Harvey, Planner 245-2607 PURPOSE: To reschedule the public hearing concerning the review of a rezoning petition seeking to rezone 4115 Old NC 10 (TMBL 5.26..40 / PIN 9893-00-8606) from Existing Commercial Five (EC-5) to Rural Residential One (R-1). BACKGROUND: This item was reviewed at the November 24, 2008 Quarterly Public Hearing where the Board adjourned the hearing until February 3, 2009 in order to allow for the Planning Board to review the request and make a recommendation to the BOCC. The Planning Board reviewed this item at its meeting on January 14, 2009 and voted unanimously to recommend approval of the rezoning petition. However, approved minutes of the Planning Board meeting will not be ready in sufficient time to allow the County Commissioners to re-convene the public hearing on February 3, 2009 to take action on the petition. The Zoning Officer recommends the Board re-convene and then adjourn the hearing until March 17, 2009. This will allow for the minutes to be completed and approved by the Planning Board for the County Commissioners to review. FINANCIAL IMPACT: There is no financial impact with re-convening the public hearing and adjourning it until March 17, 2009. The public hearing was previously advertised as part of the November 24, 2008 Quarterly Public Hearing advertisement and the Board may continue the hearing to a date and time certain without re-advertising the hearing. RECOMMENDATION: The Administration recommends the Board: 1. Re-convene the public hearing on this item, 2. Adjourn the hearing to March 17, 2009 to allow for the Planning Board to review and approve the minutes from its January 14, 2009 meeting.
