PURPOSE: Consideration of the Preliminary Plan for New Hope Rise Subdivision.
BACKGROUND: Request
John Hartley is requesting Preliminary Plan approval of eight (8) residential lots
proposed on a 16.7 acre tract. Seven lots are 2.00 acres in size and the other lot is
2.110 acres.
Location
The property is located along the south side of New Hope Church Road (SR
1723) between I-40 and Old NC 86 in northern Chapel Hill Township.
Conditions
Existing: The current zoning is Rural Buffer. Flexible Development is not
applicable in the Rural Buffer. There are no streams on the property and the site is
almost entirely wooded except for an overhead power line on the front portion of

the tract. The trees on site are mixed hardwoods approximately 35 years old. The
surrounding property is also wooded.
Proposed:
Currently, the property derives its access from New Hope Church Road (SR
1723). A proposed public road, New Rise Court, to be constructed to NCDOT
standards, will provide access to the newly- created lots. All adjacent properties
are either developed or have existing access, thereby eliminating the need for
stubouts.
In order to meet regulation requirements, a 30 -foot type A landscape buffer is
proposed along New Hope Church Road. The type A buffer is composed of
deciduous and/or evergreen vegetation, forming semi - opaque intermittent visual
obstructions from the ground to a height of at least thirty (30) feet.
All lots will be served by individual wells and septic tanks.
Planning Board: On March 4, 1999, the Planning Board unanimously approved
the Concept Plan.
On May 5, 1999, the Planning Board unanimously recommended approval of the
Preliminary Plan for New Hope Rise Subdivision subject to the conditions
contained in the Resolution of Approval.
FINANCIAL IMPACT: Not applicable: A Fiscal Impact Analysis is not required on subdivisions of 10
lots or less.
The Administration recommends approval of the Preliminary Plan for New Hope
Rise Subdivision per the Planning Board recommendation with the conditions
listed in the attached Resolution of Approval.

The Board of County Commissioners hereby approves New Hope Rise subdivision preliminary
plat, dated March 26, 1999 containing 8 lots, subject to the fulfillment of requirements specified
herein.
New Rise Court shall be irrevocably dedicated to the general public and be constructed to
standards of the North Carolina Department of Transportation. The approval of this resolution
authorizes. and directs the Orange County Manager to accept for Orange County and on behalf of
the public generally, the offer of dedication. of New Rise Court . This acceptance by Orange
County of the dedication to the general public of New Rise Court shall be without maintenance
responsibility. This road shall be maintained by the owner /applicant until such time as it is
accepted for maintenance by the North Carolina Department of Transportation or some other
governmental body. Before the Final Plat of New Hope Rise Subdivision can be recorded:
A. Sewage Disposal
1. Each residential lot shall contain an adequate area for septic disposal, and repair
area, approved by the Orange County Division of Environmental Health.
2. Disclosure that the septic system location may restrict the size and location of
improvements shall be included in a document describing development
restrictions to be recorded concurrently with the Final Plat. The document shall
also disclose that information regarding the tentative location of septic systems is
available from the Orange County Health Department, Division of Environmental
Health.

B. Roads and Access
1. New Rise Court shall be constructed to standards of the North Carolina
Department of Transportation, within a 50' right -of -way, and the construction
shall be inspected and approved by NCDOT.

A letter of credit or escrow agreement or other security shall be submitted to
secure construction of New Rise Court to the standards of the North Carolina
Department of Transportation. An estimate of the construction cost must be
prepared by a certified/licensed engineer or grading contractor and submitted to
the Planning and Inspections Department. The financial guarantee must reflect
110% of that estimate and be issued by an accredited financial institution licensed
to do business in North Carolina.
The document describing development restrictions to be recorded with the Final
Plat shall state that the financial guarantee will not be released until the road
construction has been inspected and approved by NCDOT.
2. An erosion control plan for construction of the road shall be submitted by the
applicant to the Orange County Erosion Control Division for review and approval.
3. Approved street name signs shall be erected at the intersection of streets as
required in Section IV- B- 3-c -12 of the Orange County Subdivision Regulations.
Evidence shall be submitted by the applicant that the sign is in place,. or a copy of
the receipt for purchase of the sign shall be submitted to the Planning Department.
4. All lots shall access onto the new subdivision road.
C. Land Use Buffers and Landscaping
Landscaping shall be installed or preserved as indicated on the approved
landscape plan, and must be inspected and approved by the Planning and
Inspections Department. A 30 -foot Type A buffer, as defined in the subdivision
regulations, shall be installed along New Hope Chruch Road.
2. Provisions for protection of existing trees as shown on the approved landscape
plan shall be included in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with the
Final Plat.
D. Drainage
Locate drainage easements as required following review and approval of the
Erosion Control Plan.

E. Parkland
1. Cash in the amount of $2,275.00 shall be paid to Orange County as payment in
lieu of parkland dedication.
F. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance with
Section V -D -2 and V -D -3 of the Orange County Subdivision Regulations.
2. The following easements shall be shown on the plat:
a. drainage easements as required by D.1. above.
3. Minimum building setbacks shall be as indicated on the Preliminary Plan. The
setback requirements shall be stated on the plat, and in a document describing
development restrictions and requirements to be prepared by Planning Staff and
recorded concurrently with the Final Plat.
G. Certifications
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall
be notarized on the face of the Final Plat.
2. A Certificate of Declaration and Maintenance in the form provided in Section
V -D -6 -b of the Orange County Subdivision Regulations signed by the landowner
and developer shall be on the face of the plat and included in a document
describing development restrictions to be recorded concurrently with the Final
Plat.
3. The North Carolina Department of Transportation shall certify that New Rise
Court has been constructed to State standards or that construction plans have been
approved.
4. A Certificate of Approval signed by the Orange County Planning and Inspections
Department.

This office has completed its review of the subject's proposed preliminary plans for compliance with current
Department of Transportation minimum subdivision construction standards. Pursuant to any final plan approval,
this office respectful request you to make the owner /developer aware of the following requirements before starting
any construction.
1. Prior to any construction of any new access or alteration of any existing access within the right of way, the
developer /owner is required to secure a permit with this office. It is the responsibility of the owner /developer
to obtain a permit.
2. Prior to any construction, this office should receive, review and approve two (2) complete site layouts. The site
layouts will include horizontal and vertical alignment information, a typical section, drainage facilities, vicinity
map, and the number of lots with the proposed driveway location.
3. During the construction, it is the responsibility of the owner /developer to provide verification certifying that the
roadway surface, drainage, and seeding satisfies the approved design outside the State's right of way.
4. When working within the State's right of way, the owner /developer will contact the Graham District Office
before each of the following phases: (A) Drainage, (B) Grading, (C) Placement of base, (D) Paving, and (E)
Seeding. Failure to notify this office before each phase of construction may justify a verification certified and
signed by a professional engineer.
5. In accordance with the General Statute 136 - 102.2, new roads are not eligible for the State Maintenance system
unless certain requirements are met. An explanation of these requirements can be found on pages 13, 14, and
15 of the . Particular attention should be
placed on items 2 (petition for addition), 5, 6, and 7 (occupied housing requirement), 11, 12, and 13.

6. The owner /developer should adhere to attached requirements and the remarks noted on the submitted plans.
7. Any area within the State's right of way and/or easements disturbed during the construction and/or maintenance
shall be repaired to the satisfaction of the District Engineer or his representative.
8. Before planting any landscape within the right of way, the encroaching party shall submit an application for a
planting permit to this office. The permit must be approved prior to installing any plants.

(1) New Hope Rise Subdivision
Presentation by Eddie Kirk.
The property is located along the south side of New Hope Church Road

attachment to these minutes on pages ),
