Members Present: Chairman Rarvey D. Bennett and CoaLmisaionera William C. Ray, Henry S. Walker, Ira A. Ward and C, Norman Walker. Members Absent: None Minutes of the previous meetings were read and approved. Chairman Benr_ett recognized the delegation which was present from the Chapel Hi11 League of Women Voters. Chairman Bennett recognized Mre. Da~.sy Green, Route 1, Mebane, North Carolina. Mrs. Green presented a road petition for SR 1310 and called attention to the fact that a Mr. Boone had refused to sign the petition, but that [diley Perry had signed in lieu of I~,r. Boone in order that said petition might be submitted. The Clerk was requested to foxnrard same to the State $ighway Commission along with a letter of explanation about the petition. A road petition for SR 1313 was presented and the Clerk was authorized to forward same to the State Highway Commissign. Chairman Bennett read a letter from the Itorth Carolina Department of Sooial Services which had been addressed to Sheriff C. D. Knight relative to certain aonditiona which exists in the jail. Discussion ensued relative to the matter. Chairman Bennett presented a letter from the State Department of Social Services addressed to Tom Ward, Director of the local department. Said letter commended the Crange County Department for its efficient administration of the food stamp program. Chairman Bennett advised the Board that he had attended the organizational meeting of Region J and the purpose for the establishment of this region was that application for Federal Grants could be made on a regional basis. S. M. Gatti s, County Administrator, presented a Resolution and an Agreement for the installation of a police information network terminal in the Sheriff's off3.ce. He stated that the rental coat of the terminal installation would not begin until the end of one year and that if the County chose to retain the terminal than same would coat w153.53 per month. Discussion ensued. The following resolution was offered by S. M. G'attia and a motion was made by Commissioner William C. Ray that it be adopted, this motion was seconded by Commissioner Norman Walker, and upon being put to a vote, was unanimously adopted; WIIMREAS, the Tdorth Carolina Department of Justice Police Information PTetwork plans to make available to law enforcement agencies and other appropriate agencies of the State through the use of a centralized computer system various information now available or to ba developed essential to the efficient operation of said agenoiea such as, but not limited to, information contained in the Department of Motor Vehicles' Piles, information contained in the National Crime Information Center, information contained in the State Bureau of Investigation's files, Department of Corrections' files, and information :from local law enforcement agencies by the installation of a Police Information Network terminal in the County of Crange for a period of one year provided the County of orange agrees to furnish a proper site for installing such terminal, and the necessary personnel to operate said terminal, and further agrees to assume the rental cast of such terminal at the end of one year from the date of installation' that said installation of a Police Information Network terminal is considered to be most necessary to the preservation of law and order and the promotion of publio safety within Orange County; and [+>TIQtEAS, the North Carolina Department of Justice Police Information Network and this County have agreed as follows: (A) The North Carolina Department of Justice Police Information Network will install and maintain for a period of one year a terminal connected to the Police Information Network System and also train operators selected and paid by the County to operate such terminal. d _ ~~~ (B) The County shall furnish a proper site for installation of a Police Information Network terminal and also garnish personnel to operate said terminal. (C) The County shall assume the rental coat (which cost shall include maintenance) of the Police Information Network terminal in the amount of X153.50 (par month) beginning one year fxvm the data of installation thereof. NORTH CAROLINA DEPARTT~NT OF JUSTICE POLICE ~1FORMATION NETWORK, hereinafter referred tv as PIN, and tb,e COUNTY OF ORANGE, North Carolina, hereinafter re£arred to as the County; W I T N E S SET H• WHEREAS, The Tdorth Carolina Department of Justice plans to make available to law enforcement agenaiea and other appropriate agencies of the State through the use of a centralized computer system various information now available or to be developed essential to efficient operation of said - agencies, such as, but not limited to, information contained in the Department of Motor Vehicles files information contained in the National Crime Information Center (NCICj, information contained in the State Bureau of Tnvestigation~s files, Department of Correntions' Piles and information from _ local law enforcement agenaiea; and ?•1HERE_4S, funds are available to place video terminals acid printers in a limited number of counties for a period of one year; and WAERF.AS, it will be necessary for the governing body oS the counties to assume the rental cost on such terminals after the first year for the continued use thereof, such rental coat to be paid to PIi7, N. C. Department o£ Justice, P. 0. Box 629, Raleigh, N. C., 27602; and WHEREAS, due to the cost of installation and training oP personnel to operate Police Information Network terminals, it is necessary that the County agrees to Future rental costs, prior to installation of PIN terminals, in order that maximiun benefits can be realized for the expenditure of limited funds available to PI2d. ITOW, THEREFORE, in consideration of the benefits accruing to PIN and the County, it is agreed as follows: (A) PIN will install and maintain for a period of one year a terminal connected to the Police Information Network System and also train operators selected and paid by the County to eperate such terminal. (B) The County will furnish a proper site for installation of a Police Information Network Terminal and also furnish personnel to operate said terminal. (C) The County will assume the rental coat of the video terminal and printer in the amount of X153.50 par month beginning one year from the installation thereof. IT IS UNDERSTOOD AND AGREED that should funds not be available for the - continued operation of the Police Information Iietwark, PIN shall have no further obligation under this Agreement." .. 7 ~ 41 i The County Tax Supervisor presented the following letter and amend®d order from D. R. Holbrook, Admiristrative Officer, Department of Revenue, State Board of Assessments, Raleigh, Yorth Carolina: "I am enclosing a copy of an Amended Order in the appeal of Par. J. Randolph 3egar, Jr. on his property in Chapel Rill known as the Town House Apartments. This Amended Order is to replace the original order dated January 2&, 1972. Please take the naoessary action to correct the County~s records in accordance with the Amended Order. Xour cooperation in this matter will be appreciated." Randolph Seger, ~'r., ) from the valuation of hie property in ) Chapel Hill known'as the Town House Apart- ) ments by the orange County Board of Equalize-) tion and Review for the purpose of ad valorem) ' taxes for 1971. ) This matter is before the State Board of Aasesaemtn pursuant ' to an appeal. by the above taxpayer from the valuation of his property ' tcnown as the Town House Apartments located on Hillsborough Street in Chapel Hill and identified in the Orange County records as map Pdo. 81, Block B, Lot 15 for 1971 by the Orange County Board of Equalization and Review.' Tt appearing to the Board from an investigation by its staff that the County appraised the subject propertyy - a 12.s acre tract ~ of land and 112 appartment un3.ts -- at S1,1b3,890 -- X100,000 for the land, ~1,031~,090 for the building and $29,000 for the related ~. personal property. This appraisal was made in 1965, the year of ~~ the County~s last revaluation. j I St further appearing to the Board thst the taxpayer appealed the said valuation to the County Board of Equalization and Review - for 1971 but no ahanGe was made. From this decision, the taxpayer appealed to the State Board of Assessment. I Tt now appearing to the Board that since said appeal was filed, the subject property has been visited and inspected by ~ representatives of the County and by members of the Boards staff. ~ Tt further appearing to the Board that following said inspection and a subsequent review of the matter with the taxpayer and the Orange County taxing officials, the Boards representatives have concluded that the ori~5ina1 appraisal did not fully recognize all of the factors bearir_g on the value of subject property -- particularly the topography of a portion of the tract and the fact that the original appraisal was not in line with the apprsisa].s of comparable properties. It further appearing to the Board that on the basis of their conclusions, the Boards representatives have recommended that the valuation of the subject property be reduced from 1,163,890 to $1,013,360 to take the above factors into account, which reduced figuxe the appellant has agreed to accept and which the County •Baxing officials do not contest. TT IS THEREFORE ORDERED :1PdD DECRY that the Orange County taxing officials reduce th® valuation of subject property from w1,163,a90 to w1,013,360 as set forth below and enter said reduced valuation on the tax rolls of Orange County. 1. Reduce the valuation of ~.5 acres of land from X8,000 per acre to X2,000 per acre. 2. Allow physical depreciation of 5~ and functional depreciation of 1$,o to thB buildings. 3. Allow functional depreciation of 10=~ to the swimming pool. i I L~.. Eliminate the value assigned to the breezeway. 5. Eliminate the value assigned to tho personal property. i This the 1}th day of February, 1972. f, _ ~~~ xhe Tax Supervisor presented the following request for refund of Ad Valorem taxes: 1, Genesis house requested relief from Ad Valorem taxes on 77.25 acres owned by the Chapel Hill Drug Aotion Committee, Inc. Said request being based on the statement that said property is owned by a non profit organization. This matter was referred to the County Attorney for his opinion. 2. Capt. Blair R, Barringer, owner of property on Williams Circle, Chapel Hill requests exemption from personal property tax in the amount of $7J~0.30. Said request being, based on the Soldiers and Sailors lielief Act which would exempt him from the payment of personal property taxes by virtue of the fact he is in the County because of military reasons. Upon motion of Commissioner Henry S, Walker, seconded by Camri.saivner Ira A. PJard, it was moved and adopted that a refund 3n the amount of ~1~.0.30 be made to Capt. Blair R, Barringer by authority of the Soldiers and Sailors Relief Act. 3. Request from James T3, Barton, Sr, for a refund of X51.30 based on the fact that he was not the owner of a mobile homy as of January 1, 1971, and that the home was purchased from Daniel Boone TTobile Homes during the month of January, 1971. The Tax Supervisor stated that payment of this tax was not made under protest. Upon motion of Commissioner Norman Walkex, seconded by Commissioner Ira A. Ward, it was moved and adopted that the matter of the refund of James M. Barton, Jr. be referred to the County Attorney, as the payment of the taxes were not made under protest, and that i;f the County Attorney ruled that the Tax Supervisor had the authority to refund the $51.30 then the payment would be approved. Ii.. A request from Raymond Beneville fox a refund of $7.62 due to an error in the listing of a 1969 Chevrolet instead of a 1968 Chevrolet and the difference in the tax value being ~y600.0$. Upon motion df Commissioner William C, Ray, seconded by Cottunissioner Norman IJa11~er, it was moved and adopted, that Mr, Beneville's request be referred to the _ County Attorney for a ruling; and that if the County Attorney ruled that the Tax Supervisor had the authority to refund the .7.62 then the payment would be approved. The County Administrator advised the Board that the North Carolina Department - of Insurance had requested that 0. W, Evans be appointed as Orange County's Electrical . Inspector on a temporary basis as the department needed to be advised of the name of the loasl inspector. Discussion ensued. The County Administrator was requested tv review the electrical inspectors fee and the salary schedules of other counties. Upon motion of Commissionex William C, Ray, seconded by Commissioner Henry 5. Walker, it was moved and adopted, that 0. W. k~ana be appointed Temporary Electrical Inspector of Orange County. Commissioner William C. Ray called the attention of the Board to the Statewide Water and Sewerage Bond Election which has been scheduled for May 6, 1972. He said he felt the Board of Cosraniaeioners should take an active part in the passage of this bond issue. Chairman Bennett brought to the attention of the Board that there was one vacant seat on the County Planning Board and one vacant seat on the Chapel Hill Planning Board. Discussion ensued. Upon motion of Commissioner Wslliam C. Ray, seconded by Commissioner Norman Walker, it was moved and adopted, the.t Dr. Robert Sonar oP ;Taw Hope Church Road, Chanel Hill, North Carolina, be appointed as a member of the County Planning Board with said term to be effective at the expiration of the term of Robert Strayhorn. Upon motion of Commissioner Ira A. Ward, seconded by Commissioner Henry 5. Walker, it was moved and adopted, that Philip Cooke of Hillside Estates, Chapel Hill, North Carolina, be appointed &a a member of the Chapel Hill Planning Board. Said term to become effective as of February 7, 1972, and expire as of Sune 30, 1976. Chairman Bennett recognized Charlie Davis, Orange County's representative on the Resource Conservation and Development Commission. T+1r. Davie stated that _, there were three matters of interest which he felt should be brought to the attention of the Board. They were: 7 : ; ~~,~ 1. Need for additional medical services and a clinic to County reaidents,.but that it was the feeling oP the Resource Conservation and Development Commieaion that in order to astute either of these items the County must become involved. 2. Need for adequate telephone service in that due to the fact that there are fbvr different telephone companies it is impossible in ' some instances to call even the next door neighbor without calling long distance. Y4r. Davie urged that the County help seek a solution to the telephone problem. -" 3. Need for adequate road improvements. I+Ir. Davie cited the inability of aitizena living on old 86 to astute even an answer to their inquiries concerning said road. Discussion ensued on the matters presented by Mr. Davis. `~ Chairman Sennett recognized Ebert Pierce, Chairman of the Agricultural Extension Service. Tor. Pierce filed with the Board copies of two booklets entitled "TMPACT.DESIGNATED FCR PECPLE - '76". There being no further buainesa to come before the Board the meeting was ad3ouxned. Harney D.
