The Board of County Commissioners of Orange County mat in regular session
on T4onday, Tiarch 5, 1972, at 10:00 n~clvek :1, M, in the Commissioners Room of
the Courthouse in Hillsborough, Tdorth Carolir_a.

T4inutes of the previous meetings were read and approved after some
corrections,
Chairman Bennett recognized John L, line, Jr „ President of the Idew Tiope
Improvement Association, T•x. Tiline stated that at a meeting of the association
a petition in opposition to the Town of Chanel Hill extending its current zoning
authority beyond the present limits be reported to the 3oard, Said petition
requests that the area be left under. the jurisdiction of t'r_a Crange County
Planning 3oard,

which requested the 3oard of Commissioners to call for a ,ire District
Tax ~,lection, Discussion ensued as to ther_lans already underraay for the i
establisT+slent of fire protection in the Tdew Hnpe area.

Commissioner Henry S. T+dalker stated that the Bno Fire Department and
possibly that other areas should be given the opportunity to be included in any
election that was called for the purpose of establisri ng fire districts.
Commissioner Ira A, Ward stated that perhaps the 3oard should consult
*aith Marshall Cates, Chairman of the BoardJof ~.satior_s, as to the appropriate
date for calling said election.
Chairman Bennett reported that ,.,,r. Flowers who is Assistant Chief of the
?;'no Fire District, frill arrange a meeting to see if that district wishes to be
included in the special election.
I.srion Clark, Secretar~* of the Orange Rural Fire Department, reported to
the Board tr.e eativity arising from meetings which had been held throughout
the county relative to fire protection areas.
Chandler Cates, Chief of the Hillsborough Volunteer Fire Department,
stated that if fire protection districts were not established by an election
than he would like for the County to assist in the collection of pledges.
Mr, Cates was advised that the County.had no legal authority to collect
money of this nature.
Chairman Bennett read the follotaing petition:
"iJ®, the undersigned, petition the Crange County Board of
Commissioners to reject the proposal that the zoning authority of the
Town of Cha±~el Hill he extended beyond the present limits, Tha
undersigned are satisfied with the past performance of the Orange County
Zoning Board and sinoerel~* bolieve that their cor_tinuad jurisdiction
Trill better serve the citizens of Orange County.
All of the ur_deraigned. are residents of Orange County."
The petition had been signed by approximately two hundred and forty (2!}0)
citizens.
Chairmen Bennett recognized C, D, Jones, the County~s representative or_ '
the Research Triangle Regional Planning Commission. T•Ir, Jones presented ~
each member of the Board a cony of a book entitled "Economs Indicators."

Chairman Bennett recognized Bohn Pridgen, Engineer on the Seven Mile Creek
Reservoir protect, Mr. Pridgen reported that the surveys relativ® to the location
of the proposed dam had not been received. He cited the difftaulty ?~hich was
being encountered by hi.a firm and the firm which had been retained to complete
the details of all mapping. T~iscusaion ensued cor_cerninb the possibility of
the Coixnty's taking options on land in order to proceed with the matter of the
Sever_Tnile Creek Reservoir. 1•Ir. Pridgen asked that the Board express their
wishes as to the procedure they wanted to follow. Aiscussic.n ensued,
Chairman Bennett stated that he felt it was the desire of the ',3oard to
proceed with the acquiring of options and this would allow them to enter uoon
J the premises of making the soil bearing teat.
Chairman Bennett appointed L, P^_. Cheshire, County Attorney, S. I•i. Gattis,
County Administrator, and John ?ridgen as & COmmltt9e to s9rve with him in the
assuring of the options on the land which v*ill be intimidated by the location
of the proposed reservoir.
Commissioner TnTilliam C, Ray suggested that a park area could also be planned
with the reservoir site. It was pointed out that the availability of land
would be the contrpllin~ factor of whether or not a park area could be
considered.
Upon motion of Corrdnisaioner Henry S, walker, seconded by Commi.saioner William
C, Ray, it was moved and adopted, that the comm~.ttae appointed by Chairman
Bennett proceed with the negotiations far the acquiring of options on the
properties surrounding the proposed Seven Mile Creek Reservoir. ~'
Commissioner TJilliam C. Ray presented a letter from the Chairman of the
Cedar Grove Raritan Clubs road committee. Said latter reads as follows:
"As Chairman of the Public Highway Committee of the Cedar Grove
Rvsitan Club, we the undersigned, after having made a careful survey
of the roads in our area, and upon recommendation of the Cedar vrove
Raritan Club, submit the following projects which we feel need your
attention at this time.
1. To Black-top S. R, Road 'r1~03 leading from S.R, 71K?'~ to Person
County line, a distance of 1.6 miles.
2. To Slaclc-top S,R, Road 71350 leading fro-r_ S, R. ==1357 to .S.R,
;;11001, a distance of 1.3 miles.
3. To stabilize and upgrade S,R. 71368 leading from N.C. 1r9
(loon road) back to IT.C, 1;.9, a distance of 2.5 miles.
1F. To stabilize and upgrade S,R. '-`1355 leading from Id,C, t36 to
S,R. F,_357, a distance of .6 miles.
5. To stabilize and upgrade S.R. :;11512 from S.R, x1506 to S,R.
,1513, a distance of 1.5 miles.
6. To stabilize and u»grade S.R. '17.35q from S.R. ,':.11358 to S.R.
7136D, a distance of 1.1 miles."
Road petitions for SR 7{131T2, SR 71310, SR 13b1 and Purefoy Frive were
submitted and the Clerlctaas authorized to forward same to the State Righway
Commission.
Chairman Bennett recognized 'Bill Laws, Acting Zonir_g Cffiaer. I?r. Laws
submitted a plat entitled ''I:F.I5PE3TVG PI_~ES SU3vIVTSIOT". L-Te explained that a
bond wilt be submitted for the completion of said project and that said plat
T•rolxld. not be recorded until such bond had been received.
Upon motion of Commissioner Renxy S. Walker, seconded by Commissioner
?dorman GJalker, it was moved and adopted, that Chairman Bennett be authorized tc
sign the approval certificate on said plat, but that said plat not be recorded
until the surety bond had been received.
?'Ir. Laws presented a plat entitled "';TDLP~S PC'dA." Re stated that said plat
had bean approved by the proper zoning authority.

additional property that was currently otimed by the individual,
Upon motion of Com+r3ssioner Tra A, 'ward, seconded by Covnnissioner idorman

Chairman Sennett stated ti^~t there ?•*ere zoninP rrgtter9 :which needed to

in Hillsborough as the date, tame and place of the public hearing.
Commissioner Norman :lalker stated that the :.ensrtrent of Socie_l Services
iarequestir_g legal assistance in the presentinx o? cr~ld negleat and child
abuse oases in oven court. This request is being made because the accused
parents are being represented by le~;.al.counsel and the case workers were
finding themselves unable to def®nd their position fir lack of legal background.
Discussion ensued.
Upor_ motion of Commissioner i1~i11iam C, Ray, seconded by Commissioner
Henry S. udaluer, it was moved and adopted, that the County Attorney be authorized,
on a fee basis, to represent the Department of Social Services in juvenile .
actions brought by that department relative to chii.d neglect and child abuse

Chairmar_ Sennett pre8ented a letter from the Cas:aell County Board of
Cornn3_ssioners in~riting them to a district meeting on Trursday, Piarch 30, 19?2,
at 7 P,I?, in Yanceyville, idortn Carolina
Chairman Sennett read a letter Ergo the Corlmissionera Association which
stated that District Seven would hold a meeting on 1~~zrch 9, 1972, '.'rom the
h.oura of 9:30 A.i•?, to 1?_ x?oon in Graham, 'dorth Carolina.
The following petition was submitted:
"BE IT RESOLVED by the Board of Commissioners of the County of
Orange that that certair_ unopened street 30 feet in width which begins
at the East side of -Cing Street (BarracYs Road) and which runs Eaat
thereof alvnE the Northern boundaries of Lots 1 through 7 and along
the Southern boundaries of S through 11 of "Cak Ridge Development"
as shown on a certain plat recorded in Plat Sook 2, page 76, Orange
County Registry, be permanently closed."

C, Ray, it was mooed and adopted that the petition to close that certain
unopened str®et 30f in iridtfi-which begins at the East side of Eiing Street
(3arracks Road) and which runs Last thereof along the iorthern boundaries of Lots
l through 7 and along the Southern boundaries of 8 through 11 of "Oak Ridge
Development" as shown on a certain plat recorded in Plat Book 2, nape 76, Orange
County Registrl*, be approved, - „
The County Ad?niniatrator brot>r;h; to the attention of the 3oard that the
Tax office had recent' discovered a house which wad bean built in 1967. That
said hove had never been listed on the tax record, therefore, tine statutes
require the Board to set the tax valu® on this real estate, I~ir, Gattis advised
the Board that he felt the fair value of the house should be established at
$16,87C.OC,
Upon motion of Commissioner Ira A, [lard, seconded by Cotmniseioner Borman
t.?alker, it was moved and adopted, that the appraised value on the Claiborne
_ Roberts house in Cedar Crrova tv±•rnahip, be designated as ~1n,8?O.CC, Ta.ia action
being taken as prescribed in Genera]. Statutes,
Chairman Bennett stated that he had secured a daily traffic count on
High*aay 86 South and that this oount revealed that' the traffic South of r_gF ~-
_ a^ro~tnted tv 2,II50, from 131Ackwood station 3,?Op and from Orange Church. 1~.,L~00.

The County Tax Assessor presented the following items:
1, A request for refund of X9.97 from C, A, Coppla due to a double
listing.
Upon motion of Oommissioner Henry S, Wafter, seconded by Commissioner -~
iiorman Walker, it was moved and adopted that said refund be made,
2. A request for refund of $7,30 from J, R, Ceci 1 due to double listing
and paym®nt._o£ double listing.
Upon motion of Commissioner Henry S, Walker, seconded by Cormiisaioner
:dilliam C. R¢zr, it was moved and adopted, that the rsftu~d oP X7,30 to J. R.
Cecil due to double listing and payment of double listing be approved,
3, A request from the Accounting firm representing Plaza Associates,
Ir. r„ for a refund of h2h3.97 tiahich had been charged, in 1971, against
a motor vehicle owned by Plaza Associates. Discussion ensued as to
whether Plaza Associates, Inc, and ?lazy Associates were owned by one
and the same parties, The County administrator advised the Board
that Plaza Associates, Inc., and Plaza Associates were not the same.
Upon motion o£ Commissioner William C. :day, seconded by Cemmissioner
Norman [dalker, it was moved and adopted that the County Tax Assessor bill
Plaza Associates in the amount of ;263,97, and that if said amount is received
in payment of taxes, then a check be issued to Plaza Associates, Inc. upon
receipt of the tax monies from the prover owner.
L., A request from Jeffrey Piazzo, a dental student, who in 1971, properly
" listed his dental equipment at a value of $2,000. It appears that '
the currant retail value of the dental equipment is substantially less
than the tax value indioatea and T~2r, T'Tazzo is requesting a refund in
the amount of $26,3K.
Upon motion of Commissioner Ira A, Ward, seconded by Commissioner
Norman Walker, it was moved and adopted that the request of Dr, Iiazxo be
declined.
5, A request from Artelia Degraffenreidt, a carpenter, for a refund in
the amount of $20.L~.0, I•Tr. Degraffenreidt erroneously listed, in
7.971, his tools at a value of $3,000 instead of $300.
Upon motion of Commissioner ~dilliam C, Ray, seconded by Commisaioti~er:~
Norman Walker, it was moved and adopted, that a refland of $20,40 be granted
to PIr, Degraffer_reidt, beoauae of the apparent error in hie 1971 tax listir_g,
Upon motion of Co~aniasioner Henry S, Walker, seconded by Commissioner
[villiam C. Ray, it was moved and adopted, that the Board of Commissioners
request the County Board of Electior_s to call a Fire Protection District
Election and to also sat the date of said eleotion.
The County Attorney advised the Board th..at a suit for damages had been
filed by Forrest Heath agair_st the County and that said suit had boon scheduled
to bo heard on Wednesday, b7arch ~3, 1972, before the -forth Carolina Court of
Aroeals,
Thera being no Further Business to come before the Board the meeting was
adjovrr_ed to meat again on 1•Ionday, P4arch 27, 1972, at S P,I~I, in the Courtroom
of the Courthouse in Hillsborough, North Carolina,
