BACKGROUND: The property is located in the Cheeks Township at the intersection of Bane Road and Halls Mill Road (see Attachment #1). On May 10, 1999, the Historic Preservation Commission received a letter from the State Historic Preservation Office (see Attachment #2) enclosing a .proposed National Register Nomination on the Maude Faucette House. (The National Register Nomination Form is provided as Attachment #~. As a Certified Local Government (CLG), Orange County has sixty (60) days from the date of submission of a National Register nomination to make comments on the proposal. If the County does not comment on the proposed nomination by July 8, 1999, approval of it is assumed. (CLG Information and Sample Comment Forms are provided as Attachment #3). In accordance with CLG guidelines, the Historic Preservation Commission is required to provide an opportunity for public comment during the 60-day period. To meet this requirement, the Historic Preservation Commission held a public hearing at their meeting on May 26, 1999. (Draft minutes of the S/26/99 meeting are provided as Attachment #S~. Notices of Public Hearing were published in accordance with the Historic Preservation Ordinance and letters were sent via certified mail to all property owners within 500 feet of the property being nominated to the National Register (The Notice of Public Hearing is provided as Attachment #~. Eligibility for the National Register is determined by a thorough evaluation of the historic qualities and significance of a site, structure, or area. National Register nominations are evaluated based on the following criteria: z BACKGROUND: A. Property is associated with events that have made a significant contribution to the " broad patterns of our history. B. Property is associated with the lives of persons significant in our past. C. Property embodies the distinctive characteristics of a type, period, or method of construction or represents the work of a master, or possesses high artistic values, or represents a significant and distinguishable entity whose components lack individual distinction. D. Property has yielded, or is likely to yield, information important in prehistory or history. According to the nomination form, the The Maude Faucette House is eligible for listing in the National Register of Historic Places because it embodies distinctive characteristics of an architectural type, a period, or method of construction. The house is a good representative example of an early-nineteenth century (c. 1820), two- story frame farm house of the Eno River Valley. The largely unaltered house is one of the oldest surviving structures in rural Orange County and retains its early form and its original setting overlooking the banks of the Eno River. Following the close of the public hearing, the Historic Preservation Commission reviewed and discussed the nomination to determine if the Maude Faucette House meets or does not meet the criteria for listing in the National Register of Historic Places. As indicated in the draft minutes of the 5126!99 meeting, the HPC determined that the Maude Faucette House meets the criteria for listing. The Board of Commissioners and the Historic Preservation Commission must separately notify the State and the property owners of their recommendations by July 8, 1999. The nomination will be presented to the North Carolina National Register Advisory Committee on July 8, 1999. The Committee's recommendation will then be forwarded to the US Department of the Interior National Park Service. FINANCIAL IMPACT: Not applicable. RECOMMENDATION(S): Administration Recommendation. This participation involves the review of nominations within the jurisdiction of the CLG by the CLG Commission and the chief elected local official. Opportunity for public comment must be provided during the 60-day comment period. The commission and the chief elected official are required to submit comments to the State Historic Preservation Office and the owner of the property relaying their findings as to the eligibility of the property under consideration for listing in the National Register. The attached forms are provided for you to facilitate your review of nominations and your submittal of comments to the State Historic Preservation Office. A copy of the criteria for listing in the National Register is also enclosed for your reference and use. Although the federal regulations governing the CLG program call for the chief elected local official to provide comments on proposed National Register nominations within the CLG jurisdiction, North Carolina law stipulates that the mayor or chairman of the board of county commissioners may act only in an administrative capacity on behalf of the local governing board. If a certified local government has doubts about the legality of the chief elected official assuming sole responsibility for comments on proposed National Register nominations, it may wish to consider two alternatives: 1) having the governing board review the nominations or 2) having the governing board pass a resolution granting the chief elected local official the authority to furnish comments on behalf of the governing board. 6 In order to fulfill the required comment procedures, please complete the information below and the appropriate comment paragraph which is attached after you have reviewed the nomination. P-2-99 MAUDE FAUCETTE HOUSE (THE ELMS), OR #1376 Chairman Allison opened the public hearing and thanked the owners, Robert Golan and Diana Montgomery, of The Elms for their participation in the program. Belk presented a staff report on the Maude Faucette House explaining the steps that had occurred to place the property on the National Register of Historic Places Nomination as noted: G:\CAROL\HPC\MAY99MIN.DOC DRAFT • In accordance with local government requirements, this Commission is required to provide the opportunity for pubic comment on the nomination. • On May 14, 1999 property owners within 500 feet were notified by certified mail of the notice of public hearing. • On May 15`~ and 22°d notices of the public hearing were published in the Chapel Hill Herald and on May 19~' notice of the public hearing was published in the News of Orange County. • This hearing fulfills the Historic Preservation Commission's requirement for public comment on the Maude Faucette House Nomination. • Reference to the location was given as The Elms OR #1376, located in Cheeks township, southeast of the junction of SR 1337 (Bane Road) and SR 1336 (Hall's Mill Road). Staff indicated no restrictions were connected to this nomination unless a major subdivision was planned. That would require additional review by the Boazd of County Commissioners, the Planning Boazd and the Historic Preservation Commission. Mr. Golan asked for guidance of how to approach either the Triangle land Conservancy or Eno River Association to instigate more conservancy from surrounding land owners. Anderson suggested they contact Wayne Cash, President of Eno River Association and, that he might have more information on how to go about this. Allison closed the public hearing.
