January 14, 2009 Planning Board Draft Minutes PURPOSE: To take action on the amendment of the Eno EDD Area Small Area Plan by revising the definition of the Eno Mixed Use proposed land use category to specify an acreage limit for residential development within the Mixed Use area. BACKGROUND: The Eno Economic Development District (EDD) is located within Eno Township in the east-central portion of Orange County. The planning area addressed in the Eno EDD Area Small Area Plan (SAP) is comprised of approximately 942 acres. One of the land use recommendations contained within the SAP is the establishment of a Mixed Use area that encompasses 297 acres of the planning area, excluding rail and road rights of way (see Attachment 1). The proposed Mixed Use area is envisioned as a mix of residential, commercial, office, services, and light industrial uses. At the time of adoption of the Eno EDD Area Small Area Plan, the BOCC requested staff evaluate the proposed new Eno Mixed Use land use designation to determine the appropriate limits on residential development within this new land use category and bring a recommendation back to the November 2008 Quarterly Public Hearing. This proposed amendment addresses the small area plan. Implementation measures, including Comprehensive Plan amendments and Zoning Ordinance amendments will be forthcoming and follow another full Quarterly Public Hearing (QPH) process. The scheduling of the implementation recommendations of the various adopted small area plans is being evaluated. This is to ensure the Board of County Commissioners' and the Economic Development Commission's goals are being considered and incorporated. Staff evaluated the current land use patterns within the proposed Mixed Use area and recommends a maximum of 25% of the land area within the district be permitted for residential 2 development. This acreage limit includes the existing Whispering Pines single-family residential subdivision in its entirety, which encompasses 54 acres. Undeveloped lots within the subdivision may be developed at the current density, as platted. However, new residential development within the Mixed Use area shall be developed at or above the minimum density of six (6) units per acre. This allows approximately 21 acres within the Eno Mixed Use area for new residential development. In addition, staff recommends new residential development constructed above non-residential uses (i.e., in a multi-story building) shall not count toward the 25% acreage limit within the district. On September 29, 2008 the Eno EDD Task Force met to discuss the residential limits within the Mixed Use district. Task force members concurred with staffs recommendation of limiting the acreage for new residential development to 25% of the total land area within the Mixed Use district. In addition, the task force agreed with the added provision of allowing residential units constructed above non-residential uses to not count toward the 25% residential acreage limit. This item was heard at the November 24, 2008 Quarterly Public Hearing. The BOCC voted to refer this item to the Planning Board for its review and recommendation. FINANCIAL IMPACT: There is no direct economic impact. Staff time has been accounted for in the departmental budget. PLANNING BOARD RECOMMENDATION: The Planning Board voted unanimously at its January 14, 2009 meeting to recommend approval of the proposed amendment. RECOMMENDATION(S): The Administration recommends the Board: 1. Receive the Planning Board recommendation, and 2. Approve the Small Area Plan amendment as shown in Attachment 2. Residential uses within Mixed Use areas should be have a minimum density of six (6) units per acre. Examples of housing at this density include attached homes, patio homes, and apartments. Note: prior to adoption of implementation measures, a percentage or acreage limit on residential uses within the Mixed Use area should be determined. It is the intent to limit the amount of residential uses in the Mixed Use area to encourage the development of non-residential uses. Proposed: Eno Mixed Use. Land located in areas served or to be served by public water and sewer where a mix of residential, commercial, office, services, and light industrial uses are appropriate on a district-wide basis. Individual parcels may contain a single use or more than one use. New residential uses within the Mixed Use areas should shall have a minimum density of six (6) units per acre.
