin and Commun- ._ ~L.._.._.__ Sty Development Act of 1974." B. The County Administrator presented a letter dated October 10, 1974 from the Town of Hillsborough with the request that the Board reply to the Farmers - Home Administration question. Said letter stated "Farmers Home Administration requires that any sewerage system be consistent with the County water and sewer development plans. Please advise if the proposed system is consistent with the County water and sewer plans." Chairman Walker asked Mark Burnham to comment on the request. Mr. Burnham presented the plan that was made entitled "Research Triangle Development Guide _ A rim 1 1969." He reviewed the proposals contained ih the guide and stated that~the guide had proposed a downstream flow for a new sewerage plant, however, tfie money situation for the Town of Hillsborough makes it impractical for them to change the current location of sewer lines. Chaff=man Walker stated that the next items of business had not been included on the Agenda, however, with the Board's permission he would like to recognize John Eaton, Director of the Hillsborough Activity Center. Mr. Eaton requested the aoard to declare the week of October 21-26 as "Count The Children Week." He stated that the purpose of this week was to bring to the recognition of the citizens of the state that there was a need to identify mentally and handicapped children as there was now an effort being made to assist these children. A voluntary census will be taken during "Count The Children Week." Uppn motion of Commissioner Flora Garrett, seconded by Commissioner Richard E. Whitted, it was moved and adopted, that the Orange County Board of Commissioners proclaim October 21-26 as "Count The Children Week." Chairman Walker recognized Sim Efland. Mr. Efland inquired as to what had happened to the Industrial Development Committee that had been appointed some - years previously by the Board of Commissioners. He stated that job opportunities are going to be needed in this area and he felt that this committee shpuld be - pursuing industrial growth for the area. i Chairman Walker referred to Item III on the Agendas (Continued discussion of renting office space outside the.Covrthouse.) The County Administrator advised the Board that he had been able to locate four (4) office spaces outside the Courthouse. He stated that three (3) of these spaces could be rented for $175.00 per month and that one (1) of these spaces could be rented for $135.00 per month. Mr. Gatos stated that the lack of space is critical and that there were five (S) additional employees who were being hired, but there was no office space available for the new personnel in the Courthouse and that some of the offices now located in the Courthouse must be moved to other areas. Discussion ensued. Upon motion of Commissioner Flora Garrett, seconded by Commissioner Richard E. Whitted, it was moved and adopted, that $2,000 be taken from the Contingency Fund to be used for renting additional office space. The County Administrator was authorized to proceed with the matter of allocating all office space. Chairman Walker referred the Board to Item TI on the Agendas (Continued discussion of the proposed County Recreation Ordinance.) The proposed Ordinance was reviewed and Commissioner Flora Garrett had suggested some minor changes in said Ordinance. Discussion ensued. It was agreed that a Public Hearing on the proposed Ordinance Relating to Public Recreation and Parks for Orange County would be held on Tuesday, November 19, 1974, at 8 P.M. in the Superior Courtroom at the Courthouse in Hillsborough and the Clerk was instructed to send copies of the amended Ordinance to all - members of the Recreation Committee. The matter of the Sedimentation Task Force Committee was brought before the Board. Discussion ensued on the proposed Task Farce Committee members. _~ Commissioner Flora Garrett pointed out that there would be a Erosion and Sediment Control Seminar and that she would like to have the members of the committee attend the seminar. Upon motion of Commissioner Flora Garrett, seconded by Commissioner. Richard E. Whitted, it Was moved and ddopted, that Quentin Patterson, Ebert Pierce, Kurt Jenne, Sam.Gattis, P. A. (Arnie) Vesilind, Bruce Crumpton, William Breeze, James Freeland, Charles Johnston, Shelton Merritt, Roy Wilkerson, Thomas Gates, George Tate, Mark Burnham and Bill Campbell be appointed as members of the Citizens Sedimentation Task Force and that the membership be left open far additional nominees of persons who were interested in the sedimentation problem. L~ v ~~9 It was agreed that an organizational meeting would be held on Tuesday, October 29, 1974, at 8 P.M. in the Commissioners Room at the Courthouse in Hillsborough. Commissioner Flora Garrett agreed to serve as Acting Chairman for this meeting. The Clerk was instructed to write each member of the Citizens Sedimentation Task Force advising them of the scheduled organizational meeting and to enclose data concerning the erosion and sedimentation seminar. The Clerk was also requested to write the Towns of Mebane, Hillsborough, Carrboro, and Chapel Hill requesting them to appoint a member to the Citizens Sedimentation Task Farce. Chairmen Walker advised the Board that the week of October 20-26 was being observed as National Business Women's Week and that the Board had been asked to adopt a Proclamation. Upgn motion of Commissioner Richard E. Whitted, seconded by Commissioner Melvin Whitfield, the following Proclamation was unanimously adopted: W~[ERBAS, the National Federation of Business and Professional Women's Clubs, Inc., is celebrating National $usiness Women's Week the third week of October; and WHEREAS, the Hillsborough Business and Professional Women's Club, Inc., is composed of over thirty members and it is the only Business and Professional Women`s Club in this county and it is celebrating this event concurrently with the North Carolina Federa- tion of Business and Professional Women`s Clubs, Inc. and the National Federation of $usiness and Professional Women's Clubs; and WHEREAS, the objectives of these celebrants are to elevate the standards of women in business and in the professions; to promote the interests of business and professional women; to bring about a spirit of cooperation among business and professional women of the United States; and to extend opportunities to business and professional women through education along lines of industrial, scientific, and vocational activities; and WHEREAS, these women have been pursuing their objectives since. 1919 with dignity and diligence, through their local clubs and their state federations, the $usiness and Professional Women's Foundation, the Talent Bank of the National Federation and numerous other activities well-known to our Nation; THEREFORE, the Orange Cpunty $oard of Commissioners does proclaim the week of October 20-26, 1974, as NATIONAL $USINESS WOMEN'S WEEK TN THE COUNTY OF ORANGE and does commend this observance to our citizens. The County Administrator advised the Board that the County Attorney had completed the formal agreement with the Town of Hillsborough concerning the construction of a waste water treatment plant. The Cpunty Administrator stated that the Town of Hillsborough had submitted an easement on County property that is located on the north side of the river. Mr. Gattis pointed out that this easement would cross property that is now under option to the Orange County Medical Foundation, Inc. No action was taken on the matter. Upon motion of Commissioner Richard E. Whitted, seconded-:by Commissioner Melvin Whitfield, it was moved and adopted, that the County be authorized to execute the agreement between the County and the Town of Hillsborough. Chairman walker referred the Board to Item Tv on the Agenda: (Consideration of the purchase of a garage and animal pound site.) Mr. Gattis advised the Board that the County had obtained a Option from James Bennett on a three (3) Acre site. Discussion::ensued. Chairman Norman Walker stated that he had been approached by a landowner who had offered the County an 8.4 ,acre site located Northeast of Hillsborough. This land could be purchased at less cost than the three (3) acre tract now under consideration by the $oard. biscussion ensued. The County Administrator recommended the Bennett site for the dog pound. It was agreed that the County should investigate the 8.4 acre tract prior to reaching any decision on:-the matter of a garage and animal pound site. ~' Chairman Walker inquired it there was any further business to com before the Board. He stated that the County Administrator had requested ancExecutive Session. '- EXECUTIVE SESSION The County Administrator and the Chairman of the Board reported to the Board their opinions of their meeting with the Chapel Hill-Carrboro School Board relative to the disposition of the Northside School property. Discussion ensued on the ~ purchase price of the property that was being requested by`:the Chapel Hill-Carrboro School $oard. No action was taken on the matter. There being no further business the Executive Session was adjourned. ~~ The Board of Commissioners adjourned to meet again on Monday, October 21, 1974, in conjunction with the County Planning Board for a duly scheduled Public Hearing. ~~GG~~ G C. Approved• MINUTES OF THE ORANGE COUNTY BOARD OF COMMISSIONERS ' October 21, 1974 The Orange County Board of Commissioners met in joint session with the members of the Orange County Planning Board on Monday, October 21, 1974, at $ o'clock p.m. in the Superior Courtroom of the Courthouse in Hillsborough, N. C. Members Present: Chairman Norman Walker, Commissioners Flora Garrett, Henry S. walker, Melvin Whitfield, and Richard E. Whined. Members absent: None. Chairman Norman Walker opened the duly advertised Public Hearing by requesting that Clayton Haithcock read the Notice of the scheduled Public Hearing. Said meeting had been scheduled for the purpose of hearing the rezoning request that had been filed by David Reed and Calvin Mellott on twenty (20) acres of land located in Chapel Hill Township, and shown on Tax Map 18, lot 6-A from its present classification to General Industrial classification. For the minutes of this Public Hearing you are hereby referred to the Minute Docket pf the Orange County Planning Board. Chairman Walker Stated that this was the time and date of the Public Hearing on the 1974-1975 Secondary Road Improvement Program. F. D. Hprnaday, R. H. Broome, S. H. .zones, Earl Hoover and Sohn Watkins, Representatives of the State Board of Transportation were present.
