MINUTES OF THE ORANGE CCUTdT`r
BOARD OF COMMISSIONERS
October !}, 1971
The Board of County Commissioners oP Orange County met in regular session
in the Commissioners Room of the Courthouse in Hillsborough, North Carolina at
10 o~olock A,M, on Monday, October 1', 1971.
Members Present: Chairman Harvey D. Bennett, and Commissioners William C,
Ray, Henry S. Walker, Ira P_. Ward and C. Norman Walker.
Members Absent: None
Tn the absence cP the Clerk, S, M. Gatti s, County Administrator, road the
minutes of the previous meetings. Said minutes were approved,
Norman Long, Zoning Officer, presented a plat of the Willow Ridge Subdiviaior_
for approval by the Board. Mr. Long stated that the plat had been approved by the
County Planning Board.
Upon motion of Cottm:i_asioner Ira P_. Ward, seconded by Comm_i.ssioner Henry 5.
Walker, it was moved and adopted, that Chairman Bennett be authorized to sign said
plat.
T?r. Long requested that the public hearing that had been scheduled for
Thursday, October 28, 1971, be cancelled as there were not sufficient items that
needed to be heard, therefore, the meeting was not needed. The Board authorized
the Zoning Officer to cancel said meeting.
Chairman Bennett recognized George Simmons, Pastor of the First Bavtist Church
in Hillsborough. Rev. Simmons stated that he was appearing before the Board as a
private citizen to request that the Board enact a Resolution prohibiting the sale
of wine and beer on Sunday.
Chairman Bennett advised Rev.. Simmons that any action the Board might take
relative to this matter would be ineffective within the corporate limits of any
town or city. Chairman Bennett stated further that the Board had s~ery little
control over the matter, however, it would request the County P_ttorney to
clarify the authority given the Board under the General Statutes.
Chairman Bennett recognized Cashe Boggs, County Dog Warden. Mr. 3oggs
reported briefly on hie activities and the current conditions which existed at
the dog pour_ds. The Board agreed to inspeot the premixes at the conclusion of
their meeting.
Chairman Bennett recognized C, ?d, Davie. Mr. Davis stated that he owned
property near the current site of the dog pound and he requested that the Board
not enlarge the present site as it constituted a nusiance and seriously damaged
the value of all adjoining property.
Chairman Bennett recognized Willie Glover, Local Representative of the
Farmers Home Administration. Mr. Glover stated that the Farmers Homo Administration
had made forty-four (laJa.) rural housing loans amounting to $600,000 during the past
year and that they were in a position to finance approximately eighty (80) loans
amounting to $ OODp00 during the next year. He stated that his agency now had
eighty-seven (~7) applications on file.
Chairman Sennett presented a letter from :the State Highway Commission. Said
letter stated that after investigation the Highway Commission estimated that it
would cost $620,000 to provide an interchange from Interstate B5 onto the I?immocka
T~fi11 Road and,that the Highway Conanisaion did not feel such a project could be
justified by the benefits which the interchange would provide and that the
requested interohange would not be in accordance with the Federal Highway guidelines
on spacing of interchanges.
Chairman Bennett presented a letter from Dr. Robert Senior. Said letter
requested a road in Bingham Township be relocated near the Genesis Facility.
It was agreed that Commissioner Ira A. Ward and Chairman Harvey Bennett should
inspect the proposed relocation of said road prior to the Board taking any action
on the request.
The County Attorney read the following Resolution:
"WHEREAS, North Carolina State Highway Commission has requested
abandonment from State maintained secondary road system .ls mile of
Secondary Road #1193 located just south of Hillsborough, North
Carolina, as shown on the attached map, and .5 of a mile of Secondary
Road rr1580 as shown on the attached map:
NOW, THEREFORE, BE TT RESOLVED, that the Board of Commissioners of
the County of Orange does hereby approve the abandonment from State
maintained secondary road system these two portions of said roads ea
shown on maps attached hereto."

Discussion ensued and Commissioner Norman Walker requested that notion
on the Resolution be deferred until the November meeting. The Board agreed to
said request.
Chairman Bennett brought to the attention of the Board that the Board needed
to appoint the County Committee to plan the celebration and commsmoration of the
Bicentennial of the American Revolution. The Board reviewed the list oP names
which had been submitted by the various aivia organizations of the County.
Upon motion of Commi.ssionar Ira A. 41ard, seconded by Commissioner Henry S.
Walker, it was moved and adopted, that the following persona be named to the
Hioentennial of the American Revolution Committee of Orange County:

Chairman Bennett instructed Betty June Hayes, Clerk to the Board, to eat
as Temporary Chairman oP the County Bicenxenaial:. Committee for the purpose of
calling an organizational meeting.
Chairman Bennett recognized Fred Cates, Mayor of the Town of Hillsborough.
Mayor Cates stated that within the next Psw wea~ss the town would exercise its
territorial authority to extend its zoning jurisdiction to the one mile limit.
He stated Further that he Pelt the Town Board would request the Board of
Commissioners to enact a zoning ordinance For the remainder oP Hillsborough Township.
Discussion ensued relative to the providing of water and sewer meztiicea
to the two industrial plants whioh were planning to locate Ssat of Hillsborough.
IIpon motion oP Commissioner William C. Ray it was moved that water and
sewerage facilities would be made available to the two industries by the County
if an acceptable coat sharing agreement could be reached between the induatihies
and the County. Chairman Bereaett netted far a note on the motion. Commissioners
William C. Ray, Norman Walker and Henry Walker voted aye. Commissioner Ira A.
Ward abstained Proia voting. Chairman Bennett then declared the motion passed. _

The Board directed the County Administrator to secure Prom the adjoining
counties and the neighboring aitiea, their poliaiea relative to the installation
of water and sewerage facilities to industries.
Chairman Bennett read the Fallowing Resolution:
"WHEREAS, it is necessary to institute certain tax Porealosure
salts; that many such suite will involve property lying within the ~~
corporate limits of incorporated municipalities, and whereas, it is
deemed advisable where practible to have both taxing units loin as
parties plaintiff: -- _,'
NOW, TBEREP'ORE, BE IT RESOLVED that the County Attorney in authorized
and empowered to cooperate with the attorney or attorneys of any other
taxing unit which is wholly or partially within Orange County in
bringing any tax- suits in the name of Orange County and any other
municipality as parties plaintiff under sash terms and conditions as to
cost and expenses of said suite as are agreed to between the governing
bodies of the County and municipality involved."
IIpon motion oP Commissioner Ira A. Ward, aeaonded by Commissioner Henry
S. Walker, the tax forealoaure resolution was unanimously adopted:
The Clerk was directed to write Hryant Brewer, Highway Supervisor of the
Seventh Diatriat, requesting him to investigate the drainage problem on SR'
1752 as complaints relative to the oondition oP the read had been received by
the Board.
IIpon motion oP Commissioner Henry Walker, aec,anded by Co~i.saioner William
C. Ray, it was moved and adopted, that Dewey W. Ring of Chapel Hill be
re-appointed as a member of the Jury Coamdsaion.
Dieausaion ensued relative to appointing persona to aexwe on the County
Planning Board.
Upon motion of Commissioner William C. Ray, aeaonded by ConID.isaioner Henry
Walker, it was moved and adopted that Charles W. Johnston, Giovanni Miaol
and Clarence Soakorell be re-appointed as members of the County Planning Board
for terms that would begin at the expiration oP their current term.
IIpon motion of Commi.saioner William C. Ray, seconded by Commissioner Ira A.
Ward, it was moved and adopted, that Dr. Logan Twin be re-appointed as a
member oP the County Board of Ad~ustmenta. Said term is to begin at the
expiration of his currant term.
Chairman Bennett recognized Fred Cates, Mayor of the Town of Hillsborough.
Mayor Cates requested that the Board authorize the County Accountant to issue
a check in the amount of $4,800 to the Town of Hillsborough. Said monies would
be used to defray the expenses whioh were being incurred by County residents
using the towns land fill area.
Upon motion of Commissioner Norman Walker, seconded by Commissioner William
C. Ray, it was moved and unanimously adopted, that the County Aoaountant be
authorized to issue to the Town of Hillsborough a check in the amount of $4,800.
Tha Clerk was inatruated to forward a road petition received from Central
Carolina Farmers, lnc. to the State Highway Commission. Said road is currently
being oonstruated to serve the two new plants whioh are being aonatruoted Fast
of Hillsborough.
Chairman Bennett filed the following items with the Clerk:
1. Letter from Billy Roae, Assistant State Highway Administrator, relative
tv interchange on I-85 at Dimmoaka Mill Road.
2. Letter from Ronald H. Levine, Director, Community Health Division -
Amendments to l~.S. 13D-13, 130-14.
