Gatos, eating Clerk MINDTES OF THE ORANGE COONTY BOARD OF COMMISS20NERS October 26, 1973 The Board of Commissioners of Orange County met in special session at 11 o~clock A,M, or. Friday, October 26, 1973, in the District Courtroom of the Courthouse in Hillsborough, North Carolina. Members Present: Ghairman C. Norman Walker and Commissicners Henry S, Walker, Flora Garrett, Richard E. Whitted and Melvin Whitfield. Members Abssnt: None. Also present was S. M. Oattia and Beth June Faye e, Clerk to the Board. This meeting had been scheduled for the vurpose of hearing representatives oP the North Carolina Board of Transportation. M. C, Adams, Division Engineer, John -' Watkins, Assistant Division Engineer, S, H. Jones, District Engineer and F. D, Hornaday, Second Road Councilman were present to review the recently enacted General Statutes that dealt directly with the Board of Transportation and the ~~~ County Board of Commissioners. Mr, Adams wsa spokesman for the group and he introduced F. D. Hornadas. He stated that Mr. Hornaday was charged with the responsibility of the secondary road system in the Seventh District. Mr. Adams stated that the group was not in the position to discuss in detail the proposed 1973 road program for Crange County, however, he did advise the Board that the county's allocation amounted to X287,000 and thatl3~is proportion had been arrived at by the pro rata share of unpaved roads that currently exists in the County and the current cost of construction, That the total amounted to approximately 2.7~ of the unpaved mileage that did exist, H© stated that the Board oi' Transportation will establish the criteria that would be applied for priority of paving. TDTAL RATING (Item $ + Item 11 + Ttem 12) ............................ 7-55 He stated that the priority rating had bean established for Orange County, however, the Board of Transportation was withholding $28,000 as a Contingency Fund. This Contingency Fund will be used for the paving of subdivision streets in con3unction with citizen participation, Ee advised the Board that any funds that were left in the fund would be utilized in the next yearn priority listing. Mr, Adams stated that the Hoard of Transportation would, at some later date, present the proposed program for the Counts and that the statutes required that this meeting be duly advertised in order to allow public participation. The statutes Further require that the Board of Commissioners must write a letter to the seconders road council and that said letter would either endorse the secondary road program as presented to the Board of Commissioners or re3eat the proposal or submit suggestions concerning the road program. He stated that should the secondary road aounoil fail to investigate the suggestions of the Board as apart of -the road program then the Board dial have a right to petition the State Board of Transportation. Once the presented road program had been established it was the intent of the Board of Transportation to follow the program to the fullest extent possible. Mr. Adams pointed out that cases could arise that would prevent the priority listing from being followed and he acted the failure of aitizena to give the needed right of way as one instance. He stated that it was the desire of the Board of Transportation prior to the public hearing to hold an informal meeting with the Board of Commissioners for informational purposes only. Mr. Adams stated that there would be an annual rating of roads. Discussion ensued. ------- .. --.- _...~.--__.___ _ _---- _. _._....~ ~_~3 Commissioner Melvin Whitfield inauired as to Whether any of the allocated monies would be spent in correcting the hazzards that existed on the unpaved roads of the county. Mr. Adams advised the Soard that no monies had been allocated for improving the unpaved roads. That the priority listing dealt solely with paving, however, ha did recommend that the County might consider spending some of its allocation an improving some of the unpaved roads rather than spending all of its allocation on paving. Discussion ensued. Mr. Adams advised the Board that a.definite change 3.n the General Statutes dealt with the abandonment of roads and that the Soard of Transportation can now abandon any road that it ahoosea to abandon. He assured the Board of Commissioners that abandonment of roads would not affect homeowners, but would be roads that were generally located in rural areas. A list of proposed roads that will be abandoned will be submitted to the Soard of Commissioners. A resolution for abandonment will be transmitted from the Board of Transportation to the Board of CoAanissiorera. If the Board of Commissioners disagree with the proposed abandonment then they may request the Board of Transportation to conduct a new investigation of the matter. Property owners on the proposed abandoned roads will be given a sixty (60) day notice and they must during this sixty (60) days file any protest they have relative to the abandonment. The Board of Trana~ortation can abandon a road without the consent of the Board .of Commissioners. Mr. Adams stated no new subdivision streets will be accepted for paving after November 1, 1973, the exceptions be3.ng that the streets moat be paved and if a plat of the streets have been or if a prelim3.narp plat hea been approved by a Planning Board prior to the cut off date. He pointed out that the Board of. Transportation will continue its participating paving paliay at $2.00 per running square feot for each side of a proposed street. He stated that rio funds could be spent before late 1974 due to the fact that the work program in Drange County had been scheduled through late 1974.
