BOARD OP COMP4ISSIONERS

The Board of County Commissioners of Prange County met in regvJ_ar session
in the Conference Room of the Social Services Building on Tuesday, September 5,
1972, at 10:00 o~oloak A. M.
Members Present: Commissioners Henry ~. Walker, William C. Ray and Ira
A. Ward. Commissioner Norman Walker was present for the afternoon session.
Members Absent: Chairman Harvey D.'Bennett
In the absence of the Chairman, Vice Chairman Henry S. Walker presided
at the meeting.
Upon motion of Commissioner Ira A. Ward, seconded by.Commissioner William
C, Ray, tt was moved and adopted, that the Board dispense with the reading
of the minutes.
`lice Chairman Henry Walker recognized L, ?~I. Cheshire, Tr. Mr. Cheshire
introduced Clayton Haithcock, the new Zoning Officer.
P~Ir. Cheshire requested the Board to schedule a date, time and place for a
public hearing on recent zoning requests. Disouasion ensued concerning the
possibility of establishing a definite date and time for all public hearings:
Commissioner Ira A. Ward moved that Monday, September 25, 197p, at 8 P.M.
at the Courthouse in Hillsborough, North Carolina be designated as the public
hearing on zoning matters. '
The following plate were presented:
1. Lot l0 ~iwin Carden property, University Station Road, Eno Township.
Mr. Cheshire advised the Board that a percolation teat had been conducted by
the District Health Department and the County Planning Board--did-approve said
plat.
Upon motior_ of Commissioner William C, Ray, seconded by Commissioner Ira
A. Ward, the Edwin Carden plat wsa approved for recording.
2. property of C. Dupree Smith, St. Mary~a R oad, Eno Township. Mr.
Cheshire stated that this property had undergone a percolation test and the
County Planning Board did approve said plat.
Upon motion of Commissioner Ira A. Ward, seconded by Commissioner William
C. Ray, the C. Dupree Smith plat was approved for recording.
~. Strayhorn Hills located on Old #10, r''ho Township.
The Board was advised that the County Planning Board had approved the
recording of said plat.
Upon motion of Commissioner William C. Ray, second®d by Commissioner Ira A.
Ward, it was moved and adopted, that Strayhorn Rills plat be approved for
recording.
B. B. Olive stated that he noted that the back portion of the Strayhorn
Hills Subdivision lot abuted a railroad track. He suggested that the Board
inolude a provision in the planning ordinance that the deve7,oper of ?7z~opsrtp
that ad~•oined or abuted a railroad track be required to fence off the property
at the railroad track, Commissioner Ward suggested that the Planning Officer
advise the County Planning Board of this recommendation.
Vice Chairman Henry S. walker recognized B. B. Olive. Mr. Olive stated
that he wsa present to petition the Board to revoke their previous action on
the rezoning of the Eubanks Road property. Ha stated that he was convinced
that a grave mistake would be made if the decision was allowed to stand as
the action taken by the Board was based on erroneus information. Mr. Oliva
stated that three sores of land from the University to the Town of Chapel
Hill would grant a one year period of time and thus would allow adequate time
for proper planning of any sanitary land fill area. Mr. Olive ureaented data
that he had acquired from the State Health Department and he advised the-Board
that the State Board of Health had agreed to review the matter.
Vice Chairman Henry S. Walker advised Mr. Olive that the Board would take
the matter of the sanitary landfill data under advisement, but that he did not
feel the Board was in a position to answer his request relative to the revoking
of its action to re-zone the Eubanks Road property.

IIpon motion of Commissioner Ira A. Ward, seconded by Commissioner William
C. Ray, the following Resolution wee adopted:
"SJHEREAS, the Governor declared on May 11, 1971, that one
legally constituted organization will be designed as the LEAD
regional organisation in each of the 17 multi-county regions in
North Caroline; AND
WHEREAS, such LEAD regional organization will be expected to
provide leadership for effective regional planning and for program '
implementations; AND ~ .
WHEREAS, such LEAD regional organization must be created by
gen®ral purpose local governments and must have its membership open
to all general purpose local governments within its region; AND '
WHERF.4S, the Triangle J Council of Governments meets sll of
the above descriptions and stipulations;
NOW, THEREFORE, BE ITP RESOLVED that the governing body of the
(oounty) (city) of (name your county, city, town) joins with auoh
other municipalities and counties in this multi-county planning
region as may pass this resolution in support of the designation
of the Triangle J Council of Governments as the LEAD regional
organization in multi-county planning region S.°

A road petition for Hawthorne Road in Rollingwood was presented. Commissioner
Ira A, Ward moved that the Clerk forward same to the State Highway Commission.
A petition for Wava Road in Rolling Hi11s was presented. Commissioner William
C. Ray moved that same be approved and the Clerk forward same to the State
Highway Commission.
S. M. Gatos stated that the Board had been petitioned in July to close a
street designated as Bramble Road in the Willow Ridge Subdivision and that the _
Board had scheduled the public hearing on the matter for September S, 1972.

The petitioners, James R. Hawkins, W, Glenn Young, Sr., Edwin

show unto the Board of County CommS.ssioners of the Covnty of Durham
and Orange, North Carolina:

That Petitioners are the owners in fee simple of all the real
property located on both sides of the herein below described street,
as shown on development known as "Section Three (3) Willow Ridgev
as per plat and surveyed thereof by George C. Love, Registered Land
Surveyor, dated September 3, 1971, recorded in the Offioe of the
Register oP Deeds, of Durham County, in Plat Book 70 at Page 30, and
in the Office of the Register of Deeds of Orange County, in Plat Book
19 at Page 52, a Dopy of which plat is attached hereto and made a
part hereof, said property having been acquired by the Petitioners
by Deed from James R. Hawkins, et al, as tenants in common, dated
March 5, 1970, recorded Msseh 16, 1970, in Deed 3ook 363, at Page 90, -
Durham County Registry, and Deed Book 221. at Page 983, Orange County
Registry.

That the aforementioned street known as "Bramble Road'' (being the
entire street) referred to in Paragraph One (1) above is more particularly
described as follows:
BEGINNING at a stake on the south side of Horseshoe Circle, which
stake is located 381.x.8 feet in a easterly direction from the
_ northeast corner of Lot No. lr, Block E, as shown on plat survey
hereinafter referred to, said stake being the northwest corner
of Bramble Road, as shown on in plat eurvay hereinafter referred
to, and running thence along and with a new line being a continu-
ation of Horseshoe Circle alo the arc of a counter-clockwise

Office of the Register of Deeds, Durham County, in Plat Book 70, and
in the Office of the Register of Deeda,.Oxange County, and in Plat
Book 19 at Page 52.

That the said property above described is located partially in Durham
County and partially in Orange County.

That Bramble Road as above described, to the full extent thereof, is e
dedicated publio roadway only by reason of the recordation of said plat in the
Office of the Register of Deeds o£ Orange and Durham Counties; that the afore-
,' mentioned Bramble Road has never been opened for public use since its dedication
in 1971; that since the recordation of the plats of "Section Three (3) Willow
Ridge" as aforesaid, it has bean found that a better plan of subdivision of
the lots abutting Bramble Road would necessitate the relocation of said Bramble
Road eastwardly in order to accomplish a better land use of said lots by reason
of utility rights-of-way over said property maintained by Carolina Power and
Light Company as to a 100-foot right-of-way and Duke Power Company as to an
adjacent 150-foot right-of»way to the said right-of-way of Carolina Power and
Light Company, and that the closing of said Bramble Road and the relocation of
same would serve to promote the publio interest by relocating Bramble Road
eastwardly as shown oa the above described plats to avoid the close proximity
to said publ3a easements.

That this Petition is brought pursuant to Provisions of General Statute
153-9 (17) for the purpose of aloaing the aforementioned street known as Bramble
Road; that Notice of a meeting of the County Commissioners of Durham County and
the County Commissioners of Cran a County to act upon this matter is being
nubliahed once a week for four (~}) consecutive weeks to the Durham Morning Herald,
a newspaper published in Durham County, and in the News of Orange County, a
newspaper published in Orange County; that a copy of said Notice is hereto
attached and marked as "F~rhtbit A" and is to be incorporated into and made a
part hereof as if fully set out herein.

That Duke Power Company and Carolina Power and Light Company each the
owners of easement rights over ar_d upon said property have been notified by
registered mail of the time and place of the maetiaga of the Commissioners
of Orange and Durham Counties, of which the closing of said street is to be

That the Petitioners are the only Parties owning property adjoining or
abutting the aforementioaed street known as Bramble Road.

That the closing of the aforementioned street known as Bramble Road
is not contrary to the public interest and no individual owning property in
the vicinity of said street would be deprived of a reasonable means of ingress
and egress into his or her property, but the plat and survey entitled "Section
T?~ree (3) Willow Ridge" recorded in the Office of the Register of Deeds of
Durham County in Plan Book 70, at Page 30, and in the Office of the Register of
Deeds in Plat Book 19 at Page 52, a ooPSI of which is attached hereto and marked ~..
as "Exhibit B" and is to be incorporated into and made a part hereof sa if fully
set out herein, shows the street known as Bramble Road, petitioned to be closed.

That the street known as Bramble Road as shown on the aforementioned plat
and survey should be closed and the dedicatien thereof as a public street rejected
and withdrawn and the Title thereto vested in the Petitioners, being the owners
of the Lota or Parcels of Land adjacent to said Bramble Road, ae provided by
North Carolina General Statutes, Seetion 153-9(17).
~r7EiEREFORE, your Petitioners pray the County Commisalaners oP Durham County
and the County Commissioners of Orange County, that Bramble Road as skxown on plat
and survey above referred to be closed and the dedication thereof forever
rejeoted and withdrawn and the titles thereto vested in the Petitioners therein as
provided by North Carolina General Statutes, Section 153-9(17).

Notice of Petition for Rejection of Dedication of a roadway known as
Bramble Road .as shown on plat and survey entitled "Seetion Three (3) Willow

Plat Book 70 at Page 3O, and in the Office of the Register of Deeds of Orange
County in Plat Book 19 at Page 52, bounded on the north by Horseshoe Circle,
near Craig Road and in Durham County.
The above named Petitioners will petition the Board of County Commissioners
of Durham and Orange Counties for the closure and rejection of dediaatioi~ of

Upon motion of Commissioner William C. Ray, seconded by Commissioner Ira
A. Ward, it was moved and adopted, that the Orange County Board of Commissioners
approve the closing of Bramble Road in Section Three of Willow Ridge Subdivision
provided that the Durham County Board of Commissioners also approve the petition
for the closing of said road.
Vice Chairman Henry S. Walker recognized Mrs. R. W. Islet', President of
the Hillsborough Ristoriaal Society and Mr a. Islet' in turn introduced Dan Shepherd,
Mr a. Lena Moore and Dr. Charles Blake to the members of the Board. Mrs. Islet'
requested the Board consider allocating additional space to the museum and also
requested that one of the rooms on the first floor of the Old Courthouse be
allocated to the Commission aad to the Society for office purposes and a welcome
center for the town. Discussion ensued as to the benefits which would be derived
from the establishment of & welcome center. The Board promised to take the matter
of apaoe allocation under advisement.
Vice Chairman Henry S. Walker recognized Don S. Matheson, Chairman of the
Confederate Memorial Library Board. Mr. Matheson introduced Lloyd Ostexman and
members of Harkin and Rice Architects of Raleigh. He stated that the State
Library Board was tremendously ~.mpresaed with the Burnside property. A
presentatien of the feasibility study, which had been requested by the Board,
was presented. The study revealed that the house was sturdy and it was strongly
recommended that the restoration of the property be mad®. Discussion ensued
concerning the report.

The matter of the title to the Confederate Memorial Library was brought
before the group. The County Attorney advised that re was unable to locate
any record of title to the Confederate Memorial Library. He stated that it
was his opinion that the Diooeae of North Carolina must execute a quitclaim
deed to Orange County. Mr. Cheshire suggested that the Vestry of St.
Matthews ~iisaopal Church arould be approached and asked if they would request
the Diooeae of Idorth Carolina to execute a quitclaim deed and that ha felt the
County of Orange should also request that the Town of Hillsborough execute a
quitclaim deed in order that proper title to the Confederate Memorial Library
may be vested in the County of Orange.
~'~ S. M. Gattis, County Administrator, advised the Board that he had
requested Robert Peck, Manager of the Town of Chapel, to appear before the
Beard for the purpose of discussing the proposed sanitary landfill on Eubanks
Road.' Discussion revealed fret the University of North Carolina would not ,
participate in any of the financing of the proposed sanitary landfill and
thus the proportionate percen~age share of financing for the Towns of Chapel
Hi11 and Carrboro and the County of Orange had bean increased. Mr. Peck stated
R. G. klancock, owner of the proposed landfill nronerty, had stated that he
would be willing to defer payment on one hizndred't}iousand ($100,000) for a
pear and that Mr. Hancock was interested in retaining the timber rights on the
property which the Town was proposing to purchase. A discussion ensued
concerning a buffer zone and pulp wood rights. Commissioner Ira A. Ward
asked if there had been any agreement reached as to who would take title to
the landfill prop®rty. Mr. Peok stated that na agreement had been reached,
but he was assuming the property would be deeded to the Town of Chapel F~11
and the County of Orange, but the Town of Cr~tpel Hill had the experience and
would operate h¢_•1 ill area. He stated that the landfill operation wov].d
be a separate ~nd separate accounts would be maintained by the Town
of Chapel Ri11, Se stated that he felt that it should establish a three
member Board which ±could serve as a rate board and a budgetary board and
~!'iat the salaries of all employees should come under t'_:e towns salary
schedule, but that the cost of th.e land and the coat of the equipment should
be shared jointly by the two municipalities and the County. Commissioner
William C. Ray stated that he felt the County should participate on a "One ~
shot basis" and then. the Town of Chapel Fill should operate the landfill.
Mr, Peck stated that he felt all items of cost should be shared jointly.
Commissioner Ira A. Ward stated that he agreed in pert with the other ~
statements, but that he felt the County should be allowed some authority in i
establishing the rate schedule and other physical con~rols. Commissioner
Ira A. Ward inquired if Mr. Udry of the State Health Department had given the
Towr_ of Chapel gill a date as to when to expect a reply from the r_ew ii
investigation. Mr, Peck replied that he had been assured that the reply
would be giv®n with n a few days, Commissioner William C. Ray stated he ',
felt the figure of 175,000.00 was the amount that Orange County should j
supply and that the money ahauld be applied for the joint ownership of the
landfill property with the Tawna of Chapel H311 and Carrboro supplying the
equipment. The County Administrator advised that all previous dissuasions
had been held an a percentage unit cost and that ainoe the University would i ..
not be partioipating in the landfill the Covaty+s portion had risen to 43.11.
Mr. Peck stated that he felt the collected revenues from the landfill operation
would replace worn out equipment and that he felt the County should look at
the overall starting ooat which was $327,000.00. Further disauasian ensued.
GUIDELINES FOR THE
DESIGNATION OF LEAD RE(fiTONAL ORGAI7'2ZATION3
IN NORT$ CAROLINA
As a follow-up to the designation of 17 uniform, multi-county regions,
Governor Scott, on May 11, 1971, issued a statement outlining a new policy
regarding the State-regions relationships. Dne to the multiplicity and
diversity of multi-jurisdictional agenaiea within the regions, it was felt
that a single organisation should be recognized in cash region: an
organization that could establish regional goals and objectives, and also
serve as the regional agent is dealing with state and Federal agencies.
Therefore, it was dedided that a Lead Regional Organization (LRO) would be
designated in eaoh of the regions. This, hopefully, will result in a new
relationship between State and Looal governments, a "Partnership in
Leadership." Stato government will take an active leadership role by creating
a planning and operation framevrork that will insure a consistent linkage oP

The Lead Agency policy should provide local governments with the ability
to make a stronger and more effective response to the prpblems and opportunities
facing them.

It should also provide a bettor system of coordinating and administering
many previously overlapping Federal and State programs. State government
will be provided with a meahaaiam for getting its people-oriented programs
oloaer to those people whom they are supposed to benefit.
The authority far designation oP the Lead Regional organizations resides
with the North Carolina Department aP Administration. The guidelines ~
stipulated herein will assist in determining whether a ma~lti~ounty regional ',
planning agenay has established sufficient area wide planning aspability to
assume the Lead Agenay.function Por the designated planning region. They will
also assist the regional agency in understanding the duties and responsibilities
of the Lead Regional Organization.
1. A11 requests Por designation shall be directed to the Department of
Administration.
2. There shall be only one Lead Regional Organization designated in
cash of the 1~ arulti-county planning regions.
a. Only legally constituted organizations, created by general purpose
local governments, will ba designated.
b. The designated regional organization must have its membership open
to all general purpose local governments within the region.
3. Tha applicant organization moat have the support oP general purpose
lots]. governments within its region, shown by the following:
a. Resolutions by the governing board of each local governmental
unit that is a member of the organization.
b. Resolutions by the governing board of each local governmental
unit not a member of the organization, or in the ease of those
governments not passing a resolution, a nopy oP oorrespondence
requesting such resolution and the reply, if any.
~.. The full membership of the applicant organization moat pass a
resolution setting forth its understanding of the responsibilities
of Lead Reggional Organizations, and its resolve to assume auoh
reaponsibilitiea.
s. The Lead Organization designation will be reviewed annually to determine
whether the leadership role is being carried out effectively in each ..
region.
6. Ekisting regional organizations meeting the membership guidelines, and
with adequate funding and staffing,, will be given priority consideration
in the designations.
After designation as the Lead Regional Organization, an organization shall
be expected to perform appropriate tasks inoident thereto. These include, but
are not limited to, the following r
1. Provide necessary leadership for effective regional planning and program
implementation.
2. Undertake the A-95 Clearinghouse Function for the region.
a. Those regional organizations which have already received alearing-
hou~e designations will receive priority for designation as the
Lead Organisation. IP another organization is designated as the
Lead Regional Organization, the organization designated ae the
Regional Clearinghouse must relinquish this function in favor of
the Lead Regional Organization.
b. Those organizations which have not received clearinghouse designation
must be prepared to serve this function if they are designated as
Lead Organizations.
3. Develop an overall program design, a regional development plan con- -
siatent with the Statewide Development Plan, and an annual work program
to carry out those plans.
!~. Develop a minimum budget and staff capability to Pv11Fi11 their

s. Undertake planning eativities for the entire region, regardless of

6. Participate on the State Regions Advisory Committee
In keeping with these responsibilities, the Lead Regional Organization will
have the following prerogatives:
1. Any state funds which may be appropriated for general purpose
regional planning will be administered through the designated Lead
Regional Organization.
2. All multi-jurisdictional planning and programs within the region,
unless exempted by state or federal law or policy, will be subject
to policy direction Prom the designated Lead Regional-Organization.
3. Mush of the basic data gathering and analysis to undergrid eaa2s
regional program will be provided by the State.
Failure to perform the above tasks may result is the withdrawal or
reassignment of the Lead Regional Organization designation.
The above guidelines are recommended to the Searatary of the Department
of Administration on this the 28th day of October, 1971, by his Advisory
Committee on Regional Planning and Development.

'The Board of County Commissioners oP Orange County met in regular session
in the District Courtroom of the Courthouse in Hillsborough, North Carolina,
on Tuesday, September 19, 1972 at 8 o'oloak P.M.
Members Present: Chairman Harvey D. Sennett and Commissioners William C. Ray, ,

Chairman Bennett read a letter Prom the Orange County Planning Board
advising the Commissioners that the Planning Board had voted to reject
the request of E. 0. Hardee to rezpne a five.(5) acre treat Prom a residential
area to a mobile home park area. Said property is located near Calvander.
Commissioner Ira A. Ward raised a question relative to the language used by
the Planning Board in their letter oP rejection of the rezoning request. The
Chairman directed the County Administrator to check with the Planning Board
relative to the wording of the letter and to advise the Board of his Findings
at their neat meeting.
The County Administrator presented a latter from the Area Real Estate
Office oP the V. S, Army Corps. aP Engineers. Said letter concerned the
removal of a aemstery located on the New Hope Lake project. Chairman Bennett
dtreated the County Administrator to provide the District Health Office with
a Dopy oP the letter.
J ~ The County Administrator presented, for the approval of the Board,
Amendment #1 to the Project Agreement formulated for the Lake Orange aedimant
atruoturea, This amendment adjusts the estimated coat of the aedimant atruoture
Prom $16,1OG.00 to the actual bid..aoat oP $21,607.36.
