MOBILE BASE RADIO UNIT PROVISION AND USEAGE
MEMORANDUM OF AGREEMENT
BETWEEN ORANGE COUNTY COMMUNICATIONS CENTER
AND THE ENO RIVER STATE PARK
This AGREEMENT made and entered into by and between the Orange County, on behalf of
Orange County Communications Center, a governmental agency providing Division of Criminal
Information access and serving as a communications center for the routing and servicing of
requests regarding law enforcement services, fire services, emergency medical services, and
hazardous materials services under the management control of Orange County Emergency
Management, and the North Carolina Department of Environment and Natural Resources, on
behalf of the Eno River State Park and Occoneechee Mountain State Natural Area for the
purposes and considerations hereafter set out:
I. BACKGROUND
It is recognized by Orange County Emergency Management (hereafter referred to as
Servicing Agency) and Eno River State Park (hereafter referred to as Recipient Agency)
that both agencies have a shared interest in the safety and welfare of citizens, property
and resources; the appropriate response to fires, medical and law enforcement incidents
and other emergencies within Orange County. Both agencies need cooperative
emergency rescue, emergency medical services, firefighting, search and rescue, and law
enforcement assistance within Orange County as required by specific emergencies. This
Agreement will perpetuate the cooperation and assistance provided as a management tool
in accomplishment of each agency's respective mission.
II. PURPOSE
The purpose of this Agreement is to outline the responsibilities of each agency in regards
to the provision of one (1) mobile base radio unit for the purpose of facilitating direct
communication between said agencies by the Recipient Agency to the Servicing Agency.
The communication needs that will be addressed by providing the Servicing Agency with
a mobile base radio unit by the Recipient Agency constitute: Division of Criminal
Information inquiries made by Recipient Agency; Facilitating requests for dispatch of
Law Enforcement Units/Services, Emergency Medical Services, Technical Rescue
Services, Fire Suppression Services, Search and Rescue Services and Hazardous
Materials Services: the ability of the Servicing Agency to contact the Recipient Agency
to advise of such reports made to the Servicing Agency by a third party regarding such
events requiring provided services (mentioned above) that are needed within Orange
County.
III. RESPONSIBILITIES OF SERVICING AGENCY
The Servicing Agency agrees to provide radio based communication service 24 hours a
day, 7 days a week to the Recipient Agency upon the terms established by this
agreement. This service includes:

A. Allowing the Recipient Agency to install a mobile base radio unit for the purpose
of interagency communication in a location appointed and approved by Servicing
Agency where access can be made by dispatchers without delay or obstruction.

B. Advising all dispatchers of the location of the radio unit; its intended use; the
proper procedures for the use of the radio unit; and Eno River State Park staff
contact information.
C. Following contact of the Servicing Agency by the Recipient Agency by
telecommunications or through the Orange County Fire Channel by approved Eno
River State Park staff to request monitoring of the mobile base radio unit, the
dispatcher will activate the mobile base radio unit as soon as practical with
consideration to priority needs and respond as such by communicating
acknowledgment by radio unit on Park Channel 1.
D. Servicing Agency shall not, and is not required by this Agreement, to monitor or
maintain the mobile base radio unit, unless contacted by Eno River State Park
staff.
E. Servicing Agency will provide communications and assistance necessary as
outlined in the Purpose section of this Agreement from Orange County
Communications: DCUNCIC Service, EMS unit(s) dispatch request, Technical
Rescue unit(s), Fire unit(s) dispatch request, Search and Rescue unit(s), Law
Enforcement unit(s) dispatch request and HAZMAT unit(s) dispatch request.
F. Servicing Agency will not make any adjustments, repairs, equipment
modifications and/or channel additions and deletions to the base radio unit
without submitting a written request to Recipient Agency and without receiving
written approval by Recipient Agency for any such adjustments, repairs, etc.
G. Servicing Agency will follow all FCC guidelines regarding traffic transmitted on
all channels on mobile base unit radio. If "10 Codes" must be abandoned due to
discrepancy in the agency's assignments of codes (or any other reason),
professional language will be used until confirmation is received from the
Recipient Agency that the Recipient Agency has a secure radio unit.
H. Servicing Agency will permit Recipient Agency to conduct quarterly equipment
inspections on site (Orange County Communications Center) of the mobile base
radio unit within two weeks of notification of need to conduct inspection.

I. Servicing Agency will notify the Recipient Agency when the person employed as
the Director of Orange County Department of Emergency Services has changed
so that this AGREEMENT may be updated to reflect such change.
J. Servicing Agency's responsibilities under this Agreement shall be limited in all
respects to providing the services and responsibilities asestablished herein within
Orange County. Nothing contained within this Agreement shall require the
Servicing Agency to provide emergency medical services, firefighting, search and
rescue, and law enforcement assistance or provide radio based communication
services in or to any county other than Orange County.
IV. RESPONSIBILITIES OF RECIPIENT AGENCY
The Recipient Agency hereby agrees to the following responsibilities:
A. Provide Orange County Communications Center with a mobile base radio unit
(Kenwood TK-790) and all. necessary equipment for its operation at Recipient
Agency's sole cost and expense.
B. Provide the installation of the unit and its associated features/equipment by the
North Carolina Division of Parks and Recreation Radio Engineer or qualified and
licensed technician selected by the Eno River State Park and agreed upon by the
Servicing Agency at no cost to the Servicing Agency.
The Servicing Agency has the option, upon providing notice to the Recipient
Agency contemporaneously with the execution of this Agreement, to utilize its
own staff for the installation of the base radio unit. Recipient Agency hereby
agrees to pay Servicing Agency for the reasonable costs of such installation,
which such costs shall be disclosed to Recipient Agency in advance.
C. Provide all necessary repairs, adjustments, equipment modifications and/or
channel additions and deletions to the base radio unit per written request by the
Servicing Agency to the Recipient Agency to be completed by the NC Division of
Parks and Recreation Radio Engineer or other qualified and licensed technician
selected by the Eno River State Park and agreed upon by the Servicing Agency at
no cost to the Servicing Agency unless needed as a direct result of negligence by
the Servicing Agency or its employees.
D. Provide any necessary training, at no cost, for the use of the mobile base radio
unit to the Servicing Agency.
E. Provide the Servicing Agency a current and correct list of emergency contact
information for the Eno River State Park and its staff on a minimum annual basis
and more frequently to reflect staff and contact information changes.

F. Provide a quarterly equipment inspection of the mobile base radio unit by
Recipient Agency and notify the Servicing Agency of the pending inspection in
advance to be done at the Servicing Agency's convenience.
V. TERMINATION OF AGREEMENT
Either agency may terminate this Agreement at any time by providing ten (10) days
written notice to the other agency. It is further agreed transactions made to the Division
of Criminal Information and requests for the dispatch of Law Enforcement
Units/Services, Emergency Medical Services, Technical Rescue Services, Fire
Suppression Services, Search and Rescue Services and Hazardous Materials Services
made in behalf of the Recipient Agency are provided as a service and this service may be
discontinued by Servicing Agency if at any time this service becomes a burden due to
personnel manpower or computer system availability. The Recipient Agency will be
responsible for the removal of the radio unit and all associated installed equipment upon
termination of this Agreement.
In witness whereof the parties hereto have caused to be affixed their signatures and seals by and
through officers having authority to bind the agencies party to this agreement, this the _~~_
