HomeMy WebLinkAboutAgenda - 03-17-2009 - 5a ORANGE COUNTY BOARD OF COMMISSIONERS ACTION AGENDA ITEM ABSTRACT Meeting Date: March 17, 2009 Action Agenda Item No. 5-0 SUBJECT: North Carolina Community Transportation Program (CTP) Administrative and Capital Grant Application FY 2009/2010 DEPARTMENT: Aging/Transportation PUBLIC HEARING: (Y/N) Yes ATTACHMENT(S): Community Transportation Program INFORMATION CONTACT: Resolutions, Certifications and Assurances Jerry Passmore, 245-2000 Public Hearing Notice Al Terry, 245-2008 Proposed Administrative/Capital Budget Summary PURPOSE: To conduct a public hearing on the North Carolina Community Transportation Program (CTP) grant application by Orange Public Transportation for FY 2009-2010 and approve the grant application, adopt resolutions authorizing the County to enter into an agreement with North Carolina Department of Transportation, and authorize the County Attorney to complete the necessary certifications and assurances. BACKGROUND: Each year the North Carolina Department of Transportation (NCDOT) Public Transportation Division accepts requests for administrative and capital needs for County operated community transportation programs. Orange Public Transportation (OPT) is eligible to make application for both administrative and capital funding. The current year approved application includes administrative funding in the amount of $184,620 and capital funding in the amount of$168,600. The total requested for FY 2009-2010 is $184,620 for administrative funding ($156,927 State; $27,693 local match) and for capital funds $184,800 ($166,320 State; $18,480 local match). The capital request is to replace two existing buses that have met the NCDOT replacement criteria. The new vehicles consist of two lift-equipped light transit vehicles (buses). These vehicles are being ordered with bio-diesel fuel and larger passenger capacities. Under the State contract bio-diesel is the only alternative fuel offered. The current 18 vehicle fleet has 16 vehicles that have already met the NCDOT replacement criteria (with high maintenance costs) and would be eligible if state/federal funds were available. The two replaced vehicles will be sold and funds from the sale could provide the local 10% match for the new NCDOT vehicles. Administrative funds will continue to be used to support overall transit systems management and continue to promote general ridership. A public hearing is necessary for public discussion and comments before the Board takes action on the resolution. 2 FINANCIAL IMPACT: The NCDOT Community Transportation Program Grant requires a 15% local match for administrative funding in the amount of $27,693 and a 10% local match for capital funding in the amount of $18,480. The total County match is $46,173 which will be requested in the upcoming County budget. RECOMMENDATION(S): The Manager recommends the Board: 1. Conduct a public hearing to receive public comments on the proposed grant application; 2. Approve the Community Transportation Program Grant application for FY 2009-2010 in the total amount of$369,420 with local match of$46,173. 3. Authorize the Chair to sign the Community Transportation Program Resolutions and annual certified statements of participation. COMMUNITY TRANSPORTATION PROGRAM RESOLUTION 3 Section 5311 FY 2009 - FY 2010 RESOLUTION Applicant seeking permission to apply for Community Transportation Program funding, enter into agreement with the North Carolina Department of Transportation and to provide the necessary assurances. WHEREAS,Article 2B of Chapter 136 of the North Carolina General Statutes and the Governor of North Carolina have designated the North Carolina Department of Transportation (NCDOT) as the agency responsible for administering federal and state public transportation funds; and WHEREAS, the North Carolina Department of Transportation will apply for a grant from the US Department of Transportation, Federal Transit Administration and receives funds from the North Carolina General Assembly to provide assistance for rural public transportation projects; and WHEREAS, the purpose of these transportation funds is to provide grant monies to local agencies for the provision of rural public transportation services consistent with the policy requirements for planning, community and agency involvement, service design, service alternatives, training and conference participation, reporting and other requirements(drug and alcohol testing policy and program, disadvantaged business enterprise program, and fully allocated costs analysis); WHEREAS, (Legal Name of Applicant) Orange County hereby assures and certifies that it will comply with the federal and state Statutes, regulations, executive orders, Section 5333 (b)Warranty, and all administrative requirements which relates to the applications made to and grants received from the Federal Transit Administration, as well as the provisions of Section 1001 of Title 18, U. The public hearing will be held on March 17, 2009 before the Board of County Commissioners (Orange County). Those interested in attending the public hearing and needing either auxiliary aids and services under the American with Disabilities Act (ADA) or a language translator should contact Al Terry, 245-2008 on or before March 15, 2009.
