Background: Orange County Speedway has requested that the County Commissioners approve a pyrotechnics permit for the fireworks display which is scheduled for July 2, 1999 in conjunction with the regularly scheduled race. GS 14 -414, indicates that the Board shall consider a fireworks permit for "any and all kinds of fireworks and explosives, which are used for exhibitions or amusement purposes." GS 14-413 empowers the Commissioner to authorize and issue permits for the use of pyrotechnics in connection with "...shows of all descriptions ... but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other." County policy further requires assurance from the sponsoring agency that adequate public safety measures will be exercised; and that the County will be protected as an additional insured on the insurance policy(ies) covering the event. The documents attached indicate satisfactory evidence that these requirements will be met. Financial Impact: No fees are assessed by the County for pyrotechnic permits. RECOMMENDATION: The Manager recommends that the Board approve the pyrotechnics permit for Orange Speedway for their fireworks display to occur July 2, 1999; and authorize the staff to sign off on the permit form as indicated. PYROTECHNICS PERMIT CHECKLIST—ORANGE COUNTY SPEEDWAY 7 -2 -99 North Carolina General Statue 14-413 empowers County Commissioners in the State to issue permits for the use of pyrotechnics in connection with shows of all descriptions after satisfactory evidence is produced to the effect that the pyrotechnics will be used for the aforementioned purposes and no others. The Orange County Commissioners have adopted a policy which cites the completion of the following criteria as prerequisite to the issuance of a pyrotechnics permit. Verification of the receipt of information will be evidenced by the signature of the appropriate official on this form. Only after all criteria listed below have been met will the permit be issued. It should be further noted that all signatures must be written on the face of the permit in order for the permit to be valid. Penalties for use of pyrotechnics without a permit are cited in the North Carolina Building Code, Administration and Enforcement, Volume 1A, Chapter 8.1. CRITERIA APPROVED BY DATE 1. On June 21, 1999, Orange County Speedway, Roughmont, NC, was approved for a pyrotechnic permit to be used in association with races on July 2, 1999 at the Orange County Speedway. The approval is granted based on the following assurances from the requestor. Public Safety personnel will be on site during the event to ensure public safety and to provide adequate traffic control; Proof of Liability insurance which includes the County as a named insured, has been submitted to the Orange County Director of Purchasing and Central Services. Limits of liability are no less than $1,000,000 per occurrence. Show setup will be approved by the Orange County Fire Marshal or his designee, prior to the beginning of show. Permitted explosives include those listed on attachment #1, as submitted by Fireworks Unlimited inc., Yancyville, NC. Orange County Speedway has a Current fire inspection and is in compliance with the Standard Fire Prevention Code, 1988, with North Carolina amendments. We have contracted with Atlanta Pyrotechnics of Marietta, Ga. to handle the fireworks display. I believe that Mr. John Zayc hek has forwarded some of his necessary paperwork earlier but I am including it with my information as well. Our plans are for the fireworks to be shot from the area behind turn three as has been done in the past; however, if this is not agreeable then I have indicated some alternate sites. I am including a site layout of the proposed locations. The parking lot will be closed for spectator parking in the selected area for this event and no vehicles or spectators will be permitted 300 ft. in any direction of the launch site. As is the case in all our events, we will have Orange County EMS units and the Caldwell Fire Department on premises as a precaution. Please advise immediately of any other information necessary required to get this permit under way. I appreciate your help in closing this matter as quickly as possible. Orange Speedway Management has stated that they had contacted EMS, l,rfike Tapp, who had stated all regulations were covered for them to have the event. It was also requested that we state that off -duty law enforcement would be on the premises working when the display was conducted.
