PURPOSE: To consider recommendations regarding the North Carolina Department of
Transportation's (NCDOT) Proposed 2008-2009 Secondary Roads Construction Program for
two roads, Ben Wilson Road and Jimmy Ed Road.
BACKGROUND: The Orange County Board of Commissioners held a public hearing on
January 22, 2009 to receive comments regarding paving options for two roads deferred from the
May 20, 2008 public hearing on NCDOT's proposed 2008-2009 Secondary Road Construction
Program. Property owners on Ben Wilson Road and Jimmy Ed Road stated at the May 20,
2008 public hearing that they did not want NCDOT to pave the roads. The Board voted
unanimously to approve NCDOT's proposed Secondary Road Construction Program with the
exception of Ben Wilson Road and Jimmy Ed Road, and deferred action on those roads until
NCDOT could meet with the two communities and come to consensus about paving the roads.
NCDOT has not yet acquired right-of-way for all parcels on both roads. However, both roads are
eligible for condemnation. If NCDOT cannot acquire needed right-of-way, or if NCDOT chooses
to deviate from the proposed paving program, NCDOT may put the roads or affected portions of
the roads on the "Hold List" and those funds will be applied to the roads listed in priority order in
the paving alternate list for Orange County.
Ben Wilson Road
NCDOT met with residents on Ben Wilson Road on June 24, 2008. At that forum, residents
came to consensus to support paving the northern 1/3 of the road (from Bowman Road to the
Squires property). The Board has four options to consider for its recommendation to the Board
of Transportation:
1. Pave only the northern portion of Ben Wilson Road (all residents agreed to this);
2. Pave the northern portion of Ben Wilson Road and leave open the possibility of paving the
remainder if support of property owners comes at a later time;
3. Pave the entire road subject to availability of right-of-way; or
4. Don't pave Ben Wilson Road..

Jimmy Ed Road
NCDOT met with residents along Jimmy Ed Road on June 23, 2008 and again on August 4,
2008. Residents were divided in their views regarding paving the road. At the last forum,
residents supported paving Jimmy Ed Road along the frontage of Lattisville Grove Baptist
Church, which is the major traffic generator on Jimmy Ed Road. The residents in favor of
paving the entire road agreed to continue talks with their neighbors and come to some
consensus regarding paving the remainder of the road.
The Board has three options to consider for its recommendation to the Board of Transportation:
1. Pave Jimmy Ed Road from Walnut Grove Church Road to the driveway of Lattisville Grove
Baptist Church (all residents support this);
2. Pave Jimmy Ed Road from Walnut Grove Church Road to the driveway of Lattisville Grove
Baptist Church and leave open the possibility of paving the remainder if support of property
owners comes at a later time;
3. Pave Jimmy Ed Road in its entirety, subject to availability of right-of-way; or
4. Don't pave Jimmy Ed Road.
January 22, 2009, public hearing
Ben Wilson Road. Three members of the public expressed their concerns; none objected to
paving the northern portion of the road.
• Dust and dirt cause additional maintenance to vehicles and homes and aggravate respiratory
problems for the property owner on the east side of the road located along the middle 1/3
(approx.) of the road. The property owners would like the road paved across road frontage
of their property.
• Dust and gravel are problematic to property owners on northern end of the road and those
property owners (3 parcels) would like that portion of the road paved.
• Property owner on the southern portion of the road does not want the southern part of the
road paved in order to maintain the rural character of that area and to discourage more
intense development of other properties on the road. The property owner did not object to
paving the road north of her property.
Jimmy Ed Road. Three members of the public expressed different views for paving the entire
road, but supported paving the portion from Walnut Grove Church Road to the driveway of
Lattisville Grove Baptist Church.
• Representatives of Lattisville Grove Baptist Church and Winstead Grove L.L.C. wanted the
entire road paved.
• Representatives from Lattisville Grove Baptist Church indicated that the right-of-way is
eligible for condemnation (seventy-five percent (75%) of property owners adjacent to the
project and the owners of the majority of the road frontage adjacent to the project have
dedicated the necessary property for the right of way) and the church is willing to provide
funds required by the Department of Transportation to cover the costs of condemning the
remaining property.
• A property owner on the northern side of the road expressed the concerns of other property
owners on the road that did not want the road paved past the entrance to the church, which
is the major traffic generator. The property owner pointed out that Jimmy Ed Road is a dead
end road serving only eight (8) parcels.
FINANCIAL IMPACT: There is no direct financial impact associated with this decision item.

RECOMMENDATION(S): The Manager recommends the Board endorse the following for the
2008-2009 Secondary Road Construction Program for Orange County and forward that
recommendation to NCDOT:
1. Pave Ben Wilson Road from Bowman Road to Hebron Church Road (approximately 1.10
miles), subject to availability of right-of-way, as proposed by NCDOT; and
2. Pave Jimmy Ed Road from Walnut Grove Church Road to the end (approximately 1.0 mile),
subject to availability of right-of-way, as proposed by NCDOT.
