Participate on the State Regions Advisory Committee Tn keeping with these responsibilities, the Lead Regional Organization will have the Following prerogatives: 1. Any state funds which may be appropriated for general purpose regional planning will be administered through the designated Lead Regional Organization. ' 2, A11 multi-jurisdictional planning and programs within the region, unless exempted by state or federal law or poling, will be subject to policy direction from the designated Lead Regional-Organization. 3. Much of the basis data gathering and analysis to undergrid each regional program will be provided by the State. Failure to perform the above tasks may result in the withdrawal or reassignment of the Lead Regional Organization designation. The above guidelines are recommended to the Secretary of the Department of Administration on this the 28th day of October, 1971, by hie Adviavey Committee on Regional Planning and Development. 'The Board of County Commissioners of Orange County met in regular session in the Diatriat Courtroom of the Courthouse in Hillsborough, North Carolina, on Tuesday, September l9, 1972 at 8 o~aloak P.M. Members Present: Chairman Harvey D. Bennett and Commissioners William C. Ray, Harry S. Walker, Ira A. Ward and C; Norman Walker. Members Absent: None '~ Chairman Bennett read a letter from the Orange County Planning Board I' advising the Commissioners that the Planning Board had voted to reject ~ the request of E. 0. Hardee to rezpne a five (5) errs treat from a residential area to a mobile home park area. Said property is located near Calvander. Commissioner lra A. Ward raised a question relative to the language used by the Planning Board in their latter of rejection of the rezoning request. The ~ Chairman directed the County Administrator to check with the Planning Board ' relative to the wording of the letter and to advise the Board of hie Findings at their next meeting. The County Administrator presented a letter from the Area Real Estate Office of the II. S. Army Corps. of Engineers. Said letter concerned the removal of a cemetery located on the New Hope Lake project. Chairman Bennett dtreated the County Administrator to provide the District Health Office with a aapq of the letter. rte--- ~' The County Administrator presented, for the approval of the Board, - Amendment #1 to the Project Agreement formulated for the Lake Orange aedi:nent atruaturea, This amendment adjusts the estimated cost of the sediment structure from $16,100.00 to the actual bid.aost of $21,607.35. ~_ IIpon motion of Commissioner Ira A. Ward, seconded by Coxuatsaioner Henry S. Walker, it was moved and adopted, that Chairman Bennett be authorized to sign Amendment #l. Chairman Sennett read a letter from the Health Planning Council. Said letter requested that the 8aard appoint two members to the Health Planning Council. Upon motion of Commissioner William C. Ray, seconded by Commissioner Henry S. Walker, it was moved and adopted that Dr. 0. Aavid 13arvin and Vince gavel be appointed ea members to the Health Planning Council for s term of three years. Chairman Bennett announced that the Board would at this time consider the ~ question of the County's participation in the proposed sanitary landfill - operation. Chairman Bennett recognized B. B. Olive oP D~ham. Imo. Olive stated that he would like to organise a team of individuals who would make a solid waste disposal study Por Orange County. He stated that he hoped the University of North Carolina would be willing to grant the Town oP Chapel H111 just three more cares oP land Por use as a landfill area for an additional year. He requested that Orange County not invest any money in the proposed sanitary landfill area on Embanks Road until all aspects of the appeal pending before the State Board of Health could be resolved. kIa stated that hie appeal was based on inadequate soil borings on a twenty-Five (2s) acre tract approved for the landfill operation, the Paat that rook wsa reached at a shallow depth in the holes bared on the cite, that no reasonable evidence had been offered to eatabliah the fact that the walla in the immediate area would not be polluted, the long run nowt of using the site could run into millions of dollars if the site is underlain with rock, re ulationa from the State Board of Health requires test borings to extend ten (10) feet below the maximum trench depth., and that no teat borings extended below the ten (10) foot depth of the trench, the application filed auggeated that the site would serve 39,OOD people and that the people oP the County could not be served under the current proposal, and that the life, in year a, oP this landfill had not been estimated and thus it did not comply with the State Board of Health regulations. I+~. Olive stated further that he intended to seriously pursue the appeals now on file with the State Board oP Health. Chairman Bennett read a summons that had been served upon him as Chairman of the Berard. The summons ordered the County of Orange to be present in court on Wednesday, September 27, 1972. The matter of the suit filed by the New Hope Improvement Assooiation relative to the sanitary landfill operation oa klxbanks Road was to be heard by Judge Thomas D. Cooper. The County Administrator was directed to turn the complaint and the a~ona over to the _ County Attorney. Commissioner Norman Walker moved that the Board refrain from taking any action on the sanitary landfill matter until the suit filed by the New Hape Improvement Association had been heard in court and settled. Commissioner Henry S. Walker offered a second to this motion. Commissioner William C. Ray stated that he was opposed to the motion as he felt the County should let the Town of Chapel Hill know what it intended to do about the sanitary landfill matter. Commissioner Tra A. Ward stated that he felt the Board was, at this time, considering possible methods of how the County would participate in the sanitary landfill err®a and he saw no reason to delay the discussipn on the matter. Chairman Bennett called Por a vote an Commissioner Norman Walker's motion. Commissioners William C. Ray and Tra A. Ward voted aye. Commissioners Norman Walker and Henry S. Walker voted nay. Chairman Bennett voted aye and then declared the motion defeated. Commissioner William C. Ray moved that after proper approvals, satisfactory to the Beard, were received from the State Board of Health and the Court and satisfactory agreements as to the ownership of the real estate the operation and control of the landfill were agreed upon between the County and the Towns of Chapel Hill and Carrboro that the County should signify its willingness to financially participate in the proposed sanitary landfill operation on a .- forty-three percent ((~.3~) basis. Commissioner Ira A. Ward seconded Commissioner Ray's motion. Chairman Bennett 4alled for a vote on the motion. Commissioners Harvey D. Bennett, Henry S. Walker, William C. Ray and Ira A. Ward voted aye. Commissioner Norman Walker abstained. Chairman Bennett then declared the motion passed. -' c'^.( ~ "~ .'P~ 493 Coumiiasioner Ira A. Administrator proceed witk~ the arrangements relative to the title and operation ' of the proposed sanitary landfill. --' Chairman Bennett presented a letter of resignation from the Chapel Hill Planning Board from Wesley Wallace. Said resignation was effective immediately. Upon motion of Commissioner Ira A. Ward, seconded by Commissioner William C. Ray, 3t was moved and unanimously adopted that Donald Willhoit and Billy Morgan be appointed as members of the Carrboro Planning $oard. There being no further business to come before the Board the'. meeting was adjourned to meet again on Monday, September 25, 1972,':at 8 P,M, in the Courtroom of the Courthouse in Hillsborough, North Carolina. Gatos, Acting Clerk MINUTES OF THE ORANGE COUNTY BOARD DF COMMISSIONERS September 2s, 1972 The Board of County Commissioners of Orange County met at 8 o'clock P.M. in the Courtroom of the Courthouse in 7illsborough, North Carolina on Monday, September 25, 1972. i. Members Present: Chairman Harvey D.. Bennett and Commissioners William C. Ray, Henry S. Walker, Ira A. Ward and C. Norman Walker. Members Absent: None , Also present were members of the County Planning Board, Chairman Bennett announced that this was the time and place for the public hearing an amendments to the County Zoning Ordinance. Chairman Bennett turned j the chair over to Charles Johnston, Chairman of the County Planning Board. Mr. Johnston conducted the public hearing. For minutes of this public hearing see the Orange County Planning Board minute docket. At the conclusion of the public hearing Chairman Johnston turned the chair back to Chairman Bennett and Chairman Bennett then adjourned the meeting.
