M. Members Present: Chairman Harvey D. Sennett, and Commissioners William C. Ray, Henry S. Walker, Ira A. Ward and C. Norman Walker. Members Absent: None The Clerk was directed to dispense with the reading of the minutes of the previous meetings. Chairman Bennett recognized Paul Seibel of Chapel Hill. Mr. Seibel seated that a non profit corporation plena to build forty (L}0) apartment unit buildings in the Town of Chapel Hill and that these unite would be leased to the Housing Authority. He stated that the construction of said units would be financed through municipal type bonds and that he had, recently, learned that the proposed apartments would fall in the category of other public housing, therefore, he was requ®sting the County to issue a letter or some type of document certifying to th®.fact:that said property would enJoy a partial tax exempt status. Mr. Seibel advised the Beard that ha had discussed the matter with the County Administrator and that the Attorney Generals office had been requested to render a ruling on the question df the tax exempt status of the proposed project. Mr. Seibel stressed that time w&s of the essence in hie planning and that he would like to have an indication from the Board what action they felt they would take on the request. Mr. Gattis adviaed.Mr. Seibel that he could assume that the Beard would adhere strictly to the General Statutes and that he would suggest that they must wait for the ruling from the Attorney General's office prior to taking any action on the matter. Chairman Bennett recognized Clayton Haithcock, Zoning Officer. Mr. Haithoock presented the following plats for approval and he stated that each plat had been approved by the County Planning Board; 1. Bernice R. Smith Subdivision located in Chapel Hill Township. Upon motion of Commissioner Ira A. Tdard, seconded by Commissioner Norman Walker, it was moved and adopted that Chairman Bennett be authorized to sign the Bernice R. Smith Subdivision plat. 2. Final Plat, Lot l} and 5 Partin 1ii11s Upon motion of Commissioner Z+lilliam C. Rap, seconded by Commissioner Norman Walker, it was moved and adopted, that Chairman Bennett be authorized to sign the final plat of lot L~. and 5 of Partin Hills. 3. Section 1 Meadow Estates, property of Joe Berini in Eno Township on Pleasant Green Road. Upon motion of Commissioner Henry S. Walker, seconded by Commissioner Ira P_. Ward, it was moved and adopted that Chairman Bennett be authorized to sign the plat of Section 1 Meadow Estates. A4ark Burnham, Research Triangle Planning Commiasi.on, advised the Board that the Council. of Governments had made a survey including Durham, Orange and Wake Counties relative to the mobile home parka that were located in each county. Mr. $uurham presented copies of the maps and they revealed that in proporta,on Orange County had a larger percentage of mobile home parks than did Durham and Wake: He stated that the final analysis was not yet available as to the reasons that so many parks were being located in this particular area. Airs. Carl Anderson presented a petition signed by thirty-two (32) landowners who own land on the Eno River. Said petition read as follows; "We, th® undersigned Orange County land-owners, who hold frontage on the Eno River or lands closely ad~aaent thereto, do earnestly ~.~ petition the Orange County Commissioners to take such action as they can to protect our property from lan3 condemnation by the City of Durham." Discussion ensued relative to the matter and Mr. Bennett advised the Board that it was his understanding that the City of Durham had chosen an alternate site for its proposed reservoir. A road petition was presented for Pine Trail which is located in the Whispering Pines Subdivision. Upon motion of Commissioner Norman Walker, seconded by Commissioner Ira A. Ward, it was moved and adopted, that said petition be accepted. Ths County Administrator presented a »etition for a road off of sR 1359. Upon motion of Commissioner Henry S. Walker, seconded by Commisaianer William C. Ray, it was moved and adapted, that said petition be accepted. The Clark presented a petition for Allen Street. Upon motion of Commissioner Tra A. Ward, seconded by Commissioner F_en_ry S. ~,Jalkar, it was moved and adopted, that said petition ba accepted. The County Administrator presented a latter from Mrs. Mmgdalena Beebe, 1511 Cumberland Road, Chapel Hill, North Carolina, Said letter requested that the -~ 3oard release Mrs. Beebe from the late listing penalty which had been imposed against her property and she cited that sickness and over sight wsa the reason she had failed to list by the required date. Discussion ensued. Upon motion of Commissioner Ira A. Ward, seconded by Commissioner Harry 5. Walker, it was moved and adopted, that the request of Mrs. Beebe be dented. The County Administrator stated that a clerical error was responsible for a late listing penalty being charged against Clark M. Rogara, 500 Sharon Road, Chapel Rill, PTorth Carolina and Mr. Gattis requested that the 3oard authorize the release of this penalty as there was no delinquency on the part of Mr. Rogers. Upon motion of Commissioner Ira.A. Ward, seconded by Commissioner Renry S. Walker, it was moved and adopted, that the request of the County Administrator relative to the late listing penalty of Clark M. Rogers be granted. Nir, Gattis stated that he had received a request from William Hall, 107 Holt Street, Hillsborough, North Carolina, relative to the Homestead Exemption Statute, in that, Mr. Ra11 stated he had filed his request for exemption, but that his tax notice did not reflect that he had been granted such an exemptior_. Ms. Gattis stated that his office had been unable to locate the exemption form, but that it was possible that said form had been misplaced or lost. He stated that Mr. Hall was knowledgeable of the contexts of the form and that he, therefore, believed such a form triad been oompleted. Upon motion of Commissioner Henry S. Walker, seconded by Commissioner William - C. Ray, it was moved and adopted, that the Tax Supervisor ba permitted to grant to Ms. Ra11 the Romestead Exemption which was authorized under G.S. 105-277.1. The County Administrator presented a letter of request from Dr. Thomas Griggs, one of Orange County~s Medical Examiners. Said letter requested the County to provide money for the purchase of two pager receivers. Said letter stated that these 4natrumenta would provide accees to the medical examiners at all times and to th.e County~s law enforcement and medical personnel through the North Carolina Memorial Hospital page operator. The cost of the pagers are X329 each or about $660. Discussion ensued. Upon motion of Commissioner William C. Hay seconded by Commissioner Ira A. Ward, it was moved and adopted that the sum of 660 be appropriated from the General Fund Emergency for the purchase of two Motorola pagers for the Medical Examiners who are on the staff at North Carolina Memorial Hospital. Chairman Bennett recognized Fred Cates, Mayor of the Town of Rillsborough. Ns. Cates stated that he wsa present in behalf of the Hillsborough Town Board to express the appreoiation of the Board for the service and the cooperation which had bean rendered by Chairman Harvey D. Bennett and Commissioner William C. Ray to the Town. Chairman Gannett recognized Tom Ward, Director of the Social Services Department. Mr. Ward stated that it was now mandatory that all day Care Centers be licensed, Re stated that no real problem had arisen unt31 now, but that the Social Servioea Department found itself in a position of being unable to administer the portion of the law which required that each center be inspected by an electrical inspector and a building inspector. Re stated that in the past that members of the local fire department had performed the necessary inspection, but that they now found themselves without official capacity and, therefore, the members were dubious about the impending penalty *.ahiah could be incurred in case of afire. Mr. Ward requested that the Board consider designating someone as an official inspector and that the local fire department could act as the official building inspector. Commissioner Norman Walker stated that he had talked with ~'ohn Forrest, who had conducted previous investigations, but that he was now refusing to act due to the lack of an official capacity to act as &:°ire and building inspector. ~y , ~ ! ; 'rc 5Ui Upon motion of Commissioner William C. Ray, seconded by Commissioner Norman Walker, it was moved and adopted, that Sohn Forrest be appointed the fire and building inspector for the purpose of serving the needs of the Department of Social Services on a Countywide basis. Discussion ensued as to the fees which should be charged for these -. official inspections. The Board agreed that the Social Services Director should negotiate a suitable fee with the electrical inspector and that the _ director was to report back tv the Board in order to secure the &AAPOVal - of the inspection fee. The County Administrator advised the Board that the current County Electrical Tnapector, 0. A, Evans was currently being employed by Orange County on a temporary basis and that Mr, Evans was not pleased with this current arrangement. Mr. Gattia stated that Mr. Evans had been performing satisfactorily and that he was afraid that Mr, Evans would accept employment elsewhere unless his position *.vas made permanent, therefore, he renotrmiended that the Board make permanent the position of County Electrical Tnapector. Upon motion of Commissioner SJilliam C. Ray, seconded by Commissioner Henry S. Walker, it was moved and adopted, that the position of County Electrical Inspector become a permanent position. Chairman Bennett advised the Board that .there were vacancies on the County Planning Board and the Chapel Rill Planning Board. Upon motion of Commissioner Tra A. Ward, seconded by Commissioner William C. Ray, it was moved and adopted, that Donald Wells of Glen Heights, Chapel FI311, North Carolina be appointed for a three year term as a member of the Chapel Hi11 Planning Board. Said term is immediately effective. Upon motion of Commissioner Tra A. Ward, seconded by Commissioner William C, Ray, it was moved and adopted, that Leon Yates of Erwin Road, Durham, North r Carolina, be appointed to a full tern as a member of the County Planning Board. Said term is immediately effective, i Chairman Sennett presented a letter from Ebert L. Pierce, County Extension Chairman. Said letter requested the approval of certain appointees on the Orange County Extension Advisory Board for a three year period ending July 1, 1975. 'Open motion of Commissioner Prorman Walker, seconded by Commissioner - Henry S. Walker, it was moved and adopted, that Jack Rutaherson, Curtis B, Farrington, Col. William H. Breeze, Mrs. Clyde Roberta and Mrs. John H. Jeffries be appointed for a three year period as members of the Orange County Extension Advisory Board. Commissioner William C. Ray brought to the attention of the Board the fact that State employees and County employees were not being granted the same holidays and that certain offices in the courthouse were remaining open while others were being closed and that he was requesting the Board to consider , granting the County employees the same holidays that were granted to State employees. Discussion ensued, Upon motion of Commissioner William C. Ray, seconded by Commissioner Norman Walker, it was moved and adopted, that the County employees be granted the same holidays as State employees in order to standardize the i holiday schedules. The Register of Deeds advised the Board that the *lorth Carolina Assooiation of Registers of Deeds were proposing to revise the current fees being collected in that office, She stated that in some instanoea the proposed schedule would increase the fees from fifty to one hundred percent (50~ to 100) and she could not justify this percentage increase and that i she wanted the feeling of the $oard relative to the matter, bisauseion ensued. - Upon motion of Commissioner William C. Ray, seconded by Commissioner Tra A. Ward, it was moved and adopted, that the Register of Deeds not endorse - more than a twenty percent (20p) increase in the fee schedule for that office. ~~: There being no further business to come before the Board the meeting adjourned.
