BOARD OF COMMISSIONERS
November 1, 1971
The Board of County Commieaionera of Orange County met in regular session
in the Conference Room of the Welfare Building in Hillsborough, North Carolina at
10 o'aloak A,M. on Monday, November 1, 1971.
Members Present: Chairman Harvey D. Bennett, and Commissioners William C.
Ray, Henry S, Walker, Ira A. Ward and C. Norman Walker.
Members Absent: None
Minutes oY the previous meetings were read and approved after oorrectiona
were made.
Chairman Bennett reaagnized Larry Watkins. Mr. Watkins spoke in behalf oP
residents living in the Carr Cormaunity on SR 1168. Re sited that the oondition
of thin road was unpaaaable and that ten new homes had been built on the road
in the last year. The Board inapeated the traffic count report and found that a
high aavnt did exist. Chairman Sennett Snformed the group that the Board would
write the State Highway Commission in support of improvements to said road.
Reverend Eugene Moore submitted a petition for SR 1310. Rev. Moore stated
that a similar petition was filed about a year ago and that the road, in the past,
had been scheduled for paving, however, said allocation had been withdrawn. because
two property owners had refused to sign the needed right of way. Chairman Bennett
advised Mr. Moore that the Board would forward the petition and a letter to the
State Highway Comnieaion,
Chairman Bennett recognised Norman Long, Zoning Officer. Mr. Long presented
a plat entitled "Section Three, Falls of Neu Hope". He stated that said plat had
been approved by the County Planning Board and that same had to be approved by the
Board of County Commissioners before it could be anbmitted for filing.
Upon motion of Commissioners Ira A, Ward, seconded by Commissioner William
C. Ray, Chairman Bennett was authorized to sign said plat entitled "section Throe
Falls of New Hope".
Mr. Long brought to the attention of the Board that the procedures now
being followed by the County Planning Board and the County Board of Commissioners
relative to the Pitsal approval of subdivision plate had been questioned by
several realtors; in that, the County Commisaionera are not inspecting the
preliminary Plata. The ob~eationa were based on the feat that certain stages of
development could be completed and the County Commissioners could refuse to
approve the final plat. Dissuasion ensued relative to this matter.
Upon motion of Coffiniaaioner lra A. Ward, aeoonded by Commissioner Henry S.
Walker, Mr, Long and Mark Burnham were requested to prepare an amendment to the
current subdivision ordinance dealing with this matter. Said proposed amendment
moat be presented at the next public hearing on zoning matters.
Upon motion of Commissioner Henry S, Walker, seconded by Coemnisaianer
Norman Walker, Glean Whitfield of Route 7, Durham, North Carolina, was appointed
as an alternate to the County Board of Ad~uatments for a three year term effective
November 1, 1971.
Diooueaion ensued relative to the sixth position which is now vaoant on
the County Planning Board. No cation was taken on this matter.
Commi.asioner Norman Walker reported that he had talked with Melvin Holt
relative to the abandonment of certain portions of SR 1580. Commissioner Walker
stated that Mr. Holt was anxious to have said road abandoned as persona ware
using it to dump trash and that he would like to black the road in order to
prevent fwrther public abase.
Upon motion of Commissioner William C. Ray, seconded by Commissioner
Norman Walker, the following resolution was unanimously adopted:
"WH8RFJIS, North Carolina State Highway Commission has requested
abandonment from State maintained aeaondary road system .15 mile of
Secondary Road #1193 located dust south of Hillsborough, North
Carolina as shown oa the attached map, and .5 of a mile of secondary
road #1580 as shown on the attached map:

NOW, THEREFORE, BS IT R3s30LV'}~D, that the Board of Coa¢aisaioners of
the County of Orange does hereby approve the abandonment Pram State maintained
secondary road system these two portions of said roads as shown on maps
attached hereto."

Chairman Bennett reported that he and Commissioner Ira A. Ward had '
inapeeted the portion oP the road which Dr. Robert J. Senior of (~aneaia House ' '
had requested the Board to declare abandoned. Dissuasion ensued on said
matter. The County Attorney ruled that the Board had no legal authority to
aot upon Dr. Senior~a request. The clerk was instructed to advise Dr. Senior
of the position of the Board relative to said matter.
_ Chairman Sennett preaeated letters from the State Highway Commission
--__ relative to certain road matters in the County. The clerk was instructed to
forward the petition for SR 1916 to the State Highway Commission.
The question of the legal sale of beer and wine on Sunday, in the County,
was raised. The clerk was instruoted to write to D. Livingston Stallings, - ..
Commissioner of Craven County, to request that he advise the Board as to the
ruling and/or aotion whioh has been received by Craven County on this matter.
Chairman Bennett advised the Board that the Town oP Carrboro had reaownended
that three parsons be appointed to the towns planning board. Mr. Bennett stated
that the names oP Hilliard Caldwell, Richard McCallum and Toy Cheek had been
submitted.
Vpon motion of Commissioner Izra..A. iptard, seconded by Coamitsaioner Henry S.
Walker, it wsa moved and adopted, that the three persona who had been
recommended by the Town of Carrboro be appointed to the Carrboro Planning Board.
~- J The County Administrator reported on the various polioiea relative to the ',
installation of water and sewer, which other counties were Fallowing. He stated , .
that the situation which Orange Cow~.ty now faced only brought out the need for a
region wide water and sewerage extension polioy agreement:-.end he suggested that
a definite water and sewer policy agreement, for the County, is long overdue as
the County oould be placed in an awkward position relative to the matter o!
water and sewer inatallationa.
Chairman Bennett advised the Board that he had received a letter from .
Polaris ~lnterprisea inquiring as to the feasibility oS the County making ~
available a water and seweragge line to properties owned by them which is
located near I-85 and N. C. B6. Chairman Bennett stated that he felt also '
that the Valley Forge Corporation and the Whittaker Corporation would want to
have certain assurances that the installation of the proper facilities of
water and sewer was goigg to be made by the County. The capabilities oP
'-" supplying these needed facilities ware discussed by the Board.
Chairman Bennett recognized Fred Cates, Mayor of the Town of Hillsborough.
Mayor Cates stated that a letter mom HiTD addressed to the County Attorney had i
boon received and that HUD and the Department of Natural Economio Resources
needed to be assured that the Town oP Hillsborough would be granted certain
considerations to the use of water being stored in Lake Orange. Discussion
ensued relative to Mayor Cates request.
IIpon motion oP Commissioner Ira A. Ward, seconded by Commissioner William
C. Ray, it was moved and adopted that a letter oP intent relative to the use
of the water in Lake Orange be forwarded to the Town oP Hillsborough to assure the
Department oP Natural & Economic Resources and HIID that the waters of Lake
Orange were empounded for the purpose of supplementing the stream Plow during
periods of low Plow and that the control of Lake Crapge will be left to the
jurisdiction oP the County Board oP Commissioners.
The clerk was instructed to draft a letter to the Department oP Natural
& Economic Resources advising them of the action taken by the Orange County Board
oP Commissioner a.
The Board agreed to meet with representatives of the Town oP Hillsborough
and the Valley Forge Corporation on Tuesday, November 2, 1971, at 8 p.m. in ~
the Commissioners Room and with representatives of the Whittaker Corporation on
Wednesday, November 1}, 1971, at x:30 p.ta, in the_Cnmmisaiane~s.Room.

Chairman Bennett recognized Marshall Cates, Jr., Chairman of the Orange
County Rural Fire Department, Chandler Cates, Chief of the Hillsborough Fire
Department and Clarence Rosamond, member oP the Billsborough Fire Department.
Marshall Cates, Jr. xas spokesman for the group and he advised the Board that i,
after mush consideration repreaentativea of the various fire departments had
reached the aoncluaion that it would be wiser to institute a program that
would offer fire protecticn to all citizens of Orange County by virtue oP
establishing taxably fire protection distriata. Dissuasion ensued relative to the i '
current capabilities of the established rural Pire departments. Ths Board
authorized the representative to proceed with a feasibility study for the
establishment oP County Fire Protection Districts. The Board further requested
that proposals for the institution of such districts be brought beak to the Soard.

The County Administrator advised the Board that a request had been received
Prom the State Highway Commission as.ta the name of the person who had been
designated to supervise the removal of graves. The County Administrator stated
that under new legislation adopted by the last session oP the legislature the
authoritq Por designating auah an individual was contained in General Statutes
65-13(g).
Upon motion of Commissioner William C. Raq, seconded by Comm~issinner lra A.
Ward, Dr. 0. David Garvin, Health Director, or one of his assistants was
designated to be responsible for the supervision oP the removal of graves.
Commissioner Ira A. Ward suggested that Chairman Sennett aontaot the
Department of Natural & Eaonomia Resources relative to the deaiaion reached bq
that department on the Whittaker Corporation matter.
L. M. Cheshire, County Attorney, advised the Board that he had received
a request Prom Rex Savery, Attorney Por Cora Morrow, requesting the Board to
release the one-eighteenth (1/18th) interest oP Sam and Lula Mae Parry on one
acre oi' land which had been purchased from a twenty-five sore treat belonging
to the heirs of Jerry Perry. The County 13en had been filed against Sam and
Lula Perry. Mr. Savery had submitted the Consideration oP twenty-fine dollars
($25.00) Por the release of the lien against the one acre oP land. It was
understood that the lien wsa still in effect against the other twenty-Pour acres.

S. Walker, it was moved and adopted, that the County Attorn®y be authorized to
release the one eighteenth (1/18th) interest of Sam and Lula Mae Perry from the
lien docket in the Clerk oP Courts office.

The Hoard oP County Commissioners of Orange County met in adJourned session
in the Commissioners Room at the Courthouse in Hillsborough, North Carolina at
8 P. M. on Tuesday, November 2, 1971.
Members Present: Chairman Har+rey D. Bennett, and Commissioners William C.
Ray, Henry S. Walker, Ira A. Ward and C. Norman Walker.
Members Absent: None

Bill Witherspoon, Representative of the Department of Natural & Economic
Resources, Jim Yarborough, Representative of the Whittaker Corporation, Steve
Strowd, Representative aP the owners oP the proposed plant building, Pearson
Stewart, Repr®aentative oP the Research Triangle Regional Planning Cottunisaion
and Fred Cates, Mayor oP the Town of Hillsborough, were present.
This meeting wsa held for the purpose oP disansaing with all members present
the request which had been received Prom the Whittaker Corporation relative to
the aupplging oP water and sewerage service to the proposed plant site which is
to be located Southeast of Hillsborough.
Chairman Bennett recognized Jim Yarborough. Mr. Yarborough stated that his
company planned to occupy a building which would be comprised of 87 000 square
Peet and that the plant would employ approximately seventy-Five (75j persons
and that he Pelt certain that the Whittaker Corporation would invest at least
$2,000,000.00, two million dollars,•in the proposed facility. `
