Members Present: Chairman Rarvey D. Bennett, and Commissioners William C. Ray, Henry s. ldalker, Ira A. Ward and C. Norman Walker. Members Absent: None Chairman Sennett dispensed with the reading of the minutes in order to recognize the representatives of the orange County Rural Fire Department. Chandler Cates; Chief of the Hillsborough Volunteer Fire Department, stated that the citizens of the Efland co*m++++~itq would present a petition to be included in the forthcoming Fire Protection Election and that if said election was adopted then there would arise the need for the changing of the boundarq lines between the Efland District and the Hillsborough District. Mr. Cates stated that the Commissioners had the authority to adjust the boundaries of each proposed fire district. A question and answer period ensued as to any boundary change. The following petition was filed: "PETITION FOR RURAL FIRE PROTECTION DISTRICT AS PROVIDID BY (}ENE,'~AL STATDTES 69-25.1 We, the undersigned, being resident freeholders living within the hereinafter area which lies outside the corporate limits of any city or town, which area is designated as "Efland Rural Fire Department District", da herebq petition the Board of Commissioners of Orange Countq to.oall an eleotion in said district for the purpose of submitting to the qualified voters therein the question of levying and collecting a special tax on all taxable property in said district, not axaeeding fifteen amts (15¢) of the one hundred i dollars ($100.00) valuation of property, Por the purpose of providing fire protection in said district, the deacrintion of said district is as follows: BEGINNING at a point in the Alamance County line where -- the same is intersected bq state Road 131+0, running thence in a Southeasterly direction along State Road I 13L~.0 to its intersection with state Road 131}7, thence I along State Road 13l}7 to its intersection with State Road 1313; thence with State Road 13L~3 in a Northwesterly direction to its intersection with State Road 1351; thence with State Road 1351 to its intersection with State Road 1001}; thence with state Road 1001 in a Southerly ' direction to its intersection with U. THERE IS EXCEPTID from the area described so much thereof as lies within the corporate limits of the Town of Mebane. ___ •~3~: Upon motion of Cotmmissioner Henry 3, Walker, seaonded by' Commissioner Norman Walker, it was moved and adopted, that the petition from the Efland Fire District be approved, Chairman Bennett asked the Clark to read the minutes of the previous meetings. Said minutes were approved after some corrections, Chairman Bennett recognized Ray Lester, Mr, Lester is on the staff of the Research Triangle Regional Planning Commission and he presented pertinent facts on the forthcoming Clean Water Bond Issue, Dissuasion ensued. Chairman Bennett presented a letter from the President oP the North l Carolina Commissioners Association, Said letter urged the County to take an active part iti endorsing and working far the Bond Issue. Upon motion of Commissioner William C, Ray, seconded by Commissioner Ira A, Ward the following resolution was unanimously adopted: "4dHERF~A5, Clean Water is essential to the health and welfare of the citizens of Orange County as well as all citizens of North Carolina; and • WHEREAS, on N:ay 6, 1972, the voters will determine whether or not the State of North Carolina may issue Clean Tdater Bonds to provide 150 mi.lJ.ion dollars to assist counties, cities and towns in constructing and improving water supply and water pollution control systems; and WI3EREA5, the Board of Commissioners be7.ievea it to be in the public interest to advocate support of the Clean Water Bond Issue; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Orange County' that the C7.ean Water Bond Issue is hereby endorsed and the voters of Orange. County are urged to vote "FOR'' the Clean Water Bonds on May 6, 1972.'' Corm~3ssioner Ira A. Ward suggested the appointment of a committee which would publicize the forthcoming Bond Issue, send letters to all civic clubs in the county and contact all community leaders. ' Upon motion of Commissioner Ira A. ?lard, seconded by Commissioner Remy S. Walker, it was moved and adopted, that Chairman Harvey Bennett, the other members of the Board, S. M. Gatti a, the President of the Chapel Hill-Carrboro Chamber of Commerce and the President of the Hillsborough I4erchants Aagooiation and Chamber of Commerce be appointed as the committee to promote the Clean ?dater Sond Election, Chairman Sennett advised the Board that the County had taken an option on a two hundred acre (200) site for the purpose of using said land as a landfill area, but that the State Health Department had not, as of this date, verified or approved the site, Chairman Bennett then recognized Lindsay Tapp and residents of the Chestnut Ridge area. Mr, Tapp stated that the group was present not to object completely to the idea of a landfill,area, but to inquire if the Board was aware that the site, which was being considered, had been on the market for sometime and could have been purchased, without the timber, for considerably less than the proposed purchase price. He queatinned further the fact that residents of the area were not advised of the project and he pointed out that the road, running by the property, was unsafe and in no condition to handle the conjaation which would exist if a landfill area was placed on the proposed site. Gera Sykes spoke in behalf of the Chestnut Ridge Church and Camp, Mr. Sykes stated that he had been instrumental in securing the camp for the area and that he wished to go on record objecting to the location of a landfill area adjacent to the Churah!s Camp property. He pointed out the hazzarda of the road fronting the property, Keith Glover, representative of the Y4ethodiat Church Ca4ro s, stated that his organization was ooncerned about the disposal of waste and the destroying of the ecology of the area plus the safety of the persona who would utilize the catrtp and, therefore, he was hopeful that the Board t^rould r®-consider its plans to locate a landfill area in the immediate area, He stated that he wsa hopeful that the camp and part of the surrounding area could be maintained as a wilderness area _ as it provided the atmosphere for the desired type of church and civic programs. Further discussion ensued, ~ ~ ~3~ Cha~.rman Bennett reaogaized Gordon Liner, Chief of the Orange County Rescue Squad. Mr. Liner filed a report of the operational expenses, activities and donations of the squad. ]?r. Sara Dent presented a list of the medical duties which the squad members could perform. Mr. Liner stated that a fifty (50) year lease agreement could be obtained-from the Town of Hillsborough for an ears lot on which the squad would like to aons'Eruct the proper housing facilities for the squads equipment. Copies of the pr opoaed structure were presented to the Board for inspection. Upon motion of Commissioner-William C. Ray, seconded by Commissioner Norman 47alker, it was moved end adopted that the County request the Town of Hillsborough to sign a lease agreement on a lot which would b® 175 ft x 15C ft on Corbin Street and that said property would be used for the construction of a Resoue Squad building. L. T7. Cheshire, Jr., Zoning Officer, advised the Board that the term o#' Lemuel Cheek on the Board of Ad~uatments had expired, but that Tor. Cheek would continue to serve until a replacement was appointed. L. TR. Cheshire, Jr., Zoning Officer, presented a request from I~enry Sane for re-zoning of. two acres in Eno Township located on Tax Map 26 Part of Lot 35 from residential to general corRnercial. Said request had been approved by the County Planning Board. Upon :notion of Commissioner Ira A. Ward, seconded by Commissioner William C. Ray, it wsa moved and adopted that the recommendation of the County Planning Board relative to the request of Curtis Bane be approved. i The Zoning Officer presented the following plate: Revision of the subdivision entitled "States~.de". The County Planning Board had approved this revision. Upon motion of Commissioner Ira A. Ward, seconded by Commissioner Henry S. •,~lalker,.it was moved and adopted, that Chairman Bennett be authorized to sign the certificate of approval. I Revision of the subdivision entitled "Hyde-Away Estates". Thfs revision reduced the size of the original lots from three acres to smaller lot sizes. This revision had been approved by the County Planning Board. .. Upon motion of Copaaiesioner Benry S. T•'alker, seconded by Commissioner William C. Ray, it was moved and adopted, that Chairman Sennett be authorized to sign the certificate of approval. Proposed subdivision entitled "Plount Moriah Estates" located in Chapel Hill Township. This plat had been approved by the County Planning Board ~ on the basis that the subdivision roads mat the requirements and the approval of the Stat® Highway Commission. Upon motion of Commissioner William C. Ray, seconded by Commissioner Ira A, Ward, it was moved and adopted, that said plat be approved on the basis that the subdivision roads met the requirements and the approval of the ~ State Highway Commission and Chairman Bennett be authorized to sign the certificate q~ approval. ', One acre belonging to Jerry R. Seago in ~.o Township. This plat had been approved by the County Planning Board. Upon motion of Commissioner Henry S. Walker, seconded by Commissioner ' Norman Walker, it was moved and adopted that Chairman Sennett be authorized to sign the certificate of approval. Subdivision entitled "Harden Bills" being revised in order to correct ~ undesirable pre-existing conditions. This plat had bean approved by the County Planning Board. Upon motion of Commissioner William C, Ray, seconded by Commissioner Ira A. Ward, it was moved and adopted, that Chairman Bennett be authorized to sign the aertifioate of approval. Property oP W. T. and W. L. Bumphaas in Chapel Hill. Township. This plat had been approved by the County Planning Board. i Upon motion of Commissioner Henry S. Walker, seconded by Commissioner t . Mr. Tr7ard presented the following estimated budget for the 1972-1973 fiscal year: "Nets: To be submitted to the State of Human Resources, Social Services Agency, as required by G.S. 108-51~, 55, and 59. Ray, it was moved and adopted, that the 1972-73 estimated budget request of the Social Services Department be approved. Unnn motion of Commissioner Ira A, Ward, eeoonded by Commissioner Henrq S. Walker, the following Order was unanimously adopted: "NORTH CAROLINA ORATdGE COUNTY BEFORE THE BOARD OF COUNTY COMMISSIONERS ORDER Pursuant to Article 19, of Chapter 10$, of the General Statutes of North Carolina, and specifically pursuant to G. S, 105-317 (b)-(1>, the tax supervisor of Orange County has seen to it that there was developed and compiled uniform schedules of values, standards, and rules to be used in appraising real property in Orange County; that said un3.Porm schedules of values, standards, and rules were prepared by James R. Laird Co., Inc., Appraisers and Consultants, Appleton, Visconsin, and are compiled in book form, entitled "Real Estate Appraisal Sianual, Orange County, Hillsborough, North Carolina", copywrited January 1, 1972, by James R, Laird and .~saociates, together with land value maps also prepared by James R, Laird Co., Inc. The schedules of values, standards, and rules have been reviewed and approved bq the Board of the County Commisaionera of Orange County: NOW, THEREFORE, IT IS ORDERED AND ADJUDGED that said schedules of values, standards, and rules be and the same are hereby approved. It is further ordered and adjudged that the same are hereby adopted se the schedule of values, standards, and rule a, which shall be used in the general re-appraisal of real property, required by G.S. 105-286. It is further ordered that a copy of this order shall be published in the farm of a notice in The News of Orange County and in The Chabal Hill Week14. stating that the schedules, standards, and rules to be used in the next scheduled re-appraisal of real property in Orange County have been adapted and that they are open to examination by any property owner of this county at the Office of the Tax Supervisor for a period of ten days Prom the date of publication of said notice. Ray: "That whereas, a petition has been filed with the Board of Counniseionera requesting that an election be held within the area hereinafter described for the purpose of submitting to the _ qualified voters within such area the question of levying and aolleating a special tax on all taxable property in said district, of not exceeding Pifteen cents (15¢) of the one hundred dollars ($100.00) valuation of property, for the purpose of providing fire protection in said district; and Whereas, at least fifteen per cent of the resident freeholders living in the hereinafter described area have signed said petition; and Whereas, said petition is filed with the Board of Commissioners pursuant to Article 3A, Chapter 69, of the General Statutes of North Carolina; and Whereas, such article requires the Soard of Commissioners to call , an election within the hereinafter described area: NOW, TBI:REFORE, BE IT RESOLVEp, that the Board of Commissioners of Orange County, North Carolina, does hereby call for an election within the hereinafter described district for the purpose of submitting to the qualified voters therein the question of levying and collecting a spacial tax on all taxable property in said district, of not exceeding fifteen cents (l5¢) of the one hundred dollars 0100.00) valuation of property within said district. Those who are against the levy of said tax shall vote a ballot on which shall be written or printed the words, "AGAINST TAX FOR FIRE PROTECTION IN ORANGE RURAL FIRE DEPARTMENT DISTRICT". BE IT FURTHER RESOLVED that the election shall be held on Jun® 3, 1972, and that the orange County Board of Elections shall conduct said election as prescribed by law. T'Ir. Patterson explained that the Resource and Conservation Department was preparing its forthcoming budget and that it was in the position to consider, including in its budget proposals, the Seven Mile Creek Reservoir Projeat if it was the desire of the Board of Commissioners to receive funds for the said Seven Mile Creak Project. Each representative of the Conservation Department explained how the funding of any project had to be managed. Dissuasion ensued. r, r The County Administrator presented a change order for the Webco Plant water line. Upon motion of Commissioner William C. Ray, aeconded by Commissioner Henry S. Walker, it was moved and adopted, that Change Order Number 2 be signed by Chairman Bennett and that said Order would extend the 12" water line, currently. being constructed to the Webco Plant, an additional ~, 1.20 feet w®stward along the State Highway Commissions right of way. i There being no further business to some before the Board said meeting was adjourned to meet again on Monday, April 24, 1972, at 8 o~clock P. M, on Monday, April 2!}, 1972. Merabera Present: Chairman Ziarveg D. Bennett, and Commissioners William C. Ray, Henry S. Walker, Ira A, tdard and C. Vorman Walker. Members Absent: None Miss Rebecca Wall, Don I•Iatheaon, representing the Hillsborough Library Board, Lloyd Osterman, Librarian of the Hyconeeahee Regional Library and L. M. Cheshire, County Attorney, were present. Chairman Bennett recognized Mias. Wa11. I~Cias Wall stated that she was prepared to make a gift to the County of her homeplace known as "Burnside", however, she wanted this property converted into a public library and wanted to be assured that the conversion would be made without destroying the two existing buildir~s and that if this oould not be done then she would expeot the property to be returned to her. . Chairman Bennett expressed the delight and the gratitude of the Board in the generosity of P1iss Wa11~s gift. He stated that the Board would retain an architect who would investigate the possibility and the -- feasibility of converting the homeplace into a library, He assured I•Liss wall that the Ruffin Law Office would be maintained in its present state and that iP the County found it impractioal to convert the house into a usable library facility then the property would be deeded beak to T4isa Wall. It was agreed that Miss Wa11 should be provided with a letter of intent from the County relative to her gift.
