The Orange County Board of Commissioners met in regular session on Tuesday,
August 20, 1974, at 8 o~clock p.m. at the Commissioners Room in the Courthouse
at Hillsborough, N. C.
Members present: Chairman Norman Walker, Commissioners Flora Garrett, Henry
S. Walker, Melvin Whitfield, and Richard E. Whitted.
Members absent: None
Item I (Mental Health Agency to request an additional appropiiation in order
that Developmental Pay Care Center and the Work Activity Center might continue
to operate.)
Chairman Walker recognized Mrs. Pat Walton, Administrative Director of the
Mental Health Agency. Mrs. Walton advised the Board that if an appropriation of
at least $20,000.00 of local funds were not restored to the 1974-197'- Mental
Health Agency then the Work Activity Center in Hillsborough and the Developmental
Day Care Center in Chapel H111 would be forced to close. She stated that the
X20,000.00 of local funds, if reinstated, would be matched by a state grant of
$25,000.00. Discussion ensued.
Upon motion of Commissioner Melvin Whitfield, seconded by Commissioner
Richard E. Whitted, it was moved and adopted that a twenty thousand dollar (20,000)
appropriation, be taken from the Contingency Fund, and allocated to the Orange-
Person-Chatham Mental Health Center and that this money be specifically used
for'.:the Work Activity Center in Hillsborough and the Developmental Day Care
Center in Chapel Hill. The Work Activity Center is to receive ~10,OO0 and
the Developmental Day Care Center is to recieve $10,000 £rom this appropriation.
ltem 22 of the Agenda (Approval of Schedule of Fees for the Building
Inspection Program.)
The County Administrator presented copies of the two Building Permit Fee
Schedule that he had secured from the Town of Chapel Hill and the City of Durham.
Mr. Gattis compared the two schedules and he then recommended the Fee Schedule
that was used by the City of Durham. He stated that these fees were adequate
and would cover the majoritity of the cost of the Building Inspection Program.
Mr. Gattis said that he had discussed with the officials of the Town of Chapel
Hill their Fee Schedules and that these officials had stated that the Town
was in the process of proposing a rate increase as the current Fee Schedule
was not sufficient to cover the cost of operating the program. Discussion
ensued.
Upon motion of Commissioner Melvin Whitfield, seconded by Commissioner
Flora Garrett, it was moved and seconded that Orange County adopt the Schedule
of Fees that are currently being charged in Durham County same to become
effective on September 1, 1974, with the understanding that this Fee Schedule
is to be reviewed in six (6) months in order that a determination can be made
as to the adequacy of the fees charged.
Chairman Walker called for a vote on the motion. Commissioners Flora
Garrett, Norman Walker, Melvin Whitfield, and Richard E. Whitted vote aye.
Commissioner Henry S. Walker voted nay.

Item TTI on the Agenda (Appointments)
(A. The term of Woodrow Edmonds on the Chapel Hi11 Planning Board expired
on June 30, 1974. The Planning Board unanimously recommended that Mr. Edmonds
be reappointed.)
Upon motion of Commissioner Henry S. Walker, seconded by Commissioner Richard
E,• Whitted, it was moved and adopted that Woodrow Edmonds be reappointed a5 a
member of the Chapel Hill Planning Board.
(B. Mrs. Winston Strayhorn has decided not to accept reappointment to the
Orange County Council on the Aging. Her replacement must be a person over sixty
years of age.)
• ~ Upon ;notion of Commissioner Richard E. Whitted, seconded by Commissioner Flora
Garrett, it was moved and adopted that the Reverend Ralph Cannon of the Schley
Community be appointed to the Orange County Council on the Aging to fill the
_ position that was vacated by Mrs. Winston Strayhorn.
(C. The term of J. Temple Gobbel on the County A.B,C. Board has expired.
This position is filled by joint action of the Board of County Commissioners and
the County Board of Education.)

The County Administrator advised the Hoard that Mr. Gobbel's term on the
A. B. C. Board had expired in March, however, that in order tv make this
appointment it by Statute must be done in conjuction with the Orange County
Board of Education. Discussion ensued. Action was deferred on this matter
until the September meeting.
Item IV on the Agenda (Mark Burnham, Triangle J Council of Governments,
to make a brief report on sedimentation control.)
Mr. Burnham reviewed the background information leading to the adoption
of state-wede legislation on sedimentation control. He filed with the Board
copies of a proposed Sedimentation Control Ordinance. Mr. Burnham stated that
the Ordinance required that a County Sedimentation Control Office be employed
and that this official would be responsible of erosion control in all parts
of the county. He recommended that the Board consider the possibilities of
adopting one Ordinance for the entire County and that said Ordinance be
included and made a part of each Zoning Ordinance. Discussion ensued. The
Board agreed to review the matter after they had had an opportunity to read
the proposed Ordinance.
Chairman Walker presented the following letter from Patricia Stanford
Hunt, Representative to the General Assembley from the Fourth District.
The letter was addressed to Mr. I. H. Hinton, Director, Traffic Department,
Utilities Commission, Raleigh, North Carolina.
Tt seems we always wait until tragedy occurs before we are able to
marshall our resources and move. We have had such a tragedy in
Orange County last week. Raymond Andrews died because he could not
see the train coming in time to stop and the train engineer could
not see Raymond's truck in time tv stop h3:s train.
Various groups of people in Orange County have tried for several
years to have warning signals placed at railroad crossings here
in what they considered dangerous areas and their efforts have
been in vain. T do not intend to give the many citizens of Orange
who mourn the tragic and unnecessary loss of Raymond Andrews the
same answer .as has been given to them so many times. The state of
North Carolina and the Southern Railway Company may not believe
yet. that we have dangerous railroad crossings---but the people here
in Orange now know we do:
I propose to you that all railroad crossings on state maintained
roads have some kind of visual flashing signals or that a brakeman
be required to walk in front of the train carrying a flashing light
or that trains be required to stogy at every crossing and the
engineer check his clear passage before proceeding further. Obviously
only one of these alternatives is practical. T am incensed that
railroads have such power and authority that the safety of our citizens
is the last concern of them and their supervisors.
For now, I request that flashing electriv signals be placed on the
following location in Orange County: (1) the Estes Drive extension
at the Carrboro city limits; (2) at the Homestead Road crossing
about 1 mile from Chapel Hill Senior High School; (3) on N. C. 86
halfway between Hillsborough and Chapel Hill; and (4) on the Eubanks
Road at the entrance to the newly located landfill serving most of
towns and county areas.
Secondly, I request that the sight vision be improved at the Estes
Drive crossing immediately. I do not know who is responsible for
keeping this vision safe but I do not want to have a lot of
correspondence on the matter that goes nowhere. Until these flashing
signals are installed, the Estes Drive crossing is extremely dangerous.
In fact, a young girl in Carrboro just outran this train immediately
before Mr. Andrews was killed. I have numerous conversations with
several people who have been frightened by the safety of this
situation.
Please, for once, lets show that bureaucracy and state government
can move expeditiously.
Discussion ensued on all the unmarked railroad crossing in the County.
Commissioner Melvin Whitfield stated that he would like to se the Board
enrose the contents of Representative Hunt's letter. Com.-nissioner Flora
Garrett stated she felt other areas of the county should included in any
action taken by the Board. Commissioner Henry S. Walker stated that he
felt that the officials of Southern Railway needed to get together with
the officials of the State Board of Transporation on the matter of unmarked
railroad crossings. It was agreed that each member of the Board did share
the concern expresed by Representative Hunt in her letter of August 14.
The Clerk was instructed to write the Southern Railway Company and the
State Board of Transportation.

of Hillsborough.
During the session Of the last town boaxd meeting of the Tvwn
of Hillsborough, the Commissioners by resolution agreed to replace
the sidewalk as shown on the attached description, along King Street
and into the old Court House. The existing cracked and chipped
concrete walk would be removed and replaced with a brick sidewalk
similar to the one just completed at the new Town Hall.
This came to our attention as a result of the up~-coming
bicentennial and we want to spruce up the Town for this occasion.
The estimated cost of this project is $3,500 of which we are
prepared to pay for half. It the County Commissioners will agree
to this, the work will be completed within ten days of the date
of this letter.
The Town Board Commissioners by resolution requested that I
contact you and hopefully mak arrangements for the Town of Hillsborough
to come under the jurisdiction of the County Building Inspector, Mr.
Roland Wagoner.
I would suppose that if we could make agreeable decisions in
this matter, it might be best to handle it on a fee basis as we
are presently doin with the zoning officer. At any rate we are
willing to accept any offer or decision that you of the Board of
County Commissioners make in this regard. Again, we find ourselves
as we did in the situation of the zoning officer, building permits
being issued within the corporate limits of Hillsborough of
approximately one per month which makes it awfully difficult to
maintain a building inspector.

biscussion ensued on the requests contained in said letters. No action was
taken on the request for monies to repair the sidewalk. The request that was
being made by the Town of Hillsborough for the County Building Inspector to serve
both the County of Orange and the Town of Hillsborough was pursued. The County
Administrator explained that the General Statutes of North Carolina would allow the
I County to enter into an agreement with the .Town of Hillsborough relative to the
services of the County Building Inspector. Further discussion ensued. The County
Administrator was instructed to have the County Attorney prepare a Resolution for
the consideration of the Board on the matter of allowing the Building Inspector
to serve both the County and the Town.
The County Administrator presented the following letter from Edward 5. Johnson,
President of the Orange Grove Volunteer Fire Company.
The Orange Grove Volunteer Fire Company has applied to the
Farmers Hame Administration for a loan to assist in financing
our operations as follows:
construction of fire house $24,000
purchase of radio equipment 5,000
purchase df pumper truck 36,600
overhaul of donated tanker 1,000
purchase of land for firehouse ~2 000
Total 6~ 8,600
Although the period of the loan will be for 30 years (with annual
payments totaling $4,531) we anticipate being able to pay if off
within 20 years.
Our present status is as follows. A tract of land at the
intersection of SR 1114 and SR 1006 has been purchased and the
firehouse is under construction. We expect to take occupancy
by October 1. A Sean pumper truck was ordered and delivered
in July although its full complement of equipment has not yet
been delivered.' A truck has been donated to the company and
is presently undergoing modifications to make it suitable for use
as a tanker. Radio equipment has been ordered and will be
installed as soon as the firehouse is ready. This system will
become a part of the county-wide WX4000 system. Training through
the Community College system has begun and will be completed during
the fall. Even with its. limited equipment and training, the
company has successfully answered one fire call.
FHA requires that any fire fighting service it aids be
consistent with county-wide pions. Therefore we would appreciate
your reviewing the above information and commenting on it.
In order for us to keep on schedule with our rather complex
negotiations with FHA, we would appreciate a letter of response by
Friday, September 6.

The County Administrator explained that before the Orange Grove Volunteer
Fire Company could enter into an agreement with the Farmers Home Administration
the County of Orange must executed the Contract and Agreement with the Orange
Grove Volunteer Fire Company for the levying and collection of the Fire District
Tax.
Mr. Gattis stated that he had been contacted by an individual who owned an
automobile salvage business and that this individual would pick-up all abandon
cars in the County provided that the County would execute and exlusive contract
with him on the removal of abandoned vihicles. Mr. Gattis said that he felt
that this individual would first strip the cars of all useable parts and then
sell the body to an automobile crusher. Discussion ensued. The Board adivsed
the County Administrator to present the proposed Contract to the County Attorney
for his opinion on the request.
Chairman Walker presented the following Memorandum from Clayton Haithcock,
the County Planning Officer.
Whereas the North Carolina State Highway Commission has proposed
construction of a segment of highway I-40 from Research Triangle Park
to Hillsborough along a corridor known as "alternate IA", and "alternat
1" and Whereas the portin of Orange County through which the proposed
road would pass is now in important and desirable residential, agricul-
tural and scientific use, and provides aneeded open space, all of
which would be adversely defected by the proposed highway, and Whereas
the proposed highway will not solve the region's serious traffic
problems, which are primarily local, and Whereas Orange county is
already the location of several major highways and is in danger of
becoming a highway cvrridorr to its long-range dettiment; while other
areas to the north and south lack adequate highways, and Whereas
the proposed highway would damage rare biological resources such as
the Duke Forest and the New Hope Creek, and Whereas the few benefits
to interstate traffic which might result from the construction of
the highway are far too small to balance the large cost in dollar
expense, disruption of orderly and desirable growth, and enviromental
damage.
Be it resolved that the Orange County .Planning Hoard apposes
the construction of "Alternate IA" of highway I-40 as unnecessary
and undersirable and urges that the funds be utilized in ways better
planned to serve the real traffic needs of the region.
Commissioner Flora Garrett presented the Following Resolution:
R E S O L U T I O N
WHEREAS regional organizations have been formed and financed by
local general purpose governments, and
WHEREAS the state government and the federal government finds it
more. manageable to relate with seventeen regional organizations
than with 100 county governments and over 400 municipal governments,
and
WHEREAS THE GOVERNOR has announced the creation of the Dffice of
Intergovernmental Relations to further these very relationships
between state government and local general purpose governments,
BE IT THEREFORE RESOLVED that the Board of Aldermen Of the Town
Df Chapel Hi11 petition the Office of Intergovernmental Relations
to nurture carefully a "giv and take" between its office and the
several governments involved in the region; in particular, we
petition that no interchange be required between a Lead Regional
Organization and the Office of Intergovernmental Relation unless
and until adequate time is allowed for the Lead Regional Organiza-
tion to confer with each local general purpose government through
their elected representatives as an intefral part of the Lead
Regional Organization's decision-making process.
Adopted this the 22nd day of July, 1974.
Commissioner Garrett stated that she was of the opinion that the Council
of Governments would be requested to adopt..the Resolution, however, that prior
to this or any action she wished to ask that each local governmental Board
first review the proposed Resolution.

The Orange County Board of Commissioners met in joint session with the members
of the Orange County Planning Board on Monday, August 26, 1974, at 8 o'clock p.m.
in the Superior Courtroom of the Courthouse in Hillsbrrough, N. C.
Members present: Chairman Norman Walker, Commissioner Flora Garrett, Henry S.
Walker, Melvin Whitfield, and Richard E. Whitted.
Members absent: None
Chairman Norman Walker opened the duly advertised Public Hearing by requesting
the Clayton '-laithcock read the Norice of the scheduled Public Hearing.
Said meeting had been scheduled for the purpose-of hearing the rezoning request
that had been filed by David Reed and Calvin Mellott on twenty (20) acres of Land
located in Chapel Hill Townsha.p,_arid shown on Tax Map 18, lot fi-A from its present
classification to General Industrial classification.
For the minutes of the Public Hearing you are hereby referred to the Minate
Docket of the Orange County Planning Board.
There being no further business to come before the Public Hearing the meeting
was adjourned.
