PURPOSE: To discuss and receive comment on proposed deviations from the North Carolina
Department of Transportation's Proposed 2008-2009 Secondary Roads Construction Program
for two roads, Ben Wilson Road and Jimmy Ed Road.
BACKGROUND: The Orange County Board of Commissioners held a public hearing on May
20, 2008 regarding the 2008-2009 Secondary Road Construction Program for Orange County
proposed by the North Carolina Department of Transportation (NCDOT). Property owners on
Ben Wilson Road and on Jimmy Ed Road stated they did not want NCDOT to pave those two
roads. The Board voted unanimously to approve NCDOT's proposed Secondary Road
Construction Program with the exception of Ben Wilson Road and Jimmy Ed Road, and
deferred action on those roads until NCDOT could meet with the two communities and come to
consensus about paving the roads.
NCDOT has not yet acquired right-of-way for all parcels on both roads. However, both roads are
eligible for condemnation. If NCDOT cannot acquire needed right-of-way, or if NCDOT chooses
to deviate from the proposed paving program, NCDOT may put the roads, or affected portions of
the roads, on the "Hold List" and those funds will be applied to the roads listed in priority order in
the paving alternate list for Orange County.
Ben Wilson Road
NCDOT met with residents on Ben Wilson Road on June 24, 2008. At that forum, residents
were divided in their views on paving the road as follows:
1. Residents adjacent to the northern portion of Ben Wilson Road (from Bowman Road to the
Squires property), about 1/3 of the road, wanted the road paved;
2. Residents adjacent to the southern portion of Ben Wilson Road. (from Hebron Church Road
to Lynne G. Taylor property), about 1/3 of the road, did not want the road paved; and
3. Some residents adjacent to the middle 1/3 of the road wanted the road paved and some did
not.
The residents came to a consensus to support paving the northern 1/3 of the road.

The Board has four options to consider for its recommendation to the Board of Transportation:
1. Pave only the northern portion of Ben Wilson Road (all residents agreed to this).
2. Pave the entire road subject to availability of right-of-way; or
3. Pave the northern portion of Ben Wilson Road and leave open the possibility of paving the
remainder if support of property owners comes at a later time; or
4. Don't pave Ben Wilson Road.
Jimmy Ed Road
NCDOT met with residents along Jimmy Ed Road on June 23, 2008 and again on August 4,
2008. Residents were divided in their views regarding paving the road. At the last forum,
residents supported paving Jimmy Ed Road along the frontage of Lattisville Grove Baptist
Church, which is the major traffic generator on Jimmy Ed Road. The residents in favor of
paving the entire road agreed to continue talks with their neighbors and come to some
consensus regarding paving the remainder of the road.
The Board has three options to consider for its recommendation to the Board of Transportation:
1. Pave Jimmy Ed Road in its entirety, subject to availability of right-of-way; or
2. Don't pave Jimmy Ed Road; or
3. Pave Jimmy Ed Road from Walnut Grove Church Road to the driveway of Lattisville Grove
Baptist Church.
In accordance with North Carolina General Statute §136-44.8 (d), "The board of county
commissioners may recommend deviations in the paving projects and the priority of paving
projects included in the proposed secondary road construction program only at a public meeting
after notice to the public that the board will consider making recommendations for deviations in
paving projects and the priority of paving projects included in the proposed annual secondary
road construction program. Notice of the public meeting shall be published by the board of
county commissioners in a newspaper published in the county or having a general circulation in
the county. After discussion by the members of the board of county commissioners and
comments and information presented by other citizens of the county, the board of county
commissioners may recommend deviations in the paving projects and in the paving priority of
secondary road projects included in the proposed secondary road construction program. Any
recommendation made by the board of county commissioners for a deviation in the paving
projects or in the priority for paving projects in the proposed secondary road construction
program shall state the specific reason for each such deviation recommended."
Staff, in compliance with NCGS 136-44.8:
• Posted in the Orange County Courthouse a county map showing the two tentative secondary
road paving projects;
• Published notice of the public hearing in The Chapel Hill News and The News of Orange on
January 7 and January 14, 2009; and
• Mailed notice of the public hearing to property owners (as shown in Attachment 3 per County
Tax Assessor records) on January 12, 2009.
FINANCIAL IMPACT: There is no direct financial impact associated with this decision item.

RECOMMENDATION(S): The Manager recommends the Board:
1. Hold the public hearing to discuss and receive comments regarding paving Ben Wilson Road
and Jimmy Ed Road;
2. Direct staff to bring the item back on February 3, 2009 for Board decision.

NOTICE
Representatives of the Department of Transportation will meet with the Orange
County Commissioners on Thursday January 22, 2009, at 7:30 p.m. in the
F. Gordon Battle Courtroom of the Orange County Courthouse in Hillsborough,
North Carolina to discuss with the Board and other citizens present, plans and
proposals for deviations from the 2008-2009 Secondary Road Construction
Program for Ben Wilson Road and Jimmy Ed Road. The Board of
Commissioners and Department of Transportation representatives will hear from
citizens regarding: (1) paving, subject to availability of right-of-way, an
approximate .28-mile portion of Ben Wilson Road from Bowman Road to property
owned by Walter D. Squires, Jr. etal, or not paving any of Ben Wilson Road; and
(2) paving, subject to availability of right-of-way, an approximate .14-mile portion
of Jimmy Ed Road from Walnut Grove Church Road to the driveway of Lattisville
Grove Baptist Church, or not paving any of Jimmy Ed Road. A County map
showing the e tentative road paving projects for Ben Wilson Road and Jimmy Ed
Road is posted in the courthouse.
